Iowa State AD Jamie Pollard sat down with D1.ticker/Connect’s Kristen Eargle at the 2024 NACDA Convention in Las Vegas, where he provided an update on CYTown, a fall preview, and his response to the House settlement. Pollard discusses what that might look like financially at an Iowa State. “We have a responsibility as athletics directors to protect the opportunities. I know the easy thing to say is that we will have to drop sports. I don’t want to be a part of that, if we can help it. In order to do that, a lot of those opportunities are going to have to look a lot different. … We’re just not going to be able, at a school like Iowa State, to fund all 18 sports at the highest level with the goal of being the very best in everything you do and traveling anywhere in the country. We’re going to have to be selective, and those are going to be some really tough choices. But they’re choices that can be managed and led. It won't be fun. I mean, it's not a path any of us would have chosen if I gave you a piece of paper and said write out the future, but the future was determined by the courts. And the courts have said that those athletes in the revenue-generating sports need to be paid first, and if you can pay them first and still provide all those wonderful opportunities, more power to you. I just don't think most of us can.” On leading through a changing time when the variables are still unknown: “I also just believe this logo, the logos of all the other schools around here just mean so much to the people at our schools and our country in general. I mean, 80% of all the medals won at the last Olympics were won by collegians or former collegians. Kennyhertz Perry attorney Mit Winter, immigration attorney Ksenia Maiorova, litigator Cody Wilcoxson and James Moore & Co. Partner Katie Davis participated in a panel discussion on the future of NIL at the NACDA 2024 Convention. On Title IX issues related to revenue sharing, Wilcoxson said he didn’t know how money generated by football broadcasting revenue could be divided between all athletes; however, he thinks equitable opportunities are still required and that a Title IX challenge is probably inevitable. Meanwhile, Winter said he’s not confident the Department of Education will give a black and white answer on how Title IX applies to revenue sharing, so the courts will likely have to decide. Maiorova noted that she would like to see the NCAA lobby for a legal fix for international athletes. Even if schools aren’t sharing revenue with international athletes, Maiorova believes their visas could be in danger if athletes in general are being paid. Davis remarked that if universities administer direct NIL payments/revenue sharing, there is less excess private benefit risk because it would be such a small part of the university’s finances as a whole. Ole Miss AD Keith Carter talks about moving the Egg Bowl to Black Friday: “In that negotiation, ABC came to us and said we want this date, and we wanna play at this time. And we actually did have a little negotiating power on another game that we got scheduled at the time we wanted on the road. … It's interesting. At times, when they want something to happen, they'll work with you a little bit. But the times that they just wanna impose their (kickoff times) they do. Again, we get paid a lot of money to play at whatever time they say and that's kind of how it works." (link)

ABCA Executive Director Craig Keilitz believes that “we’re probably in a golden age of college baseball right now,” but the AP’s Eric Olson observes that “beneath the surface, there is concern the transformation of college athletics will further reduce the number of programs capable of competing at the highest level. Baseball already is top heavy. The SEC has claimed four straight national championships and nine of the last 14, and has had at least one team in 14 of the past 15 finals. Since 2014, 50 of the 80 CWS teams have been from the SEC (31) or ACC (19).” Olson goes on to note that the SEC dominates in baseball NIL spending: “Since July 1, 2021, the average estimated annual NIL spending per SEC baseball team was $820K to $920K, based on more than 150K NIL transactions disclosed through or processed by Opendorse. … The average NIL spending in the ACC is half that of the SEC but still ranks second among all conferences. If scholarship limits are removed, which is the expectation, deep-pocketed programs could choose to fully fund their programs.” Recently retired Coastal Carolina HC Gary Gilmore warns that without guardrails the funnel of talent to the most highly resourced teams will only continue: “If Major League Baseball, the NBA and NFL had a system where everyone was a free agent every year, do you realize what chaos it would be? If you did it in baseball, it would be the Yankees, Red Sox, Dodgers and Texas. The rest of the teams couldn’t compete. That’s what is going on right now. There’s not a level playing field.” (link)

Several softball coaches say they worry about what sharing revenue could mean for their sport, particularly at a time when its popularity is surging. Florida HC Tim Walton hopes the changes benefit softball players, but he’s concerned that some could be cut out to take care of the best ones. “My greatest fear for a long time has just been, at what point in time is our model sustainable for all sports, coaches, programs across the country. That’s my biggest concern. I do believe we’re heading down a path that’s going to be probably a lot more equivalent for males and female athletes alike. But how many of them? I think that’s the biggest question that I would have.” Texas HC Mike White adds: “We are in a growth stage, along with several other women’s sports that have taken off right now. We’re certainly afraid of (changes hurting softball), that’s for sure. We don’t want that to happen. We’re hoping each individual school sees the benefit of keeping the money in softball and keeping it as a premier sport.” Oklahoma HC Patty Gasso is bullish about the sport’s future, “but I’ve got to trust it’s in the hands of those who are going to make good decisions for our student-athletes and for athletics in general.” (link)

Inflation held flat in May at 3.3%, and the Federal Reserve announced it would keep interest rates at their current level. The central bank has penciled in just one interest-rate cut for this year. (link)

The North Carolina Board of Education has approved policy language that prohibits athletes at public high schools from participating in NIL activities. On3’s Jeremy Crabtree: “Complicating the situation in North Carolina is the fact that the North Carolina Independent Schools Athletic Association announced changes to its handbook for the 2024-2025 school year that allow NCISAA student-athletes to profit from their NIL and maintain eligibility. The NCISAA has around 100 member schools, all non-public institutions throughout North Carolina.” Former Georgia football student-athlete/NFL All-Pro Thomas Davis, whose son is a top recruit in the class of 2026, disagrees with the decision: “I just think that if you’re going to allow it for one particular set of kids, then it shouldn’t be allowed for all of them. And if it isn’t going to be allowed for everyone, then nobody shouldn’t be able to do it. I think we have enough states that have got on board with the whole NIL structure at the high school level, and they’ve done it the right way. They opened it up for all the kids, and they didn’t make it biased to one particular group. That’s the same formula North Carolina should follow in order to keep things fair.” Another parent tells On3: “We’re being penalized because our children are going through public schools, and we can’t afford to put them in a private school.” (link)

Sportico’s Eric Jackson examines the evolution of NBA players as increasingly savvy investors and notes that “more players are conversing about deal flow and sharing investment opportunities, rather than boasting about their new sports car purchase or fancy summer home. The latter won’t ever stop, of course, but for many teams, especially ones led by veteran players who have earned multiple contracts, it’s now normal to discuss their venture and equity matters.” New Orleans Pelicans forward Larry Nance Jr. tells Jackson: “It’s been pretty drastic as to what guys are comfortable and open to talking about in the locker room. Before I could go to a vet and ask him what he does, but it wasn’t openly discussed. Now we talk about it on the plane, on the bus or in the locker room. There’s no time where it’s inappropriate.” Jackson points out that one of the catalysts for this culture change is the “shared relationships players have with trusted agents and financial advisors who are introducing and providing guidance on deal opportunities.” Meanwhile, the “rise of NIL only makes players entering the NBA more comfortable navigating the various pitches that come their way, especially since they’re screening deals earlier alongside their financial teams that were created in high school and college. Already in business mode, it’s becoming normal for rookies to arrive to the league as millionaires, an occurrence that will have a ripple effect with knowledgeable and financially astute newbies around to groom the next generation.” More from Jackson. UTSA AD Lisa Campos has agreed to a contract extension through November 2029. The extension does not change Campos’ salary structure, as she will continue receiving $25K annual increases on her current salary of $525K. Lisa is held in the highest regard within the NCAA, American Athletic Conference, state of Texas, DI, and San Antonio sports communities. Incoming Missouri State President Richard “Biff” Williams has tapped VP for University Advancement Brent Dunn to chair the search committee that will select the next Bears AD. The Springfield News-Leader’s Wyatt Wheeler: “Williams said the search process will include public forums with the final candidates. The school said the committee won't utilize a national recruiting service in its deliberations, vetting potential candidates to help Williams meet his timeline of naming the university's next AD before the school year.” (link)

Former Mountain West Commissioner Craig Thompson received $2.4M in compensation during FY23. The total includes $1.3M in severance, according to Sportico’s Daniel Libit, who also notes the Mountain West “reported $78.2M in revenue in FY23 – a slight dip from the previous fiscal year – while netting $7.3M. The league paid most of its members around $5M for 2022-23, with Boise State receiving the highest distribution of around $7.9M.” (link)

Big East men’s and women’s college basketball is on the verge of signing media rights deals with NBC Sports and TNT Sports, which are expected to join Fox Sports in presenting games beginning in the 2025-26 season, according to The Athletic’s Andrew Marchand, who adds: “While Fox Sports will remain the top partner, both NBC, which will feature most of its games on Peacock, and TNT Sports, which operates the streaming service Max, are anticipated to add a large number of games. The financial terms of the expected new agreements are not yet known. The agreement is not yet formalized and the other incumbent, CBS Sports – which does a smaller package of games – is still holding discussions.” (link)

The Power 5 conferences released a joint statement of support for the HR 8534, the Protecting Student-Athlete’s Economic Freedom Act, calling it a “significant step forward in reaching a federal solution for many of the challenges currently affecting college sports. … Categorizing student-athletes as employees of their institutions would cause harm to the future viability of many college sports programs, particularly women’s and Olympic sports.” Full statement. (link); Paul McDonald, co-counsel for the plaintiffs in Johnson vs. NCAA, has submitted an amendment to the bill that will be debated by the House Education and Workforce Committee tomorrow. McDonald argues that the proposed legislation, which would make it so college athletes cannot become employees, is unconstitutional on equal protection grounds. McDonald poses two main questions: Why not offer NCAA-mandated timesheets and fold college athletes into existing work study-style programs? What about the Constitutional requirement of equal protection? (And why would athletes be denied the rights of work-study students?) (link)

Sportico’s Michael McCann points out that HR 8534 comes with potential legal risks for the NCAA: “In a world where college athletes can’t unionize, NCAA rules regulating college athlete compensation would continue to face potential antitrust lawsuits. The only way the NCAA can preempt antitrust litigation would be through the non-statutory labor exemption. The exemption reflects U.S. Supreme Court decisions holding that when management and labor negotiate rules impacting wages, hours and other terms of employment, those terms are exempt from antitrust scrutiny. Although a settlement can resolve antitrust litigation, it can’t immunize the NCAA from antitrust lawsuits.” The bill would also not prevent states from recognizing student-athletes as employees. McCann notes that in its current form, the bill “does not contain a preemption clause and its declaration that college athletes are not employees is prefaced by ‘notwithstanding any other provision of Federal or State law.’ Should college athletes be deemed employees in a state, colleges in that state would likely gain a recruiting advantage. That, in turn, could incentivize other states to make the same determination. The same mentality led to a sudden flood of states overthrowing NCAA rules and approving NIL legislation.” More from McCann. (link)

ESPN is moving the Celebration Bowl to December 14. The SWAC says in a statement: “From a Southwestern Athletic Conference perspective, participating in the Celebration Bowl the week following our championship game will obviously pose additional challenges for our championship team to be at their optimal capacity to perform at the highest level for such a prestigious event. However, we will look to see what, if any, adjustments the Conference Office can make to help our representative have the best opportunity to be successful on the new date and time.” The game is slated to take place one week after the SWAC plays its championship game, while the MEAC champion, which is crowned in the regular season, will have a three-week break. ESPN Executive Director for the MEAC/SWAC Challenge Kickoff and Celebration Bowl John Grant: “The expansion of the College Football Playoff has a ripple effect across the bowl ecosystem. Our goal was simply to position the Celebration Bowl in the best position for growth and success. It was important to consider venue availability, fan experience, and certainly the student-athlete which is paramount. We talked to coaches for both conferences, particularly those who had been participants in the Celebration Bowl. Without question on both sides, they indicated the second weekend would not be detrimental for them to compete.” (link)

Big South and Ohio Valley Conference presidents and chancellors have agreed to extend the Big South-Ohio Valley Football Association through 2030. The new agreement includes a look-in provision following the initial four-year term, which was to end after the 2026 season. The framework also allows for the potential introduction of additional members. Big South Commissioner Sherika Montgomery: “Now more than ever, innovative and meaningful partnerships are imperative. The Association’s first season of competition displayed just that in creating a highly competitive football model. This enhanced partnership demonstrates our united commitment to continue the growth and advancement of the FCS. Maryland has installed a new center-hung Daktronics scoreboard that features four main video displays. Each main video display will measure 18 feet high by roughly 21 feet wide and blend with the four corner displays that measure 18 feet high by nearly 4 feet wide for a continuous viewing experience inside. The Softball Rules Committee has proposed modifying video review challenges regarding a runner leaving a base early on a pitch. Under the proposal, coaches could challenge whether a runner left early if it is called on the field by an umpire or if a runner successfully advances a base on the play. Other proposals from the committee include allowing umpires to initiate a video review, without requiring a coach's challenge, at any point in the game when a base is not properly covered by an umpire on a play and changing the penalty for a time-between-pitches violation by the pitcher or catcher to an illegal pitch. The Court of Arbitration for Sport (CAS) has dismissed a challenge from former Penn swimmer Lia Thomas, who had asked the court to reject a policy that would prevent her from competing in women's races at elite competitions. The panel of arbitrators determined that Thomas did not have standing to appeal the policy created by World Aquatics, swimming's international federation, because that policy does not yet apply to her. The CAS panel found that "for the time being" she is not eligible to compete in elite competitions through World Aquatics or USA Swimming. Thomas had argued that World Aquatics' gender inclusion policy, which effectively bans transgender competitors from competing in men's or women's races at elite competitions, is discriminatory.
