New Memphis AD Ed Scott was introduced yesterday, pointing to conference ascension for the Tigers: “I think the Big 12 is pretty firm with their membership right now. . I’m coming from the ACC — there’s some lawsuits (between Florida State and the ACC and Clemson and the ACC) pending, the last time I heard about the ACC. So I don’t know what’s gonna happen there. But I can tell you what my job is. It’s to position us to be ready if something were to happen in one of those two conferences. I think we fit well in both. I think we can be competitive in our revenue sports right now (in both) — in football and men’s basketball, for sure.” More from Scott: “Memphis, we’re going to need you to stand up. I’m going to call on you early. I’m going to call on you often. But when we call, we need you to come running. We cannot do this alone. [...] We’re going to have a growth mindset as an institution and an athletic department. Not surprisingly, TCU AD Jeremiah Donati says the Horned Frogs are all in on student-athlete revenue sharing: “We are very excited to announce that we will fully participate at the maximum level in this permissible revenue sharing plan with our student-athletes. Along with this, we will be prepared for the challenges and opportunities it will bring. Many questions, however, do remain and we will need time to work out many details. For example, how and when we distribute that revenue remains unclear at the moment.” (link)

Florida’s First District Court of Appeals has rejected the ACC’s attempt to pause Florida State’s Leon County lawsuit against the conference, according to the Tampa Bay Times’ Matt Baker, who reports the “appellate court’s Friday ruling did not weigh in on the conference’s larger issue, that a Tallahassee judge ‘committed a judicial foul’ in allowing FSU’s lawsuit to proceed. That appeal, a 61-page petition for writ of certiorari, remains pending and awaits FSU’s response.” Baker also notes the “Florida Attorney General’s lawsuit against the ACC will indeed be heard in court. A Leon County judge, Angela C. Dempsey, wrote in an order Wednesday that they’ll have an in-person hearing over whether the ACC’s ESPN contracts are public records that should be released. The Attorney General’s Office recently argued that no in-person hearing was necessary; the judge had enough information to rule without one.” (link)

ESPN announcer Dick Vitale reveals that his cancer has returned. "My report on the Biopsy of the Lymph Node in my neck has arrived & it is cancerous. New Texas Baseball HC Jim Schlossnagle has had some interesting comments over the past week & now you can add another to the list: “(Texas A&M AD) Trev (Alberts) came to me the day before the regional to have a conversation. He asked me if I was frustrated. I told him that I had some frustration with how slow the ballpark process was going and that it was tough to operate without a sport administrator, but I was committed to working through it. He then made a comment to me — kind of comparing his situation of leaving his alma mater, Nebraska. He said to me, ‘You know, Jim, if you ever don’t feel like this is the place for you, that’s OK, and it’s OK to move on.’ I was a little taken aback by that, and that was the moment that I began to think that maybe this wasn’t going to work out. No one ever contacted me or my agent about a new contract for our staff, so I just decided to focus on getting our team to Omaha and winning.” (link)

The expanded Big Ten means an increased travel budget for member schools and at Purdue, AD Mike Bobinski says the Boilermakers have added “less than $500K in new expenses.” He adds: “From the execution of the reality of bringing them in, I think the Big Ten has done a really good job of managing the travel circumstances for each program in a reasonable and least disruptive way that you could hope for. We all talked about that going in – you didn’t know if you could do it. Given the math of 18 and schedules and all of that, what I’ve seen from this point, no team from the core 14 has more than one trip to the West Coast in any given sport during the course of a competitive season.” When the Boilermakers travel to the Pacific Northwest, they’ll play Oregon and Washington on the same trip in volleyball, soccer and likely hoops, for an “extended stay” versus two trips there. St. John’s has been awarded a $3M New York State Higher Education Capital Matching Grant (HECap) that will be used to help finance the construction of a new basketball practice facility on the Queens campus. The new 50K-square-foot facility will serve the everyday needs of the Red Storm’s Men’s and Women’s Basketball programs, but will also be developed in conjunction with a renovation of Taffner Field House to create a “best-in-class campus recreation center for the University community.” There will be courts, locker rooms, training and strength areas, office and film rooms, interactive recruiting spaces, and more, with Gensler set to begin the design phase “immediately.” The basketball practice facility is expected to be ready by Spring 2027, while the campus recreation center is scheduled to open in Fall 2028. The Michigan State Board of Trustees on Friday approved the plan for renovation of selected areas of the office tower at Spartan Stadium. The second and third floor of the West Stadium tower, which is currently occupied by the Advancement Office and lacks space for fundraising and donor engagement events, will see office space shrink by roughly 25% under the renovation planning and the new vacant space utilized for hosting alumni and donor events. Construction is underway in Newark on the Delaware Softball Diamond, with renovations expected to be completed in time for the 2025 season. Among the upgrades: AstroTurf Diamond Series; larger, heated dugouts; expanded grandstands for increased fan capacity; an expanded press box with the installation of an HVAC system; a new video board; and a concession and restroom building to located between the softball field and field hockey’s Fred Rullo Stadium. With the renovations, Delaware was selected to host the 2026 Conference USA Championship in May of 2026, the Blue Hens’ first year in the league. (link)

Fresno State officially introduced new AD Garrett Klassy, who remarked: “My vision for Fresno State athletics is pretty clear. We're gonna win championships. … Our student-athletes are going to become leaders in the Valley. … We're gonna improve our facilities. And we're gonna make the Central Valley proud. We're gonna connect deeply with the Valley, embodying its DNA, work and grit." Asked about how the Bulldogs will specifically upgrade facilities, Klassy said: "I'm not going to make any bold statements or comments today on that. Everything is under review at this point. Obviously, I've heard of the stadium issues and I know that's been a priority for a long time. … We have to look at what our options are and try to make it better from there. It'll be a priority. I just don't have any movement on that front today." On the topic of realignment, Klassy said: “Fresno State needs to focus on being the best version of Fresno State they can be. If we focus on ourselves, tell our story the right way, build this fan base and build our revenue streams, everything will take care of itself. It doesn't mean we won't be working behind the scenes, seeing what opportunities exist, but we're loyal and we're committed to the Mountain West. If opportunities exist, we'll explore them. I think that's one of the advantages of me being at a lot of different schools – I have a lot of relationships across the country. We'll keep a pulse on what's happening." More from Klassy. (link)

Houston Men’s Basketball HC Kelvin Sampson on what the Cougars need in a new AD: “I think there’s a whole new frontier out there for us to explore. We need Lewis and Clark. We need somebody to go where we haven’t been. We need to explore. We need new ideas. [...] Chris had great strengths. Mack (Rhoades) had great strengths. Hunter (Yurachek) had great strengths. I don’t think there is a blueprint for how to be a great athletic director. I’ve always put administrators in two categories and there’s no gray area. You’re either facilitators or inhibitors. Period. [...] It’s a great opportunity. Somebody is getting a great job. I don’t care how bad it looks financially right now. I remember what it looked like in 2014. It can get done. As SMU nears its transition to the ACC, Mustangs AD Rick Hart says he “got chill bumps” upon seeing the ACC logos in Moody Coliseum for the first time. “Let’s face it: You want to see Syracuse come in here and Virginia and Duke and North Carolina and Notre Dame and Miami and Stanford. That’s just a different level of competition, of excitement and of engagement.” That said, Hart adds: “It’s one thing to have achieved membership in the ACC. That’s a vision and a goal and a dream that we’ve been chasing for 37 years. But now we have to seize that moment, and we have to make sure that we can compete, that we look the part and that we demonstrate that we’re back where we belong.” Hart also says of the Mustangs’ record-shattering $159M in fundraising during FY24: “It’s a big number. It’s a big number nationally. I think, also, for the ACC demonstrated our commitment to competing and not just being happy that we’re in the league and waiting our turn until we get a full revenue share.” The Dallas Morning News’ Lia Assimakopoulos notes the fundraising figure “wasn’t just staggering for SMU, but on a national scale. In 2022-23, Texas A&M led the nation with $115M raised, according to Sportico’s college sports finances database. Texas ranked second with $86M. SMU’s undergraduate enrollment is just a fraction of the other two universities at 7,115 in 2023.” (link)

The U.S. Supreme Court has issued a ruling in Loper Bright Enterprises v. Raimondo overturning the “Chevron defense,” which set the precedent that, per Sportico’s Michael McCann, “courts were obligated to defer to [federal] agency interpretation when a statute was ambiguous and when the accompanying agency interpretation was reasonable or permissible.” As it applies to college sports, McCann posits that “with agency deference gone, whether the National Labor Relations Board concludes college athletes are, or are not, employees within the meaning of the National Labor Relations Act could prove more vulnerable to legal challenge. … The practical impact of Loper Bright is that a legal challenge to whichever way the NLRB decides could face better odds if the challenger credibly contends the statutory language is ambiguous. Given that federal judges have opined the legal definition of an employee is ‘hopefully circular,’ Loper Bright may end up playing a substantial role. This post-Chevron framework won’t necessarily advantage one side or the other in the employment debate. But it means the final decision on whether college athletes are employees will probably be made by the courts.” The case could also impact the FTC’s ban of noncompetes. Takes the political element out of it and makes it more of a straight legal analysis.” (link)

Missouri has secured 10 seven-figure commitments toward its planned $250M renovation of Memorial Stadium, which is expected to be half-funded by donations, according to Tigers AD Laird Veatch, who says he has met with 70 donors already, and the athletics department has sold nearly all of the mezzanine-level suites that will be part of a new-look Memorial Stadium north concourse. Veatch also announced that MU has chosen Kansas City-based construction firm Whiting-Turner as its construction manager at risk for the renovations. The firm is assisting with cost estimations, scheduling and procurement strategies, according to the St. Louis Post-Dispatch’s Eli Hoff. Also from Veatch: “Here in the next few months, we will be finalizing our funding plan, we’ll be moving forward with all of our fundraising efforts. Now that I’ve made my way around the state, I will be able to assist our development team as we continue to secure more support for the project.” (link)

Wisconsin has unveiled renderings of its $285M indoor practice facility. Have a look. (link); Badgers AD Chris McIntosh discusses what he tells donors who are unsure whether to donate to the new facility or to UW’s NIL efforts: "First of all, I'm grateful that they're asking the question. But my answer to them is wherever it resonates with them. It's gone either way. Some people, it speaks to them more to help us with a capital project like the indoor [facility]. Some people are far more excited and eager to help us with our NIL efforts. … If you could draw it up, you wouldn't be doing both of those at the same time. We don't have that luxury. Obviously NIL is an important factor today, but we've found ourselves so far behind on facilities." Fleet Farm CEO John Schaefer explains that “as a donor, I'm looking forward to the time when it becomes more cohesive and you can give one place and it just gets spread how the athletic department thinks it should. But in the meantime, the bulk of my money goes to the university with donations to the NIL as needed." Ultimately, McIntosh believes facilities and NIL work hand-in-hand but are not, in and of themselves, the most important factors in initially attracting recruits. "It is about the people. It is about relationships. Even though, obviously, the times that we live in are different and there are many competing factors, that is where it starts. I think our coaches would say that that's the place that they would like it to start." (link)

Michigan State has agreed to pay former strength and conditioning coach Mike Vorkapich $195K to settle a discrimination lawsuit in which Vorkapich, who is white and has Tourette’s syndrome, alleged Spartans AD Alan Haller and Deputy AD for Championship Resources & Culture Ashton Henderson demoted him twice without cause while colleagues who were younger, non-disabled, female or black received pay raises and promotions. The lawsuit was settled in May, but details of the agreement were released this week. (link)

Inside Higher Ed’s Liam Knox examines how the fraught FAFSA rollout has impacted Lindenwood and notes that last December, the university “cut 10 of its 50 sports programs and eliminated nine nonathletic staff positions as part of a budgetary ‘rebalancing,’ as the university called it. In order to get through the fiscal year without additional cuts, the small private college in St. Charles, Mo., needed tuition revenue to hold steady. Instead…in Missouri, where the vast majority of Lindenwood students come from, only 41% of high school seniors had completed the FAFSA as of June 14—one of the lowest rates in the country, and down 12% from last year.” Meanwhile, Lindenwood is projecting a 12% enrollment dip this fall and has announced it is cutting its budget by 10% with more layoffs on the way. President John Porter: “We would not have cut to the degree that we did had it not been for what we’re seeing with FAFSA. I don’t want to put all the blame there, but it certainly caused us to take a step back and reassess our costs.” There is a silver lining, however, as Porter tells Knox the FAFSA issues exposed some of the school’s larger strategic problems and expedited plans to become leaner and increase student aid. “We’re not going to wait until August and cross our fingers hoping for the best … If we do hit the worst-case scenario, these measures allow us to operate with margins. If other universities aren’t planning this way, and are just hoping to squeak by and see what happens, I’d say that’s a bad philosophy.” (link)

The Infractions Appeals Committee has affirmed the penalties prescribed by the NCAA Committee on Infractions in the remanded Cal State Northridge men's basketball case. On December 16, 2022, the COI issued its decision finding recruiting violations in the program and prescribed penalties as Level II-Standard for the university and Level II-Aggravated for the former head coach and two former assistant coaches. On November 15, 2023, the Committee on Infractions reduced CSUN's financial penalty from $5,000 plus 1% of the men's basketball budget to $5,000 plus 0.5% of the men's basketball budget and upheld the three-year probation period on appeal. CSUN subsequently filed a second appeal in the case, arguing that the hearing panel abused its discretion, inappropriately weighed mitigating and aggravating factors, misclassified the case, and prescribed unsuitable probation time and fine penalties. In its review, the Infractions Appeals Committee determined that the Committee on Infractions sufficiently reviewed the classification of the case, did not abuse its discretion in the application of mitigating and aggravating factors, and reasonably reduced penalties. Therefore, all appealed penalties have been upheld. (link)

The NCAA Committee on Competitive Safeguards and Medical Aspects of Sports (CSMAS) this week supported a plan to reinstate the NCAA Injury Surveillance Program data request process. The data sharing has been paused since 2018 while the committee considered policy and procedural changes and may be reinstated as early as this winter. CSMAS also affirmed wearable performance technology as a priority topic for the Association and agreed that the Training and Performance Advisory Group should focus its future discussion on wearable performance technologies, with the potential goal of providing enhanced guidance to the membership. Additionally, CSMAS supported the creation of a Q&A document that provides guidance to schools as they implement mental and physical health, safety and performance core guarantees from the holistic student-athlete model adopted last year and effective August 1.
