Sportico’s Daniel Libit profiles Houston Christian’s “anomalous” outside counsel in its legal attempt to halt the House settlement, noting that James Sears Bryant, “whose resumé includes professional sports agent, Democratic state representative (from a Republican district in Oklahoma), minor league basketball team owner, consumer advocate and Hollywood producer…describes himself as ‘probably a heretic,’ and when it comes to college sports, he’s probably a paradox: a longtime player advocate and NCAA adversary who is also a full-throated defender of amateurism.” Bryant tells Libit: “It’s really [each] school’s name and likeness that makes college sports so identifiable. It was really fun on Saturday afternoon to see students that are affiliated with the program and try to win one for the alma mater. All that is gone.” Bryant goes on to register his disagreement with the House settlement: “One of the key problems of the legal system is people consistently settling to avoid liability and controversy instead of taking corrective positions in fighting. These [damages] did not happen. Nobody took $2.8B [from athletes] … I am a huge college football fan, but tell me: Who has had $280M a year taken from them? … Higher education leaders are extremely progressive in the classroom but completely reactionary about their own institutions. New College Football Playoff Executive Director Rick Clark says the CFP won't make any decisions about what the sport's postseason format will look like in 2026 and beyond until after seeing how this year’s 12-team iteration unfolds. Clark tells ESPN’s Heather Dinich: "In the January [meeting], we're going to start talking about things in earnest. Then hopefully we get things on the table, we've had a chance to look at them, and in the April one we have to start making decisions, if there's anything to decide." Clark adds: "In the military, you plan, you execute, you step back after execution, you debrief, and then you go again. That's how you get better. But each time you go, you have to go full-in. You can't go into it thinking, 'Oh, this is just a test run.' No, it's not a test run. This is the run. This is decades we're going to be doing this. We have to have the long game in mind on this and really be ready to adjust and make ourselves better over the years." (link)

Ohio State AD Ross Bjork believes college sports is in a “calming period right now and really it’s related to the television contracts. Look, what’s happening in the ACC, we have to pay attention to that. We don't know where that's going to go, but for now – and I say for now I’m talking the next three to five years – after that there's going to be more movement. TV contracts expire in late 2020s and early 2030s. You’re going to have more movement, and I think there's going to be an economic consolidation around the whole ecosystem. What that means specifically I don't know yet. We will still have the Big Ten, we will still have the SEC, we will still have our conferences, but as things evolve, the bigger brands are going to have an economic consolidation at some point in time. Whether or not we join conferences with others, I don't think that's the case, but that's where it's going to go and so let's pay attention over the next three to five years as TV contracts wind down.” Full interview. The ACC yesterday released a statement following the announcement that it would turn over redacted versions of its media contracts with ESPN to Florida Attorney General Ashley Moody’s office: “The ACC respects the public records laws of states where we have members; however, as a private nonprofit association formed and operated by public and private universities from across the country, we do not believe that our own records are subject to those laws. Both parties, while fully preserving their legal positions, have reached a solution which will include the voluntary production of certain redacted documents by the ACC, and the Attorney General then dismissing its lawsuit. The ACC will not be providing any portions of documents containing trade secrets which has been its consistent position.” (link)

WMT has acquired AI ticket-pricing platform Event Dynamic, which will be rebranded as Tillion under the WMT umbrella, per SBJ. Terms of the acquisition were not disclosed. WMT Founder/CEO Andres Focil: “WMT having this multisuite of software, we’re putting together a really robust plan toward all the different areas that we can drive revenue for these different (sports & entertainment organizations). Inside Higher Ed’s 2024 Survey of College and University Chief Business Officers found that 83% of respondents believe their institution will be financially stable over the next three years, while 85% believe the same is true of the next five years. That number falls to 73%, however, when the timeline is 10 years. CBOs were less confident about their long-term prospects last year, with 72% indicating they would be financially stable over the next five years and 65% over the next 10 years. Despite their increased confidence, fewer business officers noted positive operating margins. Slightly more than half (57%) noted a positive operating margin for FY23, down from 76% in the previous year’s survey. For FY24, 62% of respondents said they expected a positive operating margin. However, that varies by sector, with 73% of CBOs at public institutions expecting FY24 to yield a positive operating margin, compared to 49% of those at private, nonprofit colleges. Also, 94% of respondents said that their institution offers good value. But only 68% of CBOs believe that is true of higher education as a whole. And 69% believe that the public overestimates the cost of a college degree. More from the survey. (link)

NCAA President Charlie Baker last month presented to the DI Council a structure for a separate governing body involving the Power 4 conferences, according to CBS’ Dennis Dodd, who notes the proposal would “accommodate the Power 4's desire to have its own governance division to make its own rules. Not a full breakaway but a recognition that those commissioners don't want Division III presidents voting on roster caps anymore.” Currently, only 14 of the 40 members on the council are from the Power 4, and Dodd notes the “concern among those power conferences is that Council members who had no stake in an issue had the power to vote it up or down.” Also from Dodd: “While the Council presentation during the June 25-26 meeting was short on specifics, it's clear the NCAA is headed toward a further power shift. Such a move would bifurcate the 40-member Division I Council that is responsible for the day-to-day operation of the NCAA. Power conference administrators have long been frustrated at both the composition and voting structure of the Council. … Sources indicated there was acrimony and concern among smaller conferences when it became evident the structure would favor the Power Four. The initiative continues. A person with knowledge of the latest NCAA Council meeting told CBS Sports, ‘This was one of the more compelling presentations just in terms of the reality of where we are in college sports.’” More from Dodd. SEC Commissioner Greg Sankey discusses several topics with Yahoo’s Ross Dellenger, including recent machinations of some ADs and school presidents, some even within the SEC, about creating a super league. Sankey declined an invitation to meet with them in New York and tells Dellenger: “I think ideas are best when they are shared through the front door, not the backdoor.” Sankey also discusses his stance on avoiding private equity and acknowledges there is “frustration with presidents, coaches and athletic directors over the last couple years. I say, ‘I get you’re frustrated.’ When there is change and there is frustration, it’s now, ‘Let’s pursue new ideas!’ Any of the ideas identified can actually be decided within a conference or a collection of conferences. It’s not clear to me why people feel the need to cede authority to an outside entity when they can make decisions.” Sankey goes on to tell Dellenger: “The notion that money is a solution to our current situation actually should be seen as more of a threat. In a system going through upheaval, just inserting a bunch of money does not resolve the issues at the core of the upheaval. … As I understand the reality of what’s presented, we can make every one of those decisions on our own.” As the industry continues to, as Dellenger puts it, “burst free from its amateurism shell and rocket toward professionalism,” Sankey emphasizes the need to change from within. “You had a system perceived as working pretty well — not perfect. There is no perfect. We are in the classic [idea] of ‘Great is the enemy of good.’ It’s hard to change when you think something works well and it’s a historic model and when you’re in a higher education system. As we walk through this, don’t cede authority to making decisions. We should take ownership.” (link)

Johnson v. NCAA plaintiffs’ attorney Paul McDonald joins the Sports Wise podcast with Tulane Sports Law Director Gabe Feldman and emphasizes that this case has never been about comparing student-athletes on a sport-by-sport basis. “Our case has always been about comparing all of the DI college athletes to their fellow students in workstudy-style programs – some of whom, by the way, are on academic scholarship – comparing it to them and saying if they are recognized as employees, that's the benchmark, the athletes meet the same criteria more than those student employees do and so it defies logic to, for instance, say the student who took your ticket (at a game)...that student we know is an employee, but the student who's on the field (is not).” McDonald goes on to note that “DI college athletes have timesheets…just like the student who’s selling the popcorn at the games. So it begs the question, if you have timesheets for these athletes, you're basically treating them at all functions like you do the other students even though they're providing you services and working frankly harder than those other students, why don't you just fold them into the same system?” Doing so, McDonald continues, would also solve several other problems, including the question of international students earning income. “You can work 20 hours in a workstudy position if you’re on an F1 visa, whether it be tax implications – student-employment is exempt from FICA. … The question to ask is, is it a problem in workstudy? If it’s not a problem in workstudy then folding the athletes into that same system won’t create a problem.” Lots more. (link)

Florida Attorney General Ashley Moody announces she has secured an agreement from the ACC’s attorneys to provide her office with the league’s ESPN media rights contracts. Per On3’s Pete Nakos, the agreement covers “the ACC’s 2010 multimedia rights agreement, a 2012 amendment and extension, a second amendment from 2014, a 2016 restated and amended deal, the ACC Network contract from 2016 and an August 2021 letter amendment to the current (2016) deal.” (link)

West Virginia AD Wren Baker joins the Blue Gold Sports podcast and says he doesn’t envision any new facilities projects going through without 100% donor funds. Currently, WVU is building a new baseball lab, but two donors covered the majority of the project, with one donating 70% of the required funds. Baker notes there is a facility master plan being worked on with architects. While coaching salaries are unlikely to decrease, Baker says: “Probably everybody is going to see a little bit of a lull.” When discussing conversations with other ADs about revenue sharing, Baker noted revenue-generation ideas being floated include having sponsor logos on the field and potentially on student-athletes’ uniforms in the future. “I think all of those things are in play. It’s not going to be easy, it’s going to require a lot of thought, a lot of hard work.” He also mentioned that the health of Country Roads Trust, West Virginia’s NIL team, is “critical” for them as well. Baker on roster limits: “There’s great variance in what people think roster limits should be. People would be shocked and amazed at the amount of debate that’s going on and lobbying behind the scenes. … My guess is we’ll end up with a compromise, it’ll be somewhere between 85 and 120” in football. Asked about recent buzz around Florida State and Clemson potentially joining the Big 12, Baker remarked: “Most of the time when I’m reading that it’s news to me, and if it’s news to me that means there’s not a lot of accuracy to it. What we do know is that there are definitely institutions positioning and jockeying to try and put themselves in the best position. … I would just caution people to realize that a lot of times what they’re seeing is the tip of the iceberg, and the tip they’re seeing is probably not the most accurate and real information.” (link)

Denver has released its 2023-24 Annual Report, which indicates that donors and alumni combined to give $5.73M in 2023-24, the fifth-highest fundraising total in department history and a 168% YoY increase. Meanwhile, the Pioneers’ national champion men’s hockey team played in front of 12 sellout crowds in Magness Arena, and the total attendance throughout the season put Magness at 102% capacity. DU’s hockey ticket package purchases combined for 3,234 full-season equivalents (FSE), more than 50% of Magness Arena's capacity. Additionally, the gymnastics program received record support with more than 1,350 season ticket holders in Magness Arena. DU finished 13th in attendance average (4,712) at its gymnastics meets and 12th in total attendance (23,562), both program regular-season records for a single season. In men’s lacrosse, DU ranked sixth nationally in total attendance (18,792) and seventh in average attendance (2,349). The WNBA will earn $2.2B over the life of the NBA’s 11-year, $76B media rights agreements with Disney, NBC and Amazon, according to Sportico’s Kurt Badenhausen, who notes the $200M a year represents a 6x gain compared to its prior ESPN deal. “The average annual value (AAV) of the agreed-upon combined NBA and WNBA rights package is more than 150% higher than the prior pact, which was worth $2.7B a year and expires after the 2024-25 season. The W commanded only 1% of the prior TV deal but nearly 3% of the current one. The two leagues negotiated their TV rights together, but they have different term sheets. The total value could move higher if the WNBA continues on its current growth trajectory; a clause in the deal allows the league and its partners to reexamine the rights deal after three years.” The W also expects to sell two additional packages of games that could be worth $60M or more per year, and Badenhausen notes that “when all of the agreements are reached, the WNBA’s average annual TV rights fee will be worth at least $260M. CBS and Ion are be the favorites for additional packages. … The average WNBA franchise is worth $96M, according to Sportico’s June team valuations, a 45% premium to the average NWSL team last year.” (link); WNBPA Executive Director Terri Carmichael Jackson criticizes the deal, indicating in a statement that “we look forward to hearing how the NBA arrived at a $200M valuation – if initial reports are accurate or even close.
