Tulsa yesterday introduced new AD Justin Moore, who explained his decision to take the job: “I believe in this university and what it stands for and its values align with my personal values. Incoming Memphis AD Ed Scott’s MOU calls for him to earn $550K per year over the next five years with the potential to earn up to $200K more in bonuses. Scott would also get a $250K bonus should the Tigers join a Power 4 conference. The MOU also contains a provision stating that Scott will not "seek or apply for other positions without prior notice." Scott would owe 70% of his base salary for the remainder of the contract if he leaves before the second year of his deal and 50% if he leaves after the second year. Scott will be owed that amount if he's let go by the university without cause. Additionally, the MOU contains a provision that would extend Scott’s term by up to two years "should any federal, state, NCAA, or conference investigation lead to any material restrictions or penalties by the NCAA for the University's athletic programs for matters occurring prior to start date (July 1, 2024)." In a proposed court order with language both sides have agreed to, the ACC may have to provide Florida State’s legal team a copy of the unredacted agreement between the league and ESPN, according to the Tallahassee Democrat’s Liam Rooney. If Leon County Circuit Judge John C. Cooper signs the court order, the ACC must turn over the contract within seven days. Rooney: “The proposed interim protective order submitted by both the conference and FSU would allow the school's legal team to review the documents and create copies for use in the school's court battle. The order states that the documents remain confidential and only be seen by those involved with the case or authorized consultation. Once the litigation between the school and the conference ends, FSU will return the documents to the ACC and destroy any copies of it within 60 days in accordance with the order.” (link)

Florida State has unveiled a new academic logo and will reserve the Seminole head logo exclusively for athletics. FSU Chief Marketing Officer Susannah Wesley-Ahlschwede. “Previously, FSU was one of the only public universities in the country without three identifying marks. … Most prestigious and R1 universities use a university seal, their primary institution identity which is text, and a primary athletic mark. For many years, FSU has only had two marks — the seal and athletic mark.” (link)

JohnCanzano.com’s eponymous publisher contends that Oregon State and Washington State “need to invest in boosting their brands and telling their story, particularly between now and December. I’d hire Wieden+Kennedy and arm them with a Super Bowl-sized budget. Crowing about themselves is not in the DNA of Oregon State and Washington State. They need outside help.” Canzano goes on to observe that “OSU and WSU have not invested well in building their brands over the years. It’s partly why they find themselves in the current situation. The whole ‘we’re built… not bought’ mentality is a substance play. It’s great for your core fan base and a few donors, but it doesn’t speak the love language of modern college athletics. The Beavers and Cougars are living in a world dominated by schools that understand how to invest in building their brands. It’s time for the Cougars and Beavers to stop positioning themselves as ‘The Little Engine That Could’ and find a pitch that fashions them in a way that matters.” (link)

It appears Peak Sports has sent a letter to North Carolina Central via its attorneys at Frost Echols LLC refuting remarks made by Eagles AD Skip Perkins said at a recent NCCU Board of Trustees meeting. Specifically, the letter cites as inaccurate Perkins’ comments that “Peak Sports gets 40% of everything sold, “Peak Sports gets 40% of items sold by the institution,” and “NCCU tried numerous times to get out of the contract.” Peak Sports’ attorneys point out that “1) NCCU receives 100% of the revenue between $0 and $100,000. This is the guaranteed amount each year. 2) Peak Sports receives 100% of the revenue between $100,000 and $275,000. 3) Revenue above $275,000 is shared with 60% going to NCCU and 40% going to Peak Sports. Moreover, Peak Sports has only ever received monies from sponsorship sales that have been sold directly by Peak Sports. As to Dr. Perkin’s second comment—that Peak Sports gets 40% of everything sold by the institution—here are the facts: While the original contract did have this requirement, this is no longer true based on an addendum signed by Dr. Perkins on May 5th, 2023. In the original contract, Peak Sports obtained the exclusive right to sponsorship sales tied to athletic events and venues. … This addendum gave Dr. Perkins the ability to raise funds where Peak Sports would receive no credit. Dr. Perkins still has the contractual right to do this now, but it is Peak Sports’ understanding that Dr. Perkins has raised nothing.” Full letter. (link)

Straight to the Point publisher Steve Ruddock takes a look at the NCAA’s progress on convincing states to ban prop bets and notes the “modest success is a bit misleading, as the NCAA didn’t start from zero. Nine states already prohibited college player props” while four others restrict props in some way. Ruddock adds: “I’m a bit of a broken record on this, but these prohibitions will not achieve the NCAA’s stated goals of reducing player harassment and increasing game integrity. People can still bet offshore or with corner bookies, so player props are still readily available, and match-fixers could still approach athletes. A player’s performance will still impact wagers on teams, so idiot bettors will still blame the player for losing bets. The correct way to deal with each of these isn’t through a prohibition on these bets. No, the correct way to deal with player harassment is to punish the perpetrator. The proper way to ensure game integrity is to turn player props into entertainment markets and limit bets on college player props to an amount that would make match-fixing silly.” (link)

ESPN’s Pete Thamel reports that “all sides are working to complete the longform of the settlement in the House case, which is expected to be finalized in the upcoming weeks and presented to Judge Wilken. A few details need to be hashed out in the near future, per sources. The range of roster limits being discussed is between 100 and 110, with the Big Ten lobbying for the higher side of that range. There’s discussion of a ‘phase in’ on this, so teams with giant rosters – think 130/140 – potentially don’t have to make immediate giant cuts for 2025. “There’s framework being discussed about the enforcement mechanism around collectives. Those details may not be fully hashed out until after the longform is done. Enforcement, always, is vexing for everyone. Don’t expect immediate clarity on how athletic departments will handle monetary distribution. That’s still a major topic, but not one required to be addressed in this settlement.” (link)

WCC Commissioner Stu Jackson talks about the impact of adding Washington State and Oregon State as affiliate members for two years: “The presidents of the WCC were adamant about not remaining at nine members. We’re not traveling across the country to get conference games, which as we’ve seen has been the movement over the last 11 months. … The value with the institutions is stark in terms of they enter the WCC both with very good academic reputations, which aligns with our current full-time members. Certainly they will provide another level of competitiveness and strength to our conference for the next two years. That hopefully will result in improving the overall competitive metrics for the sports that they’re joining and in turn provide even more access to NCAA championships.” Jackson also points out that moving from nine to 11 teams will make scheduling easier. “The difficulty in scheduling we’ve experienced as a nine-team conference over the past year has been profound. Adding two more institutions, it’s two less non-conference games you need to add. And you still get the benefit of playing two members who are likely stronger than many of the non-conference opponents. That’s across many sports.” (link)

Austin Peay enjoyed record attendance in multiple sports, including football, basketball, soccer, volleyball, and baseball this past season, according to Govs AD Gerald Harrison, who notes: “This surge in attendance has directly contributed to increased revenues, enabling us to further invest in our programs and student-athletes. Football, basketball, baseball, and softball all saw a double-digit increase in revenues during the 2023-24 season.” Harrison also reports that “our partnership with Sabertooth Sports & Entertainment is thriving, leading to record-breaking ticket sales and corporate sponsorships surpassing $2.6M for the first time and the addition of 14 new corporate sponsors. Now in the third year of this partnership, we realized over 70% growth in overall season ticket sales, significantly boosted by our transition to Ticketmaster.” (link)

Oregon has filed three motions attempting to dismiss or reduce a federal sex discrimination lawsuit filed last year by current and former female student-athletes on the Ducks’ beach volleyball and club rowing teams. A settlement conference is scheduled for next week, but Sportico’s Daniel Libit reports: “Despite that, late last week the university filed separate motions to dismiss the lawsuit for lack of jurisdiction, for partial summary judgment and for judgment on the pleadings. In the latter, the university argues that the court should dismiss the plaintiff’s ‘novel legal theory’ about NIL. Plaintiffs have not alleged that the university directly or even indirectly controls the allocation of NIL proceeds by these third-party collectives. Further, under the current NCAA bylaws, universities cannot assist student-athletes in marketing their athletics ability or reputation.” Plaintiffs’ attorney Arthur Bryant: “The complaint doesn’t say independent third parties are violating Title IX. Oregon is violating Title IX because it is working closely with its own official NIL collective, Division Street, and its own official marketplace, Opendorse, to discriminate against its female student-athletes.” (link)

Skydance Media’s $8B merger with Paramount Global will result in upwards of $2B in budget cuts, but incoming President Jeff Shell says the company plans to increase CBS’ sports assets. “When you look at the CBS Sports portfolio, it is really pretty formidable. So while we’re going to be managing the cash flow of the business, sports is the foundation of our business. And if there’s compelling rights in the future that we think can bolster us, we are a buyer probably, rather than a seller.” Shell also commented on the erosion of linear TV, saying: “Obviously, linear is going to keep declining and I think we’re realistic about that. It’s been declining at about 8% a year when you back in everything, and we think that’s going to continue. … I think we’re going to be sitting here in 10, 20 years talking about a significant amount of viewership on CBS network, but it’s going to become part of the equation as opposed to a driving part of the equation.” Shell also notes that broadcast networks are experiencing less attrition than their cable counterparts, and Sportico’s Anthony Crupi adds: “He’s not just talking out of his hat; per Nielsen, the Big Four broadcasters now enjoy an advantage of between 14M and 15M households compared to the most widely distributed cable channels.” (link)

+ Northwestern State has promoted Asst. AD for Media Relations Jason Pugh to Assoc. AD for External Operations. Pugh will “continue to serve in his role as the mouthpiece of the NSU athletic department while overseeing various departments within athletic administration including marketing, fundraising, ticketing and the N-Club, the hub for Demon student-athlete alumni.” Additionally, Brittany Pajuluoma has been elevated from primary athletic trainer for baseball to assistant to the AD for sports medicine and will also take on SWA duties. + Nike has laid off 32 VPs, 112 senior directors and 174 directors, accounting for more than 40% of the jobs the company eliminated this year. According to The Oregonian’s Matthew Kish, workers who supported Nike’s executives have also been laid off, including 22 senior administrative assistants. CEO John Donahoe last week said the layoffs are behind the company and the focus is now on getting new products into stores. “Teams are focused on driving for the consumer innovation and execution” and are “100% focused on driving the growth and innovation we’ve been talking about.” (link)

Coaches Corner…
+ Connecticut has officially agreed to a six-year, $50M contract extension with Men’s Basketball HC Dan Hurley. Hurley will receive a base salary of $400K per year and an additional compensation for speaking, consulting and media obligations of $6.375M for the 2024-25 season, which escalates each year through the term of the contract. He will also receive a retention bonus of $1M per year. Sportico’s Eben Novy-Williams points out the deal keeps the buyout structure where Hurley owes a different sum (much more) if he leaves for another college job as opposed to an NBA job. Specifically, Hurley’s buyout starts at $6M should he take another college job. That figure decreases to $1M in 2029. Hurley’s buyout for taking an NBA job starts at $2M and decreases to $0 in 2028. Those who join the latter level will enjoy access to all hospitality spaces, (men's basketball & football), the ability to purchase up to two courtside baseline seats for men’s hoops ($1,800 per ticket), and personalized parking for men’s basketball. Nebraska and 1890 Nebraska have announced a partnership to make 1890 Nebraska the Huskers’ official collective. Under the new partnership, contributions to 1890 Nebraska are now eligible for Huskers Athletic Fund priority points and can be included in calculating Huskers Athletic Fund membership levels, including Nebraska Leadership Society annual and lifetime memberships. In addition, 1890 contributions are eligible to receive tax deductibility when directed to the 1890 Foundation and priority points are declined at the time of the donation. (link)

A suite of new federal regulations take effect today, including those which boost oversight of postsecondary programs, flag colleges at risk of closure and put new requirements in place for colleges to access federal financial aid. The Education Department also is limiting when universities can withhold students’ transcripts and requiring institutions to provide adequate career services and more information on financial aid offers to students, including details of the actual cost of the education being provided. Further, the Biden administration’s rule expanding overtime eligibility to lower-paid workers kicked in this week, though a federal judge has blocked the change for state workers in Texas. Under the rule, employees who work in an executive, administrative or professional capacity and make less than $43,888 are now eligible for overtime pay. Previously, employees who earned more than $35,568 a year were exempt from overtime. The overtime threshold is set to increase again, to $58,656, starting Jan. 1, 2025. On college campuses, nearly 11K employees across 646 institutions will be affected by the July 1 increase, according to an analysis by College and University Professional Association for Human Resources (CUPA-HR). Ticket scalpers have figured out how to extract “untransferable” tickets from their accounts by “generating entry barcodes on parallel infrastructure that the scalpers control and which can then be sold and transferred to customers,” according to 404 Media’s Jason Koebler. A lawsuit filed in California by concert giant AXS alleges that brokers are delivering “counterfeit” tickets to “unsuspecting consumers,” and that they are “created, in whole or in part by one or more of the Defendants illicitly accessing and then mimicking, emulating, or copying tickets from the AXS Platform.” The lawsuit accuses these services of hacking and says AXS does not know how they are doing it, but Koebler notes the “tickets themselves are often not counterfeit at all, and in the vast majority of cases, they scan as genuine.” Koebler also explains that “there is almost no online information about these services for brokers” and “typing in the URLs for these services usually leads to what looks like a broken website. According to one ticket broker source…some of these services are offered as part of larger ticket management software packages and some are standalone services sold to brokers by word-of-mouth.” Pseudonymous security researcher Conduition tells Koebler: “What I can say for sure is that Ticketmaster and AXS have had every opportunity to support scam-free third party ticket resale and delivery platforms if they wished: By documenting their ticket QR code cryptography, and by exposing apps and APIs which would allow verification and rotation of ticket secrets. But they intentionally chose not to do so and then they act all surprised-pikachu when 3rd party resale scams proliferate.” (link)
