CollegeAD reports Santa Clara has conducted final interviews with AD candidates and is expected to make an announcement soon. Additionally, Missouri State has held virtual interviews and is starting to trim its list of candidates. MSU is expected to begin in-person talks next week. Also: “Early on, we heard the names of several sitting ADs, but because the final round is expected to be public, it seems Missouri State has had to cast a wider net. It’s our understanding the Bears talked with more than 10 candidates as part of the virtual process.” (link)

House plaintiffs’ attorney Jeffrey Kessler joins Tulane Sports Law Director Gabe Feldman to discuss the ins and outs of the House settlement, including a rebuttal against those who would argue the revenue-sharing cap creates an artificial restriction on compensation given the absence of collective bargaining. Kessler explains there is no opt-out right for the future “because it’s an injunctive settlement.” However, if a future student-athlete wishes to file a damages claim arguing the cap creates an unreasonable restraint on trade, they could do so. “Do I think such a case would likely win? Probably not. Why? Because we know in this area that so far the rule of reason has applied consistently in these cases. Under the rule of reason, the defendants would argue, I'm sure, that having such a system survives rule of reason scrutiny. … But the courts would decide that. If that’s not correct, there’s nothing to preclude someone from filing a damages claim.” Feldman asks Kessler specifically: “Why is it that this group of plaintiffs lawyers and the NCAA get to determine the reasonable price for athletes in the future?” To which Kessler responds: “Because class-actions allow settlements of this type.” Kessler cites antitrust cases involving Oscar Robertson and Reggie White as examples of such settlements that resulted in long-term injunctive relief. “The reason it’s proper is because we aggressively represented the interests of the players in negotiating that settlement and it has to be judicially approved by a court. Those are the two protections. This is not just the NCAA imposing its own system going forward. … Moreover, it’s in the interest of the athletes to do this because the alternative is we would be litigating for another 10 years to get a system in place if we couldn’t negotiate a settlement.” (link)

Knight Commission Co-Chairs Len Elmore and Pam Bernard sent a letter to Georgia President/DI Board of Directors Chair Jere Morehead asking the board to reconsider one aspect of the payment plan to fund damages for the proposed House settlement. Specifically, the Knight Commission is requesting that the board protect the Academic Performance Fund incentives and “recommends two financially prudent and equitable alternatives to fund this portion of the damages payment, estimated at $10M annually, without drawing down the academic success awards.” The first option involves replacing the planned reductions with savings generated by the NCAA eliminating coverage of the national expenses for FBS football, “such as catastrophic insurance, enforcement services and legal services.” The second option involves adjusting the “skewed 30-year-old NCAA revenue distribution formula for rewarding scholarships” to replace the funding. “Despite receiving zero revenue from the CFP or FBS football generally, the NCAA remarkably still pays out tens of millions of dollars each year to cover the national costs for the sport of FBS football. … As FBS conferences receive additional autonomy to operate FBS football, those conferences can use CFP revenues to fund services that the NCAA has covered in the past. Second, 30 years ago, the formula for the NCAA grant-in-aid distributions was designed to ensure schools with FBS football received a greater portion of this fund due to the financial commitment of providing 85 football scholarships. But with the creation of the independent CFP distribution just for FBS schools, this portion of the plan is plainly overdue for an overhaul.” Full letter. (link)

Lawyers for former Brown women’s basketball student-athlete Grace Kirk and former men’s basketball student-athlete Tamenang Choh, who have filed a lawsuit concerning Ivy League schools’ refusal to award athletic scholarships, are asking U.S. District Court Judge Claudia Wilken not to hold a preliminary hearing earlier than September 5, as House plaintiffs have requested. The filing cites the “threat the Settlement poses to the rights” of Choh and Kirk, “which will be made clear in the forthcoming objection.” The attorneys also say the proposed House settlement would “improperly (and likely inadvertently)” release their clients’ claims “without redressing their principal claims and concerns.” (link, link)

San Diego Chargers/former Michigan Football HC Jim Harbaugh addressed violations reported to be included in a draft Notice of Allegations being sent to U-M: "Never lie. Never cheat. Never steal. I was raised with that lesson. I have raised my family on that lesson. I have preached that lesson to the teams that I have coached. No one is perfect. If you stumble, you apologize and you make it right. Today, I do not apologize. I did not participate, was not aware nor complicit in those said allegations. So, it's back to work and attacking with an enthusiasm unknown to mankind." (link)

Attorney Tom Mars shares an email exchange he had with the NCAA in which the NCAA insisted Mars review more than 6K of former Michigan Football HC Jim Harbaugh’s emails to identify confidential and privileged information in less than 24 hours. Mars: “For those who might be curious about the tactics used by NCAA enforcement, here’s the factual basis for the NCAA’s allegation that Coach Harbaugh ‘failed to cooperate’ in their investigation of Connor Stalions by not producing his personal emails and text messages.” In the exchange, Mars explains that the searching and sorting software does not allow one to search for and designate particular emails as confidential or privileged. Therefore, assuming searching each email would take 30 seconds, the entire endeavor would take 51 hours. Mars added that he would not be willing to do without informing Harbaugh of the cost (at least $38K) beforehand. Mars adds: “Interestingly, in the same investigation, the NCAA allowed other Michigan coaches to withhold emails and text messages ‘that are not relevant or potentially relevant to the investigation, as determined through a meet and confer process with the NCAA.’” (link)

The NCAA will offer member schools post-eligibility injury insurance coverage for student-athletes beginning August 1, 2024, the Board of Governors announced last week. The coverage will be for two years after student-athletes complete their college athletics experience and will cover injuries that occur while playing for their school. The policy's annual premium is projected to be $26M, and it will have a $90K excess limit per injury, with no deductible. There will also be limited coverage for mental health care related to the documented injury. The policy, which will be available to schools in all three divisions, is secondary to other insurance policies. NCAA President Charlie Baker: "Student-athletes deserve the coverage offered in this plan, no matter their division. Thanks to the many voices who have supported this idea since the Division I Transformation Committee formalized it in their final recommendations earlier this year. It's another occasion where the NCAA can show its unwavering commitment to and support for student-athletes." (link)

Sports Illustrated’s Pat Forde observes the influx of international swimmers at American colleges and universities – as well as professional swimmers coached by Texas Director of Swimming and Diving Bob Bowman – “comes at a time when overall opportunities in American college swimming are decreasing as the sport—particularly on the men’s side—could face significant cuts in coming years. With the settlement of the House v. NCAA and other court cases that will put billions of dollars in the pockets of athletes over the next decade, the budget crunch is real for many university athletic departments. They will largely target men’s Olympic sports—swimming very much included. That is a compounding concern after a weak showing by the American men in Paris. They won just two gold medals, and just one in an individual event. It would be one thing to blame it on the presence of a generational talent like [French swimmer Leon] Marchand, but here’s the reality: If he didn’t exist, none of the four races he won would have defaulted to Americans.” (link)

As he gets set to officially begin in his new role, College Football Playoff Executive Director Richard Clark tells SBJ’s Ben Portnoy: “My last job in the military … every day we’re thinking about the worst days in America. We’re thinking about getting ready for war. We’re thinking about a day that we hope never happens, but that we have to be ready for it. In this job, I get to wake up every morning and think about football. I get to think about the best days in America, and I know it’s gonna happen and I want it to happen.” As far as what to expect from Clark’s tenure, Air Force AD Nathan Pine says: “Whether you’re a sports writer, a football coach or a university president, he’s going to be open and honest with you, and he’s going to try to do what’s best for the greater good. And honestly, for me, that’s all you can ask for in a leader.” Clark on the future of the CFP: “Right now, it is our job, really it’s our charter, to make sure the playoff is spectacular and that we do that in the right way. But with the changing landscape, clearly we have to stay engaged and understand how college football and college sports in general are changing, even though I don’t have decision authority. … I am responsible to the commissioners to understand the pressures that they’re under and understand what the landscape is bringing, so that when executing this playoff, we’re not caught flat-footed.” (link)

Big East Commissioner Val Ackerman has been chosen as a recipient for the Forbes Women Annual 50 Over 50 Awards, which recognizes those awardees who are creating their greatest impact at age 50 and beyond. The winners will be recognized at the Over 50 Luncheon in New York City on October 24. The group also will gather on International Women’s Day in 2025 at the 30/50 Summit. (link)

Stanford AD Bernard Muir talks with The Mercury News’ Harold Gutmann about several topics, including the Cardinal’s decision to join the ACC and says: “Part of the experience we promised [student-athletes] is to make sure that they have the best academic, enriching experience and to be able to have a great athletic experience. And we think we can still offer both, but I’m grateful to a number of faculty members who are working with us trying to figure out how we can ease this transition as best we can. … We’re taking less of a media share to start, but we have support of the institution and also support of our alumni base. Our community has been very generous over the years, has created endowments for us that have been quite helpful, and we’re going to have to continue to build those endowments moving forward.” As far as maintaining a broad-based athletic department, Muir asserts that “we’re committed to Olympic excellence. We take great pride in that. … Yes, there are some challenges that we’re working through as it relates to funding and being able to do this in what will be a new environment, but we’re coming off of these Games and taking such great pride across the board with the breadth of our programs, we’re going to try.” Muir on the changing landscape: “We still have a high degree of excellence that we are striving for each and every day, and we think we’re going to be able to continue to do that even within the changing landscape. Is there more work to be done? Yes, but we think we can adapt and come out stronger through all of this.” (link)

Ohio State AD Ross Bjork maintains the Buckeyes will keep an open mind when it comes to naming rights and tells On3’s Pete Nakos: “So Safelite is exclusive for the field naming, so it’s the field name. But in and around the perimeter of the stadium, adjacencies to the field, things like that. I’ve been saying, ‘Look, we have to put everything on the table.’ Naming rights of the stadium. The jersey patch is a conversation. We have to work with our partner, Nike, in that conversation. If we’re breaking glass right now and we’re going to put the window back, let’s get it all on the table so we can put the window back in the right position. Everything has to be on the table right now to analyze. That doesn’t mean we’re going to do it. It just means let’s at least answer the question. Here’s the value. Is this the right thing to do? Yes or No. If it’s not, OK, fine. If it is, how do we pursue it? Or how does it fit in?” Meanwhile, Bjork suggests OSU could implement different funding tiers for different sports and explains: “What sports are in the financial aid category, what sports are in the revenue share category – all sports can be in the NIL category. We can try to support them for all sports. And then what you have to do is, depending on how it’s funded in those other categories, you have to determine what are the resources needed to support that sport. If we have sports that become walk-on sports where the athletes are walk-ons, do they need as much infrastructure around them? … We don’t have full clarity on that piece yet. That’s part of our analysis. And so when we say shrink, I think the answer is, what do you need to operate that program? And what do you need to operate the program where you don’t impact the student-athlete experience? You still have health and safety. You’re not going backward on that. But the other stuff that we do for our sports, you may have to pull back.” More from Bjork. (link)

The NCAA’s new data dashboard offers several NIL insights, according to On3’s Eric Prisbell, who notes the information displayed as of August 1 includes information submitted by members who elected to share their data from the 2023-24 academic year. Data provided shows that 37.3% of disclosures are from football, 15.4% from men's basketball and 8.2% from women's basketball. The average total earnings per Power Four conference football and men's basketball player was $89,643. The average total earnings per Power Four athlete in sports other than football and men's basketball was $7,504. For Power Four football players, the average athlete earnings per player was $76,740. The average per P4 quarterback earned $151,275, and the average per Group of 5 quarterback earned $20,961. For P4 QBs, the average total earnings per athlete for autograph deals was $201,203. For social media-focused deals that figure is $258,218. For P4 men's basketball players, the average earnings per athlete was $171,272. For P4 women's basketball players it was $16,222. (link)

Profound Sports, which primarily serves as an NIL agency, is launching a claims service through which student-athletes would be offered an upfront payment from the House settlement through private equity and then give the rights to collect on the 10-year payment over to Profound. The agency would take a 15% cut. Profound Founder Luis Davila tells On3’s Pete Nakos: “College athletics is evolving before our eyes and our organization is poised to be a custodian and negotiator for NIL proceeds for current and former student-athletes. I have experience in class action settlement recovery for Wall Street shareholders and now we have built a similar platform for ‘athlete shareholders.'” Davila says the agency has entered into partnership talks with multiple Power 4 schools. The new rule allowing analysts, quality control coaches and others to provide on-field instruction “changes everything,” according to Clemson Football HC Dabo Swinney. Oklahoma HC Brent Venables adds: “It’s fantastic from a development standpoint in helping young coaches develop in the profession, getting opportunities, creating value for themselves, having experience through it. It does give you another lens and another set of eyes, and maybe, again, for you as a staff to be a little more efficient. And I think ultimately the players, if done the right way, will be benefactors of that.” The Athletic’s Seth Emerson notes that with athletic departments looking to find ways to control costs in the coming years, there are some questions about whether programs will continue to employ large numbers of coaches. However, Emerson notes that “cutting these jobs wouldn’t make a huge dent, football is the cash cow, and athletic directors don’t want to risk losing any competitive edges there.” Plus, as Swinney pointed out, it’s not costing anything extra. “We haven’t added staff, we have the same amount of staff that we’ve always had, but they just haven’t been able to coach on the field, within the rules. They’ve been able to do everything else — they can recruit, they can help the coaches support the coaches and game plan, that kind of stuff. But they were limited as far as practice. So what it’ll do, it will make you more efficient. It’ll create hopefully a little more scrutiny, a little more attention to details across the board. Because everybody can coach. Everybody’s got a voice.” (link)

Some former Colorado football student-athletes describe a culture under HC Deion Sanders beset by violence, guns and gambling, with one anonymous student-athlete saying: "It's like a real-life Grand Theft Auto video game. There are many distractions with fights, guns, and money floating around. The environment is unlike any I've come from before.” Football Scoop’s Doug Samuels: “Other anonymous claims include the bullying of former five-star freshman Cormani McClain, who was often publicly criticized by Prime for his immaturity and later transferred to Florida, and another stated that another highly rated freshman (Jordan Seaton) was pressured into fighting a lineman where both exchanged blows that left both parties bloodied in an attempt to prove their ‘manhood.’ Another instance involved a $10K gambling debt between backup quarterback Colton Allen and wide receiver Kaleb Mathis, the son of CU defensive backs coach Robert Mathis. When Kaleb reportedly refused to pay the debt, he was beat up in the locker room where players and coaches allegedly witnessed the assault. The report also shares a screenshot of Chidozie Nwankwo's celebratory livestream, who while announcing his commitment to Colorado, had a handgun appear in the background of his stream.” More. (link)

Some Utah State donors say they will withhold donations following the university’s decision to part ways with Football HC Blake Anderson and former AVP/Deputy AD for External Affairs Jerry Bovee. Alumnus Tom Grimmett, who has given about $500K to the athletic department over the years, says he will no longer donate due to his lack of comfort with Aggies AD Diana Sabau’s leadership. “I’m not going to do that again until I feel more comfortable with who’s in charge up there. I think ultimately it’s going to damage the reputation of the university, and it’ll take a long time for it to work itself through it.” Grimmett also says when he met with Sabau earlier this year he told her he suspected there would be pressure from a new administration to clean house. “I just wanted to make a comment to kind of tell her that what was going on was pretty transparent. ... She’s been given walking and marching orders, and she’s going to do it.” Meanwhile, donor Chris Seibert is supportive of Sabau and USU’s decision to reset the culture. “I think there’s a lot of layers to this. But ... I don’t think you can sweep this sort of thing under the rug. They made a really difficult decision to do it when they did. I want to give them credit there.” (link); Bovee today officially filed a grievance with the university and says in a statement: "I recognize that varying accounts and allegations have surfaced regarding the activities that led to decisions that were made. Nonetheless, I believe the truth will prevail, and my proven legacy and reputation, founded in integrity and honesty, will be restored. The Friars also report generating $8.5M in revenue through ticket sales for men’s and women’s basketball, men’s ice hockey and Late Night Madness, surpassing last year’s record of $6.8M. The Orange County Register’s Luca Evans reports that Jeff McKay, a co-founder of USC-focused Conquest Collective, has joined House of Victory collective as a board member. “With McKay’s move, Conquest Collective will shut down, leaving House of Victory and the TOMMY Group — an organization that has been quiet of late — as USC’s only NIL collectives. … And last week, according to [a] source, various high-level figures in USC athletics — [Trojans AD Jen] Cohen, [Football HC Lincoln] Riley, even USC basketball coach Eric Musselman — pushed hard to integrate McKay into House of Victory. The goal for McKay’s arrival, sources indicated, is to continue building donor relationships to add to House of Victory’s fundraising base.” Also from Evans: “Since her arrival at USC last summer, athletic director Jen Cohen — both in internal meetings and external communication — has tried to centralize House of Victory as the primary collective for donor funds, distributed to athletes in the form of contracts structured in part around event appearances. … A source with knowledge of the situation confirmed Friday that House of Victory has over $12M available in NIL funding for the 2024-25 year. That number is still a cut below a program like Ohio State, whose NIL collective, athletic director Ross Bjork told Yahoo Sports in late July, had distributed over $20M to football players this past season.” (link)

The Dow fell to a session low of more than 1,000 points today amid fears of a U.S. recession. The Nasdaq lost 3.43%, and the S&P 500 slid 3.0%. In addition to Friday’s disappointing July jobs report, investors are concerned that the Federal Reserve is behind in cutting interest rates to bolster an economic slowdown, with the central bank choosing instead to keep rates at the highest in two decades last week. Tech shares were among the worst performers with Nvidia tumbling 6.4% and Apple falling more than 4% after Berkshire Hathaway cut its Apple stake in half. Global markets also tumbled, as the 12.4% loss on the Nikkei marked its the worst day since the “Black Monday” of 1987 hit Wall Street. (link)
