NCAA President Charlie Baker covered several topics at the 2024 NACDA Convention yesterday, including sports betting, which he wishes “had just stayed in Las Vegas.” Baker noted that some of the harassment college athletes face comes from classmates and friends and asserted: “This all has to stop. So far we've managed to work with four states to shut down prop betting on college sports." Baker also addressed the House settlement, about which he remarked: "There is a lot of pressure here on everybody. I think it's much better than the pressure of what could have been catastrophic losses. That would have taken another few years. So, we'd be spinning our wheels for another few years without really knowing what was going to happen. … If the court blesses [the pending settlement], then it puts us in a position where we can go to Congress and say: 'One of the three branches of the federal government blessed this as a model to create compensation without triggering employment.’ I think that's a good place to start a conversation with Congress." Baker added: “One of the things I've said about this is that the settlement gives everybody a chance to own a piece of what the future looks like, which I think for many people is an important part of this agreement. It's hard to plan, and it's hard to make decisions when you really don't know much about what the field looks like going forward. Hopefully this will give everybody the ability to do something people [weren’t able to do] the past five years, which is to make decisions, plan, create a strategy and pursue the implementation of that.” More from Baker. NCAA President Charlie Baker also joined Fox Sports/Connect's Bryan Fischer to discuss the House settlement, his tenure and future leading the association, the latest from Washington D.C., his thoughts on private equity in college athletics and more. Baker points to the House settlement: “Generally speaking in these kind of situations, you don't get the settlement months and months before. You usually get the settlement somewhere around the time when everybody thinks they’ve got to put pencils down and start preparing for trial. And we spent all day in Dallas working through a lot of this stuff and everybody gave for the good of the cause, and I think we're going to end up putting a long-form document in front of Judge Wilken, who has kind of owned this issue for the federal courts for over a decade, sometime before the middle of July. The rest of the process from that point forward is going to be kind of up to her and the plaintiffs.” In regard to opposition from non-Power 5 conferences regarding their portion of back damages, Baker notes the lawsuits have been about the rules that prohibited NCAA schools from paying student-athletes. “And those rules were voted on and supported by the DI membership. All of them. And I’ve talked to many people in the DI membership who have been around for a long time, and I said to them, ‘Did anybody ever, like, say we shouldn't do this?’ And the answer I basically got from everyone I talked to about that was ‘no’. … I think our way of trying to address some of the concerns that people had about the expense associated with this was to take on 42% of the cost of the settlement.” More on Collegiate Sports Connect. Coastal Carolina Chair of Athletics/Executive Advisor to the President Joe Moglia joins Athletes.org Co-Founder Jim Cavale’s Now It’s Legal podcast and asserts: “I’ve not yet seen a college president step up and try to be a leading voice in this. I've not seen a college athletic director step up and try to be a leading force on this. Now certainly [SEC Commissioner Greg] Sankey and some of the commissioners have spoken up because they get interviewed, but I haven't seen them necessarily step up to do this.” Moglia explains he was in several meetings in the weeks after NIL was legalized as college leaders attempted to come up with a solution, and “in so many of the meetings, somebody would come up with a good idea and then somebody else said, ‘Well, that’s not going to be good for women’s tennis.’ Somebody else would come up with a good idea and, ‘Well, our lawyers are never going to allow us to do that. So if you keep coming up with reasons why you can't do something, you're never going to get anything done. A leader doesn't do it that way. A leader takes everything into account then figures out a way to be able to get things done. And sometimes you’ve got to take it in bits and pieces to be able to do that. Power 5 football with regard to NIL is very, very different from men's tennis. You cannot solve the two and still wind up with something that works. At the end, you’ve got to be able to solve for one, get it right, solve for the next, etc. So what you’re talking about, Jim, with regard to the commissioners, they’d better be able to get their arms around it. The more business-minded they are, the better the chance there’ll be, but I still think it comes down to being a good leader.” Full podcast. (link)

Outgoing Tulsa AD Rick Dickson joins the Eye of the Hurricane podcast and says he wants to “walk away knowing that the next year is provided for, give the next successor coming in the chance to get acquainted, know people. Facing challenges, there’s enough of them out there that you don’t want to start behind. Primarily for the purpose of our student-athletes I really want to make sure that that's accounted for.” Dickson also talks about the House settlement and says: “It was not surprising, extremely disappointing, aggravating, but it’s kind of symptomatic of what’s got us here. … And the big thing that's changed, and it's at every level – president, commissioner athletic directors – in the athletic space is it's not a collegial group anymore. When I entered into it at a time in the late '80s, early ‘90s, [major college athletics leaders] were as interested and committed to making sure that their teammates – meaning everybody at our level – remained whole and were healthy because we valued competition, and that's not the case today. It’s cutthroat. I mean, look at what we've done to our whole organization, to the structure that we've had.” Dickson points to the 500K student-athletes, most of whom won’t go pro in sports, and remarks: “I'm concerned we've put that model at risk. There’s a high probability that you'll be looking at programs, even at the highest level, that operate in a reduced fashion. … Olympic sports are in peril of being reduced to club sports. … I don't want to be part of that. … To get away from a model that provides that many opportunities all because 1% may be pro, not a fan of it.” Full podcast. More from Washington State Interim AD Anne McCoy, who comments on WSU being able to handle $20M in revenue sharing with student-athletes, McCoy responded: “I think that’s a more challenging proposition for most schools than they’re probably willing to admit right now, requiring a complete philosophical shift. … Once we have more details, more information, we’ll need to sit down as an athletics team and a university and decide. … In a way it’s no different than many other expenses as they’ve come online. It’s determining where we want to be in that space and what makes the most sense for us.” (link)

Temple AD Arthur Johnson says the Owls are still working out whether the athletic department will opt into sharing revenue with student-athletes: "We're in the process of having discussions with an ad hoc committee of board members and some others on campus where we're also trying to prepare for what might happen in the future. … A lot of it depends on the courts, the judge, when they get the longform to the judge. Right now they just have a seven- or eight-page MOU with some terms on it. Now you've got to get the attorneys in the room to put together the documents and really a whole lot more detail." Johnson also doesn’t shoot down the possibility of a Group of 5 football playoff: "I think everything is on the table. In this environment, you have to be prepared to look at everything and be respectful of what opportunities may come to figure out what's best for us." Johnson goes on to remark that the industry as a whole needs help from Congress: “We're going to need their support. We're in this position because we haven't moved fast enough as the NCAA. But there are also a lot of lawsuits out there. And if we don't get the support, the lawsuits are going to continue to come." (link)

Oncoor Marketing/The Collective Association President Russell White, BYU Assoc. AD for Student-Athlete Experience/NIL Gary Veron, TrueNU Executive Director Jacob Schmidt and Basepath Co-Founder/CEO Thomas Thomas participated in a NACDA Convention panel discussion about relations between athletic departments and collectives. Business of College Sports’ Kristi Dosh shares some highlights: “Veron says he only sees collectives becoming more important as we move into revenue sharing. In particular, the collective organizing athlete activities, following up with athletes to ensure they follow through, etc.” Veron also explains that he “dedicated 6-8 hours/day for weeks on the Built Bar [BYU] deal working with the AD, university, legal counsel, etc. to paper and execute that deal. Emphasized the workload that will increase if athletic departments are going to get more involved in sourcing deals. Veron says their collective has no overhead because one of the board members funds the overhead. That allows 100% of money from outside sources to go directly to athletes.” Schmidt, meanwhile, notes the Northwestern-focused collective has “developed skills the athletic department hasn’t that will be valuable going forward: negotiating contracts with agents, athletes and parents. Texas Director of Swimming & Diving Bob Bowman’s departure from Arizona State left several of the professional swimmers he coaches feeling “furious” and “betrayed,” according to Sports Illustrated’s Pat Forde, who notes the impact on ASU student-athletes may have been worse. Former Sun Devils student-athlete Grant House: “It was like someone shot your puppy. It severely impacted everyone’s emotional well-being.” Forde notes Bowman’s announcement came just 75 days before the U.S. Olympic Trials, “throwing a bunch of America’s top swimmers into uncertainty. … A routine-obsessed group had their lives disrupted at a critical stage of preparation for the most pressurized meet in the world—the one that selects the 26 men and 26 women who will represent the stars and stripes in Paris.” That said, Forde points out the elite swimmers are willing to follow Bowman wherever he goes. “[Michael] Phelps did it twice, going with Bowman from the North Baltimore Aquatic Club to the University of Michigan and then to ASU. … And truth be told, this particular mess might have been unavoidable. The Texas men’s coaching job might be the most desirable in college swimming. The Longhorns have won 15 NCAA championships and enjoy the backing of massive athletic department revenue. … Bowman wasn’t going to be able to put Texas athletic director Chris Del Conte off for two-and-a-half months. If he wanted the job, he had to take it and let the most talented pro group on the planet deal with the fallout.” (link)

Moats will owe Missouri State $185K for terminating his contract before June 30, 2025, to seek other employment. The Springfield News-Leader’s Wyatt Wheeler outlines what the Bears’ next AD can expect walking in the door: “It will be up to [incoming President Richard ‘Biff’] Williams and his new athletics director to lead Missouri State into a new era of athletics, which will immediately entail the need to upgrade football facilities and keep the athletics department's financials stable when the outgoing administration promised the move to be budget-neutral. A new athletics director will take over a men’s basketball program that recently hired Cuonzo Martin to a five-year guaranteed deal worth nearly $3.2M. Missouri State is entering its second year under football coach Ryan Beard and third under women’s basketball coach Beth Cunningham. The DI-AAA ADA and FCS ADA have collaborated with The Pictor Group to draft a position paper on the distinguishing factors of both subdivisions’ financial models and operational philosophies. The goal is to create specific actionable strategies to help the subdivisions chart a course forward to play a distinctive role and actualize the important value within Division I athletics. The Chronicle of Higher Education’s Nell Gluckman: “Broadly, it seeks to de-professionalize athletics on their campuses, so that sports look more like extracurricular activities and less like jobs. … One piece of the plan is a tool for determining when a coach or athletic department is exerting too much control over athletes. A chart that will be presented to member institutions lists appropriate expectations a coach can impose and inappropriate ones that should be avoided because they verge on something more like an employer-employee relationship.” Another component of the plan involves giving student-athletes more of a voice in governance at the school, conference and NCAA levels. UNC Asheville AD Janet Cone: “The thing that is really driving this model is that student-athlete voice is going to be intimately involved going forward with everything we’re doing.” Kansas City AD Brandon Martin adds: “This is a test of how committed we truly are to the college athletic enterprise. The Tampa Bay Times’ Matt Baker has obtained a document that shows which ACC schools approved filing a lawsuit against Florida State and which ones didn’t participate. In short, Clemson and North Carolina missed the ACC Board of Directors vote, and Cal, a non-voting incoming member, was also absent. All three were listed as “invited but unable to attend,” according to Baker. Virginia President/Board Chair James Ryan stated in an affidavit that the members “present voted unanimously” to approve the complaint. The affidavit did not elaborate on who was present. Baker goes on to point out that UNC’s absence from the Zoom call has an extenuating circumstance in that it was Interim Chancellor Lee Roberts’ first day on the job. “The Zoom call is a key point in the nine-figure litigation over FSU’s future in the ACC. ACC schools did not vote before the conference sued FSU on Dec. 21 (a day before FSU trustees authorized a suit against the ACC). Instead, ACC members approved the updated complaint on Jan. 12. The conference filed it five days later. FSU has questioned whether the ACC’s after-the-fact vote violated league protocols. Here’s why the debate matters: Who sued whom first is a pivotal factor in determining where the litigation will proceed. FSU and the ACC are both seeking a literal home-court advantage for where their arguments will be heard.” More from Baker. (link)

South Dakota State AD Justin Sell sits down with Sioux Falls Live's Matt Zimmer for the first of a two-part interview in which he discusses the state of Jackrabbits athletics. Sell says winning the FCS national championship has had positive impacts across the board: “You can pick every category — branding, university applications, interest from students and a passion for their school. If you want to talk ticket sales, fundraising, corporate sponsorships and the auction. The new (basketball) arena and creating scarcity impact — people are worried they're not gonna get in and get their tickets, and part of that comes from not being able to get into four (football) games last year. So from all of those measurables it's crazy. We're all trained as mid-major ADs to be men's basketball-centric, at least from a business sense. … But being able to step back and get out of that thinking and understand the value of football — and for us wrestling and women's basketball, too, those four are all revenue drivers for us — but football has been way bigger than I ever thought, and I thought it could be big.” As far as a potential move to FBS, Sell notes it’s a university-wide decision, not just an athletic department or football program decision. “Nobody wants to be asleep at the wheel, so you get kind of pushed into — there's a panic that happens around not wanting to be the last one there. So some of the choices of the last 10 years are people jumping to things where they aren't really sure what they're jumping into. Is (moving to FBS) really the better of two options or the lesser of a bad one? You can't quite tell and everyone is in their own situation and how they're reading the tea leaves.” More. (link)

Learfield will revamp its Compass platform designed to help brands and athletes execute on NIL deals at a higher rate. Student-athletes using the new Compass app will receive access to a list of brands Learfield has worked with over the last three years. As part of the process, local Learfield staffers will help connect athletes with brands who match their individual profiles and interests. The platform will also include a list of outstanding deliverables for all NIL deals an athlete might have signed, and athletes will be able to be paid directly through the system. CEO Cole Gahagan tells SBJ’s Ben Portnoy: “[This] represents Compass’ biggest stage of evolution. Things are moving pretty quickly. More than ever, schools and student-athletes alike are going to be focused on how to create more NIL revenue opportunities, and the faster we can put the Compass platform in the hands of our property sellers, the faster we can accelerate NIL dealmaking.” Portnoy notes brands working with student-athletes through Compass will pay Learfield a 2% fulfillment fee, while individual student-athletes will not pay any fees and school partners won’t be charged software as a service (SaaS) fees. The advent of NIL has enabled car dealerships, which had “long been conduits for the whispered inducements coaches or boosters promised talented players,” to now conduct deals in the daylight, according to The Athletic’s Christopher Kamrani and Brian Hamilton, who observe: “Car dealers nationwide quickly exchanged leases and keys for players boasting about their new ride on social media or even starring in commercials. The scheming, overzealous outsider morphed into the connective tissue for landing a star.” Ricart Automotive Group of Columbus CEO Mike Ricart: “All of a sudden, it was like, ‘What are the rules here?’ There are no rules anymore.” Fred Caldwell Chevrolet GM Martin McKinley, a Clemson alumnus, says he saw Ohio State players posing in front of cars and has since struck a deal with Tigers QB Cade Klubnik. “I just went with the most recognizable person on Clemson campus because it’s always going to be quarterback. + Members of NC State's 1983 men’s basketball national championship team are suing the NCAA, which they claim has "systematically and intentionally misappropriated the Cardiac Pack's publicity rights…without the players' consent and while paying them nothing." According to the News & Observer’s Andrew Carter, the lawsuit is being brought by Stacy Miller of the Miller Law Group. Raleigh attorney Elliot Abrams of Cheshire Parker Schneider firm is also involved. Abrams represented North Carolina’s Tez Walker in his eligibility case last season. (link)
+ Dapper Labs, creator of the NBA Top Shot Moments NFT collection, has settled a class-action lawsuit alleging the company violated securities laws by improperly selling the digital collectibles. The company agreed to pay $4M as part of the settlement and says in a statement: “The settlement in the Friel vs. Dapper Labs case further asserts Dapper Labs’ conviction that NBA Top Shot Moments are not securities under federal law.” (link)
