Plaintiffs in Choh, et al. v Brown University have filed an opposition to preliminary approval of the House settlement. They argue their claims challenging Ivy League rules prohibiting athletic scholarships and benefits for athletics services are being improperly released, according to Kennyhertz Perry attorney Mit Winter, who adds: “I expect we’ll see a similar opposition from the Fontenot plaintiffs and Riley Cornelio (who sued the NCAA this week). I also expect to see an opposition/objection at some point from individuals who are future college athletes.” From the filing: “In short, even though the defendants in Choh—the Ivy League institutions and the Ivy League itself—are not defendants or parties to the cases underlying the proposed Settlement, and even though no Ivy League athlete is a named plaintiff here, and even though the claims in Choh are not mentioned in the cases that would be resolved by the proposed Settlement, this Settlement purports to release all of the Choh plaintiffs’ unique claims against all the defendants in Choh without even purporting to provide any relief that would or could serve to redress the claims in Choh. Such a release would be improper.” (link); Full filing. (link)

The Ninth Circuit U.S. Circuit Court of Appeals has set an initial briefing for Houston Christian’s appeal of a decision rejecting its bid to intervene in the House settlement. USA Today’s Steve Berkowitz notes that HCU’s opening is due on October 25 and an answer is due on November 25. “Keep in mind with these dates that U.S. District Judge Claudia Wilken has set September 5 as the date for a hearing on the preliminary approval of the proposed settlement.” (link)

Opendorse CEO Blake Lawrence breaks down what average budget percentage the schools in each conference will have to allocate to fully share revenue post-House. The SEC will allot 14%, followed by the Big Ten (16%), ACC (18%), Big 12 (23%), Mountain West (46%), AAC (50%), MAC (70%), Sun Belt (76%) and Conference USA (79%). For perspective, Lawrence notes Jacksonville State is competing for the same football national championship as schools in the Power 4 despite the full revenue share comprising 114% of the Gamecocks’ total budget. James Moore & Co. Partner Katie Davis: “I haven't verified these numbers, but in my own number crunching and conversations, the numbers are staggering for G5's. One G5 said incremental change to fully fund scholarships up to new roster caps is $10M increase annually. Yet only $2.5M of that can count towards rev share. I don't see how schools could ever fully fund rosters up to cap given (1) impact on budget and (2) compliance requirements for Title IX.” (link)

From Law360: “In a blistering response to the NCAA’s defense of its ban on college athletes receiving prize money in non-collegiate competition, [North Carolina women’s tennis student-athlete] Reese Brantmeier pointed to the contrast between the ban and new policies allowing NIL compensation, saying the disparity in rules “strains credibility.” More. The WCHA names Augsburg (DIII) Women’s Hockey HC Michelle McAteer as its new commissioner. Minnesota State AD/WCHA Board of Directors Chair Kevin Buisman: “She brings a unique perspective as a former WCHA student-athlete and coach, who literally started with us on the ground floor and, over time, has witnessed its ascension to the most highly respected league in all of women’s college hockey. Michelle emerged from a talented pool of candidates with a skill set and prior experiences that provide a great deal of confidence about her ability to lead us to future successes in moving forward.” (link)

Former UMBC AD Brian Barrio has filed a lawsuit against the university in which he claims he was unlawfully fired and blamed for former Swimming & Diving HC Chad Cradock’s sexual misconduct and a U.S. Department of Justice investigation that found UMBC failed to protect student athletes. From the complaint: “There is little Brian will be able to do to get his career back on track at all, let alone back to where he would have been without these actions by UMBC. Scapegoated by UMBC and connected to the Cradock/UMBC debacle, Brian is unemployed, effectively unhirable and his reputation, job prospects, and future opportunities have been forever impaired and tarnished.” The suit also claims that Barrio raised questions about Title IX compliance during his interviews for the AD job and that he asked specifically about Cradock. Barrio was subsequently told that Cradock was “an important and respected leader” on campus. “Had UMBC been even remotely truthful regarding Cradock and the allegations that had been made (and covered up) about him, Brian would not have even considered UMBC.” UMBC did not immediately respond to a request for comment from The Baltimore Sun’s Madeleine O’Neill. Barrio is seeking monetary damages, but no amount was specified. (link)

Penn State has officially selected Elevate to lead strategy on fan engagement, ticketing, and premium seating and experience as the Nittany Lions begin the $700M renovation of Beaver Stadium. SBJ’s Bret McCormick: “The news was first reported by SBJ back in May. In the 10-year deal with Penn State, Elevate will drive the strategy, sales, and service for the renovated stadium’s new hospitality opportunities; the renovation project – managed by Nations Group, designed by Populous and built by a joint venture including Barton Malow, AECOM Hunt and Alexander – is expected to finish by the fall of 2027.” (link)

North Florida unveils refreshed branding and logos ahead of the 2024-25 season. Ospreys AD Nick Morrow: “UNF has a strong brand with great logos, but it is time to update many of our marks while introducing some new looks. The new family of logos simplifies and modernizes our brand while maintaining the same bold look that has identified the Ospreys over the past ten years. Thank you to CLC and to the group of coaches, student-athletes, staff and donors who were a part of the brand refresh process. I’m excited to implement our enhanced look as we compete for ASUN Championships and NCAA Tournament appearances.” Have a look. (link)

ScoopDuck’s Justin Hopkins talks about Oregon’s NIL infrastructure and notes it’s not just about flashing money. “Oregon is not richer than these other schools. Sure, Phil Knight has a lot of money and he can spend whatever he wants to spend. But he’s really not out here writing senseless checks.” Hopkins adds: “The structure is the key. The organization of Oregon’s NIL is the key. It’s put together in such a thoughtful way and there’s so many long-term benefits as to what Oregon presents on their NIL packages. That’s really what gets the parents and the kids motivated. Because again, it’s not them saying ‘here is $5M.’ Like, look, here’s a competitive offer, but then look at how this thing can stack up for you and how we can help you grow your brand and really help you monetize things. … I think that’s what people are missing. I know a lot of fans are mad at Oregon because they’re recruiting at an unreal level that we’ve never seen, but you have to understand, I don’t think they’re out there outbidding and buying everybody.” (link)

New Mexico has created a new team that will guide the department’s NIL strategy. The group will collaborate with the Lobos-focused 505 Sports Venture Foundation (505 SVF) to “help guide the growth of NIL deals in the future while providing education to student-athletes that will allow them to magnify their profile.” The team will be led by Senior Associate AD/Executive Director of the Lobo Club Jalen Dominguez under direction of Deputy AD David Williams. Lobos AD Eddie Nunez: “The development of an internal NIL strategy team for the benefit of Lobo student-athletes has been a priority. I have asked the team to focus on development of new NIL business opportunities, community impact, and education, all for the benefit of our student-athletes. Additionally, the team will work collaboratively with 505 SVF, CEO Kurt Roth and his team to further the success of the official collective of Lobo Athletics.” (link)

Rice Stadium's turf playing surface will be replaced after it was deemed unsafe for play due to damage from Hurricane Beryl. The Houston Chronicle’s Joseph Duarte: “An inspection of the AstroTurf Rootzone 3D3 Turf System — which was installed in 2021 — revealed damage to the turf’s padding caused by water saturation from the storm that hit the area in mid-July. The surface should be installed in time for football season. (link)

NCAA President Charlie Baker will be “shocked” if the DI Board of Directors’ proposal to begin awarding NCAA Women’s Basketball Tournament units has any issues gaining approval in January. “I think this is all critically important to us and to the sport generally and to women's sports, since this is in some respects a premier women's collegiate athletic event every year. And I think it's only going to get more so going forward, which is going to be great.” Baker also says of the NCAA’s media rights agreement and the decision not to offer women’s hoops separately: “I can tell you that from where I sat, ending up with an agreement with ESPN that will make it possible for us to create a separate value for the women’s basketball tournament was a major part of our strategy going into those negotiations, because we wanted to be in a position to put a structure like this in place. I know it was something that for many people around the organization – both membership and folks in Indianapolis – was an important element of that entire strategy in that whole negotiating process.” Additionally, Baker believes the House settlement will not hinder the NCAA’s ability to pay out the units. “I view it as a completely separate issue. … The schools that were part of the community that put the rules in place for which the suits are based on [and] the formulas that have been developed and voted on by the membership are going to be required to finance their piece as well. But that should have no impact at all on the way this program works.” (link, link)

West Virginia AD Wren Baker covers several topics with the Charleston Gazette-Mail’s Taylor Kennedy, including keeping some “regionality” with the non-conference football schedule, “especially when you’re in a conference that has such a geographic spread. Getting Cincinnati in as a conference game now, and to a certain degree, UCF, those are good games for us. There’s not a lot of natural rivalries and natural connections to a lot of our opponents.” That said, Baker notes there are no plans in the works to play in-state rival Marshall. “I wouldn’t say that we’re never going to play Marshall, but it certainly isn’t high on the priority list of the way we’re building our schedules.” Baker says he’s seen nearly every Power 4 football and basketball venue and noticed that “there is premium seating inventory, suite club lounges and seating. [We are in] the bottom quartile…in both of those. That puts a real constraint on us. Our budget has grown. It’s not grown over the last five to 10 years at the same clip that a lot of our peers have grown at. The reason why is that most of those other institutions have opened up additional seating. It’s important that we fully explore ways to create that premium inventory.” More from Baker. (link)

The Fresno Bee’s Robert Kuwada wonders whether Fresno State can renovate Valley Children’s Stadium, home of the Bulldogs’ football team, while carrying debt on the basketball team’s Save Mart Center. President Saul Jiménez-Sandoval says in a statement: “Fresno State remains committed to maintaining and enhancing our facilities to provide the best possible environment for our students, athletes, and the broader community. With the recent hiring of Garrett Klassy as our new athletic director, we are confident in our path forward. Garrett brings extensive experience in capital improvement projects, which is a critical asset for advancing our ‘Elevate’ athletics master plan. As we navigate our next steps, our goal is to strike a balance between necessary investments in our facilities and maintaining the university’s overall financial health.” Meanwhile, Kuwada notes the athletic department had a budget deficit of $2.8M in FY23, adding: “Another seven-figures loss is expected in 2023-24 and university funding to the department, its largest source of revenue, is likely to be cut again this year.” Also: “Will any renovation have to wait until 2031, when the university is scheduled to be out from under the $36M remaining on the Save Mart Center capital lease obligation? That includes a $10.3M principal and interest payment in 2024-25.” (link)

On3’s Pete Nakos shares some takeaways from the Personnel & Recruiting Symposium, where one high-level SEC personnel staffer called for shutting down the spring portal altogether. Nakos notes that while the spring window was previously short on “elite talent,” it has “turned into a time to unload scholarships or for players to renege on deals signed in the winter and get a last-minute pay bump. Some staffers pointed out to On3 that programs have altered schedules, so spring games are slated after the portal closes.” Meanwhile, “multiple staffers told On3 that a 30-day window in December would be ‘perfect.’ They were unfazed about having to deal with the portal during bowl season or the College Football Playoff.” As far as scholarship limits go, a handful of Big Ten staffers tell Nakos they anticipate stopping short of 105 in football. One says: “We will be around 95 and then try to go partial scholarships up to 105.” Others say they will continue offering walk-on opportunities. More from Nakos. (link)

D1Baseball’s Kendall Rogers is told by a source there is hope that a final decision on roster limits will be made at some point before the early signing period, which begins on November 8, adding: “The biggest question people in our sport have right now is where the scholarship limits will end up when the negotiation process comes to a close.” To that end, Rogers has asked several coaches and ADs what they’re hearing about potential limits and reports: “Multiple SEC coaches believe they will sit anywhere from 23-25 scholarships when the dust settles. The SEC has not decided on if the scholarship total will be a league-wide mandate. There seems to be a mixed bag of opinions in the Big Ten Conference. At least one coach told me a while back he didn’t see the league moving off 11.7 right off the bat. Another coach said his administration had no clarity, and yet another said he was told they’d have access to 20-23 scholarships.” Meanwhile, a “premier mid-major program in the northern half of the country felt like they could get a bump to 15, though staying at 11.7 for the foreseeable future is also still on the table.” Also from Rogers: At least two Big 12 programs believe the limit will be “relatively low, while two other coaches were cautiously optimistic. … One historically successful California mid-major thought they had a pathway to 18-20 scholarships spread out over 34 players. … [And] one Sun Belt athletic director said they thought their league would place a very high priority on the ‘diamond’ sports such as baseball and softball. The idea is to increase scholarships on a ladder over the next three years to somewhere in the 15-25 range.” (link)

David Wadsworth, the court-appointed trustee overseeing the bankruptcy estate of Colorado football student-athlete Shilo Sanders, has asked to hire a special counsel after having “reached an impasse in their discussions concerning the turnover of this (NIL) information, as well as other documents and information,” according to USA Today’s Brent Schrotenboer. Wadsworth adds in his request: “While the Debtor (Shilo Sanders) has provided the Trustee with certain NILs, the Trustee needs to confirm he has received all of the NILs and has full information of the use of revenue generated by the NILs.” Federal bankruptcy Judge Michael Romero then approved that request yesterday, although Sanders’ attorneys dispute the notion of an impasse: “At all times during this case, the Debtor (Sanders) has been forthcoming with information and has made his retained professionals, including multiple sets of attorneys, his accountant, and other professionals available to the Trustee.” Attorneys for John Darjean, a security guard who claimed Sanders gave him permanent and severe spinal and nerve injuries, question whether Sanders is hiding assets in LLCs he uses to conduct NIL business. Daktronics reported a gross profit of $222.4M for FY24, up 91% from FY22. SBJ’s Bret McCormick: “The Live Events segment, which booked a $95.9M profit this past fiscal year, continues to lead the way, booking $321.2M in FY24 orders, up from $259.7M in FY23. The company attributed that nearly 24% climb in part to increased demand in the college athletics space. Net sales were up 8.5% year-over-year; 91% of the company’s sales were made in the U.S. And, following Daktronics’ flirtation with serious financial issues in the immediate post-COVID months, the company reported more financial breathing room: cash and cash equivalents stood at $81.3M at the end of FY24, a significantly larger cushion than the conclusion of FY23 when that number was $23.99M. The company took on new long-term debt, which now stands at $53.2M.” (link)

The U.S. Department of Education says FAFSA for 2025-26 will be fully available by December 1. The department will begin testing the new form with a limited number of students and institutions on October 1. The phased approach is aimed at ensuring complete functionality when the form fully launches. Secretary of Education Miguel Cardona: “Following a challenging 2024-25 FAFSA cycle, the Department listened carefully to the input of students, families, and higher education institutions, made substantial changes to leadership and operations at Federal Student Aid, and is taking a new approach this year that will significantly improve the FAFSA experience. Thanks to the partnership of our stakeholders, we’ve developed a better implementation process for 2025-26. I look forward to continuing to work with our partners to ensure this school year’s FAFSA implementation better serves our nation’s students.” (link)
