Northwestern’s AD search committee will be chaired by trustee Milton “Chip” Morris and includes Women’s Lacrosse HC Kelly Amonte Hiller, history professor/chair of Northwestern’s Committee on Athletics and Recreation Geraldo Cadava and trustees Pat Ryan, Jr., Kip Kirkpatrick and Wendy Nelson. Also, Director of Golf and and Player Development Pat Goss has been appointed Interim Senior Deputy AD, not Interim AD. The U.S. Third Circuit Court of Appeals today affirmed the dismissal of the NCAA’s motion to dismiss Johnson v. NCAA, thereby rejecting the NCAA’s “longstanding position that college athletes cannot be employees and athletes at the same time – an edict with major consequences for college sports in America,” according to Sportico’s Michael McCann, who adds: “At the same time, the Third Circuit ordered the district court to apply a different test to assess the athletes’ employment.” Specifically, McCann explains the three-judge panel instructed U.S. District Judge John Padova to “apply an economic realities analysis of the issue that is grounded in common-law (case precedent) agency principles. To that end, Padova should find that college athletes are employees if they (a) perform services for another party, (b) necessarily and primarily for the college’s benefit, (c) under the college’s control or right of control and (d) in return for ‘express’ or ‘implied’ compensation or ‘in-kind benefits.’” Notably, McCann points out that “given Padova’s findings in earlier rulings, it appears extremely likely he will conclude the athletes are employees. The NCAA could once again appeal, but if denied, the case would then move to pretrial discovery. That would be a momentous development. FLSA discovery tends to be public-facing, a factor that might incentivize the NCAA…to try to cut a deal.” Plaintiffs’ attorney Paul McDonald says the ruling “confirms what we've been arguing – that college athletes can be both students and employees. Because students are employees in work-study programs and athletes meet the same criteria, we're confident they will be found to be employees like other students." Tulane Sports Law Director Gabe Feldman adds: “Broadly speaking, this is another dent in the amateurism armor of the NCAA. The NCAA has been under attack in other areas of the law. This is a sign that employment cases are just getting started." McCann notes the case could take years to play out. The ACC has seven days to give Florida State copies of its ESPN contracts and related documents, according to the Tampa Bay Times’ Matt Baker, who reports: “The Leon County order obtained by the Tampa Bay Times formalizes confidentiality terms previously agreed upon by both FSU and the ACC as part of their ongoing, dueling lawsuits. The documents will be ‘treated as confidential in their entirety’ until a court can fully determine whether they deserve protection as trade secrets. Florida’s broad public records law is also a factor for issues involving a state entity like FSU; the Florida Attorney General’s Office has sued the ACC, claiming the contracts are public. Until these questions are resolved, the order…prohibits FSU from sharing or disclosing details of the documents for any reasons unrelated to the litigation. The documents to be shared are: the ACC’s 2010 multimedia rights agreement, a 2012 amendment and extension, a second amendment from 2014, a 2016 restated and amended deal, the ACC Network contract from 2016, and an August 2021 letter amendment to the current (2016) deal.” (link)

Arizona State AD Graham Rossini says regarding the House settlement that “we’re tracking toward having that ratified toward the end of the calendar year” and adds: “ A lot of (the discussion) is tied to what compensating student-athletes will look like. We don’t know what that will look like. That’s a conversation that will happen over the next several months. It’s going to start from identifying roster caps (and) some scholarship limits will evolve in the roster class. What that does is allow us to understand sport by sport, what is the roster cap and the corresponding investment each school will have and the ability to distribute that throughout.” Former ASU swimming student-athlete Grant House, the named plaintiff in the House case, tells the Arizona Republic’s Matthew Self: “I think it’s a step in the right direction. First and foremost it’s a settlement, but there’s nothing on paper.” He also notes that the ability to benefit from corporate sponsorships is a big help for Olympic athletes. “Unless you're at the very top, you're really trying to scrape by and make sure you win out at these meets or have a job supporting you. Now at least in college you have a brand to support your career. You focus on performing while you can in life, because (the window to compete) is not a long one.” (link)

The Men's Basketball Committee approved Indianapolis as the host site for the 2026 DII and DIII men's basketball championship games, as well as the semifinals and finals of the NIT. All five games are scheduled the same weekend as the DI Men's Final Four, which was previously awarded to the city. The committee also spent “considerable time discussing principles and procedures for selecting, seeding and bracketing teams, and affirmed that the 2025 championship will feature an automatic qualifier from each of the 31 conferences to go along with the best 37 at-large teams as determined by the committee. The evaluation of teams will be enhanced by the addition of two metrics as the committee voted to include the Torvik and Wins Against Bubble rankings on the team sheets.” NCAA SVP of Basketball Dan Gavitt: "The committee has always valued different data points and metrics to assist with its evaluation process, and these two metrics have increasingly been referenced by members in recent years. Adding them to the team sheet ensures that all 12 members easily have access to this data.” The committee also selected Sun Belt Commissioner Keith Gill as its vice chair for the 2024-25 season. Gill will then serve as chair for the 2025-26 season. (link)

CBS’ Matt Norlander points out that one issue the Men’s Basketball Committee didn’t tackle was tournament expansion. “The topic was discussed at length Tuesday and remains up for debate for many reasons, arguably the biggest being the significant financial commitment (with millions more in expenses) that would come with expanding – not just the men's tournament but the women's as well. The NCAA is deliberating whether to stay at 68 teams or increase to 72 or 76. There's no timeline on a decision,” per sources. “Committee members also discussed the consequence that would come with expanding the field, sources said, namely that going to 72 or 76 teams would require teams that would be in a 68-team field to be pulled out of the Thursday/Friday matchups to play on Tuesday/Wednesday in the First Four-type of event. Some of those teams would likely be No. 10 seeds, which does have impacts of competitive balance of the bracket.” Norlander also says of the addition of Wins Above Bubble to the tournament’s selection criteria: “The fact the NCAA has progressed enough to officially adopt it in 2024 is a significant sign of evolution in how the 12-person selection committee evaluates teams. WAB will derive from the NCAA's NET formula.” (link)

The Women’s Basketball Oversight Committee last month received an update from the governance staff on the timeline and opportunities for the membership to provide feedback on the development of a women’s basketball performance fund. The Board of Directors Finance Committee completed its membership survey in which 180 respondents provided feedback specific to fund value, preferred option, timeline to fully fund and payout option. The finance committee will continue to review survey results and will meet in August to prepare its final recommendation to the board for a full DI membership vote in January 2025. The oversight committee “strongly supports the creation of the fund and discussed two key concepts driving the creation and implementation of the fund: (1) The overall unit needs to be a significant dollar amount to recognize the value the new broadcasting agreement and incentivize continue investment in women’s basketball, and (2) The unit amount must be equitable compared to the Men’s Basketball Performance Fund, which would suggest a higher allocation to catch-up to the long established fund.” (link)

UTSA reports increases in several metrics this past season, including in women’s basketball, where “season ticket purchases have increased each of the last three seasons to a record high in 2023-24. Season-ticket sales have increased by more than 70% over the course of head coach Karen Aston’s three-year tenure. More than 12,000 fans passed through the UTSA women’s basketball turnstiles this season, marking the most for UTSA since the 2011-12 campaign. UTSA women’s basketball average game attendance has increased 83 percent over the last three seasons. The UTSA women’s basketball social media reach on Meta platforms (Facebook + Instagram) increased 318% from the first quarter of 2023 to the first quarter of 2024.” In men’s hoops, attendance totaled nearly 20K fans for the season, marking the highest attendance figure since 2010-11. Its social media reach on Meta platforms increased 505% from the first quarter of 2023 to the first quarter of 2024. Yahoo’s Ross Dellenger talks about buzz in Las Vegas about the possibility of Florida State and Clemson joining the Big 12 and notes the schools have three main options: joining the Big Ten or SEC, reforming the ACC with a smaller number of teams “where you would get a financial advantage because you wouldn’t split the TV distribution with 18, maybe you would just split it with 10. … And option three is to probably join another league. Obviously, there's only one other power conference league, and that's the Big 12. So, you look at those options and, again, they probably prefer number one, but I don't know that that's going to happen because the SEC has schools in those states already in Florida and South Carolina, and the Big Ten, I don't know how interested they are in coming south. I mean, those things might happen, but I think there is at least early conversation between the Big 12 and those schools about the possibility. I don’t know if it’s anything serious yet because they do have to get out of the ACC, whether that's through a settlement or a court ruling. So we could be months, if not years, away from something, but that does seem to be one of the possibilities is the Big 12.” Dellenger also notes the Big 12 could utilize private equity to help FSU and Clemson exit the ACC, “but then you’d have to pay them a distribution when they get to the league, an amount that is at least close to what the Big Ten and SEC are paying their schools.” The question then becomes whether Big 12 decision-makers would be okay paying FSU and Clemson upwards of $20M more per year than the other schools. Pac-12 Commissioner Teresa Gould Q&As with The Inside Zone’s Matt Fortuna and says of the possibility of a one-year extension with the Mountain West for football – as broached by MWC Commissioner Gloria Nevarez – that “there are timelines dictated in that agreement, and we all are anxious to find out what our schedule looks like for the fall of 2025, including the coaches and the student-athletes. It's an important thing for us to get resolved and for us to have clarity around. So I would imagine in the coming weeks, we'll make good progress on that. We've all been focused on spring meetings and season preparation and all that, but I think there's a good window here in July, over the next couple weeks, for Gloria and I to make some progress on that.” Gould explains that when it comes to the possibility of rebuilding the Pac-12, “I always want to be really clear that my job and what I got hired to do was put these [Oregon State and Washington State] in the best possible position for the long haul. That might be rebuilding the Pac-12, it might not be. And my commitment and obligation to them is to be open-minded about any potential scenario that might come down the pipe. And I'm sure there's scenarios we don't even know about at this point to be honest with you, given kind of the chaos in the industry right now.” Looking forward, Gould believes OSU and WSU are “in a place to be able to take some risks and to be able to try some new things and think outside the box from a revenue stream perspective. And I think Pac-12 Enterprises is one example of that for us. The reason that the two presidents made a commitment to keep that (is) because I think we view that as a very valuable financial asset.” Lots more. (link)

More from Utah AD Mark Harlan at Big 12 Media Days, where he said of the House settlement: “We are all-in on wherever the settlement falls. We certainly have a straw man of what it’s going to look like, but until it’s ratified…but we’re all-in, we’ve been preparing for that. We’re blessed to have an incredible fan base, donors, corporate program. We’ll get there and we plan on carrying our sports. I think that how we’re going to get there is just a lot of really good work in the community, continued work to explain how important that is for our student-athletes to continue to move forward in that way. And again, we’re just very lucky. We have some amazing supporters that really get it and want to help us.” Harlan also asserts the Utes will not be eliminating any sports post-House: “We have a president that’s all-in. We have a board of trustees that’s all-in, and we have a fan base that has proven time and time again they’re all-in. We’re going to learn, we’re studying Title IX as it relates to the settlement. … We cannot have any of our Olympic sports do anything else but go forward.” Harlan on private equity: “I think you can’t just dismiss something because you’ve got a feeling about it or you’ve read something about it. I think it’s incumbent on the commissioner, which he’s done a great job of bringing opportunities and being thoughtful about it, and I kind of feel the same way. I think we need to look at every possibility. It does not mean it’s the right thing to do, but you’re derelict in duty if you don’t look into these things.” More. (link)

Arizona AD Desireé Reed-Francois was asked at Big 12 Media Days whether the Missouri Board of Curators’ actions influenced her decision to take the UA job and replied: “You know, I just love the University of Arizona. The University of Arizona was there when I needed them.” Reed-Francois explains that in 1994 her brother suffered a neck injury that left him paralyzed during her first year in law school at the U of A and says the “University of Arizona was there for me when I really needed them…and now I’m bringing my skill set to a place where, when Dr. [Robert] Robbins recruited me into the role, he said, ‘Your alma mater needs you.’ And so that’s why I came back.” (link)

During his annual presentation to the Minnesota Board of Regents, Gophers AD Mark Coyle remarked: "There's no doubt there's going to be some financial pressures as we try to navigate the new chapter of college athletics. We'll have to take a hard look at all of our sports and what we provide our student athletes." Coyle also noted that for Olympic sports, the Gophers are likely to focus on more regional non-conference traveling and slow down on new facilities projects. "I think you can see in our Olympic sports, for example, some of the experiences our student athletes have might look different. All programs are trying to figure out how to manage the back payments for the House settlement and how to determine the revenue share model moving forward." Additionally, Coyle noted the athletic department anticipates a balanced budget for FY24 at $135M, which ranked 10th in the 14-team version of the Big Ten. The Gophers' projected budget for FY25 is $150M, which is expected to rank 14th out of 18-team version. (link)

Northwestern has named Director of Golf and and Player Development Pat Goss as Interim AD, according to The Daily Herald’s Jim O’Donnell, who reports that in an interdepartmental statement obtained by The Daily Herald, Northwestern President Michael Schill wrote: “We plan to announce members of the search committee and the search firm we are engaging. The search committee will work expeditiously to recruit and hire our next AD…to ensure the incoming athletic director reflects Northwestern's values and goals.” (link)

Houston Football HC Willie Fritz weighs in on the Cougars’ AD search: “They talk about two things: hiring coaches, that’s one, and raising money, that’s two. In this day and age, it might be the opposite, it might be raising money one and hiring coaches two. James Madison AD Matt Roan’s five-year contract will pay him $350K in annual base pay, per CollegeAD, which reports Roan can earn up to 25% of his base in bonuses for academic, athletic, fundraising and other achievements. Roan is also in line to pick up a $40K bonus if he is still leading the Dukes on May 12, 2027. Roan will earn an additional $50K per year for promoting and supporting the Duke Club Proud and True Fund. JMU will also pay up to $100K to cover Roan’s buyout from Eastern Kentucky. Should either side terminate the contract without cause the remainder of Roan’s base pay would be owed, and both sides have agreed to explore a potential contract renewal by June 30, 2028. (link)

We have analyzed the entire structure of MAF and have redistributed some of the work. Heath will take over the operations. Big 12 AVP for Brand Katie Ristow sits down with D1.ticker/Connect’s Bryan Fischer to talk about the league’s top initiatives this past year, unique ideas that created a stir, Commissioner Brett Yormark’s leadership and influence on the Big 12’s branding initiatives and more. Ristow explains that when collaborating with institutions it’s important to remember they have their own identities. “We want to be a springboard where they can try new things and do different collaborations. One of the biggest ones that we did was when TCU was in the CFP Championship we went out to LA. We worked with them, we did some takeovers and some different boards around LA. … We found a town called Frogtown right outside, which was perfectly fitting for the Horned Frogs, and worked with a local brewery there and did a purple sparkly beer. We also wrapped a taco truck and drove around LA giving out free tacos. That was very much Big 12-branded that had TCU hints and influence.” More on Connect. (link)

Frost Echols LLC attorney Cooper Walker, who represents Peak Sports, has released a statement indicating that “Peak Sports has no desire to sue North Carolina Central University. Peak Sports greatly values its relationship with North Carolina Central University and looks forward to working together for many years to come. Peak Sports' only motivation in sending its letter to the Board of Trustees was to provide the truth regarding the inaccurate statements made by Dr. Perkins regarding Peak Sports.” HBCU Legends’ Kyle T. Mosley adds that Peak Sports “has no intention of seeking legal action regarding Dr. Skip Perkins's remarks.” Instead, Peak Sports President Ryan Holloway has requested that Eagles AD Skip Perkins "communicate these inaccuracies (as enumerated in a letter earlier this week) verbally during the upcoming Board Meeting with the Board of Trustees." Ahead of the upcoming Summer Olympics in Paris, the NCAA reports that “75% of U.S. Olympians will have competed collegiately as part of their journey to Team USA, which includes NCAA, junior college, NAIA and club programs. Of those, 65% (385 of 592) have competed in NCAA varsity sports across all three divisions. In total, 151 NCAA schools from 45 conferences will have one or more U.S. Olympians competing in Paris.” The top three NCAA schools represented on Team USA are Stanford (38 athletes), UCLA (17) and USC (16). The top five conferences represented on Team USA are the Big Ten (116 athletes), ACC (98), SEC (85), Ivy League (47) and the Big 12 (28). In terms of Olympic sports, the top five with NCAA varsity athlete representation are track and field (113 athletes), swimming (44), water polo (26), volleyball (24) and rowing (24). USOPC CEO Sarah Hirshland: "We are incredibly grateful for the collegiate athletics administrators, coaches and support staff who inspire greatness in the student-athletes who will represent Team USA in Paris this summer. With more than 440 current and former college athletes on the U.S. Olympic Team, we know they are competing not only for themselves and our country but also proudly for their schools and school communities."
