ESPN’s David Hale examines some of the consequences of roster limits as part of the House settlement and notes that in football most Power 4 programs “are currently at somewhere between 120-130 total roster spots (including walk-ons) but schools don't want the scholarship number that high because it would be VERY expensive to hand out 130 football scholarships (which also likely means 45 + on women's side too for Title IX). So they've negotiated for a lower number that theoretically still allows a team to handle normal attrition and hold full practices, though most coaches I've talked to aren't thrilled with the outcome. But, set all that aside, and there are bigger ripple effects. First, assume all P4s max out & go 85->105. That's 20 new scholies/team or 1,380 new P4 schools. Where do nearly 1400 scholarship players come from? Well, for one, it's a great year to be a high school recruit. After years of saying they're getting squeezed by the portal, there are going to be WAY more offers from bigger schools. But the flip side of that is G5s are going to get KILLED. First, tons of fringe players who might've gone to Ohio or Troy will be going to Ohio State or Auburn now. Second, a whole mess of G5s are going to hit the portal knowing there's room at a higher level. I've talked to a number of G5 coaches who think they can at least still sell playing time but... it's going to be a bloodbath. Moreover, most G5s are NOT going to be able to afford 105 scholarships, so they'll be at a bigger disadvantage regardless.” Also, Hale notes that several P4 coaches feel obligated to use all 105 scholarships but few are eager. “Clearly some underfunded P4s are going to be reluctant. Several schools I talked to who will not go to 105 – and some may even go below 85(!) in this new world and just choose to invest elsewhere. They'll get killed for it on the recruiting trail but they'll live w/it.” More from Hale. More FB scholarships can make Title IX math much harder if the school uses other sports for enrollment management. Wouldn't be shocked if some stay at 85-90.” (link)

Athletes.org Co-Founder Jim Cavale continues to emphasize the need for a student-athlete voice in the wake of the long-form House settlement and tells On3’s Eric Prisbell: “I really hope this big first step of the settlement that [enables] schools to now share money with athletes has a next phase before next year, when the money starts getting shared, that includes the athletes negotiating for themselves. … I’m concerned because the athletes aren’t involved in the setting of those terms (of enforcement of “true NIL” deals). But if the athletes were to agree to that because they felt, as a whole, they were going to recoup that same money plus more guaranteed money because it’s coming from the school and not a collective and they were willing to give that up – that would be one thing. But just saying ‘You’re giving that up?’ That’s not how this works. That’s how transfer rules were eliminated because schools and conferences and the NCAA chose to set them up without the athletes agreeing to it.” Meanwhile, another industry source tells Prisbell using this settlement to transition to a more professional model is like “turning a camper into a houseboat. I suppose it could work, but everyone would prefer to have started from scratch and built something made for water, versus form-fitting something not actually intended to be used in this way. My money is still on employment and a CBA at some point in two to five years. I don’t see this framework being long-term given how it is constructed.” (link)

SBJ’s Ben Portnoy profiles Texas AD Chris Del Conte, who was named SBJ’s AD of the Year, and is told by Oklahoma AD Joe Castiglione: “Chris deserves every accolade he’s received, because he’s [been successful] for years now. The University of Texas has always had some opportunities not available to many other universities, but that doesn’t mean they’ve consistently maximized them. They did under DeLoss Dodds and are back doing it now [under Del Conte] and subsequently knocking it out of the park. Candidly, I’m not surprised at all.” Longtime colleague and TCU AD Jeremiah Donati adds: “He’s done an incredible job [of] what I would call rebuilding their brand. There’s no question that they had underperformed kind of across the board, to be honest. He’s done a really good job, just like he’s done in his previous stops, understanding what the challenge was, what the resources are and he’s deployed them, and he’s been able to use his vision.” Del Conte, meanwhile, tells Portnoy: “Everyone says that a job like Texas is easy. It’s more difficult because expectations are so high and you’re trying to figure out how to restabilize a dysfunctional unit that has been [systematically challenged] for a 10-year period in leadership voids. You can’t keep changing leadership hoping [something changes]. That’s the definition of insanity. We just collectively said, ‘Wait a minute, before we start pointing fingers at anybody else, let’s fix us first. And if we fix us first, good things will happen.’” More. (link)

New Orleans President Kathy Johnson this spring ordered the athletic department to cut its budget by 25% as the school seeks to trim a $15M deficit. Nola.com’s Marie Fazio notes UNO’s enrollment has plunged from a peak of around 17K in 2003 to 6,600 last fall, prompting the university to dip into cash reserves and revenue from other sources, including federal pandemic aid, to stay afloat. The university's new budget includes the elimination of more than 70 positions; however, Johnson says the “vast majority” were already unfilled because of employees who quit after Johnson required all staffers to end remote work and return to campus full-time. Johnson says UNO is optimistic about this year’s enrollment but declined to share specific numbers. (link)

In its investigation of Michigan’s football program, the NCAA reportedly found instances of impermissible contact with football recruits during the pandemic-era dead period, a staffer who engaged in impermissible on-field activities over the course of a season, and alleges former HC Jim Harbaugh engaged in “unethical or dishonest conduct and a failure to cooperate.” According to the 11-page Notice of Allegations, the NCAA grouped multiple instances of impermissible contact with three recruits involving unidentified coaches and staff members as part of Allegation No. 1, a Level II violation. Allegation No. 2 found that a redacted staffer, reportedly revealed as former defensive analyst Ryan Osborn, committed a Level II violation by providing “technical or tactical instruction to football student-athletes.” The third allegation claims Harbaugh committed a potential Level I violation when he “violated the NCAA principles of ethical conduct and failed to cooperate” during a 2022 interview with investigators regarding the impermissible in-person and off-campus recruiting contact involving his program. From the NOA: “The factual information establishes (Harbaugh) met with the football prospective student-athletes and their fathers.” The NCAA enforcement team believes a hearing panel could find Harbaugh “undermined or threatened the integrity of the NCAA Collegiate Model” and could issue him a Level I violation and a show-cause penalty. USF has officially appointed Assoc. AD/Football Chief of Staff Andrew Warsaw to oversee a new NIL Strategy unit within the department. Warsaw, who will add the title of NIL General Manager, will lead a staff tasked with identifying NIL opportunities, marketing, fundraising, education, scheduling and execution of NIL commitments, and the growth of NIL resources among their duties. Bulls AD Michael Kelly: “College athletics is changing and evolving rapidly and the University of South Florida intends to be on the forefront of that evolution. We are building a model athletic department for these modern times. As the era of permissiveness with what we can provide student-athletes and revenue sharing continues to evolve, South Florida intends to be as aggressive as we can be and continue to meet every new standard.” (link)

Duke unveils the new Devils Deck at Brooks Field at Wallace Wade Stadium. Available for the 2024 football season, the tiered deck spans seven sections, accommodates just over 1,500 fans and offers a “unique social experience to continue tailgating while watching the Blue Devils compete on the gridiron.” Conceived in collaboration with WME Sports, the Devils Deck also features standing and non-reserved seating areas throughout its free-flowing space where fans can enjoy all-you-can-eat tailgate food and non-alcoholic beverages, access to purchase beer and seltzer as well as availability to rotating yard games. As part of the renovations, the stadium’s overall capacity will decrease from 40,004 to 35,018. Passes start at $45 for fans and $35 for students. (link)

ESPN Chairman Jimmy Pitaro says of Disney’s negotiations with the NBA and WNBA that “we were completely aligned in terms of prioritizing digital and prioritizing streaming. So, yes, the linear television business remains important to us. It has been important, it will continue to be important to us, but at the same time, we’re running parallel paths here, we’re significantly invested in streaming. Because, again, they understand that this is where our audience is migrating — to these direct-to-consumer platforms – and so we need to be there. At the same time, cable and broadcast are still important to the NBA and the WNBA.” In discussing the WNBA specifically, Pitaro explains: “The league has been a priority for ESPN for decades, and we take a lot of pride in how much we’ve invested in the league. We love to see the current momentum, especially coming out of the recent All-Star Game — I’m sure you saw the ratings, but close to 3.5M viewers — we maintain rights to the All-Star Game going forward for all 11 years of the new deal, but keeping the WNBA as a part of this deal was critical for us. “We’re looking at a rising tide right now, where we’re seeing our competitors in the industry really get behind women’s sports in general and behind the WNBA, and that’s a good thing.” (link)

Sportico’s Michael McCann reviews the full House settlement filing, says “challenges loom.” Key notes: “Wilken will weigh the settlement against the complexity, expense and likely duration of continued litigation. This preliminary review could take several weeks or months. Wilken might urge or require the parties to modify their settlement during the preliminary approval stage. For example, if she believes the distribution of funds would overly advantage some athletes and overly disadvantage others, the parties might rework the math to comport with Wilken’s suggestions. The judge might also contest areas of the settlement that punt key specifics to future deliberations. While preliminary approval might require settlement revisions and court hearings, Wilken will likely grant it. It is rare for an antitrust settlement to be rejected at an early stage since the settlement’s claimants—college athletes—have not yet been heard in court.” McCann goes on to outline multiple examples of lawsuit settlements that have been rejected by judges for a variety of reasons: “...keep in mind, those details are very much subject to change at the judge's behest. The UFC settlement has changed a lot over the last few months. Don't rely on NCAA settlement details yet.” (link)

Starnes Davis Florie attorney Jay Ezelle: “As someone who has fought the NCAA for over 20 years on extra benefits rules for student athletes, I am uncomfortable ever defending the NCAA, but I think the criticisms of the mandatory reporting requirements in the House settlement are not well reasoned. First, for all of those concerned about the disclosure rules, you should probably be even more concerned about an employment model. Many states require state employees to disclose outside income and even impose significant penalties if that income is a conflict of interest with their position or violates statutory restrictions on such income. Moreover, citizens can request copies of their employment agreements and other records, including cell phones (just ask Hugh Freeze). Second, the same is true for those assuming collective bargaining would solve all the problems. Almost every collective bargaining agreement in professional sports contains provisions limiting outside income and requiring arbitration to determine if outside income is greater than fair market value. Finally, those claiming that the disclosure requirement is a clear antitrust violation may want to read some more antitrust law, or at least go back and read the Supreme Court’s Alston opinion (the actual opinion and not just Justice Kavanaugh’s concurring opinion).” More. Katherine Dunne, mother of high-profile LSU Gymnast Livvy Dunne, via X: “If schools can act as agents for some athletes but others still have to disclose contract terms even if they opt to use outside representation, this would jeopardize their negotiating power (which can sometimes be against another athlete at the same school).” Kennyhertz Perry attorney Mit Winter responds: “Very good point. Disclosure of athlete NIL agreements to schools can create conflict of interest issues when a school is also serving as an agent for athletes.” (link)

How will the House settlement impact Men’s Hockey? College Hockey Insider’s Mike McMahon: “I don’t think 26 players is enough. By my math, 13 teams carried 26 players or less last season. That means 51 teams carried more than 26 players. I had one coach tell me yesterday, “We carried 26 last year, and it was doable, but it was light.” Hockey is a contact sport, and injuries happen. There were multiple examples last season of teams dressing less than a full roster due to injuries. St. Thomas dressed less than a full roster during the CCHA playoffs. [...] According to several coaches, they had some low-level input on roster cap numbers, but the college hockey body did not set this cap — the NCAA did. [...] Over the last 48 hours, I’ve talked to coaches from 17 different programs about this change. My unscientific polling resulted in what you might expect: Bigger programs welcome the change, and smaller programs are terrified of what this might mean for them.” More. (link)

“Everything outside of the Big Ten and SEC is shuffling. It’s just part of college athletics. Both schools know they’re essentially free agents that have TV value… that (TV value) is what is driving realignment today. Both of those schools are Power 4 schools. Is there going to be enough movement to open a spot for them? Or do they need to figure out if there’s another measure with other schools that have TV value? In the Group of Five, there are only a handful of schools that have TV value. Oregon State and Washington State know who they are.” That’s current Washington AD Pat Chun to JohnCanzano.com’s namesake. Which other non-P4s have “TV value?” Canzano continues: “I turned to a couple of TV-world sources for some input. Their short list included: San Diego State, Colorado State, Memphis, South Florida, UTSA, North Texas, and the service academies (Air Force, Army, Navy). They may also include Boise State, Fresno State, and UNLV because of brand and geography. It’s worth chewing on this ‘best of the rest’ idea because it appears the world of college athletics is.” (link)

How much revenue (is there)? All we’ve done is create more things going out. We have to be creative on how things come in.” Texas State HC GJ Kinne: “We are going to be part of that. I think that’s going to be, especially people at our level, are you going to be able to even do it? That’s a big question probably for a lot of the (Group of Five), are you going to be able to do it? We already started that process to kind of see how it goes, but I don’t know.” Rice boss Mike Bloomgren: “I don’t want to tell you anything I don’t know about. The program is committed to making this thing go, and to give us the tools we need to win football games. Front Office Sports’ Amanda Christovich wonders if the Mountain Pacific Sports Federation, which now sponsors 11 sports, has only six employees listed on its website and annual revenues just shy of $700K, could be the saving grace for the Olympic sports pipeline. “The MPSF has been adopting orphaned Olympic sports teams since 1992, when it launched for the purpose of providing an inexpensive, but high-quality, league to compete in. Unlike most conferences, it operates around sport-specific sponsorships that schools can participate in, rather than school affiliations. It sponsors neither football nor basketball, and it has fewer than 10 employees—and yet, the conference has sent more than 100 affiliated athletes and coaches to each of the 2024 Paris Games and the 2021 Tokyo Games. … The latest wave of conference realignment has thrown the U.S. Olympic pipeline into chaos. Beach volleyball is just one example of a sport whose NCAA leagues serve as the main development track for future Olympians in the U.S. and abroad—and whose infrastructure was decimated by football-driven realignment decisions. The MPSF offers regular-season leagues and conference championships. It allows its sports, which generate limited revenue, to stay local, helping with travel costs and the athlete experience. And it has the freedom to focus on building business opportunities that help keep competition fees low, and send any extra money back to the teams in the league.” Commissioner Foti Mellis: “We just want to be flexible, we want to be nimble, to be able to adapt to this ever-changing landscape. We want to make sure that we’re here to meet the needs of the membership, and obviously to continue with Olympic success, and make sure our Olympic athletes can thrive and [have] a place that they can train and be ready for the Olympics.” More. Western Illinois Interim President Kristi Mindrup says that the school still needs to cut $10M to balance the budget and that more layoffs are on the horizon. One proposal under consideration is cutting $500K out of the athletic department’s budget. (link)
