U.S. District Court Judge Claudia Wilken has denied the request from House plaintiffs' lawyers to move up the date of the hearing on motion for preliminary approval, per USA Today’s Steve Berkowitz. The hearing is set for September 5. (link)

NCAA lead counsel Rakesh Kilaru joins Tulane Sports Law Director Gabe Feldman to discuss what a finalized House settlement means for the future of college sports and notes that in addition to opting in and opting out of the damages piece of the agreement, student-athletes can object to the damages piece as well as the forward-looking component. “And that’s going to take time because we have to get the information to contact student-athletes, they have to have a reasonable amount of time to review the terms of the settlement, they have to have time to actually file papers with the court if they do want to opt out or if they do want to object to the settlement, and the culmination of all this is that at some point next year – and I think based on the timeline that was laid out in the brief, that would be February-March, somewhere in that window – there will be a second hearing where Judge Wilken will hopefully hear from anyone who wants to raise an objection, hear from the parties as to why they think the settlement is a good deal and then hopefully bang the gavel and put the settlement into place.” Kilaru notes that it's possible that if someone objects and Wilken approves the settlement anyway, they could appeal and “maybe I'm a little optimistic on this, but I think at the end of the day my hope and expectation is that…there won’t be a ton of objections or concerns raised about the settlement.” Kilaru also explains the enforcement and arbitration system of the settlement’s new rules may or may not include the NCAA. Cases involving violations of the settlement terms via a particular contract or a particular year of the pool will go into a new arbitration process “where there will be some group of third parties who review decisions and render decisions. The plaintiffs’ attorneys will have a role in those arbitrations in helping set up the rules for what that process looks like. I think beyond that, as a general matter, those arbitrations are going to be between, for example, the school and the student-athlete or between the NCAA and the school or between the enforcement entity and the school.” Some of the particular enforcement details, Kilaru adds, are still being worked out but one new feature includes a mechanism that allows student-athletes and/or schools to seek nonbinding guidance before signing deals to maximize compliance. The DI Board of Directors on Tuesday voted unanimously to introduce a proposal that would award NCAA Women’s Basketball Tournament units to participating teams, starting in 2025. The proposal, which would create a Women's Basketball Equal Conference Fund and a Women's Basketball Performance Fund, is scheduled for a vote by DI members at the NCAA Convention in January. If approved, the funds would build up over three years to $25M and units earned would be paid out to schools' respective conference offices starting in 2026 on a rolling three-year basis. The proposed combined funds would begin at $15M in the 2025-26 fiscal year, increase to $20M for the 2026-27 fiscal year and reach the proposed $25M starting with the 2027-28 fiscal year. After reaching the fully funded amount of $25 million, the women's basketball funds would grow at the same rate as all other Division I funds, which is approximately 2.9% each year. The board also appointed Virginia Tech President Tim Sands as its next chair, effective immediately. His appointment runs until August 2026. (link)

When you look at just the last few years, the numbers that we’ve drawn, the fans, the crowds, the dynamic players that we have, we absolutely need unit distribution. I think it lets our presidents, athletic directors and fans know the value." UCLA HC Cori Close adds: “I want to be grateful. I want to be excited. Boise State President Marlene Tromp confirms the Broncos have extended AD Jeramiah Dickey’s contract: “Jeramiah Dickey has made an incredible impact on Boise State Athletics, forging relationships within our community from the moment he arrived. His heart is in his work, and he is a Bronco through and through. Since last spring Jeramiah and I have collaborated and prioritized doing everything that we can to keep him at Boise State. And today, I am thrilled to announce that he has committed to stay. Jeramiah is leading the way in collegiate athletics as an innovator, and his work has been invaluable building the strength of our athletics programs nationally. Howard AD Kery Davis confirms the university has not vetted Men’s Basketball HC Kenny Blakeney's proposal to sell a one-third stake in the program in exchange for $100M. Davis tells ESPN’s Jeff Borzello: "Men's Basketball Head Coach Kenny Blakeney is a terrific leader of young men and has made a significant contribution to our Athletics Department and the University at large. … Like all of our coaches and athletic administrators, Coach Blakeney continues to enthusiastically explore ideas to generate financial support that will allow our student athletes to be more competitive as they represent the University. Over the years, we have been extremely fortunate to secure sponsorships and gifts that have tremendously helped our 21 Division I teams, from a multi-million-dollar renovation of our training facility to covering expenses for student athletes to engage in cultural enrichment programs allowing them to travel and compete abroad. Recent remarks attributed to Coach Blakeney reflect his own personal ideas and have not been vetted by University leadership." (link)

Oklahoma State AD Chad Weiberg participated in an X Q&A with fans and fielded a query regarding OSU’s plans to address new roster sizes. Weiberg: “With the introduction of permanent rosters, there are many strategic options we can utilize for remaining competitive at the highest levels. We are evaluating strategies daily. We are not in a position at this point in time to add additional programs.” On the status of the Boone Pickens Stadium remodel: “It will be ready for the opener and will make Boone Pickens Stadium one of the best college football venues in the country with an atmosphere second to none, thanks to our great fans!” Asked whether he believes FBS will inevitably split into two divisions, Weiberg answered: “We will continue to see change. The Des Moines Register’s Tyler Tachman spent some time with Iowa AD Beth Goetz over the summer and observes: “Based on how she can connect with others, it would be difficult to tell that Goetz is the type of person who likes Excel spreadsheets. That is, indeed, accurate. Goetz considers herself an introvert. Not because she doesn’t like interacting with people. Because she does. But more so that, in her own time, she would prefer to do activities in a smaller group setting. But talking is an important part of her job. And she is good at it.” One morning in July, Goetz acknowledged she was no different than other fans in some cases: ”When one of our teams is on the road, I’m doing exactly the same thing. Did I buy that subscription? Where do I find it on my TV? Wait a minute, today it’s not on this, it’s on Peacock.” Tachman goes on to note that “Goetz is intentional about the energy she wants to exude. Genuine and authentic is the way she describes what she is going for. That part of the job is fulfilling.” Goetz: “Who doesn’t like an Excel spreadsheet? I like numbers. I like the finance side. I guess an outcome of that is rewarding. But not the same as a personal interaction. You get to feed off of that a little bit.” On moving forward as the industry continues to change, Goetz says: “What’s that expression about? That you just eat an elephant one bite at a time. It’s just like what’s in front of you. You deal with it. You make the best decisions you can with the information you have and then you go forward.” More. (link)

UCLA AD Martin Jarmond joins the Excellent Leadership podcast to discuss several topics, including what he looks for when hiring for the department. Jarmond explains there are certain attributes he looks for, starting with energy and enthusiasm “because it gets hard. You have to have something that’s going to propel you when it’s hard, and so if you don’t have that enthusiasm, that energy, that’s going to be a challenge. … I look for hunger. I hire for hunger. I want to know how bad do you want it? How important is this to you? Because everybody can do a job when it's good. They don't pay you for when you’re winning championships and everything's great. They pay you for the hard times. They pay you for the challenge and the struggle and how do we move forward when it looks difficult.” Jarmond also emphasizes the importance of integrity: “I can’t worry about you at night. I don’t want to go to bed worrying about you. That’s really important. Arkansas and Tyson Foods have unveiled the new “Razorback Nuggets,” chicken nuggets in the shape of a Razorback. Tyson Foods SVP/GM Kristina Lambert: “The opportunity to combine food and sports is always a great opportunity. With the announcement of [Men’s Basketball HC John Calipari] coming to the University of Arkansas and our close relationship and proximity to the UofA, it got us excited as Razorback fans ourselves that ‘Hey, could we get a Razorback nugget and have it on shelf before the next football season?’ So, we really just said, ‘Let's do it.’” Razorbacks Sr. Assoc. AD for Public Relations Kevin Trainor adds: “The branding of it – the Razorback, the trademark – but also down to the very shape of it, Tyson was very intentional that they wanted a nugget that looked like the Razorback. We worked alongside Tyson to look through that and make sure the product that was coming was going to be true to the Razorback brand.” (link)

Texas and Sodexo Live announce a new multi year agreement today through which Sodexo Live will expand its food and beverage service to the entirety of Darrell K Royal-Texas Memorial Stadium. SBJ’s Bret McCormick notes the company “previously handled just general concessions but now will oversee premium areas. It also will manage other UT venues, like UFCU Disch-Falk Field, McCombs Field, Gregory Gymnasium, Mike A. Myers Stadium and the Texas Athletics Nutrition Center. Moody Center, where F&B is handled by Oak View Group, is excluded from the deal.” (link)

Wake Forest received $30M in cash gifts from donors this past year, contributing to a four-year total of $131M, a 19% increase from the previous four years. Wake also reports that a total of 470,792 fans and 48,945 students attended 147 Demon Deacons home contests in Winston-Salem during the 2023-24 season. (link)

USC AD Jen Cohen shares an update with fans on the move to the Big Ten, how the Trojans will approach the House settlement and more. Cohen writes of the latter: “There are still many outstanding questions about what comes next, including, but not limited to: 1) how will USC distribute the estimated $22M across our 23 sports; 2) will USC add scholarships to any of our sports; 3) how will USC fund the additional $22M cost and any additional scholarships for our student-athletes. While we await further guidance from the courts, the Big Ten Conference, the NCAA and others, our team has been hard at work modeling out every potential scenario to ensure we thrive in this new era.” Cohen also discusses the Trojans’ NIL efforts: “Our partnership with House of Victory, the official collective of USC Athletics, has never been stronger, and we truly believe no collective in the country has enhanced its profile, operations, and results more in the past year than HOV. For the 2023-2024 academic year, HOV exceeded all its fundraising goals, and our donors stepped up to help us more than double our total funds from the previous year, putting USC in the upper tier of NIL collective support nationally.” Additionally, Cohen announces USC will “offer all our supporters a free year of B1G+, the Big Ten Network's subscription video streaming service for non-televised events. Northern Illinois AD Sean Frazier is adamant the Huskies will not be eliminating sports due to the House settlement: “Zero. Zero opportunity. While I'm athletic director, I can feel comfortable to say that we're not pursuing or looking at cutting any type of sport here." Frazier adds that even in prior years with tighter budgets, eliminating sports was not an option. (link)

FIU has sold the rights to its football stadium to Pitbull, Mr. 305 himself, who will pay the school $1.2M per year for the next five years and says: "For me, what it boils down to is, Miami is always known for being underdogs, no matter what we do and what level we take it to. ... Being underdogs is what I always felt about FIU – fighting, clawing their way to just be seen, to be recognized whether it be from education, business, through sports. So when this idea came about, it came about just like a Miami-Dade County, 305 idea would come about – nobody would believe in it. ... All we had to do was, just like we say in Miami, take it to the house." Panthers AD Scott Carr: "This is a historic day for FIU athletics to uniquely partner with a world-renowned artist and amazing person who truly values relationships and his community. Armando's financial support is program-changing, but him providing a microphone to amplify FIU will be even more beneficial to growing our brand." The deal includes an option for Pitbull to renew the agreement for five additional years. ESPN’s Pete Thamel reports Pitbull will also create an anthem for FIU, post about the school on social media 12 times a year and appear at one athletics fundraising event per year throughout the term of the agreement. In addition, Pitbull will get use of the stadium 10 days per year throughout the term of the deal and the vodka company he owns will be the preferred brand distributed in the stadium. The DI Board of Directors was expected to meet today to introduce a proposal to award NCAA Tournament units to women’s basketball teams. NCAA President Charlie Baker tells The AP’s Doug Feinberg: “Unless something very odd happens, and I don’t expect that it will, the finance committees have already signed off on creating a units program for the women’s tournament.” Connecticut HC Geno Auriemma: “The rewarding of the teams that participate in the NCAA Tournament is something that will have a significant impact on the sport. You will see an increase in the level of support for women’s basketball that has not been seen before. We should all be excited going forward.” Final approval would be voted on at the NCAA Convention in January. (link)

Pickens County judge Perry H. Gravely, who is presiding over Clemson’s lawsuit against the ACC in South Carolina, says the state has a "strong interest" in adjudicating a dispute concerning the league's ESPN agreements. Gravely notes that if the ACC wanted a North Carolina court to have sole jurisdiction over the contracts, the league should have included a venue clause in the deal. “This Court will not, in effect, add such a provision to the parties’ bargained-for agreements after the fact.” In his ruling against the ACC's motion to dismiss Clemson's case in South Carolina, Gravely added that the ESPN agreements "contemplate and were designed to generate performance in South Carolina. … Clemson’s generation of that media content on its campus in South Carolina is the performance of Clemson’s obligations (for which the parties bargained) under the very contract at the center of this case: the GOR.” Gravely did side with the ACC by not offering Clemson a declaratory judgment that it has "sovereign immunity" and can't be sued in another state. He dismissed the sovereign immunity claim "without prejudice," meaning the university could argue the point later. The university's request for damages, Gravely continued, also gives a South Carolina court jurisdiction because it's a matter of tort law. More. (link)

The SEC is moving toward instituting mandatory injury reports for the upcoming football season, according to CBS’ Alex Scarborough and John Talty, who note: “A mandatory injury report hasn't been officially approved, but multiple sources indicated the details are close to being finalized and are expected to be in place at the start of the 2024 season. A decision could come as early as next week when league athletic directors are scheduled to meet.” (link)

Appalachian State AD Doug Gillin says Kidd Brewer Stadium is “busting at the seams” and notes that so far donors have pledged $8M to support expansion. Gillin envisions a day when the Mountaineers will play their football games in front of 40K fans. “It’s capitalism, right, supply and demand. We need more premium seats. Season tickets have sold out for the third straight year. We’ve led the Sun Belt Conference in attendance for three straight years. We have the bleachers in the North end zone that we thought might come out after a game or two, but they’re going to be in all season long due to demand. Fan support is at a high, high level.” There is currently no timetable on when a potential expansion will occur. Gillin also says the Mountaineers are still discussing what is best for the program post-House: “We have to make sure that we understand the marketplace and then make decisions that are prudent and fiscally responsible. Right now we can continue to operate how we are operating and that’s at a pretty good level.” (link)

+ Disney will raise the prices for most Disney+, Hulu and ESPN+ plans by $1 to $2 per month. The most expensive plans for Hulu, which include live TV, will cost $6 more per month, according to CNBC’s Justine Fisher, who notes: “Disney+ basic and premium will be priced at $9.99 and $15.99, respectively. Hulu with ads will cost $9.99 monthly, while Hulu without ads will cost $18.99 per month. ESPN+, which features ads, will cost $11.99 per month.” (link)
+ Fox CEO Lachlan Murdoch reiterates the goal for Venu is to reach 5M subscriptions within five years. According to Recode’s Peter Kafka, Murdoch “also insists those subs will come from cord cutters and cord nevers – not by existing cable customers trading down.
