House plaintiffs' attorney Jeffrey Kessler blames “infighting” between the NCAA and its power league co-defendants for the hold-up in submitting the proposed settlement to U.S. District Judge Claudia Wilken. Kessler tells Sportico’s Daniel Libit: “The NCAA and the conferences have been extraordinarily slow, and we are really pushing them to speed this up. They just have to get their act together or frankly we are going to go to the court.” NCAA Director of Communications Michelle Hosick calls Kessler’s assessment “inaccurate” and tells Libit: “All parties are working through these complicated issues together and expect to have resolution soon." Kessler, however, contends: “We had very extensive term sheets that resolved really all the substantive issues, so we are really just on language – and some of this is technical language – and that is really why it shouldn’t be taking this long.” When asked, Kessler says that he is “not aware” of any members of the proposed settlement classes looking to opt out. “Why would there be defections? The past damages are one of the largest antitrust recoveries in history, period – not just in sports cases. … We are estimating that over the next 10 years this will provide athletes on the order of $20B in new benefits they couldn’t otherwise receive. There is not a lot not to like about this.” (link)

Sportico’s Michael McCann is curious whether U.S. Third Circuit Court of Appeals Judge David Porter’s concurring opinion in Johnson v. NCAA will gain the same kind of traction U.S. Supreme Court Justice Brett Kavanaugh’s did in the Alston case. While concurring opinions are neither law nor precedent, McCann notes many “court and agency filings have favorably invoked Kavanaugh’s concurrence, where he – unlike the other eight U.S. Supreme Court justices – described the NCAA as a cartel. His words have repeatedly surfaced in litigation concerning college athlete employment, scholarship caps, NIL collectives and even UFC fighter pay. … Porter, who like Kavanaugh was nominated by President Donald Trump, suggested that while FBS football players, ‘March Madness-level men’s basketball players’ and possibly other revenue-generating college athletes likely meet the legal definition of employment, other college athletes probably do not. It’s a distinction that is popular in some corners of college sports. Porter has now lent it legitimacy.” McCann parses several components of Porter’s argument, including his rejection of the NCAA’s position that amateurism precludes employment. Porter stresses that “a combination of market forces, decades-spanning behavior of the NCAA and some Division I teams and athletes, and the Supreme Court’s relevant antitrust decisions have enervated” the “existence or virtue of amateurism” for some college athletes. McCann subsequently notes: “The new goalpost for the NCAA might not be whether college athletes are employees, but instead which ones.” (link)

SEC Commissioner Greg Sankey was asked about future expansion following his opening remarks at SEC Media Days and said: “I’ve responded three times where our focus lies. Our focus is on our 16 members. I have a responsibility to pay attention, but I’m certainly not going to fuel speculation on what happens next. We can certainly remain at 16 for a long, long time and remain incredibly successful. … We know who we are in the Southeastern Conference. We’re the one conference at this level where the name still means something: the Southeastern part of the United States, where when we expanded, we actually restored historic rivalries. Our expansion restored historic rivalries while adding only 100 miles to our longest previous campus-to-campus trip.” Sankey went on to say of the ACC’s current situation: “Our presidents have been clear that I am not going to entangle us in litigation around expansion. So I pay attention but I’m not engaged in those conversations. In fact, as I understand, the issue (in the ACC) is agreements have (been) signed and decisions have been made among a conference, and the question is are those going to be honored as they were established. Apparently, that’s for a court to decide. The broader implications, obviously if things change there’s a new level of uncertainty. It already creates speculation that I think is counterproductive. But I don’t spend an enormous amount of my time thinking about it.” Sankey on private equity: “We have new-wave entrepreneurs who want to be in on the so-called front end of a new paradigm for college athletics. We’ve been incredibly successful, and I understand why so many outside of the campus and conference realm are interested in coming in and being a part of it, but that responsibility lies with us to bring people into the solution, not to cede authority to external actors.” (link); Also from Sankey: We're going to continue our dialogue with Congress. Again, we're going to have to make decisions on our own. We have to do those with the right legal counsel. But Congress is a place that can help set national standards and address the issues our student-athletes have raised. We're not waiting for change to land in our laps. We have a responsibility to engage with our Congressional leaders. Our leaders are elected to lead, and I appreciate those conversations. But on behalf of the now over 8,000 student-athletes in the Southeastern Conference, the future doctors and lawyers and engineers and teachers and nurses and real estate agents, the leaders of tomorrow, my ask again is that Congress continue not only to engage in conversation but help with us resolve some of these outstanding issues and restore clear national standards for college athletics. West Virginia AD Wren Baker discusses how the Mountaineers will move forward post-House and says: "For us, you are trying to think through all the contingent scenarios. People are talking about the settlement like there is a settlement, but right now there's a proposed settlement and the judge still has to agree on the initial terms and the people can object. There's already been some people and institutions who have said they are going to object, so the finalization of this settlement really won't be until after the turn of the calendar year and may be much longer than that. It's really hard to have a definite plan for something you don't know how it will exactly look." However it looks, Baker says WVU is committed to competing at the highest level. “I've said this millions of times. Our program is important more than for just the brand representation of the university. We are very much joined with the state of West Virginia in advancing the brand and reputation of our state. So, we cannot afford to not compete at a high level and that means we will be participating in those opportunities. If you look at it historically, when Alston came around, we participated in it. So as we look at this permissive cap on revenue share, we will be fully participating as allowed by the rules, the court decision and the settlement." More from Baker. (link)

Purdue AD Mike Bobinski also talks about the difficulty of planning for the post-House world and tells the Journal & Courier’s Sam King: “Of all the alternatives out there with lawsuits and other challenges brought to us by individual judges' rulings or state legislature passing rules and regulations specific to each school's state, none of that was headed in a good direction. Settling this lawsuit was the best of a bunch of challenging alternatives. Doesn't mean it's not challenging. It is challenging. And it will be different in a lot of ways. We won't know some of those actual mechanisms and details until this settlement actually is worked out through a full approval process. … The damages piece will actually be withheld from NCAA distributions over a period of 10 years. That is the current working model from the Big Ten membership perspective. It means we will be reduced approximately $1.2, $1.3M a year for the next 10 years. That provides a hole that we've got to fill somewhere, somehow. We've been accustomed to receiving those dollars.” As far as the future of NIL, Bobinski remarks: “To presume that just going out and purchasing rosters, which has happened in some instances – and in some instances to no avail – I wonder how people who provided the resources in certain cases, and I am not going to name names, but significant dollars and got no return for it, how that feels. There's a little bit of, let's earn it. That is the approach we have chosen to adopt here at Purdue. I think it fits with the Purdue philosophy and approach. We attract folks that understand I've got to show something, have to prove it, before I am compensated in a significant way.” More from Bobinski. (link)

The NCAA has extended its agreement with officiating services provider RefQuest Plus and is implementing a long-term strategy to provide additional resources and tools to assist all conferences in addressing concerns about officiating. Starting with the 2024-25 academic year, the NCAA will cover the cost of the RQ+ officiating platform, including payment transaction fees and signature software costs, for DII and DIII and single-sport conferences. Additionally, the NCAA will supplement up to $10K in platform costs for DI conferences. Other benefits of the initiative include offering immediate financial relief for conferences, increasing the number of NCAA-registered officials from ~23K to over 35K, ensuring better-educated officials and consistent officiating through national standards in education and training opportunities, and identifying and addressing regions experiencing officiating shortages. NCAA VP of Championships Anthony Holman: "This agreement with RQ+ puts in place a long-term strategy to help solve some of the biggest concerns we've heard from the membership regarding officiating. We are committing the financial resources to aid conferences and growing the next generation of officials while better educating and supporting current ones." (link)

The ACC has partnered with Apple to bring iPad technology to football sidelines and coaches booths starting with the 2024 season. All 17 ACC football programs will have access to conference-provided iPad Pro and iPad Air models to immediately view video playback. Commissioner Jim Phillips: “The ACC continues its commitment in embracing the use of technology to elevate the performance of our student-athletes, teams, officials, and more. We are proud to advance the sport of football and build upon our positive experiences over the last two years of testing in men’s and women’s basketball. Nebraska’s partnership with the 1890 Nebraska collective could provide a new template for the way schools engage with fans and potential donors, according to Sportico’s Daniel Libit, who notes: “Behind the buzz phrases was a ‘data sharing agreement,’ executed on June 26, between the collective—which includes both a for-profit LLC and non-profit 501(c)(3)—and the Big Ten institution. The 10-page document, which was obtained through a public record request, is to date one of the most extensively memorialized school-collective compacts, and models how others might soon follow suit. … Not unlike other data sharing agreements, this one sets out lengthy clauses detailing ‘use restrictions,’ ‘confidentiality’ and ‘sharing method’ and allows either party to terminate the deal after 30 days of a prior written notice. The agreement only refers to donors and makes neither allusions nor reference to athlete data. Neither representatives of the collective nor school responded to interview requests from Sportico.” The Collective Association President Russell White: “I don’t think they are going to want to put on paper too much data sharing, as far as disclosure of [athlete] deals. I still don’t think they are going to want the school to have full visibility into that.” SANIL Founder Jason Belzer adds: “The further and deeper of a contractual relationship you have with a third-party entity, the closer you get to making the argument that the third party is working directly under the university. Higher Ed Dive’s Naaz Modan and Natalie Schwartz report the U.S. Department of Education has delayed its Title IX athletics rule: “In its Spring 2024 Unified Agenda — which also included updates for high-profile forthcoming regulations on student debt relief — OMB (the Office of Management and Budget) moved the athletics proposal to a ‘long-term action’ without a rough deadline, meaning the agency doesn’t expect a regulatory action within at least the next year. The rule, which is expected to provide a framework for colleges to include or exclude transgender students from athletic teams aligning with their gender identities, had previously been listed as being in the “final rule stage.” Now its final deadline is “to be determined.” U.S. Secretary of Education Miguel Cardona: “The Title IX [athletics] proposal was submitted nine months later” than the broader Title IX proposed rule. It would have been great to put them together. But the reality is we would have had to delay the other one to get through this one.” (link)

Illinois AD Josh Whitman talks potential House settlement & if it could lead to the Illini cutting any sport programs: “It puts us in a position where we’re evaluating every line item in our budget, trying to find those dollars so we can make that strategic investment and at this moment, kind of like when we were in COVID. We’re not foreclosing any options and so there’s a lot of different levers at our disposal and one of them is which sports are we sponsoring? Obviously that’s a last resort for anybody in my situation and we want to make sure we have exhausted other possibilities before we would pull on that lever.” (link)

Tulane AD David Harris joined NCAA Leadership Development Director Lamarr Pottinger at the 2024 NACDA Convention to discuss the concept of “Cultural Renovation” as a new AD, which emphasizes the importance of trust and communication with a new staff. Harris and Pottinger also discuss the use of the “start, stop, keep” method when evaluating a program, the creation of a strategic plan at Northern Iowa, and the advice former Missouri AD Mike Alden shared with Harris on his first day as the Panthers’ new AD: namely, that every staff wants four things: direction, trust, hope and results. Harris: “Culture starts with having everyone all in as far as knowing that what they bring to the table is important, that they’re encouraged to be able to speak on the things they know and that we’re ultimately all pulling together in the same direction to try to do what’s best for the athletic department and student-athletes we serve.” Harris adds that he will meet with every staffer to ask them what they should stop doing, what they should start doing and what they should continue to do. “If you’re looking to renovate (the culture), you’ve got to know where you’re starting from. And so it's really helped me in that regard and I think it's also helped the staff to understand that what they have to share is important, that somebody's going to listen to what they have to say. I can't do everything that everyone wants…but people will understand that they were listened to. In the second of a two-part interview with Corsicana Daily Sun’s Todd Aaron Golden, Indiana State AD Nathan Christensen talks about balancing the financial outlay between facilities and student-athletes as the landscape continues to change. Christensen says the focus will always be on student-athletes, adding: “Certainly we need to make sure our facilities are up to par because we want to recruit high level student-athletes to be competitive. Are we going to spend crazy money that’s not moving the needle? No, but we’re going to invest in areas that we know that truly are going to make an impact for our athletic department, but also for our programs. I think the biggest thing is we need to have broad-based success, like some institutions, they really focus on one or two sports more in my mind. For us to be the best version of Indiana State, that goes back to the (Missouri Valley Conference) All-Sports Trophy that should be our goal.” Christensen says of the future of college sports that “we can’t just have the Big Tens and SECs do all the decision making. … The Missouri Valley is a top 10 conference. So for us to be in a top tier is a major deal for us. Do we look at adding more institutions within the Valley that’s really going to move the needle from a basketball standpoint? That’s what we really need to look at, especially from the revenue side of things with the settlement.” Lots more. (link)

Pioneers AD Josh Berlo: “To comprehensively excel by bringing home 14 conference championship trophies, have nine programs proudly representing our University in NCAA Championships and to have five of those programs advance in the NCAA Tournament continues to showcase the success we're capable of on a national level. This is proof positive of the exceptional culture and tradition inside DU Athletics. We will keep raising the bar in the Ritchie Center to continue to foster our tradition of broad-based excellence." The Indianapolis Star’s Zach Osterman notes that Indiana’s extended partnership with Adidas is worth $54M over 10 years and “the bulk of that compensation — nearly all of it, in fact, more than $49M — will come in the form of product allotted to Indiana by Adidas on an annual basis. IU will receive $4.745M in product in the fiscal year that began July 1, with that number rising across the course of the deal before peaking at $5.045M in the contract year 2033-34, the last of the contract. Terms of the contract will also require Adidas to commit $500K annually in the first five years, and $550K annually in the last five years, on what the contract language terms ‘mutually agreed upon marketing activities.’” Hoosiers AD Scott Dolson explains that taking less in product could result in overages, resulting in the need to buy more gear from Adidas eventually anyway. “There’s no question every penny counts. We look at every dollar. When you trade off product for cash, it’s not like you say, that’s no big deal. The reality was, we felt we would be spending cash to make certain we could accommodate (product) demands moving forward. It was a pocket shift in a way. We felt we would’ve been spending money if we hadn’t increased the product line.” Osterman adds: “Ultimately, the department’s long-standing relationship added a comfort level to all the relevant factors Dolson weighed before settling on an extension. Evaluating Indiana needs from and vision for its relationship with its apparel partner, sticking with a familiar partner made, in Dolson’s estimation, the most sense.” (link)

+ The Athletic’s Max Olson, Bruce Feldman and Sam Khan break down the domino effect of former Alabama Football HC Nick Saban’s retirement, which resulted in more than 400 job changes during the offseason. Starting with the Crimson Tide’s hire of then-Washington HC Kalen DeBoer, the staffs at UW, Arizona, Buffalo, San Jose State, South Alabama, UCLA and the high school level all experienced some level of turnover, and former South Alabama HC Kane Wommack says: “I remember thinking (upon hearing Saban was retiring), ‘I just hope nothing changes with my program.’” DeBoer called Wommack the next morning to get his opinion on whether he believed Wommack would be a good fit for the Tide. He then asked whether Wommack would like to be a part of the staff, and Wommack explains: “It just wasn’t an opportunity I was gonna turn down. It happened fast.” The ripple effect continued until it reached Cisco College (NJCAA), which competes in the Southwest Junior College Conference. HC Stephen Lee informed now Cisco HC Charlie Rizzio that he’d been offered a job coaching tight ends at Tarleton State. Clemson’s attorneys argue the word “is” could determine whether the Tigers are able to leave the ACC. The Post and Courier’s Jon Blau explains: “In recently revealed paragraphs of Clemson's April 17 complaint – which were previously redacted because they might contain ‘trade secrets’ – the university asserts the ACC's deal with ESPN only conveyed the broadcast rights to games played by a ‘conference institution.’ That is defined in the ESPN contract as a ‘college, university or other institution that is a member of the ACC.’ … If the Tigers left the ACC, they wouldn't be a ‘conference institution’ in the present tense – ‘is’ – as written in the ESPN deal. According to Clemson's lawyers, the ESPN contract doesn't speak to a school that ‘was’ a member.” Blau also reports that “as Clemson's lawyers have said repeatedly, a reading of the ESPN deal and ACC's grant of rights ‘together’ might shine a more favorable light on their position; that the conference can air the Tigers' games when Clemson ‘is’ a conference institution — and replays of games from when they were. The ACC doesn't, however, have the right to future games when Clemson no longer ‘is’ a conference member, the university's lawyers argue.” From Clemson’s complaint: "The Grant of Rights is not, as the ACC has claimed, a blanket grant of rights. “Nike is in a crisis,” according to Financial Times’ Sara Germano, who notes that “on June 28, the day after executives issued a dim forecast for the year ahead, its shares plummeted 20% in the single-worst day for the swoosh since its 1980 initial public offering. Consumers are not as fond of the brand’s classic shoes, such as the Air Force 1s, Air Jordan 1s and Dunks, as they used to be. Wall Street, disappointed with Nike stock that has fallen 30 per cent since the start of the year, is openly calling for ‘regime change’ in upper management.” Stifel Managing Director Jim Duffy tells Germano that Nike “took its eye off the ball” coming out of the pandemic, and “having a tech executive who came in to run a consumer product company and introduce a strategy shift, it’s proven to be the wrong approach.” One point of contention has been CEO John Donahoe’s decision to reorganize Nike into men’s, women’s and kids’ categories instead of divisions devoted to individual sports, and “one longtime employee, who left the company voluntarily during Donahoe’s tenure, said the MLB [uniform] fiasco ‘would never have happened’ when Nike’s internal structure had focused teams for each sport.” Meanwhile, On’s market share of DTC customers under the age of 30 has risen from 24% in 2021 to 29%, and Duffy explains the growth is underscored not only by On’s popularity with younger consumers, but also wider growth in athletic brands among older adults, a trend that Nike has missed. “Traditionally that sweet spot was the 15- to 35-year-old age bracket. But a lot of older adults are now wearing sneakers to work, sneakers traveling, embracing that smart-casual look.” More. (link)

Front Office Sports’ Michael McCarthy takes a big-picture look at what professional leagues are doing to prevent game fixing, illegal betting, and the sharing of inside info and observes: “The strictest bans appear in the NFL. No one in the nation’s richest league is allowed to bet on league games or events, such as the draft and combine – period. Everyone besides the players is prohibited from legally betting on other sports.” While punishments vary by infraction across all leagues, McCarthy notes: “Although some people in the industry are willing to risk it all in the cases where expulsion is the punishment, for the most part this ultimate consequence keeps many stakeholders from crossing the few hard lines the leagues draw. And while any suspension will pose an issue, for many in pro leagues, is losing a year of play and salary enough to dissuade people from testing the limits? (Comparatively, Tommy John surgery could take out a pitcher for far longer than a single season, after all.) With relatively lax penalties—in some cases, simply fines—the people governed by these policies often find these outcomes palatable enough to risk.” Declan Hill, author of The Insider’s Guide to Match-Fixing in Football, tells McCarthy that many athletes are gambling addicts and believes leagues should ban all gambling. “The NFL and all leagues need to take a long, hard look in the mirror because they’re dancing with the devil. More fans are looking at the sports product and saying, ‘Did that really happen? Or am I watching something scripted?’ As soon as you get to that point, you will see people switching off.” (link)
