Big 12 Goes To Vegas…
+ Big 12 Commissioner Brett Yormark kicked off Big 12 Media Days in Las Vegas by highlighting the conference’s success this year. The league’s sponsorship revenue grew by 79% in 2023-24, while ticket revenue also jumped 23%. Yormark also discussed the possibility of generating new revenue by moving football games off of some traditional start times. "There's a lot going on on Saturdays, lot of competition. So the question is, are there new TV windows we can explore where we can highlight and amplify our football programs. We're exploring that." While declining to go into specifics, Yormark did acknowledge that discussions with private equity firms have taken place. "I do believe that, given where we are in the industry, having a capital resource as a partner makes a ton of sense. That's really how you conduct good business, I really believe that. And if you see where private equity is kind of making a path into professional sports, at some point in time, it's going to come here into college athletics. … We are exploring what that might look like and a structure and model of what that looks like is going to be critically important so that we're not compromising the long-term future of the conference. We have surrounded ourselves with subject matter experts as we vet out of the possibilities. Whatever we do is going to have to benefit the conference, both short term and long term, and provide optionality for schools." On conference naming rights: "You've got to have someone who will elevate and amplify the conference, that's critically important. If it's someone who just wants to leverage the brand power of the Big 12, that's of no interest to us. If they can come in and the economics are right and they can provide value creation for us, then it becomes a very interesting opportunity for us." (link)
+ More from Yormark via Yahoo’s Ross Dellenger, who notes Yormark revealed he has pushed the NCAA to allow conferences to don commercial patches on the uniforms of game officials/referees like the NBA. Also from Dellenger: “Big 12 Mexico, originally announced as basketball and football games in Mexico, is now ‘pivoting’ to women's soccer and baseball games, Yormark says.” In the league’s next TV deal (2030), Yormark noted the league is deeply exploring “bifurcating” football and basketball and selling both sports as packages to media networks separately. + The Big 12 is set to launch a 24/7 audio station through a partnership with TuneIn, which will become the new audio home of the Big 12, SBJ’s Ben Portnoy reports. Terms have yet to be made available. Portnoy reports the league “was up for renewal with SiriusXM, but tapped TuneIn instead. A source with knowledge of the discussions told SBJ that country music icon Garth Brooks helped facilitate the partnership in part through his involvement with TuneIn and his work as a member of the Big 12 Business Advisory Board. Sponsorships for programming will be sold in a joint effort between the Big 12 and TuneIn. The 24/7 audio network will also be free to listen to, while TuneIn Premium will house live game commentary for football and men’s and women’s basketball from all Big 12 schools.” TuneIn CEO Rich Stern: “We see tremendous growth over the next three-to-five years for college sports. Part of that is about how the economics of college sports are changing, but also we see it in the fandom today and we see it in the interest of our partners. … It's very easy to kind of keep doing what everyone else has been doing year-over-year and say ‘Hey, if it ain't broke, don't fix it.’ But I think [Big 12 Commissioner Brett Yormark] has the benefit of coming in, not only with a fresh set of eyes, but with a new set of rules that are very new and that everyone's still rationalizing.” (link)
+ The Big 12 has reached a partnership with Microsoft to provide Microsoft Surface devices to each football program for use throughout the 2024 season. The tablets will be available for usage on the sideline and in the coaching booth, allowing players and coaches access to video review in-game. (link)

In the second of a two-part interview with GoldandBlack.com’s Mike Carmin, Purdue AD Mike Bobinski talks about the Title IX uncertainty that will likely remain post-House. “We’re not going to disregard Title IX, but the extent that it applies to every element of what we’re going to do moving forward remains to be seen. I think there are decisions that need to be made there, and people will have judgments about that. We’re 57% male, 43% female, primarily due to the heavy STEM deal. That’s just the way the numbers work, and they have for a long time. All of that has to be kept in mind as you make these plans.” As far as how the newly shared revenue will be distributed by sport, Bobinski explains that “until you make some decisions as to how that is going to be divided up, it’s hard to know how far and what that means for any specific program and also, by extension, by any individual. The reality is – and this was pointed out to us pretty clearly – the revenue that’s included in the calculation, basically close to 90%, is football generated. And so, logic would tell you – maybe not 90% – but some significant chunk of this should reside in the football world. That’s reality. Those are part of the decisions that are yet to come but have a huge impact on how you make allocation decisions and where dollars go.” As far as how revenue sharing will impact facilities projects, Bobinski notes the Boilermakers have taken on no debt to finance projects during his eight years in West Lafayette, “and I think that’s going to continue to be the case. In the meantime, ones with a revenue component that can ultimately help pay off or add to your revenue and meet the expenses of the new world will probably move up in priority.” More from Bobinski. USF AD Michael Kelly pushes back on AAC Commissioner Tim Pernetti’s suggestion that the league establish an agreed upon revenue-sharing cap: “I understand where the new commissioner is coming from, but we would not be supportive of any (conference) cap. In this era of change and permissiveness in college athletics, USF has found ways to meet the new standards. We are going to be as aggressive as we can be. … My biggest focus now is to understand what the Division I landscape will look like. There is no reason for us to hold anything back.” If/when the conference realignment wheel starts spinning again, Kelly remarks: “Don’t leave a place like USF out. Do you want to look back 20 years in making that decision, or look ahead 20 years at what we’re going to be?” (link)

The Houston Chronicle’s Joseph Duarte has spoken with several sources who “told me that several potential candidates had informal conversations about their interest in the [Houston’s AD post]. Now that university president Renu Khator is back in town from an overseas trip, the search is expected to gain some momentum this week. My guess is a hire will be in place within the next 10 to 14 days.” Duarte also answers a mailbag question concerning when the Cougars could match up with Texas again: “After playing in 2023, don’t expect the two schools to meet on the football field again any time soon. The men’s basketball team has approached the Longhorns about playing a non-conference game as part of the 2024-25 season but talks never materialized. The best chance to play UT will likely come in baseball, softball or volleyball.” (link)

Montana’s $10.2M Grizzly Indoor Practice Facility is nearly complete with the inflation of the dome awaiting as the next step. Grizzlies AD Kent Haslam: "Eventually the bubble will be inflated. We see that happening in the next two to three weeks, and then the work on the inside of that bubble will take place. They've got to cut out exits, they've got to hang lights, a lot of work they've still got to do when that structure goes up. … It's taken us a little while longer, that was purposeful. We got to a point where there's no reason to rush it, because putting it up any earlier wouldn't make any difference. So we're on target to have it in place and ready to go by the time we start fall camp." Football, soccer, and spring sports like track and field and softball will all utilize the new facility. (link)

The NFL has filed a motion asking U.S. District Court Judge Philip Gutierrez to toss out the $4.7B judgment handed down last month in the Sunday Ticket antitrust lawsuit. According to SBJ’s Ben Fischer, NFL lawyers argue the jury foreperson was biased and Gutierrez gave improper instructions to the jury and allowed plaintiffs to change their whole theory of the case at the last minute. As such, they are asking for the judgment to be reduced to $1 or order a new trial entirely. The NFL also argues that the jury foreperson was biased because he or she pays for a household member’s current Sunday Ticket subscription. Fischer notes the “juror was allowed because the household member was not a customer during the class period, but the NFL argues that doesn’t eliminate the possibility of bias. One outcome of the verdict could be lower prices going forward. The NFL is also trying to get a new trial because of Gutierrez’ jury instructions. Prior cases and the American Bar Association’s model jury instructions say the question for antitrust jurors is whether ‘the competitive harm [of the NFL’s business tactics] substantially outweighs any competitive benefits.’ But Gutierrez omitted the word ‘substantially,’ effectively lowering the bar for a verdict. ‘There was no justification for this consequential departure,’ the NFL’s lawyers write.” (link)

Tulsa yesterday introduced new AD Justin Moore, who explained his decision to take the job: “I believe in this university and what it stands for and its values align with my personal values. I love the community in the city, and I think it’s a great place for me and my family. And I like the fact that as a department, our relationship with the community will be an important part of our success. And it will be important for us to represent the city in a way that makes you proud.” Moore went on to promise that “we will operate with great integrity. We will follow the rules and we will treat people the right way. We will be integrated with campus and strive to be a point of pride for this university and its supporters in the city of Tulsa. We will work hard to intentionally develop our people, our coaches, our staff, and most importantly our student athletes. They are the main reason we are here and we will not lose sight of that. We will be adaptable to the ever changing world of college athletics. We will not complain about the things we cannot change or how things used to be. We will work hard to make sure Tulsa is at the best position possible for whatever the future holds. Incoming Memphis AD Ed Scott’s MOU calls for him to earn $550K per year over the next five years with the potential to earn up to $200K more in bonuses. Scott would also get a $250K bonus should the Tigers join a Power 4 conference. The MOU also contains a provision stating that Scott will not "seek or apply for other positions without prior notice." Scott would owe 70% of his base salary for the remainder of the contract if he leaves before the second year of his deal and 50% if he leaves after the second year. Scott will be owed that amount if he's let go by the university without cause. Additionally, the MOU contains a provision that would extend Scott’s term by up to two years "should any federal, state, NCAA, or conference investigation lead to any material restrictions or penalties by the NCAA for the University's athletic programs for matters occurring prior to start date (July 1, 2024)." In a proposed court order with language both sides have agreed to, the ACC may have to provide Florida State’s legal team a copy of the unredacted agreement between the league and ESPN, according to the Tallahassee Democrat’s Liam Rooney. If Leon County Circuit Judge John C. Cooper signs the court order, the ACC must turn over the contract within seven days. Rooney: “The proposed interim protective order submitted by both the conference and FSU would allow the school's legal team to review the documents and create copies for use in the school's court battle. The order states that the documents remain confidential and only be seen by those involved with the case or authorized consultation. Once the litigation between the school and the conference ends, FSU will return the documents to the ACC and destroy any copies of it within 60 days in accordance with the order.” (link)

Florida State has unveiled a new academic logo and will reserve the Seminole head logo exclusively for athletics. FSU Chief Marketing Officer Susannah Wesley-Ahlschwede. “Previously, FSU was one of the only public universities in the country without three identifying marks. … Most prestigious and R1 universities use a university seal, their primary institution identity which is text, and a primary athletic mark. For many years, FSU has only had two marks — the seal and athletic mark.” (link)

JohnCanzano.com’s eponymous publisher contends that Oregon State and Washington State “need to invest in boosting their brands and telling their story, particularly between now and December. I’d hire Wieden+Kennedy and arm them with a Super Bowl-sized budget. Crowing about themselves is not in the DNA of Oregon State and Washington State. They need outside help.” Canzano goes on to observe that “OSU and WSU have not invested well in building their brands over the years. It’s partly why they find themselves in the current situation. The whole ‘we’re built… not bought’ mentality is a substance play. It’s great for your core fan base and a few donors, but it doesn’t speak the love language of modern college athletics. The Beavers and Cougars are living in a world dominated by schools that understand how to invest in building their brands. It’s time for the Cougars and Beavers to stop positioning themselves as ‘The Little Engine That Could’ and find a pitch that fashions them in a way that matters.” (link)

It appears Peak Sports has sent a letter to North Carolina Central via its attorneys at Frost Echols LLC refuting remarks made by Eagles AD Skip Perkins said at a recent NCCU Board of Trustees meeting. Specifically, the letter cites as inaccurate Perkins’ comments that “Peak Sports gets 40% of everything sold, “Peak Sports gets 40% of items sold by the institution,” and “NCCU tried numerous times to get out of the contract.” Peak Sports’ attorneys point out that “1) NCCU receives 100% of the revenue between $0 and $100,000. This is the guaranteed amount each year. 2) Peak Sports receives 100% of the revenue between $100,000 and $275,000. 3) Revenue above $275,000 is shared with 60% going to NCCU and 40% going to Peak Sports. Moreover, Peak Sports has only ever received monies from sponsorship sales that have been sold directly by Peak Sports. As to Dr. Perkin’s second comment—that Peak Sports gets 40% of everything sold by the institution—here are the facts: While the original contract did have this requirement, this is no longer true based on an addendum signed by Dr. Perkins on May 5th, 2023. In the original contract, Peak Sports obtained the exclusive right to sponsorship sales tied to athletic events and venues. … This addendum gave Dr. Perkins the ability to raise funds where Peak Sports would receive no credit. Dr. Perkins still has the contractual right to do this now, but it is Peak Sports’ understanding that Dr. Perkins has raised nothing.” Full letter. (link)

Straight to the Point publisher Steve Ruddock takes a look at the NCAA’s progress on convincing states to ban prop bets and notes the “modest success is a bit misleading, as the NCAA didn’t start from zero. Nine states already prohibited college player props” while four others restrict props in some way. Ruddock adds: “I’m a bit of a broken record on this, but these prohibitions will not achieve the NCAA’s stated goals of reducing player harassment and increasing game integrity. People can still bet offshore or with corner bookies, so player props are still readily available, and match-fixers could still approach athletes. A player’s performance will still impact wagers on teams, so idiot bettors will still blame the player for losing bets. The correct way to deal with each of these isn’t through a prohibition on these bets. No, the correct way to deal with player harassment is to punish the perpetrator. The proper way to ensure game integrity is to turn player props into entertainment markets and limit bets on college player props to an amount that would make match-fixing silly.” (link)
