Sportico’s Michael McCann reviews the full House settlement filing, says “challenges loom.” Key notes: “Wilken will weigh the settlement against the complexity, expense and likely duration of continued litigation. This preliminary review could take several weeks or months. Wilken might urge or require the parties to modify their settlement during the preliminary approval stage. For example, if she believes the distribution of funds would overly advantage some athletes and overly disadvantage others, the parties might rework the math to comport with Wilken’s suggestions. The judge might also contest areas of the settlement that punt key specifics to future deliberations. While preliminary approval might require settlement revisions and court hearings, Wilken will likely grant it. It is rare for an antitrust settlement to be rejected at an early stage since the settlement’s claimants—college athletes—have not yet been heard in court.” McCann goes on to outline multiple examples of lawsuit settlements that have been rejected by judges for a variety of reasons: “...keep in mind, those details are very much subject to change at the judge's behest. The UFC settlement has changed a lot over the last few months. Don't rely on NCAA settlement details yet.” (link)

Starnes Davis Florie attorney Jay Ezelle: “As someone who has fought the NCAA for over 20 years on extra benefits rules for student athletes, I am uncomfortable ever defending the NCAA, but I think the criticisms of the mandatory reporting requirements in the House settlement are not well reasoned. First, for all of those concerned about the disclosure rules, you should probably be even more concerned about an employment model. Many states require state employees to disclose outside income and even impose significant penalties if that income is a conflict of interest with their position or violates statutory restrictions on such income. Moreover, citizens can request copies of their employment agreements and other records, including cell phones (just ask Hugh Freeze). Second, the same is true for those assuming collective bargaining would solve all the problems. Almost every collective bargaining agreement in professional sports contains provisions limiting outside income and requiring arbitration to determine if outside income is greater than fair market value. Finally, those claiming that the disclosure requirement is a clear antitrust violation may want to read some more antitrust law, or at least go back and read the Supreme Court’s Alston opinion (the actual opinion and not just Justice Kavanaugh’s concurring opinion).” More. Disclosure of athlete NIL agreements to schools can create conflict of interest issues when a school is also serving as an agent for athletes.” (link)

How will the House settlement impact Men’s Hockey? College Hockey Insider’s Mike McMahon: “I don’t think 26 players is enough. By my math, 13 teams carried 26 players or less last season. That means 51 teams carried more than 26 players. I had one coach tell me yesterday, “We carried 26 last year, and it was doable, but it was light.” Hockey is a contact sport, and injuries happen. There were multiple examples last season of teams dressing less than a full roster due to injuries. St. Thomas dressed less than a full roster during the CCHA playoffs. [...] According to several coaches, they had some low-level input on roster cap numbers, but the college hockey body did not set this cap — the NCAA did. [...] Over the last 48 hours, I’ve talked to coaches from 17 different programs about this change. My unscientific polling resulted in what you might expect: Bigger programs welcome the change, and smaller programs are terrified of what this might mean for them.” More. (link)

“Everything outside of the Big Ten and SEC is shuffling. It’s just part of college athletics. Both schools know they’re essentially free agents that have TV value… that (TV value) is what is driving realignment today. Both of those schools are Power 4 schools. Is there going to be enough movement to open a spot for them? Or do they need to figure out if there’s another measure with other schools that have TV value? In the Group of Five, there are only a handful of schools that have TV value. Oregon State and Washington State know who they are.” That’s current Washington AD Pat Chun to JohnCanzano.com’s namesake. Which other non-P4s have “TV value?” Canzano continues: “I turned to a couple of TV-world sources for some input. Their short list included: San Diego State, Colorado State, Memphis, South Florida, UTSA, North Texas, and the service academies (Air Force, Army, Navy). They may also include Boise State, Fresno State, and UNLV because of brand and geography. It’s worth chewing on this ‘best of the rest’ idea because it appears the world of college athletics is.” (link)

Group of 5 Football HCs in the state of Texas comment on the potential impact of the House settlement. UTEP HC Scotty Walden “For the G5 programs, the revenue sharing is rather difficult. How much revenue (is there)? All we’ve done is create more things going out. We have to be creative on how things come in.” Texas State HC GJ Kinne: “We are going to be part of that. I think that’s going to be, especially people at our level, are you going to be able to even do it? That’s a big question probably for a lot of the (Group of Five), are you going to be able to do it? We already started that process to kind of see how it goes, but I don’t know.” Rice boss Mike Bloomgren: “I don’t want to tell you anything I don’t know about. The program is committed to making this thing go, and to give us the tools we need to win football games. That’s what our athletic director has said, that’s what our board of trustees has said, and our president. They’ve all said that.” (link)

Front Office Sports’ Amanda Christovich wonders if the Mountain Pacific Sports Federation, which now sponsors 11 sports, has only six employees listed on its website and annual revenues just shy of $700K, could be the saving grace for the Olympic sports pipeline. “The MPSF has been adopting orphaned Olympic sports teams since 1992, when it launched for the purpose of providing an inexpensive, but high-quality, league to compete in. Unlike most conferences, it operates around sport-specific sponsorships that schools can participate in, rather than school affiliations. It sponsors neither football nor basketball, and it has fewer than 10 employees—and yet, the conference has sent more than 100 affiliated athletes and coaches to each of the 2024 Paris Games and the 2021 Tokyo Games. … The latest wave of conference realignment has thrown the U.S. Olympic pipeline into chaos. Beach volleyball is just one example of a sport whose NCAA leagues serve as the main development track for future Olympians in the U.S. and abroad—and whose infrastructure was decimated by football-driven realignment decisions. The MPSF offers regular-season leagues and conference championships. It allows its sports, which generate limited revenue, to stay local, helping with travel costs and the athlete experience. And it has the freedom to focus on building business opportunities that help keep competition fees low, and send any extra money back to the teams in the league.” Commissioner Foti Mellis: “We just want to be flexible, we want to be nimble, to be able to adapt to this ever-changing landscape. We want to make sure that we’re here to meet the needs of the membership, and obviously to continue with Olympic success, and make sure our Olympic athletes can thrive and [have] a place that they can train and be ready for the Olympics.” More. Western Illinois Interim President Kristi Mindrup says that the school still needs to cut $10M to balance the budget and that more layoffs are on the horizon. One proposal under consideration is cutting $500K out of the athletic department’s budget. (link)

Big South Commissioner Sherika Montgomery provides her perspective on the House settlement: “The level of competitiveness across the board when it comes to recruiting as well as retaining student-athletes, sport-by-sport, I do think that’s going to become increasingly difficult. Which is why I feel like institutions and administrators as well as conferences are going to have to be very intentional and strategic as it relates to how we move forward, whether that’s institution to institution or having some type of conference-overall parameters and/or requirements when it comes to making sure we’re able to continue to be competitive with this shift and this change.” Winthrop AD Chuck Rey: “It’s only going to increase the transfer portal too. Now, very good athletes or athletes that are at mid-major schools like (Winthrop), there’s going to be more scholarship opportunities at Power Five schools. Because of that, we may lose some of our top student-athletes to scholarship opportunities at those schools. We’re not going to have the capability to scholarship all of our student-athletes.” (link)

Of the nearly 600 American athletes competing at the Paris Olympics, 75% of them played in the U.S. college system. More than 800 athletes with NCAA ties will compete for other countries in Paris. In all, more than 1 in 10 of the 10,500 athletes at these Games played college sports in the U.S. The Associated Press’ Doug Feinberg and Eddie Pells: “None of this comes cheap. One estimate is that NCAA schools spend more than $5 billion a year on so-called nonrevenue, or Olympic, sports.” That level of spending, of course, could be changing with the impending House case shakeout. On that front, CEO of the USOPC Sarah Hirshland: “It is extraordinarily top of mind to us. We’re going to keep a close eye on programs being cut, or even talked about being cut. … We’re going to do everything we can to contribute to saving that system because it works beautifully for us and, frankly, it’s the envy of the world.” (link)

Opendorse co-Founder Blake Lawrence observes: “The House Settlement allows NCAA to prohibit booster payments above fair-market value (FMV). They don’t require ALL NIL deals to be FMV. Only BOOSTER deals. If the goal is to prevent circumvention, either 1 Booster definition must be AIR-TIGHT OR 2 All deals must be FMV.” (link)

As Washington enters everyday life in the Big Ten, the Seattle Times’ Andy Yamashita talks to ADs who previously made big conference moves to understand moving dynamics. Former Utah AD Chris Hill points to three key factors when the Utes went from the Mountain West to the Pac-12: “First, university leaders made a commitment to invest in athletics. Next, having continuity in the football program, specifically in longtime head coach Kyle Whittingham, was an important advantage as Utah prepared for a new conference. Finally, Hill said Utah was able to retain key coaches and staff, and maintained a unified vision with the university about the importance of competing, not just participating, in the Pac-12.” TCU AD Jeremiah Donati notes: “The day we were selected to go to the Big 12 was an exciting day. But day two of that was (asking) are we truly prepared to move into this nicer neighborhood? [...] If this is what you want, if this is what’s important to you, then your investment needs to match that. The duo emphasizes the importance of a carefully crafted, impassioned cover letter, your elevator pitch and being comfortable with Zoom as Turner notes 41 of CSA’s 42 searches since 2020 have used Zoom as part of their process. Asked about how to get on the firm’s “radar,” every application or expression of interest is vetted, with Turner adding: “It's always more meaningful if your current AD. or if you're an AD, if you have a colleague or somebody that does know us that can reach out and advocate, that helps but it's certainly not the only route.” More on Connect. Fresno State Deputy AD Rob Acunto sits down with ADU’s Tai M. Brown at the 2024 NACDA Convention to discuss his experience serving in the Interim AD role at four different moments in his career – at American U., twice at The Citadel and most recently at Fresno State. Acunto, who also sat in the Big Chair as the AD at Presbyterian before taking the Deputy AD role at Fresno State, shares key learnings he’s garnered from his experience as an interim. Acunto credits then-American AD/current NCAA SVP Jodi Comstock for giving him this advice: “Treat people the same way you would in your current role because more than likely you’re going to go back to that role. Nothing is ever as urgent as other people might want you to believe that it is.” He adds his own observations: “It really is understanding the ebbs and flows that I’m not in a position to make dramatic changes, which is good, I can tweak things as they need, but I’m really there to prepare it for the next person that comes in to be functioning as well as it possibly can during a time of transition and uncertainty.” Lots more. Citing the 1000% increase in WNBA player merchandise sales, led by former Iowa star Caitlin Clark & former LSU standout Angel Resse, NBA agent Nate Jones believes the men’s hoops side should take note of how the women’s side operates: “Read this and you’ll understand why I keep saying the NBA needs guys in school 3 years in this new media environment. March Madness the last frontier of a basketball event being monoculture and the NBA barely benefits because of 1 and done rules.” He continues: “Customer acquisition is hard and expensive. When you have a ready made customer acquisition machine, why would you ever keep rules that prevent you from benefiting from it? MoffettNathanson’s co-founder & Senior Managing Director Michael Nathanson downloads with The Athletic’s Richard Deitsch with his latest thoughts on the future of media. Of particular note: “We have a long history of saying, ‘This is the top.’ Then, NBC comes along and bids $2.4B (for the NBA). Even Netflix, who forever has been saying, ‘We don’t need sports rights,’ has come along to do Christmas games at a really good price. I think at some point Netflix will more actively say, ‘We need to be in the sports rights business.’ There’s just so much tonnage in our lives with only so much channel capacity and sports just stops us and so I think the future has to be live and it has to be sports. [...] Every time Netflix says it’s something they’re not going to do, it’s coming. [...] Netflix will come back in two, three, four years and be bigger into sports because they have to be. Let’s see what happens with the next NFL rights. Can they outbid Paramount? Probably. [...] Their whole point is they want appointment TV and the NFL is certainly that.” (link)
