Maryland AD Damon Evans last month agreed to a contract extension through June 30, 2029, according to CollegeAD, which reports Evans will earn $1M in annual base pay, $280K in supplemental compensation and up to $45K in bonuses. Evans previously earned a base salary of $725K with a supplemental income package of $120K per year. Should UMD part ways with Evans without cause, he would be owed the remainder of the base pay in his contract along with any bonus compensation already earned. Should Evans leave for another athletic post before June 30, 2027, he would owe the Terps $500K. That figure drops to $250K during the next year, and Evans would owe nothing should he leave after June 30, 2028. (link)

Big Ten Commissioner Tony Petitti talks with The Mercury News’ Jon Wilner about how he has prioritized working with the SEC. “So many challenges are similar. The resources are similar. The decision-making. The influence in terms of fans. The size of it. … So I flew to Birmingham a few weeks into the job.” Petitti says he and SEC Commissioner Greg Sankey hit it off immediately, adding: “We have a good, honest working relationship, and I’m proud of the things we’ve been able to do together.” Petitti says of adding the four erstwhile Pac-12 schools: “For the four new members, being part of the Big Ten was important (for having) a seat at the table where they have the influence and the ability to help to drive change. The Big Ten is in a good position, and those four really significant universities now are part of that group, and they expand our influence.” Petitti goes on to describe his role as representing the Big Ten and how he has tried “to build consensus. Whether it’s the process to get to a settlement (in the House case) or how we felt about the CFP or where we are with roster limits — all that is sort of the same thing over and over again: Build consensus in the league, represent the league well outside, and use the influence you have. Ultimately, because of the governance structure, there isn’t always going to be some level of compromise. Sometimes, we’ll have to compromise a little more. Other times, other leagues might have to compromise more. That’s the process. It starts internally, and it always moves out. It’s a system that repeats itself.” (link)

Front Office Sports’ Amanda Christovich observes that the NCAA is counting the Olympic participants and their medals from former Pac-12 members toward their new conferences. Christovich also points out that “France’s star swimmer Léon Marchand, who trains at former Pac-12 member Arizona State, has technically never competed in Big 12 conference competition. But because the school is joining the Big 12, the conference has wasted no time making multiple social graphics promoting his three gold medals and Olympic swimming records. The graphics on X include Marchand’s affiliations with Arizona State and France—and sport the Big 12 logo. Similarly, the ACC has promoted Katie Ledecky’s gold medal and Olympic record in the 1,500-meter freestyle given that she used to swim at Stanford.” Meanwhile, Christovich notes the NCAA’s Olympic stats “do not mention the Mountain Pacific Sports Federation, which has sent 121 affiliated athletes and 15 affiliated coaches to the Paris Games.” An NCAA spokesperson tells Christovich that “medals are being counted for schools’ current primary conferences.” MPSF Commissioner Foti Mellis says he sent his league’s tallies to the NCAA but has yet to receive a response. “We are still hopeful that they will include the MPSF on their Olympic dashboard.” (link)

According to Warchant.com’s Ira Schoffel, “there appears to be confirmation of Florida State’s contention that the ACC’s long-term TV deal could actually be scrapped by ESPN in 2027, as opposed to the earlier publicized date of 2036.” Schoffel cites the following from Section 14.1 of the ACC-ESPN contract that was released yesterday: “[ESPN has the] exclusive, revocable option, but not the obligation, to extend this Agreement” until (date redacted). The contract goes on to state that the extension would run from July 1, 2027 through (date redacted), and that it would have to be exercised “no later than two years after the launch date of the ACC-ESPN Network.” Schoffel notes the “ACC Network was officially launched on August 22, 2019. On August 10, 2021, according to the documents released Thursday, ESPN officials and ACC Commissioner Jim Phillips signed a one-page agreement stating that the language in Section 14.1 would be amended. The change in language is redacted in the contracts released to the public, but that is where Florida State contends the new date is February 2025.” (link); Full redacted contract. (link)

Kansas AD Travis Goff notes he doesn’t have a crystal ball to foretell the future of conference realignment: “For so much of this, you (media members) are getting a lot of the same info that the practitioners are getting. I saw or read where a colleague said, another AD I think in our conference, said, ‘You try and read tea leaves. You pick up on (rumors) here, there and the other.’ A handful of Twitter people think they have the answers. Maybe they do. But I think the reality is most of this discussion is occurring in such a small, isolated space that the facts aren’t out there. And even making reasonably educated guesses aren’t. You (media) don’t have the ability to do that either. So the short answer I would say is, I don’t know that anything that I’m picking up on indicates major, imminent movement.” Asked about the ongoing legal dispute in the ACC, Goff says KU tries to “simplify some of the noise around conference realignment by further encouraging us to focus on ‘what can we do to make the University of Kansas and Kansas athletics the best it can be?’ … We’ve got to continue to invest in and facilitate those kinds of aspirations. And I’m not talking about conference affiliation aspirations. I’m talking about just being the best version of ourselves. And so if we’re doing that, then I think we’re doing the most impactful work as it relates to that. And the other part of it is, hey, a couple pretty impressive and proven programs (Texas and Oklahoma) have departed the Big 12. And we see that as a window for KU to be a bigger player in our league in a lot of ways.” (link)

Nebraska AD Troy Dannen talks about the process that led to his arrival in Lincoln and explains that when a media member called him to ask if he was in the running to be Nebraska's next AD, he called former NU Interim President Chris Kabourek and told him he was out. Kabourek said he’d call back, which he did, at midnight central time, and offered him the job. Dannen also says he wanted the Husker AD position for years, beginning in 2017, when the job went to Bill Moos. “I tried really hard to get involved when I was at Tulane. I couldn’t even get a return call from the search firm.” Asked about the biggest change he’s experienced while working in college sports, Dannen remarks: “Everything is about money now. Nobody asks about the degree anymore.” As far as what he hopes to see in conference realignment, Dannen explains he wants to protect access to the College Football Playoff for all schools, pointing to Tulane’s 2022 season, in which the Green Wave would’ve made the 12-team field. “If people are qualified to be in the national championship playoff, they should be in the national championship playoff.” (link)

In the third of a multipart interview series, Liberty AD Ian McCaw talks baseball and golf facilities: “The baseball pitching lab project is progressing well. It is scheduled to be complete in November. That will be a huge asset for Coach LeCroy and the baseball program. The golf practice facility is on track to be ready this spring. We are planting grass I believe later this month. That will be fully ready for the spring. There are some Campus East improvements to lounges for field hockey and lacrosse. Gensler and LS3P have released renderings of renovation concepts to PNC Arena in Raleigh, home of NC State hoops. The News & Observer’s Luke DeCock notes the 10 projects involved in the $300M renovation include “an overdue expansion to the loading-dock area on the north side of the building — that infrastructure will likely be in the first phase of construction, in the summer of 2025 — reimagined main and upper concourses and a potentially massive expansion of the south side of the building, facing Carter-Finley Stadium, that could include an exterior re-skin of the 25-year-old arena. The authority saw three scaled options for that expansion, with the largest creating a new, multi-story lobby.” Have a look. (link, link)

Northeastern officials are proposing a new Multipurpose Athletic Facility to replace the longstanding Matthews Arena as the home to Northeastern’s men’s and women’s basketball and hockey programs. The proposed new facility would span 290K square feet across six stories (with only the bottom four floors being occupiable and the top two floors reserved for mechanicals), according to Huskies Senior Capital Projects Manager Carla Morelli, who is managing the project team, which includes Boston-based architecture firm Perkins&Will. The Boston Sun’s Dan Murphy reports that “inside the new facility, around 173K gross square feet will be devoted to the arena (which would still seat more than 4,000 spectators for hockey games), as well as for public space, while about 117K gross square feet will accommodate student recreation and varsity practice space.” The period for public comment closes today. UTSA is looking for developers to lease 28 vacant acres at its Park West campus for mixed-use projects to help fund a slate of athletic facilities. The San Antonio Express-News’ Madison Iszler reports UTSA officials said they don’t have programmatic requirements but would prefer a master developer to build, finance, operate and maintain mixed-use projects through a public-private partnership and ground lease with the university. The Roadrunners plan to invest $57M in athletic facilities over the next five years, including $35M in a basketball and volleyball practice facility, a football practice pavilion, baseball and softball spaces and a nutrition performance center. AVP of Real Estate, Construction and Planning Corrina Green: “This mixed-use development is a testament to our commitment to providing vibrant, accessible, and enriching environments for our students, faculty, and neighbors.” (link)

Butler has launched the Butler Way Society for donors who contribute $75K or more over a five-year period. The Butler Way Society structure includes tiers of $75K, $125K, $250K, $500K, and beyond, and stewardship benefits include opportunities such as Wildman Room access during Butler Men’s Basketball games, pre-game presidential receptions, and reserved Hinkle Fieldhouse parking. Hockey East Commissioner Steve Metcalf agrees to a two-year extension through the 2026-27 campaign. Northeastern AD/Men’s Hockey HC Jim Madigan, who serves as chair of the executive committee for the men’s league: “We’re very excited to have Steve leading Hockey East into the future. He navigated us through a global pandemic at the start of his tenure, greatly expanded our external reach to the passionate fans across the league and helped foster a first-class experience for the student-athletes of our member institutions. We look forward to his continued leadership in elevating our great conference.” (link)

The AP’s Ralph Russo examines the long-term solidity of the House settlement, noting that some “legal experts see ample precedent in professional sports leagues to support the NCAA’s attempt to regulate NIL.” Tulane Sports Law Director Gabe Feldman, for instance, points out that it’s common for pro leagues to regulate outside sources of income to prevent circumvention of salary caps and luxury taxes by teams. “Now the big difference is, obviously, the pro sports rules are collectively bargained. These are not. So there will be no antitrust immunity for these cases.” Alabama-based attorney Jay Ezelle, who has worked on previous NCAA cases and antitrust lawsuits: “The idea that there’s going to be a whole lot of litigation around this disclosure requirement, to me, was not completely well thought out,” and NCAA VP for Academic and Membership Affairs David Schnase, in fact, acknowledges that [NIL] Assist (more on it below) is not intended to be an enforcement tool and not part of the settlement’s mandatory reporting. “There are a lot of things happening outside of what we can control with this platform. So while this platform will not influence those outcomes, when the (NCAA) board starts making decisions, we’ll have pretty good data to help them make informed decisions.” Meanwhile, Kennyhertz Perry attorney Mit Winter says disclosure isn’t as problematic as parsing the rules that target what the NCAA deems to be boosters and the difficulty in determining fair-market value. “And the way that you have to show its fair-market value is based on some comparable (deal) that’s not with a college athlete.” (link)

More on House from CBS’s Dennis Dodd, who catches up with sports attorney Maddie Salamone, who laments the lack of student-athlete participation. "You have a bunch of lawyers working with the NCAA without athlete involvement to sort of work out these issues. Maybe athletes get in a room and they decide these are things they're in favor of and they're bargaining. This is not that. It really comes across as an effort to settle the case and collect fees." Athletes.org Co-Founder Jim Cavale adds: “This is purgatory. A lot of people look at this as 'The Great Fix' and everything is going to be OK now … It's not. 'The Great Fix' would be the college athletes having a partnership with their school, conference and NCAA through an agreement. Whether that's collective bargaining, [as] employees, unionization, or whether there is another mechanism in the current state where they're not employees, they need to have a partnership to make this work." Dodd, meanwhile, cites Kansas football student-athlete Jared Casey as an example of how difficult it can be to determine fair market value. After catching the game-winning touchdown in overtime at Texas as a walk-on, Casey went viral and signed a commercial deal with Applebee's. Dodd: “What Casey did literally had no comparison – an anonymous walk-on who barely played becoming an overnight viral sensation. How does FMV account for that?” Lots more, including this from Salamone in regards to potential arbitration in enforcement cases: “Having been involved in arbitration, I can tell you it's a kangaroo court. North Carolina has launched CAROLINA NIL, bringing together Carolina Athletics, The Rams Club, NCHOF and Old Well Management to form an “all-sport marketing and student-athlete services entity” designed to “provide top NIL services, knowledge and experiences to the new generation of Tar Heels, while expanding outreach to new audiences interested in supporting Carolina student-athletes.” Tar Heels AD Bubba Cunningham: “Supporting Name, Image and Likeness opportunities is crucial to ensuring that Carolina attracts and develops the very best students and athletes in the world while continuing to build on our championship tradition. We are committed to providing championship opportunities for our student-athletes, and consolidating and enhancing our NIL services through CAROLINA NIL is our next step in this new era of college athletics.” (link)

The NCAA’s suite of core guarantees officially takes effect today, enacting a series of reforms that include expanded health care coverage, increased mental health support and academic guarantees. The NCAA also officially launched NCAA NIL Assist, a platform designed to connect student-athletes with potential service providers, facilitate disclosures of NIL activities, and provide student-athletes with access to educational resources and insight into evolving trends within the NIL environment. More on the NIL Assist platform, which is being launched in collaboration with Teamworks and includes a voluntary registry where agents and other interested professional service providers can submit information about their offerings and seek potential student-athlete clients; a "rate your experience" tool so student-athletes can share reviews of those same service providers; a simple process by which NCAA schools can submit NIL disclosure data; aggregated data with identifying information removed and trends about NIL agreements, including the ability to sort by subdivision, conference, sport and player position; and access to educational programming related to NIL, including resources about NCAA rules, tax implications and intellectual property. Baker: "Before I even started in my new role at the NCAA, one of the first things I heard from student-athletes and their families was that the NIL landscape was confusing and challenging to navigate. It was a priority for me from day one to find ways to help student-athletes pursue and capitalize on NIL opportunities with confidence, and a little over a year later, the launch of this platform will help them do exactly that." Sportico’s Daniel Libit reports that “in an embargoed Zoom call with reporters last week, representatives of the NCAA and Teamworks repeatedly stressed that the quality of the platform—and its data—will continue to improve as time goes on. After being named the project’s third-party administrator in April, Teamworks had less than four months to build out its ‘web-based solution,’ incorporating input from coaches, athletic administrators and members of the NCAA’s Student-Athlete Advisory Committee.” Teamworks SVP of Business Development Kevin Barefoot notes: “This isn’t an enforcement mechanism for eligibility. It is not intended to set what the fair market is, and does not solve all challenges. … It is a small and solid step forward.” Barefoot also distinguishes INFLCR’s bid withdrawal in 2021 from its now-parent-company Teamworks winning the project three years later: “INFLCR did recuse itself, in large part because a lot of (competitors) who were interested in that (bid) were interested in making money off athletes and winning the award so they could take transactional revenue from athlete deals. We are maybe the only NIL tech company that does not take transactional fees from NIL deals.” (link)

Non-House Legal Matters…
+ A Texas appellate court has dismissed claims for breach of fiduciary duty, good faith and fair dealing related to allegations that Texas A&M’s 12th Man Foundation breached certain promises or agreements with its existing endowed donors when it relocated those donors from “the best available seats” and downgraded other game day perks in light of new fundraising priorities surrounding the redevelopment of the Aggies football stadium. “In so ruling, the court found that there is no special relationship giving rise to a fiduciary obligation between a group of endowed football program donors and the Texas A&M Foundation that the law would recognize in this case,” according to JD Supra, which adds: “The takeaway? While donors’ loyal fandom and commitment to ‘core values’ did not support a legal fiduciary duty in this case, it remains to be seen in the second half of this litigation how the lower court will rule on claims that the Foundation breached certain oral or written agreements with the donors. In this game of inches — and within the changing economics of college football — the biggest question that remains is who will earn the best seats at Kyle Field…the donors who loved the Aggies first or the new generation of fans who helped fund the rebuilt stadium.” More on the case. + Former Michigan State Football HC Mel Tucker has filed a wrongful termination lawsuit against the school, claiming that MSU let him go without due process. The suit names former Interim President Teresa Wooduff, Spartans AD Alan Haller, VP for Legal Affairs/General Counsel Brian Quinn and the MSU Board of Trustees as defendants. Tucker is also accusing the officials of racial discrimination and breach of contract. From the suit: "In short, the individual defendants acted in their own self-interest to avoid the fate of their predecessors who were dismissed or forced to resign in the aftermath of the Larry Nassar and the other scandals involving the university, including its athletics programs.” (link); Full complaint. + Northeastern and Playfly Aspire announce a second extension of their partnership since first linking up in 2018. Playfly Aspire’s Fan Relationship Management Center (FRMC), on-site at Northeastern’s Boston campus, generated a 78% YoY increase in revenue in FY24 and has driven $2.1M since inception for the Huskies. + Connecticut women’s basketball student-athlete Paige Bueckers is signing an NIL deal with Unrivaled, the new three-on-three league launched last year by WNBA stars Breanna Stewart and Napheesa Collier that promises the highest average pay in pro women’s basketball. According to The Athletic’s Shams Charania, the deal makes Bueckers the first NCAA athlete to receive ownership equity in a league. Bueckers is expected to join the league after her first WNBA season. (link)
