College athletic leaders from the Power 4 and NCAA are working through final edits to the long-form document in the House settlement, “a process that could delay the expected filing date next week and result in an extension from the court,” according to Yahoo’s Ross Dellenger. Plaintiffs' attorney Jeffrey Kessler tells Dellenger: “We’re waiting for their final comments. We are hoping to file by the end of next week.” While changes submitted to the long-form document submitted by plaintiffs earlier this summer are not expected to be significant, Dellenger reports: “There are many looming issues regarding the future revenue-sharing model coming to college athletics, such as roster sizes by sport, a new third-party enforcement arm and the exact revenue cap figure. These items are not necessary to completing the long-form agreement, Kessler said, and are ‘internal issues’ that conference leaders must determine themselves. … The timeline for a full finalization of the settlement is likely to be ‘early next year,’ said Kessler, who suggested the month of January. However, implementation of the new revenue-sharing model would not begin until the start of the 2025-26 academic year. Revenue-sharing checks would most likely be distributed starting in the late summer or early fall.” (link)

A pared down version of the ACC’s lawsuit against Clemson will continue in North Carolina. According to the Tampa Bay Times’ Matt Baker, Judge Louis A. Bledsoe III “dismissed many of the ACC’s claims but will allow the dispute over who owns the Tigers’ future TV rights to remain in the North Carolina Business Court. His ruling comes in advance of an upcoming ACC-Clemson hearing in South Carolina, where the Tigers have sued the league. From Bledsoe’s ruling: “The only court that has jurisdiction over [Florida State], Clemson, and the ACC – and thus the only court that can assure a consistent, uniform interpretation of the Grant of Rights Agreements and the ACC’s Constitution and Bylaws, the determinations at the core of the Pending Actions – is a North Carolina court. Only a North Carolina court, most likely in a single consolidated action in North Carolina, can render consistent, uniform determinations binding the ACC, FSU, and Clemson concerning the documents that are at issue in all four Pending Actions.” Bledsoe dismissed multiple ACC claims that Clemson breached its duties related to league contracts and its constitution as well as the ACC’s claim that Clemson owes fiduciary responsibilities to the league. The ACC released a statement following the ruling: “We are pleased with today’s ruling as it confirms that only a North Carolina court can render a decision that would apply to both Clemson and Florida State. … As the court found, Clemson does not challenge whether the ACC Grant of Rights is valid or enforceable. This recognizes the ACC’s consistent position that the 2013 and 2016 Grant of Rights are valid and enforceable agreements that each of our members entered into voluntarily, with full knowledge of their terms.” (link)

The FTC is reportedly preparing to sue UnitedHealth Group, on whose board NCAA President Charlie Baker has sat since November, over alleged price-fixing related to the sale of insulin and other drugs. (link)

While it’s unclear how Florida State’s new 10-year multimedia rights deal with Sixth Street-owned Legends “may affect the private capital conversations between the two sides, it highlights one aspect of the ongoing talks between many schools/conferences and institutional funds looking to invest in college sports,” according to Sportico’s Eben Novy-Williams, who adds: “Many of those firms are looking to provide capital—and reap benefits on the back end—but they’re also pitching their strategic experience. Sixth Street, as an example, owns Legends, which has deep experience with managing the various ways pro and college teams commercialize their rights … Financial specifics of the Legends relationship weren’t included in the formal announcement, which does not mention Sixth Street by name. The deal does not involve Sixth Street’s private capital team, a spokesman for the firm said in an email. A representative for FSU didn’t immediately respond to a request for comment.” (link)

Illinois intends to phase out the Athletic Facilities Student Fee over the coming years, thereby eliminating the fee from the athletic department’s budget. The fee currently comprises $34.63 of the $313 General Fee assessed to students each semester and generates approximately $3.44M in revenue for the department. Illini AD Josh Whitman: "Our staff has worked diligently to put the athletic program on strong financial footing, but change across our industry is accelerating. As a result of the pending legal settlement that has been well publicized, we are preparing for the opportunity for DIA to invest meaningful resources directly into the pockets of our student-athletes. Although the use of the student fee is compartmentalized for facilities, we want to avoid any suggestion that our student body is underwriting more expansive economic benefits for their fellow students. With so much about our financial model being reimagined, now is the right time to make this change." (link)

Some Penn State trustees and alumni are pushing back on the Nittany Lions’ planned $700M renovation to Beaver Stadium. “They challenge the school’s rosy financial forecasts for the project and point to the still-uncertain impact of new rules allowing player endorsement deals and revenue-share payments,” according to the Wall Street Journal’s Melissa Korn. Anthony Lubrano, one of two trustees who voted against the renovation proposal in May, says: There has to be some responsible adult in the room who says we just can’t afford to do this.” In its stadium plan, PSU predicts annual athletic expenses will increase by 2.5% over the next 30 years, which Korn notes is less than half the rate they have risen in the past decade. “The school also budgets minimal outlays for other sports construction projects. The university anticipates that the athletic department will likely record a $44M surplus 30 years after the renovation.” Alumni trustee Jay Paterno, son of former Football HC Joe Paterno, is among those who argue the math is unrealistic. “It’s hard to project 30 months, even 30 weeks, let alone 30 years. You don’t want to be the most leveraged university in this new world.” More. (link)

Baylor Football HC Dave Aranda’s explanation for the Bears’ recent success on the recruiting trail is simple: “We’re paying players.” Asked in a follow-up during Big 12 Media Days if that’s really all there is to it, Aranda replied: “Yes.” Aranda in November admitted that he was part of the reason why the Bears were initially behind on NIL efforts, explaining: “I think the way it stands right now just with our record and with the amount of freshmen that are playing on our team. …. We are kind of the perfect example of a team to be poached [by other teams]. So, all that’s in play right now and is happening right now and is something that I’m spending a lot of time on. So, whether that’s NIL for the guys on our team and getting that to where that is way competitive. And then, for guys that are coming in, and that are going to be on our team and all that, I think it’s something that is a major focus.” (link)

The 10 schools that left the Pac-12 will play in Pac-12-affiliated bowls the next two seasons rather than bowl tie-ins with their new conferences, Big 12 Commissioner Brett Yormark tells Action Network’s Brett McMurphy, who adds: “How the Pac-12 bowls will be filled remains unknown. Because the teams would be chosen from different conferences, the selection order likely won't be based on conference records. The Alamo Bowl has the first pick from the Big 12 and Pac-12 after the College Football Playoff. It will be able to select any Pac-12 legacy school or Oregon State/Washington State, regardless of record as long as the teams are bowl-eligible.” (link)

The Big 12 has launched the first ever Big 12 Alumni Council, which includes two student-athlete alumni from each school. The alumni will “provide guidance and insights surrounding a variety of topics, including brand building, athlete relations, storytelling, digital content and much more. In turn, each Council member will receive a variety of resources and amenities, including networking access to the Big 12’s Business Advisory Board for professional networking, league support of council member’s community initiatives, media opportunities on behalf of the league and VIP access to all Big 12 Championships and Conference events.” (link)

Denver and Playfly Aspire have now exceeded $20M in lifetime ticket and donation revenue through their partnership. Since linking up with Playfly, DU has experienced “double-digit revenue growth in every non-COVID year of the partnership, a 50% increase vs. pre-partnership hockey full season equivalents (FSEs), and maximized women’s gymnastics revenue by tripling season ticket sales.” (link)

The NBA and network executives have finalized contracts that will make NBC and Amazon Prime Video new partners, while maintaining ABC/ESPN as the home of the NBA Finals, per the Athletic’s Andrew Marchand, who notes the agreements are for 11 seasons and are worth $76B. Marchand also points out that “while the NBA and its partner agreed to all the language, incumbent TNT Sports continues to threaten to match. The CEO of TNT Sports’ parent company, Warner Bros. Discovery’s David Zaslav, has publicly stated he may attempt to use language in the current contract to remain involved with the NBA. If Zaslav goes through with that, he is expected to target Amazon’s package. … The board of governors has meetings Tuesday in Las Vegas. At some point following the final step by the league’s governors, the NBA will send the finished contracts to TNT Sports. At that point, the company will have five days to make its move. If it declines, then the NBA is expected to make an official announcement before the Olympics, which open on July 26th.” (link)

Rhode Island AD Thorr Bjorn last summer received a contract extension through June 30, 2028, according to CollegeAD, which reports Bjorn’s base salary increased from $328K to $341K. Other terms remain unchanged, meaning Bjorn can earn a pair of $10K bonuses for meeting fundraising and academic goals. He is also eligible for bonuses ranging from $1K to $10K for meeting athletic-related benchmarks. Should the Rams part ways with Bjorn without cause he would be owed the remainder of his base pay for the remainder of the contract. (link)

Florida State is set to announce a new 10-year multimedia rights agreement with Legends with an official announcement expected today, Seminoles AD Michael Alford tells SBJ’s Ben Portnoy. He adds: “When you look at the changing environment of the collegiate landscape, you have to look at what you can do to make up the difference to be able to support your student athletes at an elite level – and that’s looking at various new revenue streams that we haven't looked at before. I go back to our relationship [with Legends] on the premium sales side that we're doing extremely well. We've had the best couple years we've ever had in concessions at [Doak Campbell Stadium] and throughout all of our athletic venues, and now [adding] the MMR side of things. We’re constantly going to be looking to be innovative in what we can bring to the table that makes sense for Florida State to drive those revenue streams.” (link)

Florida AD Scott Stricklin covers a wide range of issues on the Gator Nation Football Podcast, including the future of roster limits. “Everybody uses baseball because it's a really dramatic illustration, but in baseball you can have what 35, 40 guys on the team, but you only have 11.7 scholarships and you would divvy those up among the players on the team. The thought is that that's going to be the next target for an antitrust lawsuit – that we've all agreed to cap the amount of scholarships at 11.7 – and that roster limits are a more legally defensible approach. … [In football], you've got rosters of 120, 130, 85 of whom currently have scholarships and the rest are walk-ons. And whatever the roster limit is, in the SEC, I'm guessing that's going to be your scholarship limit because everyone's going to fully scholarship up to that roster number. So, I don't think it'll be 130. My guess is it won't be 85, it'll probably be somewhere in between, but when you talk about the end of amateur athletics, schools could still have walk-ons but walk-ons as we know it will go away because the power conference schools probably will be in a position to fully scholarship all their athletes.” Stricklin also talks about his role in promoting the Florida Victorious collective and says it hasn’t impacted UF’s facilities goals. “Let’s say that the facility piece was felt to be really important. There's no current facility projects, so all of our fundraising efforts for the last 24 months, I'd say 80% have been focused on NIL. As he settles into his new role, Coastal Carolina AD Chance Miller tells SBJ’s Ben Portnoy that “the biggest thing is we’ve got to grow revenues. We've got to grow that base. And I look at a place like Coastal, where you're sitting in a tourism capital. How do you tap into that tourism industry to get people out to your games, but also to help your athletes?” Miller adds “tongue-in-cheek,” per Portnoy: “You go to all these SEC official visits and they've got the balloon arches and unlimited food. Those things are done. You don't need that stuff. Prospects are seeing through that stuff. They want to know, ‘How are you going to help me when I get here in terms of developing me? Is it going to be a good culture that I want to be a part of, and what are those resources that you're going to be able to provide?’ That other stuff, I think it was just we've always done that. ... You don’t need that anymore.” (link)

Colorado was offered a $2.5M signing bonus from the Big 12 last year as an enticement to convince CU to leave the Pac-12, according to USA Today’s Brent Schrotenboer. Asked about the signing bonus, Big 12 Commissioner Brett Yormark said during yesterday’s Big 12 Media Day: “I’m not going to discuss my negotiating tactics, but listen, we were thrilled that Colorado was the first mover. Ultimately one got us four, you know, when you think about it. Whatever we did in those negotiations seemed to work out pretty well for us.” CU Director of Athletics Strategic Communications Steve Hurlbert declined to comment: “We’re not going to get into specifics with respect to negotiations between CU and the conference.” (link)

Utah AD Mark Harlan says that during the plane ride to Las Vegas for Big 12 Media Day that student-athletes asked whether they could talk positively about the Pac-12, to which he responded in the affirmative. “There’s a narrative about the Pac-12 and if you weren’t in it, it’s easy to poke fun at it, but if you were in it and you fought for it, you have great respect for the time there and the people there. Our players loved competing in the Pac-12 and it did great things for the university and great things for them too. You’re talking about guys with two championships in that league and in this stadium. It’s just crazy.” (link); More from Harlan, who says of the transition to the Big 12: “It’s certainly been in stages. We were blessed to connect with Commissioner Yormark early. It got less emotional and more ‘to work’. This is a great fit for us. It really hasn’t been all that challenging. It has felt right and we’re excited to be here.” Harlan also commented on the Utes’ rivalry with BYU: “Realignment has been crazy, but you’ve got a rivalry that’s come back together when a lot of them have been pulled apart. We realized that we’re not (committed to playing BYU on the last day of the season). We all agreed to put it on a day where it can get the best possible coverage. Former North Carolina Central AD Ingrid Wicker McCree responds to suggestions that the athletic department’s budget issues are attributable to her time in charge and writes: “Every FCS department has deficit issues, fundraising challenges, insurance issues, and just plain ‘not enough money’ issues. The key is to have a plan. The athletics budget was near $15M at one point before COVID 19, and then things changed just like they did for EVERY collegiate program. Our budget was cut by $2.8M which caused shortfalls in staffing, travel, equipment, game day operations, pretty much the entire budget which included furloughs.” On the contract with Peak Sports specifically, Wicker McCree explains: “You have to be creative to raise funds and Peak Sports was an opportunity to do that. Learfield, Taymar Sports, Aspire, and many other third-party companies base their partnerships off of shared revenue. Duke, [North Carolina, NC State, Appalachian State, ECU, Elon] and other DI programs have sports properties that have similar revenue-sharing deals to increase the bottom line and meet budget projections because that’s what it is, a projection, a loan, for which the athletics program has to technically ‘pay back’ the University each year by meeting its revenue goals. So, the contract with Peak is not a ‘new’ concept but rather what is industry standard when a school decides to outsource corporate sponsorships or ticket sales or marketing. … The revenue share was 60% to NCCU, 40% to Peak ONLY on corporate sponsorships and marketing transactions, not on individual donations or other aspects of fundraising. However, I believe that revenue sharing breakdown has slightly changed to better benefit NCCU, but don’t quote me, I haven’t been there lately.” Full letter. (link)
