Former Utah State Deputy AD Jerry Bovee intends to “file a grievance pursuant to USU policy” after he was terminated last week following an external review of alleged noncompliance with university policies that implement Title IX law. Utah State alleges that Bovee and former Football Director of Player Development and Community Engagement Austin Albrecht both violated school policies “related to the reporting of sexual and domestic violence and failures of professional responsibilities.” Bovee says he was blind-sided by the school’s decision, “based on an inconclusive and untimely review of an incident that took place more than a year ago in April of 2023.” In his statement released yesterday, Bovee “is vigorously defending his reputation as [an] Aggies alum and stellar associate vice president and deputy athletics director. … In his tenured career, he has never incurred disciplinary action or accusations of misconduct of any kind.” (link)

Delaware AD Chrissi Rawak sat down with AthleticDirectorU’s Tai M. Brown at the 2024 NACDA Convention to discuss the Blue Hens’ administrative talent pipeline strategy, the value of an executive coach, connecting student-athletes with the business community & more. Rawak: I’ve worked with executive coaches for 25 years. I had the same one until about a year ago. Leadership has always been of interest to me. [...] I knew I just wanted to get better. I wanted to be better to serve others. [...] I needed to have someone who could help me grow. Someone who had this subjective perspective, can be a truth-teller, a sense-maker, and help me evolve and grow. [...] Fundamentally, executive coaching is the idea that you have a lot of the answers within yourself and you haven’t been asking the right questions or someone hasn’t been asking you questions. There’s a component that I use that’s homework. A new $25.7M video board in the north end zone of Auburn’s Jordan-Hare Stadium gets the green light & will be ready by the 2025 season, but Tigers AD John Cohen thinks there’s more opportunity at that end of the venue: “There’s no premium seating there and it has a very generic look. And I don’t say that to be mean to anyone that sits there because I know they’re great seats. But I think we can make them better. [...] I also think we have a need for increased premium opportunities in Jordan-Hare because we have waiting lists for all of our premium opportunities. We just opened up a premium opportunity, the Locker Room Club, and we sold out of it in less than two weeks, which really speaks to the passion of our fanbase and what is happening in our football program right now.” (link)

Chalmers v. NCAA demonstrates that the NCAA’s assertion of cost certainty post-House is likely wishful thinking, according to CBS’ Dennis Dodd, who notes: “The association's legal liability is merely getting hitched up to a different train headed off a different cliff. … In this case, what's to keep any former roster of national champions from filing similar complaints? The answer is even more chilling for the NCAA. The case was filed as a class-action, which means all players from that period could be added.” Citing recent tax filings which show the NCAA has paid $61.5M in legal expenses since FY23 and $433M since 2014, Dodd asks: “At what point does the membership's patience run out when the association is averaging $1.18M in legal expenses per week? Ten years? At this rate, the NCAA will run out of money to plug all the dikes in 10 months. … How could the NCAA not address this issue, especially after crowing about legal certainty in House? (It is a settlement, by the way, that has yet to be approved.) Chalmers vs. NCAA looks a lot like that O'Bannon case that started this merry-go-round 15 years ago. In both cases, plaintiffs argued the NCAA used athletes' likeness for commercial gain without the players' permission. You'd think the first thing the NCAA has to do is remove the highlights in question. As of publish, Chalmers' game-tying shot against Memphis in the 2008 championship game can be seen on NCAA.com with an advertisement for Invesco QQQ.” (link)

Extra Points’ Matt Brown wonders if non-P4 leagues should consider capping House payments as a competitive & sustainability measure: “Rather than a hard ‘cap’, I’ve heard more leagues discuss the idea of unified ‘floors’ (i.e, we will all pledge to fully fund X number of scholarships in Y sports, we’ll offer Alston money to X athletes, etc.), as well as more unified messaging. [...] Right now, I don’t think it’s worth freaking out about how a conference could hypothetically decide to ‘limit’ revenue sharing money. We don’t know that the settlement terms will be approved by a judge, we don’t know to what extent the NCAA will actually be able to enforce policies meant to limit outside donor activity in NIL, and we don’t know what type of money will be considered in that $21 million or so.” (link)

Front Office Sports Jake Kring-Schreifels profiles Joe Tipton and Hayes Fawcett, the two reporters and graphic design gurus who handle hoops and football graphics for On3, respectively. Tipton builds graphics for “every major transfer announcement and recruiting commitment across the basketball landscape.” He notes: “While the portal is open, it’s absolute mayhem and madness. Every time my phone buzzes, I have to check it.” Tipton got his start helping JuCo and DII student-athletes before he opened ESPN’s Top 100 high school players list and began soliciting stars with his free services. Fawcett, meanwhile, started local and offered his design skills to several heavily recruited players from his state-champion high school team. His service took off when former LSU football star Derrius Guice began posting Fawcett’s promotional and showcase graphics. Determined to make On3 a college sports destination, Founder Shannon Terry hired them both, “We wanted to build an authentic media company heavily around first-hand reporting. A headlining deal in the media ecosystem as Paramount is set to merge with Skydance with the latter “offering $4.5 billion in cash or stock to shareholders and providing an additional $1.5 billion for Paramount's balance sheet.” CBS is part of the deal as Skydance says it is “committed to energizing the business and bolstering Paramount with contemporary technology, new leadership and a creative discipline that aims to enrich generations to come.” (link)

CNBC announces the launch of CNBC Sport, which will focus on the intersection of business and sports. CNBC President KC Sullivan: “The spotlight on sports has never been brighter with more money at play than ever before. CNBC Sport will offer the highly engaged sports business audience and those looking to invest in this rapidly growing sector, a trusted destination where they will get analysis, updates and insider insights to help them get in on the action.” Forbes SportsMoney Managing Editor/co-host Mike Ozanian will join the network as a CNBC Senior Sports Reporter and will “create a new valuation program that dynamically provides audiences with an understanding of how the money is moving across franchises and leagues. In addition to showcasing his data-driven rankings, Ozanian will provide breaking news, insights, and analysis of the inner workings of the business across all CNBC platforms. Fitch Ratings has released its latest annual medians report for U.S. private colleges and universities, which shows that despite an increase in net tuition revenue growth, the “uphill battle continues” for the sector. Fitch Ratings Senior Director Emily Wadhwani: “Looking ahead, additional operating pressure is expected through with many institutions grappling with elevated costs and a fractured enrollment environment. Cash flows and coverage are likely to face continued pressure, particularly emerging from an admission cycle fraught with FAFSA issues this spring casting concerns over fall enrollment expectations. … Limited increases in tuition will be insufficient to mitigate still-elevated operating costs, which over time will further widen the credit gap between larger, more selective institutions versus their smaller, less selective and more tuition-dependent counterparts.” Strong balance sheets for these schools allowed for the available funds levels to hold steady in FY23 against expenses and adjusted debt. Further, Fitch’s release notes that “Leverage and liquidity medians returned to slightly better than pre-pandemic levels, a favorable development which will in time be tempered by still-narrow operating margins and hampered operating flexibility.” (link)

“The best way to generate resources is for us to focus clearly on football and men's basketball. Economically, that's how the waterfall works. We have a better chance of selling out Mountain America Stadium and Desert Financial Arena with frequency. Those revenues allow us to invest throughout the athletic department and give all 26 sports a high chance of success.” That’s new Arizona State AD Graham Rossini, who also talks to the Arizona Republic’s Michelle Gardner about making more inroads with fans in the greater Phoenix area: “We need to tap into all facets of the market. There are so many people coming here in the last decade and they're looking for something to connect to. Why can't it be ASU? We have 26 sports so wherever you're from, whatever you're into, we probably have it and how do we use that to get somebody on campus so they see all we have to offer?” (link)

Fresno State AD Garrett Klassy talks with SBJ’s Ben Portnoy about taking over an athletic department during a period of transformation throughout the industry and notes that “college athletics has become this environment where it's not run like a business, and it's very much a herd mentality. We have to start thinking more like professional sports franchises and figuring out different ways to monetize every opportunity as part of your portfolio. That's kind of the approach that I've taken since I've been at UIC, up to Nebraska, to Houston, and now I'll bring that mentality to Fresno.” Also from Klassy: “Anytime you sit in a chair, you have to be willing to take some chances, to be bold and aggressive and innovative to move anywhere forward. Leadership is leadership, right? Doesn't matter if leadership is in your home with your family or in an organization – you still have to lead people, lead by example, and [create] a culture of setting expectations and holding people accountable.” (link)

New North Carolina Central AD Skip Perkins has dealt with a number of financial challenges in his first few weeks on the job. The Eagles settled unfiled secondary insurance claims for student-athletes with Duke Health by giving a donation of $500K, a figure “much lower” than what was owed per HBCU Gameday’s Steven Gaither. Second, coaches exceeded their recruiting budgets, leading to the retraction of travel cards previously issued to coaches. Third, efforts to renegotiate or exit the school’s contract with Peak Sports have been unsuccessful. Perkins: “We have signed a ten-year deal with a corporate sponsorship company…where they get 40% of all of our corporate sponsorship. We have had numerous meetings with them…they’re not going to let us out.” NCCU CFO/VC for Administration & Finance Akua Mathewson pegs the budget at $16M-$17M needed to be competitive in Division I athletics, the current budget is between $12M-$13M. Talk of strategies to overcome these financial hurdles are ongoing. (link)

Front Office Sports’ Daniel Kaplan takes a look at the influx of private equity firms into sports over the last 10 years as Bruin Capital founder George Pyne remarks: “Today, there’s like 25 or 30 different organizations investing in sport. When you take a step back and say today, ‘Sports really is an asset class’ … it’s amazing, really, that it hadn’t been really looked at that way.” Scrum Ventures Managing Director Michael Proman: “We’re moving towards this experience economy. [...] When you look at the franchise appreciation right now taking place in NWSL that gets a lot of people’s attention, and private equity does not want to miss those opportunities. I think there is this kind of FOMO [fear of missing out] that takes place.” Pyne & Proman both note the capped number of franchises as one limitation of investment, though SeventySix Capital’s Founder Wayne Kimmel points to the impact of tech: “About eight years ago, we said, ‘What industry had not been disrupted by tech, data, and analytics.’ And it was like, staring straight in our face: the sports industry, this trillion-dollar industry that really hadn’t embraced the opportunities.” (link)

FIU Senior Assoc. AD for Compliance/Deputy Title IX Coordinator Kevin Kendrick and Dartmouth Executive Assoc. AD for Administration Taurian Houston joined D1.ticker/Connect's Kristen Eargle from the 2024 NACDA Convention for a Compliance Panel discussion. Kendrick and Houston highlight the topics that could have the most impact on their universities, how they communicate information with their teams, and handling changes such as the impact of student-athletes unionizing at Dartmouth. Houston on navigating unionization: “It was bound to happen, so I’m not naive to think that unionization was going to be a situation that we never faced or never encountered. … What I’ve learned from being in that experience is the relationships that I’ve been able to create with campus colleagues to help us navigate it – the general counsel's office, communications, the president’s leadership. It really allowed me to get exposed to understanding the resources that we have on campus to help navigate an unprecedented situation for all of college athletics.” Full conversation on Connect. The Athletic’s Scott Dochterman looks back on Maryland’s 10 years in the Big Ten, and Terps Football HC Mike Locksley recalls: “I can just remember thinking more as a fan, because I’m a young coordinator at the time, I’m saying to myself, ‘What are we doing?’ But having 10 years of hindsight and being in the league now, I can tell you we are very fortunate of the decision that was made. It’s been one of the best decisions I would say during my brief time in the history of Maryland athletics.” Dochterman explains that as former UMD President Wallace Loh “learned more about the university, he became aware of the athletic department’s financial woes,” including a 49% drop in fundraising over a three-year period. Loh: “Calling it financial challenges is putting it diplomatically. … If I had known how deep the shortfall was in the athletic department, I’m not sure I would have taken the job.” Loh called his former boss, then-Iowa President Sally Mason, for advice. “She said, ‘Wallace before you simply write this thing off, talk to the Big Ten and see if they want to move to the Northeast.’ I will personally recommend the admission of the University of Maryland into the Big Ten.’ She guided me every step of the way.” Meanwhile, Loh’s advisors warned him of the region’s societal polarization and how that might affect the way a conference switch was perceived. “There was something called the Civil War here: Half the people in Maryland fought for the South, and half for the North. The war has been over for 100 years, but there are still people at Maryland who think of themselves as Northerners or who think of themselves as Southerners. And here you are a Chinese-American, who arrives here, and you are siding with the North and you are trying to move the university into a northern conference. They said, ‘You have to be very, very careful about this.’” Lots more. (link)

Tennessee professor Shannon Scovel discusses the role of equitable publicity in Title IX compliance and says there is this “presumed expectation that certain teams get certain coverage and certain teams get certain publicity support. So this is something as simple as cheerleaders – if they only cheer for the men’s football team and no women’s teams, that’s a potential violation. There’s more flyers promoting the men’s football team than the women’s basketball game – that’s a potential Title IX violation. And it all depends on how [schools] balance that promotion with other sports at the school and the gender breakdown of students at the school.” While media companies are not beholden to Title IX, Scovel notes the media’s “perception of interest is impacted on what they know, which is often a result of schools’ publicity – who are schools promoting in their press releases, who their school sports information director is sending pitches to journalists about certain athletes, who’s kind of in the public ethos, public discussion as an relevant athlete. And so a lot of that does fall on schools and yes, sports information directors overworked. They have a lot of things on their plate. But their job is to promote their athletes and the success stories of the student athletes on their campus, and they should be doing that in a way that celebrates men and women athletes.” In a study conducted by Scovel, she found that “80% of the 300 articles that were published during that [first week NIL was legal] that used the phrase ‘name, image, and likeness’ were about men – specifically men’s basketball players and men’s football players – and the argument that journalists [made] very subtly was that these are quote revenue-generating athletes. … These journalists were telling us which athletes were important, which athletes were ideal ambassadors, and why and which businesses should then sponsor these athletes.” Lots more. In another development that could impact NIL, U.S. District Court Judge Joan Lefkow has ruled that social media influencers can violate the law by failing to disclose a paid relationship with a brand. The ruling stems from a lawsuit brought by “two dissatisfied consumers of Blue Ice Vodka,” according to Sportico’s Michael McCann, who adds: “Mario Sava and Alin Pop accuse the vodka’s maker, 21st Century Spirits, and 10 influencers of violating the Federal Trade Commission Act (FTC Act), Florida and Illinois and California consumer protection statutes. The defendants are also accused of unjust enrichment, negligent misrepresentation and breaching express warranties. Sava and Pop, who seek for their lawsuit to become a nationwide class action and demand damages of ‘at least $11 per bottle,’ argue that marketing for Blue Ice is rife with falsehoods, exaggerations and distortions intended to mislead consumers. Among other grievances, Sava and Pop contend Blue Ice contains more calories than advertised” and isn’t “handcrafted” but is instead “industrially manufactured” by machines. McCann: “To illustrate allegedly problematic influencer behavior, one influencer apparently framed Blue Ice as a healthy alternative when stating she can make Blue Ice cocktails to contain fewer calories than an apple—a claim that doesn’t appear possible. … For athletes who influence, the case highlights that when they promote or amplify items to their followers, they should be mindful of potential lawsuits if they aren’t transparent about whether they’re being paid.” (link)
