SBJ’s Ben Portnoy catches up with AAC Commissioner Tim Pernetti, who explains his decision to return to college athletics after spending the past decade in the private sector. “A lot of people close to me in the industry are like, ‘What are you doing?’ And what I said was, I do think sometimes in your career you may shy away from things that feel like there’s chaos. There’s uncertainty [in college sports]. It’s a little disorganized. There’s a lot of unknowns. … But the business is full of great people that actually care about the industry – and when there’s chaos and uncertainty, that’s when there’s more opportunity to do things differently.” To that end, Pernetti says the AAC is willing to take risks. “I wouldn’t have seriously considered it if I wasn’t convinced [of that] by the presidents that I met. … When you talk about selling a jersey patch across the entire conference – every school, every sport – and the revenue from that flowing directly to student-athletes as compensation, it makes people uneasy because they don’t understand it. The hard part for me — and the part I’m looking forward to — will be getting everybody in these conversations, being transparent, batting it around and seeing if we can find a way to do some of these things.” (link)

Louisville AD Josh Heird is contemplating budget cuts in advance of the potential approval of the House settlement and tells LEO Weekly’s Tim Sullivan: “I think we’re definitely shifting to an attitude of what is needed in college athletics as opposed to what is wanted. If our marketing department has eight staff members, do we need eight staff members? If our senior leadership team has 10 people on it, do we need 10? That’s a scary proposition for people to think about.” Sullivan notes that in addition to reducing employee headcount, trimming expenses and shelving plans for new capital projects, ticket prices are also likely to go up. Heird: “We need to be benchmarking against professional teams as opposed to college teams. What’s it cost to go to a Colts game, a Bengals game, a Titans game? That’s going to be the balance of trying to make sure our fans feel they are getting value for what they’re paying for while at the same time maximizing the amount of money we can raise. … We have to totally rethink how we do things. And that’s not, ‘Hey, we found a cheaper flight.’ Operationally, fundamentally, how do we do things differently?” (link)

The possibilities of the GOP retaking the Senate and the reelection of Donald Trump to the White House are real enough that college sports leaders should plan for what comes next, according to Extra Points publisher Matt Brown. “A world where Ted Cruz or Bill Cassidy or Rand Paul becomes the chair of the Committee on Health, Education, Labor, and Pensions, and where Bob Good and Burgess Owens can get higher education bills to the House floor, is absolutely a world where a bill that explicitly bans the concept of college athlete employment could get passed and signed by the President.” Brown goes on to observe that “economists, lawyers and academics are correct when they point out that generally, conservatives tend to support policies more aligned with the free market, and preemptively locking out a class of individuals from participating in the formal workforce, while allowing the NCAA to set a different price cap on revenue sharing…would not be a very Free Market-y policy. But the Real Life House of Representatives and US Senate are not some ideological debating societies where everybody makes decisions that completely line up with consistent ideology. It’s a place where folks are willing to make all sorts of ideological compromises in the name of Triggering The Libs or Getting On Cable News or Placating An Important Donor. … For athlete advocates or business owners who want a different world…I think now is the time to at least create a plan B. And reporters ought to recognize that this scenario could absolutely happen.” (link)

Paying student-athletes could trigger workers’ compensation coverage, according to Sportico’s Michael McCann, who explains: “Whether a worker counts as an ‘employee’ for purposes of workers’ comp laws has generated much litigation. Employers pay more in workers’ comp insurance when more of their workers count as employees. Estimates for costs depend on (among other things) frequency of injury in the line of work and requirements of the applicable state law, but a ballpark estimate is employers pay around $1.00 to $2.00 for every $100 in payroll.” McCann points out the term “student-athlete” was coined in response to a workers’ comp claim filed by Denver student-athlete Ernest Nemeth in 1950 “with the word ‘student’ intentionally appearing before ‘athlete,’” hoping to convince judges of a link between playing a sport and pursuing a college education. “While the NCAA continues to push the ‘student-athlete’ term, it is simultaneously pushing a settlement that would betray what that term has historically meant. That could take on legal significance. Colleges paying athletes…a de facto wage to play sports could invite injured players to contend they’re covered by workers’ comp laws. While colleges would cite case law from decades ago indicating workers’ comp law doesn’t apply, the precedential value of those decisions is highly suspect. Those cases occurred in a radically different and now antiquated era with respect to college athlete compensation.” (link)

The “NASCAR-ification” of college sports is inevitable now, according to Yahoo’s Dan Wetzel, who’s told by one major conference commissioner: “It’s a scramble for money. Everything is going to be for sale.” Wetzel asks: “Is some of this unfortunate? Of course. Tradition is a big part of college sports. Corporate names are uninspiring. Then again, the Big Ten has 18 teams, including four on the West Coast. The “Atlantic Coast” Conference has two outposts in the Bay Area. What’s the value of tradition? What is in a name anyway? Maybe the Ivy League carries too much brand power to be bought, but for everyone else, there is a price. … The big change here is that the suits who run college athletics have mostly given up any pretense of what this is. If the players are going to be paid by some mechanism, then this is no longer a reason to hold onto decorum. The NCAA will soon allow corporate logos to be placed at the 50-yard line and each 35 – or the equivalent on a basketball court. A certain number of patches will be allowed on team jerseys. If you want to change your team name…have at it. The bigger the brand, the bigger the price. Just know it’s coming. Everything is the Duke’s Mayo Bowl now.” (link)

Bowl Season Executive Director Nick Carparelli tells Front Office Sports’ David Rumsey that “I think we would all be naive to think that [NIL contracts for bowl games are] not right around the corner for everybody.” He adds that “any payments to student-athletes for participation in bowl games would need to be a shared initiative between the bowls, the conferences, and the institutions themselves. If the conferences and the universities were to tell the bowl games, ‘Hey, we would like these payments to go directly to the student-athletes through NIL,’ then that would be very easy for the bowl games to execute.” Carparelli also addresses the decision to move some games up to December 14 due to the expanded College Football Playoff starting on December 21: “[That] was a big decision that we did not take lightly. At the end of the day, our hand was forced, with the new College Football Playoff schedule, to put some games on that day. But we were very, very careful to make sure that we did not infringe upon that exclusive [Army West Point-Navy football] TV window.” (link)

Former LSU Football HC Les Miles is suing the school for vacating wins in response to an NCAA infractions case, causing Miles to fall below the threshold for College Football Hall of Fame qualification. Miles, who is also suing the NCAA and the National Football Foundation, argues he was deprived of property rights to the vacated wins and his nomination for the Hall of Fame, which must be done by those affiliated with an NCAA member school. ESPN’s Adam Rittenberg reports the “37 vacated wins dropped Miles' overall record from 145-73, a winning percentage of .665, to 108-73, a winning percentage of .597. Coaches must have a career winning percentage of .600 in at least 100 games to qualify for selection to the College Football Hall of Fame.” Miles' lawsuit also states that "the bulk" of LSU's infractions, including the most serious violations, occurred in basketball, and that the team's coaches, including former coach Will Wade, were "directly implicated" in violations. Additionally, the suit contends that two of the three violations the NCAA found with LSU football occurred after Miles' tenure. (link)

The Athletic’s Scott Dochterman takes a look at how the Big Ten formed its 18-team volleyball schedule and notes that “to ensure the West Coast members avoid hardships beyond on-floor competition, the Big Ten office solicited feedback from its coaches on double-play opponents. In collaboration across the athletic departments, there was a goal to bunch together as many trips as possible and limit missed class time.” Oregon HC Matt Ulmer: “I had no idea what it was going to look like for the four West schools. But at least at the end of the day, I think they did a really good job of keeping in mind not missing class.” Dochterman points out the West Coast schools will play home-and-homes and then split matches with the other 14 schools home or away. “Those seven road trips east are more like four to save on travel expenses. Oregon, for instance, travels to Michigan State and then Michigan over three days.” Big Ten Senior Director of Television Administration Grace McNamara: “The sequencing of those trips was very intentional and heavily leans into what we call geographically relevant opponents.” McNamara goes on to say: “Volleyball is a part of the conference’s strategic scheduling initiative, which has demonstrated to pay dividends in viewership and also significantly contribute to the growth of the sport. As an example, volleyball matches with a Saturday football lead-in on Big Ten Network average 110,000 more viewers than matches without a football lead-in. That’s a 93 percent increase. So creating the schedule with volleyball and football together has really allowed us to take advantage of unique opportunities.” More from Dochterman. (link)

The Indiana Board of Trustees has approved the construction of a $110M IU Indianapolis Athletics Center in downtown Indianapolis that will serve both the university and the community. The 134K-sq-ft facility will include seating for 4,500 spectators, house a multipurpose arena with an auxiliary gymnasium and community gathering spaces, and accommodate approximately 16K square feet of office spaces, as well as significant athletics support spaces. It will be funded by $89M in state appropriations along with $21M in funding provided by IU Indy. (link)

UC Santa Barbara has received gift commitments totaling $22M from UCSB Foundation trustee John Arnhold ’75 and his wife Jody Arnhold, along with their Arnhold Foundation. Included in the campus-wide commitments is a $5M gift to endow the AD position as the Arnhold Directorship of Athletics. (link)

U.S. District Court Judge Danny Reeves has blocked new Title IX rules proposed by the Biden Administration. The injunction prevents the U.S. Department of Education from “implementing, enacting, enforcing, or taking any action to enforce the Final Rule, Nondiscrimination on the Basis of Sex in Education Programs or Activities Receiving Federal Financial Assistance,” which was set to begin August 1; however, the injunction only involves Tennessee, Kentucky, Ohio, Indiana, Virginia and West Virginia, whose attorneys general filed the initial complaint. Reeves: “At bottom, the Department would turn Title IX on its head by redefining ‘sex’ to include ‘gender identity.’ But ‘sex’ and ‘gender identity’ do not mean the same thing. The Department’s interpretation conflicts with the plain language of Title IX and therefore exceeds its authority to promulgate regulations under that statute.” (link)

The U.S. Supreme Court has rejected a request by West Flagler Associates to hear a case on Florida’s gaming compact with the Seminole tribe. As a result, Wallach Legal Founder Daniel Wallach notes the “Seminole Tribe will retain exclusive statewide control over legal sports betting in Florida until 2051.” (link)

Incoming Ohio State AD Ross Bjork and Learfield EVP for NIL Growth & Development Solly Fulp sat down with AthleticDirectorU’s Tai M. Brown at the 2024 NACDA Convention to discuss the future of NIL in the context of today’s athletics landscape, Learfield’s recently revamped Compass NIL platform, the integration of storytelling content into brand campaigns, how to future-proof the college athletics enterprise and lots more. Bjork believes there will be significantly more involvement at the university level and with Learfield as NIL evolves. “Now that that wall has been lowered, if not just eliminated, there are so many more opportunities, especially in our community. Columbus is 2M people. We have all these major brands that are based there. I mean, we have White Castle, Chipotle, Limited Brands, Huntington Bank – I could go on and on about the brands that are based in Columbus who say to Learfield, ‘Hey, how do I get access to an athlete?’ Now you can.” In talking about Compass, Fulp explains there is an added feature that allows brand partners to engage directly with student-athletes. “We need to own the dealmaking process from beginning to end. It doesn't make sense for us to outsource any part of that. With Ohio State and all our other school partners, they expect us to pick up the efficiency in NIL dealmaking, and the best way to do that is to do it on our platform. It’s also going to have a searchable database for student-athletes so we understand their interests and likes outside their sport and major. … It’s next-level engagement with those brand campaigns, and so we want to own that process from beginning to end.” More on ADU. Missouri AD Laird Veatch talks about the uncertainties associated with the House settlement, particularly those related to economics. “First of all, of course, the institutional NIL or that revenue-sharing piece: How will that be distributed? What’s going to be the parameters around that – at the national, conference and institutional level? Then, of course, the above-and-beyond NIL: How is that going to be structured from an enforcement, accountability, transparency side? How do we position ourselves for that? That’s where it starts to get into, OK, once you understand the bigger picture and what the potential parameters may be, how do you start applying that to your organization? There’s going to be a lot of modeling, a lot of concept discussion.” The Every True Tiger collective has branded itself as a marketing agency that can arrange deals with student-athletes, and Veatch believes that “you’re going to see a lot of continued innovation and restructuring of how NIL is managed at schools across the country. I think the Mizzou model is a model that many will end up trying to duplicate or reflect in some way, shape or form – because it is kind of the beginning of that institutional NIL in how it’s structured, how it operates.” Veatch also notes turning to corporate deals to sponsor NIL could be an emphasis moving forward: “That’s where we’re really going to have to push to get to another level with our partnership with Learfield, working with Every True Tiger as well and their staff, and reaching out to corporations and organizations across the state to really get back to what NIL was intended to be on the front end.” (link)

West Virginia AD Wren Baker discusses potential upgrades to Milan Puskar Stadium: “When I talk to our board and donors, I call it our existential crisis. As we move into this new era of college athletics and revenue share with student athletes, we will not be able to compete at a high level if we don’t invest in our facilities in a meaningful way. … If you look at the Coliseum and Milan Puskar Stadium, neither of those have much premium seating. We’ve got to change that.” Baker also says: “I tell donors, politicians, board members, or anyone who will listen, for the future of the health of the state, it’s really important we are competitive in this new world of college athletics.” (link)

Dave Campbell’s Texas Football’s Cory Hogue unpacks conversations regarding the potential creation of the Texas Athletic Conference, which West Texas A&M (DII) President Walter Wendler envisions would include some combination of FCS and DII schools. “There would be symmetry in this Texas collection of colleges, as all the schools in the conference would play football.” Sources tell Hogue multiple presidents have considered the possibility in recent months and at least one meeting has been held. Abilene Christian President Phil Schubert remarked: “If you’re asking me would I love to see an all-Texas conference at some point? You better believe I would, and if I ever get the chance to bring something like that about or have an influence on bringing Texas schools together under one brand to play Texas sports together, especially football, man, we would jump at that chance. If there is a state in the country that could [have its own conference], it’s Texas. … We would certainly be interested in that.” Schools in the proposed TAC include ACU, Tarleton State, UT Arlington, Lamar, Stephen F. Austin, UTRGV, Texas A&M-Commerce, Incarnate Word, Houston Christian, Texas A&M-Corpus Christi and West Texas A&M, which Hogue notes would need to transition from DII to DI. Hogue adds, however, that “every source contacted for this piece was “skeptical [the TAC] would ever come to fruition.” (link)

Washington is projecting a $2M operating deficit, along with almost $29.6M of one-time non-operating expenses before UW’s transition to the Big Ten, according to Huskies AD Pat Chun, who went before regents last week for approval of the department’s budget. Chun: “We’re inside our last 50 days in the Pac-12 Conference. It’s been a long, storied history with Washington inside that conference, and it’s unfortunate. All 12 schools, as we disperse, are all challenged financially because of decisions made for the past decade. … Where we’re headed is the right place. There is a bright future for us in the Big Ten that aligns us with similar institutions.” UW’s proposed budget projects the Huskies to make almost $165M in revenue during FY25 against $167.1M in operating expenses. UW expects gate revenue ($31.6M), contributions ($36M) and NCAA or conference distributions ($42M ) to be the biggest revenue streams. Washington will also utilize two interest-free $10M loans from the Big Ten and Fox Sports, respectively. (link)

With Washington State and Oregon State having until summer 2026 to rebuild the conference, The Mercury News’ Jon Wilner asked the NCAA if/how the schools could receive an extension – or a waiver – to extend the initial two-year grace period. The NCAA’s response: “Generally, the Division I Board of Directors would have the ultimate say on membership status and related issues, including an extension of a grace period.” Wilner subsequently wonders: “Would the DI board agree to a waiver? The Hotline has no desire to guess along with the NCAA on any issues. Nor are we convinced that extending this purgatory period is the optimal move for WSU and OSU. The longer they are adrift as a two-team conference, the greater the risk of irrelevance. Put another way: Let’s reassess after the football season.” Should the two schools find success this football season, Wilner notes they will remain in the national narrative. However, “any loss of traction in the fall of 2024 will make a return to relevance extremely difficult. Extending the NCAA’s grace period to a third or fourth year in that environment would be counterproductive. Everything depends on their performance this fall. Before they pursue a waiver and extend their purgatory, the Cougars and Beavers need to win.” (link)

USA Today’s Dan Wolken contends the Big 12’s idea to potentially sell its naming rights “feels like a trial balloon for the league’s presidents to gauge just how much backlash and ridicule is worth $50M a year split among the league's 16 schools. But in this era of college sports, dignity is cheap. Paying college athletes is expensive.” Wolken acknowledges the Big 12 is falling behind the SEC and Big Ten financially and by and large don’t boast the “biggest fan bases or richest donors,” so “for better or worse, this is what [Commissioner Brett] Yormark was hired to do. And as ridiculous as it seems to sell the name of a college sports conference (while, for some reason, retaining the number 12 when the league now has 16 teams), would it really even rank among the 10 most offensive things we’ve seen in the corporatization of college sports? … Being too precious about the name of a conference — especially when that name no longer reflects anything about the league’s geography or number of teams — doesn’t make a lot of sense anymore. Yes, the ‘Allstate 12’ would be worth an eye roll, but how much more of one than the Pop-Tarts Bowl or the Boston Celtics playing in the TD Garden?” (link)

Recent developments in conversational Artificial Intelligence could help usher in a new social strategy for rights owners across sports, according to JohnWallStreet, who points out that content posted from the personal accounts of players, coaches, and executives tends to outperform comparable programming coming from their organization. The problem is that it requires those individuals to consistently churn out content when they are often the ones with the least time to do so. AI-enabled likenesses may offer a solution by enabling sports properties to “drive deeper fan engagement than previously thought possible. More specifically, a rights owner can begin to transform social media from a one-to-many channel (think: team posts and fans like, comment, or engage with the same text, video, or image) into one that facilitates a series of custom one-to-one dialogues between players, coaches, and executives and individual fans.” JWS goes on to point out that conversational AI could also be used to make the game watching experience more compelling. For example, a young fan may want to ‘watch’ a game with a player and ask their ‘likeness’ questions about it as it's going on. Meadowlark Media CEO John Skipper weighs in on the WNBA’s next media rights deal: “I think the deals will be significantly increased from what they get paid now. I believe now they get paid $60M a year, $40M from ESPN, $20M from the other four partners. I don't know what the mix will be going forward, but I have consistently suggested that the WNBA is going to get a 300% increase. … The NWSL got $60M a year. I think their rights fees before were less than $20M. So, that's a market indicator. It’s like when you buy a house, they say, ‘Well, here's a comparable.’ Here's a comparable: the NWSL, which is clearly not as valuable as the WNBA, got $60M dollars a year in the open and free market.” (link)
