More from NCAA President Charlie Baker’s sit-down with Fox Sports/Connect’s Bryan Fischer from NACDA, as Baker explains his opposition to student-athlete employment: “99% of the kids who play DI sports at the most heavily resourced institutions are not going to be playing professionally either. The folks in the band aren’t compensated and aren’t employees. The folks who participate in theater groups don't. The singing groups don't. I mean this idea that somehow these people are dramatically different and therefore should be employees, I don't buy it. I just don't. And neither do most of the student-athletes that I talk to or most of the student-athlete advisory councils at the conference level, the college level, or at the NCAA level. The other significant issue with it is it will torque to some extent the nature about why you're actually there. You know, that employee that you're talking about is working in a field that they’re actually going to make a life and a living in. The student-athlete, except in very rare circumstances, that’s not a field they’re going to be making a living in.” With regards to private equity, Baker says he wouldn’t tell schools what to do, and there may be circumstances where it makes sense, but doesn’t know if private equity’s model is applicable to college sports. Baker points out that football programs at the highest-resourced universities tend to account for 75% of the revenue and 25% of the spend, and that 50% difference is what is used to fund women’s sports, Olympic sports and some facilities projects. “And it’s hard for me to imagine how, in a private equity world, if football was in some sort of separate league like that, they would permit that big a number to go outside the four walls of the sport. … I think that in particular would be something that would be pretty important for people to wrestle to the ground.” (link)

USA Today’s Steve Berkowitz reports the U.S. House Committee on Education and the Workforce’s markup hearing on Thursday will include a bill from Congressman Bob Good (R-VA) that states a college athlete "may not be considered an employee of an institution, a conference or an association.” Co-sponsors for the bill include Committee Chair Virginia Foxx (R-NC). Yahoo’s Ross Dellenger adds: “The bill, Protecting Student Athletes’ Economic Freedom Act, will be up for debate Thursday in a hearing. It is a narrow bill that would prohibit college athlete employment – one of the NCAA's essential asks of Congress. Bill is intended to be a ‘rider’ with other legislation. Incoming Ohio State AD Ross Bjork sits down with D1.ticker/Connect’s Kristen Eargle at the 2024 NACDA Convention, where he talks about the transition from College Station to Columbus, the next steps in the House settlement, the possibility of bringing collectives in-house, leveraging Ohio Stadium to generate new revenue and more. Bjork also shares his thoughts on protecting Olympic sports and complying with Title IX: “I think the definition of revenue sharing, that is the part that everybody is analyzing right now. I read commentary from some legal experts that say it's proportionality-based on your campus, so if you have 51% female athletes, 51% of the money will go to female athletes. I see some commentary where maybe it's market-based. Football and men's basketball drive the majority of our revenue, do they deserve a majority of the revenue share? So I think we need some clarity on that.” Regardless, Bjork says the female student-athletes can and should benefit. “I think it's a way to bolster what women's athletics and what women's sports mean to our campuses. We have no plans at Ohio State to cut any sports. We have 36. How do we fund that and how do we stratify that? That's what we're working on right now and that was happening before I got there.” The future of collectives, Bjork says, remains to be seen, but “I do know, for sure, that universities – and Ohio State, we've already started it – we will build out a more robust NIL infrastructure where we will have our sponsors and our Learfield partner and our athletic staff work directly with student-athletes and try to connect that athlete with companies. James Moore & Co. Director of College Advisory Services/former Virginia Deputy AD for Administration Jim Booz tells the Richmond Times-Dispatch’s David Teel: “In my 30 years in college athletics, there’s never been anything like (revenue sharing), in terms of the impact it’s going to have on the day-to-day operations. It’s totally going to change, I think, some of the infrastructure and the skills, experiences that some staff members are going to have, or athletic departments are going to need to have.” He adds: “There’s going to have to be some belt-tightening for sure. We thought COVID was going to be really, really tough, and it was, from a financial perspective and obviously from a health and mental well-being perspective. But this is going to be long-term. This is going to be tough for folks. … I just don’t think that every institution in the ACC will be (all in on revenue sharing) because I think the finances are just going to be too much, and I don’t know that they will make that commitment or have the resources with donors to make up the difference. I think it will be most of them but not all of them.” Booz also comments on the potential of private equity in college sports: “From people I’ve talked to and trust, boy that is a dangerous, dangerous proposition, You lose control. You might not think you are, but that ROI is a big, big deal.” Still, he expects some to take the plunge “because sometimes the allure of being at the grown-up table is so great some folks will just go in that direction.” (link)

NACDA officially announces Texas as the winner of this year’s Learfield Directors’ Cup. While baseball still needs to finish, there are not enough points remaining for the schools to catch the Longhorns, who have amassed 1,339.50 total points. Texas claimed two national titles – women's volleyball and women's rowing – while also notching three runner-up finishes (women's swimming and diving, softball and men's tennis). Overall, Texas has scored in three of four countable sports (baseball not yet included), along with 15 additional total sports. Overall, one sport was omitted from the final standings, women's cross country. Stanford was this year’s runner up, followed by Tennessee, Florida and UCLA. The SEC is the conference leader. Final points will be tallied following the Men’s College World Series. (link)

The Athletic’s Scott Dochterman catches up with several Big Ten ADs and football coaches to hear their thoughts on potential roster caps, and Illinois HC Bert Bielema says: “You hate to eliminate opportunities. I literally went to the University of Iowa because of the walk-on program. I’m from Illinois. My best opportunity was some Division II, DIII schools. But Iowa had a tradition, and that’s why I chose to go there. Because of that influence, when I went to Kansas State, when I went to Wisconsin, I always looked at that number (of walk-ons), and then when I came to Illinois we grew our roster. I believe in my first year there was 110. And now we grew to 120.” Illini AD Josh Whitman is more measured in his response: “I think it’s premature to comment on anything specific to roster limits or what the implications of those decisions will be for any particular sport at this point in time.” Iowa Asst. HC Seth Wallace predicts that “eventually what this thing’s going to look like is you’re going to get X amount of dollars to run your program and spread it across however you want to. It’s funny how it’s taken all these years to come back to what has been working at the Division II and the FCS level, where they’ve taken that pool of money and just use it as a salary cap.” (link)

Tennessee State AD Mikki Allen in a recent address to trustees emphasized the need to invest in facilities: “We need to get revenue-generating facilities on campus so we can start offsetting the brunt of institutional dollars that are going into athletics.” Allen cited the refurbishment of the Ed Temple Track as an example, noting the upgrade will allow TSU to host junior and AAU national track events, thereby creating new revenue streams. He further discussed a proposed $40-50M operations building project, which would centralize athletic operations and enhance efficiency. However, to make such an investment feasible, Allen stressed the need for facilities that can generate high-level ticket and premium seating revenues. Allen also emphasized the need to improve housing facilities on campus: “When we bring young men and young ladies into our program, the first thing aunties and mama say is: ‘Hey, where is my young person gonna stay?’” Finally, Allen suggested a phased approach to developing a new on-campus stadium, incorporating ADA-compliant features and possibly a turf field, which would support a variety of events and generate new revenue. Paramount has ended merger discussions with Skydance, and the Wall Street Journal’s Jessica Toonkel reports National Amusement President Shari Redstone will likely pursue a sale of just National Amusements, without trying to merge Paramount Global into another company. As reported previously, NAI has received interest from two potential parties, including an investor consortium led by Hollywood producer Steven Paul, as well as from media executive Edgar Bronfman Jr., whose bid is backed by Bain Capital. A committee of Paramount directors had approved the economic terms of the merger but continued to negotiate with Skydance about other deal points, including pushing for the transaction to be subject to a vote of all other shareholders. National Amusements was supportive of such a vote, the Journal previously reported. Skydance has said such a vote is a nonstarter. It is unclear whether the vote occurred. (link)

CBS Sports is exploring a sale of MaxPreps, according to Sportico’s Eben Novy-Williams and Scott Soshnick, who report Inner Circle Sports is assisting with the sale. Novy-Williams and Soshnick note the “process is still in its early stages, and there is no guarantee a sale is made. CBS bought the website in 2007 for $43M, according to an SEC filing. … The ongoing MaxPreps sale process does not include CBS’ other high school sports/recruiting platforms, 247Sports and Scout Media, said the people. CBS acquired 247Sports in 2015, then integrated Scout, which it bought out of bankruptcy in 2017 for $9.5M.” Of note, CBS CEO George Cheeks said during last week’s stockholders meetings that the company was looking to streamline its assets and planned to use the proceeds to pay off debt. NCAA President Charlie Baker covered several topics at the 2024 NACDA Convention yesterday, including sports betting, which he wishes “had just stayed in Las Vegas.” Baker noted that some of the harassment college athletes face comes from classmates and friends and asserted: “This all has to stop. So far we've managed to work with four states to shut down prop betting on college sports." Baker also addressed the House settlement, about which he remarked: "There is a lot of pressure here on everybody. I think it's much better than the pressure of what could have been catastrophic losses. That would have taken another few years. So, we'd be spinning our wheels for another few years without really knowing what was going to happen. … If the court blesses [the pending settlement], then it puts us in a position where we can go to Congress and say: 'One of the three branches of the federal government blessed this as a model to create compensation without triggering employment.’ I think that's a good place to start a conversation with Congress." Baker added: “One of the things I've said about this is that the settlement gives everybody a chance to own a piece of what the future looks like, which I think for many people is an important part of this agreement. It's hard to plan, and it's hard to make decisions when you really don't know much about what the field looks like going forward. Hopefully this will give everybody the ability to do something people [weren’t able to do] the past five years, which is to make decisions, plan, create a strategy and pursue the implementation of that.” More from Baker. NCAA President Charlie Baker also joined Fox Sports/Connect's Bryan Fischer to discuss the House settlement, his tenure and future leading the association, the latest from Washington D.C., his thoughts on private equity in college athletics and more. Baker points to the House settlement: “Generally speaking in these kind of situations, you don't get the settlement months and months before. You usually get the settlement somewhere around the time when everybody thinks they’ve got to put pencils down and start preparing for trial. And we spent all day in Dallas working through a lot of this stuff and everybody gave for the good of the cause, and I think we're going to end up putting a long-form document in front of Judge Wilken, who has kind of owned this issue for the federal courts for over a decade, sometime before the middle of July. The rest of the process from that point forward is going to be kind of up to her and the plaintiffs.” In regard to opposition from non-Power 5 conferences regarding their portion of back damages, Baker notes the lawsuits have been about the rules that prohibited NCAA schools from paying student-athletes. “And those rules were voted on and supported by the DI membership. All of them. And I’ve talked to many people in the DI membership who have been around for a long time, and I said to them, ‘Did anybody ever, like, say we shouldn't do this?’ And the answer I basically got from everyone I talked to about that was ‘no’. … I think our way of trying to address some of the concerns that people had about the expense associated with this was to take on 42% of the cost of the settlement.” More on Collegiate Sports Connect. Coastal Carolina Chair of Athletics/Executive Advisor to the President Joe Moglia joins Athletes.org Co-Founder Jim Cavale’s Now It’s Legal podcast and asserts: “I’ve not yet seen a college president step up and try to be a leading voice in this. I've not seen a college athletic director step up and try to be a leading force on this. Now certainly [SEC Commissioner Greg] Sankey and some of the commissioners have spoken up because they get interviewed, but I haven't seen them necessarily step up to do this.” Moglia explains he was in several meetings in the weeks after NIL was legalized as college leaders attempted to come up with a solution, and “in so many of the meetings, somebody would come up with a good idea and then somebody else said, ‘Well, that’s not going to be good for women’s tennis.’ Somebody else would come up with a good idea and, ‘Well, our lawyers are never going to allow us to do that. So if you keep coming up with reasons why you can't do something, you're never going to get anything done. A leader doesn't do it that way. A leader takes everything into account then figures out a way to be able to get things done. And sometimes you’ve got to take it in bits and pieces to be able to do that. Power 5 football with regard to NIL is very, very different from men's tennis. You cannot solve the two and still wind up with something that works. At the end, you’ve got to be able to solve for one, get it right, solve for the next, etc. So what you’re talking about, Jim, with regard to the commissioners, they’d better be able to get their arms around it. The more business-minded they are, the better the chance there’ll be, but I still think it comes down to being a good leader.” Full podcast. (link)

Outgoing Tulsa AD Rick Dickson joins the Eye of the Hurricane podcast and says he wants to “walk away knowing that the next year is provided for, give the next successor coming in the chance to get acquainted, know people. Facing challenges, there’s enough of them out there that you don’t want to start behind. Primarily for the purpose of our student-athletes I really want to make sure that that's accounted for.” Dickson also talks about the House settlement and says: “It was not surprising, extremely disappointing, aggravating, but it’s kind of symptomatic of what’s got us here. … And the big thing that's changed, and it's at every level – president, commissioner athletic directors – in the athletic space is it's not a collegial group anymore. When I entered into it at a time in the late '80s, early ‘90s, [major college athletics leaders] were as interested and committed to making sure that their teammates – meaning everybody at our level – remained whole and were healthy because we valued competition, and that's not the case today. It’s cutthroat. I mean, look at what we've done to our whole organization, to the structure that we've had.” Dickson points to the 500K student-athletes, most of whom won’t go pro in sports, and remarks: “I'm concerned we've put that model at risk. There’s a high probability that you'll be looking at programs, even at the highest level, that operate in a reduced fashion. … Olympic sports are in peril of being reduced to club sports. … I don't want to be part of that. … To get away from a model that provides that many opportunities all because 1% may be pro, not a fan of it.” Full podcast. More from Washington State Interim AD Anne McCoy, who comments on WSU being able to handle $20M in revenue sharing with student-athletes, McCoy responded: “I think that’s a more challenging proposition for most schools than they’re probably willing to admit right now, requiring a complete philosophical shift. … Once we have more details, more information, we’ll need to sit down as an athletics team and a university and decide. … In a way it’s no different than many other expenses as they’ve come online. It’s determining where we want to be in that space and what makes the most sense for us.” (link)

Temple AD Arthur Johnson says the Owls are still working out whether the athletic department will opt into sharing revenue with student-athletes: "We're in the process of having discussions with an ad hoc committee of board members and some others on campus where we're also trying to prepare for what might happen in the future. … A lot of it depends on the courts, the judge, when they get the longform to the judge. Right now they just have a seven- or eight-page MOU with some terms on it. Now you've got to get the attorneys in the room to put together the documents and really a whole lot more detail." Johnson also doesn’t shoot down the possibility of a Group of 5 football playoff: "I think everything is on the table. In this environment, you have to be prepared to look at everything and be respectful of what opportunities may come to figure out what's best for us." Johnson goes on to remark that the industry as a whole needs help from Congress: “We're going to need their support. We're in this position because we haven't moved fast enough as the NCAA. But there are also a lot of lawsuits out there. And if we don't get the support, the lawsuits are going to continue to come." (link)

Oncoor Marketing/The Collective Association President Russell White, BYU Assoc. AD for Student-Athlete Experience/NIL Gary Veron, TrueNU Executive Director Jacob Schmidt and Basepath Co-Founder/CEO Thomas Thomas participated in a NACDA Convention panel discussion about relations between athletic departments and collectives. Business of College Sports’ Kristi Dosh shares some highlights: “Veron says he only sees collectives becoming more important as we move into revenue sharing. In particular, the collective organizing athlete activities, following up with athletes to ensure they follow through, etc.” Veron also explains that he “dedicated 6-8 hours/day for weeks on the Built Bar [BYU] deal working with the AD, university, legal counsel, etc. to paper and execute that deal. Emphasized the workload that will increase if athletic departments are going to get more involved in sourcing deals. Veron says their collective has no overhead because one of the board members funds the overhead. That allows 100% of money from outside sources to go directly to athletes.” Schmidt, meanwhile, notes the Northwestern-focused collective has “developed skills the athletic department hasn’t that will be valuable going forward: negotiating contracts with agents, athletes and parents. Texas Director of Swimming & Diving Bob Bowman’s departure from Arizona State left several of the professional swimmers he coaches feeling “furious” and “betrayed,” according to Sports Illustrated’s Pat Forde, who notes the impact on ASU student-athletes may have been worse. Former Sun Devils student-athlete Grant House: “It was like someone shot your puppy. It severely impacted everyone’s emotional well-being.” Forde notes Bowman’s announcement came just 75 days before the U.S. Olympic Trials, “throwing a bunch of America’s top swimmers into uncertainty. … A routine-obsessed group had their lives disrupted at a critical stage of preparation for the most pressurized meet in the world—the one that selects the 26 men and 26 women who will represent the stars and stripes in Paris.” That said, Forde points out the elite swimmers are willing to follow Bowman wherever he goes. “[Michael] Phelps did it twice, going with Bowman from the North Baltimore Aquatic Club to the University of Michigan and then to ASU. … And truth be told, this particular mess might have been unavoidable. The Texas men’s coaching job might be the most desirable in college swimming. The Longhorns have won 15 NCAA championships and enjoy the backing of massive athletic department revenue. … Bowman wasn’t going to be able to put Texas athletic director Chris Del Conte off for two-and-a-half months. If he wanted the job, he had to take it and let the most talented pro group on the planet deal with the fallout.” (link)
