Plaintiff attorneys in the House, Carter & Hubbard lawsuits have pushed back on Houston Christian’s attempt to challenge a potential settlement in the cases. Per Sportico’s Michael McCann: “(Steve Berman and Jeffrey Kessler) argue HCU—an ‘unnamed coconspirator’ of the NCAA—allegedly lacks standing. To that point, Berman and Kessler belittle HCU for raising ‘hypothetical fears’ since the parties haven’t yet filed a preliminary approval motion for Wilken to consider (they are expected to do so by July 15). HCU’s claims about settlement terms and impact are dismissed as ‘mere’ and unactionable ‘conjecture.’ The attorneys also contend that ‘contrary to HCU’s speculation,’ the settlement envisions ‘all potential future payments from universities to college athletes’ as ‘voluntary’—just like, Berman and Kessler point out, it is voluntary for universities to play in D-I and remain NCAA members. Berman and Kessler also maintain that HCU’s interests are ‘adequately protected by existing parties that have identical interests.’” More, including an accusation that HCU has known about the proceedings since 2020 when House filed & never raised a concern until now. Ohio State President Ted Carter on new Buckeyes AD Ross Bjork: “Ross has a view of the changing landscape of college athletics, and we're going to need that kind of leadership. I mean, as we're sitting here doing this conversation, something has probably just changed again in college athletics. And Ross is that leader that's going to help guide us through these next multiple chapters that we're going to have. … What made Ross stand out was his experience. He was the youngest Division I athletic director in the country. He had been through multiple athletic director programs, some that had some controversy. And that's been noted. I answered that at his opening press conference. I made a comment that smooth seas never made a good sailor. And Ross had been through some rough seas, and I thought he handled things about as well as he could.” Carter also gives a nod to former OSU boss Gene Smith: “There really is no replacing Gene Smith. Rice AD Tommy McClelland joins the On the Fly podcast and explains that his previous post as Deputy AD for External Affairs and Revenue Generation at Vanderbilt “put me in a position of strength. I did not have to leave. Candice Lee was investing in me at a very high level, was giving me autonomy to lead and run a program from an external standpoint. We were doing really amazing things there, and so I was able to operate out of a position of strength in terms of how I made decisions for my future. And when I first got the phone call about Rice, my initial reaction was I'm not sure that I'm interested. I had a perception of Rice because I had competed against them for seven years in Conference USA when I was athletic director at Louisiana Tech, and my perception was maybe that winning was not of the most importance. Again, it's not the most important thing. At most schools it probably is not, but I wanted it to be something that was very top of mind because at the end of the day if we're going to keep score, let's win.” McClelland also says he’s anxious to see whether AAC Commissioner Tim Pernetti continues the “challenger mindset because I think the one thing about Mike Aresco was he had this challenger mindset that the American was the Power 6. He really pushed the limits of what was possible, and I think you have to have that mindset. If you begin to change your mindset to something else, then I think you're susceptible to just kind of getting grouped into everyone else. And for us, I think if you look even if it's just the Group of 5 in general, it's been primarily coming out of the Mountain West and the American in terms of that CFP slot or that New Year’s Six bowl, and I think that will continue because the schools in those leagues are investing individually more than the schools in the other Group of 5s.” Full Q&A. JohnCanzano.com’s namesake posits a possible Pac-12 rebuilding scenario may be a reverse merger with the Mountain West that would require a minimum athletic department budget. Canzano: “For this discussion, let’s use $60 million as the annual budget floor. A three-year grace period to get there? That would motivate investment in athletic departments, and affirm the Pac-12 as the best football conference on the West Coast. That kind of conference champion would also frequently access the College Football Playoff. It allows the MWC schools to self-select. If only five or six schools decide they can afford it, so be it. If seven, eight, nine, 10, or all 11 get there, great. Those who can’t get to the $60 million floor aren’t serious about funding athletics anyway. Their campuses may welcome the reprieve and maybe they even collect a buyout fee. The real financial silver lining: It eliminates the costly penalties to the Pac-12 and exit fees for the joining members. […] This potential rebuild scenario also buys the Pac-12 some time to wait for further chaos in the ecosystem.” As it currently sits, four MWC schools (Air Force, San Diego State, UNLV and Colorado State) clear Canzano’s hypothetical $60M floor. AD for Revenue Generation and Business Intelligence Andrew Schoepfer sits down with Connect/Fox Sports’ Bryan Fischer from the 2024 NACDA Convention to discuss the progression of ticketing, mobile ticketing, and how Providence uses data to increase student ticket sales. Schoepfer also talks about the need to generate more revenue in the post-House world: “It’s a hard conversation because we are talking about and speculating that – if details are as they’re currently reported – there may be knock-on effects of what that means for our other sports that aren’t our premier sports. … But we’re also [sending] the message that it’s too early to be concerned about it. According to recent surveys, almost half of job seekers say the process has burned them out, while 90% of employers say they aren’t finding the people they need, according to Korn Ferry, which adds: “Those stats don’t seem to make sense in an era of low unemployment and more than 8M job openings, a higher number than ever seen pre-pandemic. … The current job market has become hugely frustrating—for candidates and companies alike. Opendorse CEO Blake Lawrence explains how college athletes’ contracts could/should look like professional athletes’ contracts in the revenue-sharing era: “The buyer that is investing in the NIL activity of the athlete is now going to be the school, so then how does the activity that the athlete’s performing benefit the school? That’s a new world of thinking, but it's not new for professional sports. If you have eight hours of appearances over the course of a year from an athlete, then you are stacking up eight different sponsorship activities and events that the athlete has to attend contractually. That creates value for the organization, so it's just taking a professional look.” (link)

The Baltimore Orioles have selected Populous as the architect for the club’s planned $400M renovation to Camden Yards. Rhode Island-based Gilbane and Maryland-based WarrenBuilds will “provide construction services as a joint venture.” The Maryland Stadium Authority, which owns the ballpark, has also approved a motion to “permit the Orioles to explore and analyze land surrounding the ballpark.” (link)

Meanwhile, the Tampa Bay Rays have selected construction/real estate development firm Mortenson to oversee the club’s $1.3B plan to construct a new stadium and 86-acre mixed-use development area. SBJ’s Bret McCormick reports the project still needs approval from the city, and a vote is scheduled to take place this month. The Rays are kicking in roughly $700M for the project with Pinellas County and the city of St. Petersburg contributing the rest. McCormick also notes: “The new ballpark would be one of the smallest in MLB, with capacity for 30,000. It’ll feature a rectilinear design by Populous, instead of a traditional curved one. This approach is more cost effective; it’s cheaper to build straight lines than curved ones,” per Adam Hardy, director of project development for Mortenson’s Sports and Entertainment vertical. “The Rays also have high aspirations for incorporating sustainability into the design, though that’s not been fully defined yet.” (link)

SBJ’s Bret McCormick takes a look at the increasingly competitive food and beverage industry and notes that “incumbents have lost roughly $300M worth of marquee F&B business during the past year, according to Food Service Matters founder and CEO Mike Plutino, with Footprint Center, Indian Wells Tennis Garden, Indianapolis Motor Speedway, Oriole Park at Camden Yards, new Highmark Stadium, Soldier Field, and new Nissan Stadium all switching providers. Most of the six main competitors — Proof of the Pudding is the seventh, but still way behind the main pack — have taken prominent accounts off each other in the past 12 months.” Plutino tells McCormick that “in many cases, incumbents didn’t see it coming. What’s creating that dynamic? For this many incumbents, and it’s nipping everyone, the volatility is only fueling the competitive scenario. … There are six now, full-throated, we’re all in, and they’re at every major intersection.” Plutino also notes that concessions prices, which have historically increased at 1%-2% annually, have jumped as much as 15%-20% annually the past few years and says it’s not all attributable to inflation. Sodexo Live North America CEO Belinda Oakley: “We should be paranoid in what can be an extremely predatory segment of the business. The issue is not the high-end premium options. If you want a Dungeness crab roll topped with Beluga caviar, it’s going to cost more if you choose that. My biggest concern is the family of four.” More on what’s next for the industry. (link)

AAC Commissioner Tim Pernetti chats with the Memphis Commercial Appeal’s Jonah Dylan about the proposed House settlement, membership changes and more. Asked how AAC members will handle revenue sharing, Pernetti: “I think some institutions in our conference are resourced in different ways than others. What we want to try to avoid is creating competition and gaps in our own league. For instance, and I'm just throwing it out there, the idea of us discussing as a membership, which I think we will, the prospect of revenue sharing within our conference. And should we have an agreed-upon conference cap for revenue sharing to try to create as much of a level playing field as we possibly can. Nothing's off the table on that front.” Pernetti notes the league is having active discussions about membership and says of Memphis’ push to a Power Four conference: “I, for one, encourage people being open about it. I think that it's healthier for everyone to be open about it and discuss it in the way that even Ed did in his first press conference. It doesn't need to be something that everybody knows is going on in the background but nobody's discussing or pretending it doesn't exist. But for us, we can't get distracted by anything we don't control. We have to focus on the things that we do control.” On the prospect of a Group of Five playoff, Pernetti states: “There's not a conference commissioner, or AD, or football coach in the Group of Five that thinks creating something to compete with the CFP is a good idea. It's a terrible idea. The CFP is hugely important to our conference and the entire Group of Five.” (link)

“I want to be very honest with you: Everything I’ve heard about Jeff is phenomenal. I’m going to do everything I can to keep him. And if he wants to stay I’d love to have him. It’s really gonna be Jeff’s choice, and … I think he deserves it. That’s how I would want to be treated if I was in Jeff’s shoes.” That’s new Memphis AD Ed Scott on Tigers Deputy AD Jeff Crane, who also served the department as Interim AD before Scott’s hire. Scott also tells the Daily Memphian’s Tim Buckley about some key early initiatives: “We’ve got to do two things. … No. 1 is selling tickets, but No. 2 is getting butts in the seats and creating the atmosphere for our student-athletes and creating a home-field advantage. And those aren’t necessarily the same. We’ve got to fill up, you know, the Liberty Bowl. We’ve got to fill it up. There’s no two ways about that.” As for Memphis’ relationship with LEARFIELD via Tiger Sports Properties: “They know that I’m gonna come in here and we’re probably gonna shake things up a little bit in how we do it.” (link)

Purdue AD Mike Bobinski dives into the ramifications of the proposed House settlement with GoldandBlack.com’s Mike Carmin. The financial impact come 2025-26 will include $1.2M to $1.4M withheld from NCAA distributions for the next decade in addition to the nearly $22M for revenue-sharing, of which Bobinski says: “It’s going to require some creativity and honestly, lots of reimaging in some ways, and our relationship with the broader university. That has been well known and acknowledged by our leadership, by President (Mung) Chiang, by our board that the scale of this is not something athletics can deal with it. […] Clearly, there’s an acknowledgment amongst the university community that having a competitive athletics program has and does and will provide value to Purdue. It is part of the fabric of this place. Walking back from that is not a viable option. […] While it’s a huge challenge, those numbers are sobering in scope, but there is an opportunity to be had here if we are able to find our way there. I think this leveling of the field a little bit and a more balanced and competitive opportunity is good for places like ours. It just is. It behooves us to get an answer as quickly as we can, and we’ll be working on that in the months ahead pretty diligently.” Asked how NIL will continue to factor into the equation, Bobinski believes true NIL will continue to exist, adding: “The other foolishness needs to go away, and by virtue of this cap, there should be a much more balanced competitive opportunity for people to make offers and provide people with a financial or an economic package that is more like what other people receive.” More. New Washington State AD Anne McCoy continues to be in headlines, sits down with Inlander’s Colton Rasanen to touch on her priorities in leading the Cougars, the future and more. On her top priorities: “I think one of the things I tried to start with our staff and student athletes is a lot of open communication. I don't beat around the bush, because I think people deserve that openness. We started right away with having more open communication and making sure people felt like they were important and valued regardless of the role they play in our department. I think going forward, our goal is to find out what people have really enjoyed or what's been missing. It's just a chance to look in and reflect on what the department looks like. It's a different place than it was when I started here 23 years ago.” Asked about the legacy she hopes to leave behind: “I hope the legacy that I leave is part of what led me to this position, which is truly selfless leadership. That's kind of how I live my life, professionally or personally, and I would hope it's an example for whoever succeeds me.” (link)

Clemson concluded 2023-24 with a 20%+ increase in home attendance across all sports, resulting in a record number of ticket sales and more than 1.06M fans in attendance. Tigers’ AD Graham Neff on the future: “I know there are many headlines about the changing landscape in college athletics. Speaking of the Tigers, attorneys for Clemson are pushing to unseal the majority of two pages redacted from the ACC’s media rights deal with ESPN, stating they include definitions such as game or composition clause, which the attorneys note: “(The ACC) cannot, on the one hand, rely on these terms to publicly advance its incorrect construction of the Grant of Rights while, on the other hand, hiding behind a claim of trade secret protection to hamper Clemson's ability to advance Clemson's own construction of that agreement. […] It is hard to imagine how the ACC or ESPN might 'derive independent economic value' from the definition of ‘conference institution.’” ACC attorneys argue: “The ACC does not dispute that this lawsuit has public significance. But the lawsuit’s public interest in these matters, standing alone, does not outweigh the harm to the ACC and ESPN if the ESPN Agreements are disclosed.” (link)

If you’re wondering what happened to the 64 Pac-12 officials who worked the final football season for the league in 2023, CBS Sports’ Dennis Dodd has your answer. “CBS Sports was able to account for 55 of those 64 officials in regard to their on-field duties for 2024. Approximately 32 of them were hired by FBS leagues, the majority of which are in the Power Four. Eight of those 55 will be in the Mountain West, C-USA and American conferences. Two retired. Two were hired by the NFL. Nineteen stayed with the Pac-12 to populate three crews that will work Oregon State and Washington State games this season.” Pac-12 Exec. Assoc. Texas A&M-Commerce is exploring changing its name, which dates back to 1996, when it was changed from East Texas State before joining the A&M System. Commerce Chief Marketing and Communications Officer Michael Johnson: “We are currently engaging with key stakeholders and groups to assess the possibility of a name change for the university. These groups and individuals have provided feedback, perspectives, and opinions on the pros and cons of such a change. […] Whatever happens in the future, we will remain focused on our 135-year mission to transform lives while building on our legacy, traditions, and values. We remain committed to ensuring our university is at the forefront of higher education excellence, providing quality and affordable education to urban, suburban, and rural communities across the Northeast Texas region, Texas, and beyond.” Per KETR’s Mark Haslett: “Rumors of a name change involving ‘Dallas’ have been circulating on social media and elsewhere locally in the past week,” and a petition to prevent the renaming has more than 6,700 signatures as of this afternoon. The SWAC will expand its Men’s and Women’s Basketball tournaments over the next two seasons from the current eight to 10 in 2025 and all 12 members in 2026, in addition to tweaking the schedule for WBB games to be played on Thursdays and Saturdays and MBB games to be played on Saturdays and Mondays. For football, the SWAC will provide all teams with sideline tablets for in-game video review. (link)

Missouri State Men’s Basketball HC Cuonzo Martin says of the school’s AD search: "I don't really consume myself with those types of things because my job is the task at hand and I've been around the block before. I'll give them my two cents if anyone asks me that. My job is to do my job. At 52, I understand how it goes. Every place I've gone, whether it had been a year or six months, there was a new AD. There's a new president everywhere I've gone. It's part of it. It's easy-flowing to me. It's just a part of the job in the sports world. My focus is simply these players in this program." Martin adds: "If you're an athletic director, you're the CEO of every program. That entails a lot. You have to have a great team around you. No coach is good without great assistants, so I think your whole team has to be good, and whoever that is, he or she, we have to give them time to implement their style, whatever they want to do and how they go about their business. I'm happy for both sides, because again, sometimes change is good. I think change is good for Kyle Moats, who said it himself, so it's probably good for everybody." (link)

ESPN college basketball analyst Dick Vitale has undergone surgery to remove the cancerous lymph node and is awaiting a pathology report to determine whether any cancer remains. The iconic broadcaster announced on X that “I’m in recovery after my surgery & the surgeon Dr Vosler removed the Lymph node that was cancerous & surrounding lymph nodes which he sent for a pathology report he stated & was pleased with what took place.
