Big South Commissioner Sherika Montgomery provides her perspective on the House settlement: “The level of competitiveness across the board when it comes to recruiting as well as retaining student-athletes, sport-by-sport, I do think that’s going to become increasingly difficult. Which is why I feel like institutions and administrators as well as conferences are going to have to be very intentional and strategic as it relates to how we move forward, whether that’s institution to institution or having some type of conference-overall parameters and/or requirements when it comes to making sure we’re able to continue to be competitive with this shift and this change.” Winthrop AD Chuck Rey: “It’s only going to increase the transfer portal too. Now, very good athletes or athletes that are at mid-major schools like (Winthrop), there’s going to be more scholarship opportunities at Power Five schools. Because of that, we may lose some of our top student-athletes to scholarship opportunities at those schools. We’re not going to have the capability to scholarship all of our student-athletes.” (link)

Of the nearly 600 American athletes competing at the Paris Olympics, 75% of them played in the U.S. college system. More than 800 athletes with NCAA ties will compete for other countries in Paris. In all, more than 1 in 10 of the 10,500 athletes at these Games played college sports in the U.S. The Associated Press’ Doug Feinberg and Eddie Pells: “None of this comes cheap. One estimate is that NCAA schools spend more than $5 billion a year on so-called nonrevenue, or Olympic, sports.” That level of spending, of course, could be changing with the impending House case shakeout. On that front, CEO of the USOPC Sarah Hirshland: “It is extraordinarily top of mind to us. We’re going to keep a close eye on programs being cut, or even talked about being cut. … We’re going to do everything we can to contribute to saving that system because it works beautifully for us and, frankly, it’s the envy of the world.” (link)

Kennyhertz Perry attorney Mit Winter: “There will undoubtedly be litigation that results from the House settlement if it’s approved & the NCAA enacts the rules & procedures laid out in the agreement. Requiring 3rd party NIL deals to be disclosed and approved will be a likely source of extensive litigation.” (link)
|
Opendorse co-Founder Blake Lawrence observes: “The House Settlement allows NCAA to prohibit booster payments above fair-market value (FMV). They don’t require ALL NIL deals to be FMV. Only BOOSTER deals. If the goal is to prevent circumvention, either 1 Booster definition must be AIR-TIGHT OR 2 All deals must be FMV.” (link)

As Washington enters everyday life in the Big Ten, the Seattle Times’ Andy Yamashita talks to ADs who previously made big conference moves to understand moving dynamics. Former Utah AD Chris Hill points to three key factors when the Utes went from the Mountain West to the Pac-12: “First, university leaders made a commitment to invest in athletics. Next, having continuity in the football program, specifically in longtime head coach Kyle Whittingham, was an important advantage as Utah prepared for a new conference. Finally, Hill said Utah was able to retain key coaches and staff, and maintained a unified vision with the university about the importance of competing, not just participating, in the Pac-12.” TCU AD Jeremiah Donati notes: “The day we were selected to go to the Big 12 was an exciting day. But day two of that was (asking) are we truly prepared to move into this nicer neighborhood? [...] If this is what you want, if this is what’s important to you, then your investment needs to match that. We’re going to ask more of you as fans than we’ve ever asked, but that’s the key to success.” More. (link)

Collegiate Sports Associates President/CEO Drew Turner and Vice President/Chief of Staff Marcy Lanoue sit down with Connect’s Steph Garcia Cichosz to dive into advice for candidates, how industry changes may impact staffing and hiring and more. The duo emphasizes the importance of a carefully crafted, impassioned cover letter, your elevator pitch and being comfortable with Zoom as Turner notes 41 of CSA’s 42 searches since 2020 have used Zoom as part of their process. Asked about how to get on the firm’s “radar,” every application or expression of interest is vetted, with Turner adding: “It's always more meaningful if your current AD. or if you're an AD, if you have a colleague or somebody that does know us that can reach out and advocate, that helps but it's certainly not the only route.” More on Connect. Fresno State Deputy AD Rob Acunto sits down with ADU’s Tai M. Brown at the 2024 NACDA Convention to discuss his experience serving in the Interim AD role at four different moments in his career – at American U., twice at The Citadel and most recently at Fresno State. Acunto, who also sat in the Big Chair as the AD at Presbyterian before taking the Deputy AD role at Fresno State, shares key learnings he’s garnered from his experience as an interim. Acunto credits then-American AD/current NCAA SVP Jodi Comstock for giving him this advice: “Treat people the same way you would in your current role because more than likely you’re going to go back to that role. Nothing is ever as urgent as other people might want you to believe that it is.” He adds his own observations: “It really is understanding the ebbs and flows that I’m not in a position to make dramatic changes, which is good, I can tweak things as they need, but I’m really there to prepare it for the next person that comes in to be functioning as well as it possibly can during a time of transition and uncertainty.” Lots more. North Dakota AD Bill Chaves and Deputy AD Erik Martinson chat with Asst. AD for Broadcast Properties Paul Ralston for the UND Athletics summer update. Most notably the trio covers the updates on the facilities front. Chaves points to the hundreds of apartments being built around the athletic facilities: “The density and the activity that’s going to happen in this area is exciting moving forward. … The ability for our students to be in a living-learning environment is exciting.” The new Albrecht Field (softball) should be open in September. Citing the 1000% increase in WNBA player merchandise sales, led by former Iowa star Caitlin Clark & former LSU standout Angel Resse, NBA agent Nate Jones believes the men’s hoops side should take note of how the women’s side operates: “Read this and you’ll understand why I keep saying the NBA needs guys in school 3 years in this new media environment. March Madness the last frontier of a basketball event being monoculture and the NBA barely benefits because of 1 and done rules.” He continues: “Customer acquisition is hard and expensive. When you have a ready made customer acquisition machine, why would you ever keep rules that prevent you from benefiting from it? The nation will be getting to know/falling in love with JuJu these next 3 years. NBA will see no such thing.” (link)

MoffettNathanson’s co-founder & Senior Managing Director Michael Nathanson downloads with The Athletic’s Richard Deitsch with his latest thoughts on the future of media. Of particular note: “We have a long history of saying, ‘This is the top.’ Then, NBC comes along and bids $2.4B (for the NBA). Even Netflix, who forever has been saying, ‘We don’t need sports rights,’ has come along to do Christmas games at a really good price. I think at some point Netflix will more actively say, ‘We need to be in the sports rights business.’ There’s just so much tonnage in our lives with only so much channel capacity and sports just stops us and so I think the future has to be live and it has to be sports. [...] Every time Netflix says it’s something they’re not going to do, it’s coming. [...] Netflix will come back in two, three, four years and be bigger into sports because they have to be. Let’s see what happens with the next NFL rights. Can they outbid Paramount? Probably. [...] Their whole point is they want appointment TV and the NFL is certainly that.” (link)

@1QLeadership Question: What happens when a perfectionist realizes that no one can be perfect?
Jessie Gardner, Executive Senior Associate AD at UNT, discusses her evolution from being a perfectionist to considering herself an achiever. She acknowledges that perfectionism held her back in her prior leadership roles. Gardner gives credit to enneagram, Strengthsfinders, and self-reflection for her leadership self discovery.
• leadership is a constant evolution of who you are and how you show up in the world
• leaders must learn themselves to understand how they can be the most effective
Gardner gives examples of her progress while acknowledging that people around played a big part in her development. She currently focuses on what the people she leads need from her, and how she can create spaces that people want to be in. 🎧 on Spotify or Apple Podcasts.

Full House…
+ Takeaways from the NCAA under the heading ‘Unresolved Issues’: “The settlement does not resolve the patchwork of state laws, many of which may conflict with the settlement. These laws will need to be preempted by federal legislation in order for the settlement to be effective. The settlement does not address ongoing efforts to designate student-athletes as employees under state and federal labor and employment laws. These efforts by the NLRB and plaintiffs' attorneys pose a direct threat to both the sustainability of sports programs (especially for non-revenue generating ones) and to the baseline of support provided to all athletes.” From A5 Commissioners & NCAA President Charlie Baker: “This settlement is an important step forward for student-athletes and college sports, but it does not address every challenge. The need for Federal legislation to provide solutions remains. If Congress does not act, the progress reached through the settlement could be significantly mitigated by state laws and continued litigation.” (link)
+ Yahoo’s Ross Dellenger with key notes: “83% of the back pay — $2.3 billion — is expected to go to an estimated 19,000 football and men’s basketball players, many of them from power conferences. That is an average of about $120,000 per player over the 10-year period, or $12,000 a year. [...] A court-appointed ‘special master’ will settle disputes over compliance and interpretation matters about the revenue-sharing model, a role currently occupied by the NCAA office. A ‘neutral arbiter’ is charged with hearing and ruling on appeals from athletes or schools found to have violated rules connected to the new model, a role currently held by the NCAA infractions entity. [...] Language in the settlement seeks to eliminate or greatly reduce what many college leaders describe as ‘phony’ NIL payments from booster organizations to athletes. The settlement does this through an assortment of rules and an enforcement mechanism that is protected through the court. [...] The settlement makes clear that school funds used by an outside entity to distribute to athletes will count against the revenue-sharing cap. [...] There is, however, one way to circumvent the cap. As part of the revenue-sharing model, schools can serve as an athlete’s ‘marketing agent’ for third-party NIL deals by entering into exclusive or non-exclusive endorsement agreements to purchase a player’s NIL. This is the transaction that permits schools to share revenue with athletes, but it also does something else: Schools are permitted to procure outside, third-party NIL deals for their athletes that do not count against the revenue-share cap, as long as those deals are proven to be authentic.” Lots more as Dellenger continues to lead the way on the industry changes to come. (link)
+ On3’s Jeremy Crabtree details more roster caps “ Rowing – 68; Acrobatics & tumbling – 55; Equestrian – 50; Men's lacrosse – 48; Indoor/Outdoor Track & Field (M & W) – 45; Women's lacrosse – 38; Swim & Dive (M & W) – 30; Soccer (M & W) – 28; Field hockey – 27; Ice hockey (M & W) – 26; Gymnastics (M & W) – 20; Cross country (M & W) – 17; Tennis (M & W) – 10; and Golf (M & W) – 9. (link)
+ Check this out from Sportico’s Daniel Libit & Eben Novy-Williams: “...the law firms Hagens Berman and Winston & Strawn—can apply for a $20 million ‘upfront injunctive fee’ paid by the defendants, as well as an annual percentage share of the revenue that schools will distribute to athletes over the next decade. This would then be deducted from the pool of available funds for athletes the following year. [...] Under the House settlement terms, the lawyers’ maximum share will start at 0.75% for the first three years of the agreement, jump to 1% in years 4-6, increase to 1.25% in years 7-9, and then jump again to 1.5% in the 10th year. That’s likely tens of millions of dollars over the life of the deal.” (link)
+ Here’s how USA Today’s Steve Berkowitz frames the attorney awards: “According to documents filed Friday, they will ask the judge to approve up to $495.2 million in fees, just under 18% of the total, plus ‘out-of-pocket expenses.’” (link)
+ Kennyhertz Perry attorney Mit Winter with a super useful thread via his X account where he details the different sub-funds that make up the overall settlement fund & how each will determine what a student-athlete in the class will be compensated. Of particular note: “NCAA rules that prohibit schools from paying NIL compensation will be enjoined. Class members will be prohibited from bringing damages & injunctive relief claims relating to NCAA rules on NIL compensation & compensation for athletic performance during the 10 yr settlement period. Future college athletes will also be prohibited from bringing claims for injunctive relief during the 10 year period, but will not be prohibited from bringing future damages claims.” Also: “An item in the House settlement I haven’t seen mentioned is that it allows the NCAA to cap the number of years an athlete can receive new rev share payments at four years. I read this as the NCAA having the ability to prohibit 5th year players from receiving rev share payments.” (link)
+ Boise State Sports Law Professor Sam Ehrlich: “The settlement agreement casts an extremely broad net, essentially seeking to end all remaining and potential new litigation over NCAA compensation rules (at least litigation not related to employment classification). But I imagine that won’t be nearly as easy to accomplish as they would hope.” (link)

ACC Commissioner Jim Phillips reflects on his impassioned address earlier in the week to kickoff the league’s preseason football media event with the Richmond Times-Dispatch’s David Teel: “It was the legal cases overshadowing the incredible success of an amazing conference. Exclamation point! I’ve seen it over the last six months. Every time I went to talk to someone, everyone in the media, right, I’d say, ‘Look at that.’ And they’d say, ‘That’s nice. Tell me about the legal cases. Tell me what’s happening.’ The speculation blanketed a conference that was excelling in all areas of key metrics. … As often as I tried to get people to talk about those incredible successes, they just continued to ask (about the lawsuits). So I had the mic for 30 minutes (Monday), and questions and answers for another 20 minutes, and so I had a chance to state what I’ve been feeling over the last (several) months.” (link)

Utah State AD Diana Sabau speaks out: “This independent investigation was commissioned before I was hired as an athletic director. So these events happened in April. The independent investigation was commissioned in July of 2023. And then I came to campus and was hired in August [of 2023]. So I learned about this investigation after I was hired. So for people to think that, or to allege that this is [for] an agenda, or it was conducted to move people along, is false. And that timeline can show them. That timeline is indicative of that. … Because of the findings in this investigation, actions had to take place. And we’re going stand by those actions every single day, because it will make our culture better. It’ll make Utah State stronger.” Of note, the U.S. Department of Justice has been on campus since 2020 and will remain in Logan for another year, per Sabau, who adds: “We have to have integrity moving forward. … We can’t keep moving that forward without change. So yeah, sometimes good people make bad mistakes. And it’s not popular, but you have to do what’s right. You have to do what’s right when no one’s watching. And you have to make decisions that are hard, and that are challenging.” (link)

Colorado AD Rick George on the future of revenue sharing: “You share 22 percent of your revenue (with the student-athletes) probably starting in 2025-26, so you have to prepare for that. How do you get to that point? The one thing I am really proud of is every time the NCAA has changed a rule, we've met the challenge. We'll meet this challenge. I consider it an opportunity to relook at our department, our business, and get another pathway moving forward that starts in '25-26. It'll look a lot different than it does today.” George also responds to criticism of Football HC Deion Sanders: “Our goal is to focus on what we have in front of us, tune out all that noise that is out there and make this program really great. And I think Coach Prime is going to do that. I think this is going to be a big step in that direction this year. Let the naysayers say what they want to say, we're not listening to it. We're just focused on what's ahead.” (link)

Kansas AD Travis Goff says construction of phase one is on time for the KU vs. Fresno State football game to take place at David Booth Kansas Memorial Stadium on Aug. 23, 2025. The Jayhawks are “on the cusp” of surpassing the $200M mark in fundraising to reach the goal of $250M in donations toward the overall $450M project. (link)

NCAA Director of Digital Communications Chris Dion chats with Collegiate Sports Connect’s Stephanie Garcia Cichosz to discuss the association’s Made Here campaign tied to the 2024 Olympic Games, preparing and forecasting for the 2028 Olympics in Los Angeles and more. Dion on the association’s social media mindset: “It's about storytelling, about the values and benefits that the NCAA provides to student-athletes, as well as the exceptional performances and accolades that they achieve in their growth through the NCAA. We've really taken a different look this year and really narrowed it down to that. That narrow focus allows us to be very deliberate with our storytelling, be very purposeful, not chase things that don't matter, but also chase things that reinforce our values and celebrate these athletes on a different stage.” On the runway of these Olympics towards 2028: “I keep saying to our team this is our training ground. We've been in this partnership for quite some time, but we're really taking it way up a notch this year with this eye and focus on 2028. As you said, I would be lying if I said we don't already have plans about 2028, how we want to execute and how we want to be, but we're using Paris as our training ground to really see what we can do, how we can do it, how fast we can do it and scale before we really put our eyes towards LA but I'm salivating at that opportunity.” More only on Connect. There are 262 athletes (current and former) competing in Paris from the 10 outbound Pac-12 universities, according to the NCAA. Because the schools are officially Pac-12 members through the EOB on August 1, athletes from the departing schools will represent the Pac-12 for the first nine days of the Olympics and their new conferences for the final 10 days. Which conference(s) will claim the athletes? For the Pac 12’s part, it issued the following statement: “We’re excited to celebrate the many Olympians who have come through Pac-12 athletics programs in the Paris 2024 Games. Though celebration of Olympians from our 10 departing schools is more appropriate moving forward for the platforms of each institution’s new conference, we will proudly root for Olympians made here!” The Big 12’s statement: “The Big 12 plans to celebrate the achievements of the Olympic athletes from all 16 of our schools moving forward.” One athlete in conference flux is Arizona grad student/platform diver Delaney Schnell, who will compete in the synchronized 10-meter platform dive, which awards medals on July 31, and the individual 10-meter platform event, which takes place August 6.
