The NCAA Board of Governors unanimously approved $25M in additional funding to award NCAA Women’s Basketball Tournament units to participating teams. Baylor President/Board Chair Linda Livingstone: "Investing in women's sports is a priority for the NCAA and for the Board of Governors. Women's sports — and women's basketball in particular — have seen an incredible trajectory in popularity in recent years, and these distribution funds for women's basketball performance should continue to encourage campus and conference-level investment in the women's game to continue that growth." The Board of Governors also directed the governance bodies in all three NCAA divisions to pursue the legislative changes necessary to restructure the existing four DEI committees into one all-encompassing committee focused on diversity, equity, inclusion and belonging efforts following the recommendation of the NCAA Diversity, Equity and Inclusion Committees Review Working Group. Additionally, the board voted to extend Livingstone as chair for the 2024-25 academic year. (link)

USA Today’s Steve Berkowitz reports Texas A&M AD Trev Alberts is making $2.2M annually in base salary as part of his deal which runs through September 30, 2029. The contract also includes a $450K longevity payment that would become due after March 31, 2027, and a $300K payment that would become due two years later. Also from Berkowitz: “Alberts can get bonuses based on Directors Cup and any team championships. If football wins SEC or plays in CFP, he would get $100K – and an additional $150K for the title. Alberts' base salary is fully guaranteed in case of termination w/o cause, subject to duty to mitigate. If Alberts leaves, the buyout he would owe starts at $4M and decreases after April 1, 2026. Owed amount would be cut in half if school president Mark Welsh departs. And Texas A&M did agree to pay the $4.12M that Alberts was known to have owed Nebraska.” (link, link, link)

SBJ’s Rachel Axon posits that “in the wake of a changing economic model, Olympic leaders don’t have to wonder what their collegiate peers might do. They saw it during COVID, where schools around the country cut teams.” As such, USOPC Chief of Sport and Athletic Services Rocky Harris tells Axon: “We want to make sure that they don’t cut the sports that matter most. We have to be careful about just saying, ‘Everything has to stay the same,’ because we know that’s not realistic. Instead, we have to create a more targeted approach and a more customized approach by conference, by region, by school. And making sure they have the data that we have and the understanding of how they’re driving Team USA’s success.” Stanford AD Bernard Muir: “We certainly want to continue our Olympic prowess. It’s part of the fabric of our place, and I know many others have great aspirations of providing the world’s best to compete on the international stage. It’s going to be a fine line to thread the needle here, but we’re hoping we can do that.” (link)

New on Connect: Uni USA President/former UCLA AD Dan Guerrero joins Connect’s Steph Garcia Cichosz to discuss the future of Olympic sports in the U.S., including the impact of a potential revenue-sharing model for college athletics on the broader Olympic sport movement and the place of Olympic sports within the higher education framework. Guerrero also shares details of the 2029 World University Games, set to be hosted in North Carolina, and early momentum for the LA 2028 Olympics. Guerrero: "The intercollegiate model in the United States is the envy of most countries around the world. What has been such a viable and successful enterprise for us has been Olympic sports and what they mean to the future of the Olympic movement. … It’s concerning to me that as we decide where this enterprise is going to go, it's a zero-sum game in terms of resources that are available to the different institutions. Someway, somehow, we need to be able to figure out how we can, in fact, preserve those Olympic sports because they are too valuable not only for our country, but certainly for the world.” Guerrero adds that he believes ADs across the country are committed to doing “everything they can to continue to provide those opportunities to compete at the highest level and ultimately achieve their dreams of competing in the Olympics.” More. The Big 12 extends its partnership with SeatGeek and makes SeatGeek the league’s Official Ticket Marketplace. As part of the deal, SeatGeek will further its brand presence in new markets through prominent sponsorship assets, such as event entitlement of Big 12 Homecoming’s music platform and a supporting partnership of Big 12 Pro Day. The agreement will also include in-venue signage and LEDs at all Big 12 Championship games and media assets across broadcasts. (link)

James Moore & Co. Partner Katie Davis notes that her team has “noticed a trend in apparel contracts with Nike shifting to less cash & more product, which isn't a big deal if you're a school that purchases on top of the in kind. Also seeing provisions trying to stop coaches from wearing other brand pants (like lululemon). These apparel contracts are another example of 22% on top of already a large percent of ‘revenue’ aka gear and apparel going to athletes. These amounts (including the in kind) are picked up in Category 15, which is in the Average Shared Revenue formula. One more example of a tax on what's already going to athletes. The other glaring example is grants-in-aid (aka scholarships!) and other grant-type NCAA revenue distribution in Cat 12.” (link)

The NCAA Playing Rules Oversight Panel has approved expanded use of one-way communication devices in baseball beginning with the 2025 season. Under the new rule, a player on the field or coaches in the third base or first base boxes can initiate one-way communication to relay signals to offensive or defensive players. Previously, the use of an exclusively one-way electronic communication device from the dugout to the field for the purpose of relaying the pitch or play call was allowed. The use of other electronic devices in the dugout remains prohibited. The panel also approved a measure that requires batters to be alert and ready to hit with 8 or more seconds remaining in the 20-second time limit; the allowance of a double first base as an optional rule for all games, including NCAA championship competition; a rule stating that on force play slide rule calls, the ball will remain live until the play has fully concluded, and more. The NCAA Playing Rules Oversight Panel on Thursday also approved new rules on the shoes that competitors can wear and a modification to rules on lane violations in men's and women's track and field. The shoe rule brings the NCAA in line with World Athletics rules and allows student-athlete performances to be accepted for eligibility in world competitions. The lane violations rule centers on indoor and outdoor track and field races run on a curve. Competitors will face disqualification for stepping on or over the lane line to their left with more than one step anywhere on a curve for the entirety of the race. Other rule changes include: allowing pacing light technology at non-championship competitions; better defining the roles of meet management; and adding the competition manager position as part of meet management, among others. Plaintiffs in Choh, et al. v Brown University have filed an opposition to preliminary approval of the House settlement. They argue their claims challenging Ivy League rules prohibiting athletic scholarships and benefits for athletics services are being improperly released, according to Kennyhertz Perry attorney Mit Winter, who adds: “I expect we’ll see a similar opposition from the Fontenot plaintiffs and Riley Cornelio (who sued the NCAA this week). I also expect to see an opposition/objection at some point from individuals who are future college athletes.” From the filing: “In short, even though the defendants in Choh—the Ivy League institutions and the Ivy League itself—are not defendants or parties to the cases underlying the proposed Settlement, and even though no Ivy League athlete is a named plaintiff here, and even though the claims in Choh are not mentioned in the cases that would be resolved by the proposed Settlement, this Settlement purports to release all of the Choh plaintiffs’ unique claims against all the defendants in Choh without even purporting to provide any relief that would or could serve to redress the claims in Choh. Such a release would be improper.” (link); Full filing. (link)

The Ninth Circuit U.S. Circuit Court of Appeals has set an initial briefing for Houston Christian’s appeal of a decision rejecting its bid to intervene in the House settlement. USA Today’s Steve Berkowitz notes that HCU’s opening is due on October 25 and an answer is due on November 25. “Keep in mind with these dates that U.S. District Judge Claudia Wilken has set September 5 as the date for a hearing on the preliminary approval of the proposed settlement.” (link)

Opendorse CEO Blake Lawrence breaks down what average budget percentage the schools in each conference will have to allocate to fully share revenue post-House. The SEC will allot 14%, followed by the Big Ten (16%), ACC (18%), Big 12 (23%), Mountain West (46%), AAC (50%), MAC (70%), Sun Belt (76%) and Conference USA (79%). For perspective, Lawrence notes Jacksonville State is competing for the same football national championship as schools in the Power 4 despite the full revenue share comprising 114% of the Gamecocks’ total budget. James Moore & Co. Partner Katie Davis: “I haven't verified these numbers, but in my own number crunching and conversations, the numbers are staggering for G5's. One G5 said incremental change to fully fund scholarships up to new roster caps is $10M increase annually. Yet only $2.5M of that can count towards rev share. I don't see how schools could ever fully fund rosters up to cap given (1) impact on budget and (2) compliance requirements for Title IX.” (link)

From Law360: “In a blistering response to the NCAA’s defense of its ban on college athletes receiving prize money in non-collegiate competition, [North Carolina women’s tennis student-athlete] Reese Brantmeier pointed to the contrast between the ban and new policies allowing NIL compensation, saying the disparity in rules “strains credibility.” More. Former UMBC AD Brian Barrio has filed a lawsuit against the university in which he claims he was unlawfully fired and blamed for former Swimming & Diving HC Chad Cradock’s sexual misconduct and a U.S. Department of Justice investigation that found UMBC failed to protect student athletes. From the complaint: “There is little Brian will be able to do to get his career back on track at all, let alone back to where he would have been without these actions by UMBC. Scapegoated by UMBC and connected to the Cradock/UMBC debacle, Brian is unemployed, effectively unhirable and his reputation, job prospects, and future opportunities have been forever impaired and tarnished.” The suit also claims that Barrio raised questions about Title IX compliance during his interviews for the AD job and that he asked specifically about Cradock. Barrio was subsequently told that Cradock was “an important and respected leader” on campus. “Had UMBC been even remotely truthful regarding Cradock and the allegations that had been made (and covered up) about him, Brian would not have even considered UMBC.” UMBC did not immediately respond to a request for comment from The Baltimore Sun’s Madeleine O’Neill. Barrio is seeking monetary damages, but no amount was specified. (link)

Thank you to CLC and to the group of coaches, student-athletes, staff and donors who were a part of the brand refresh process. I’m excited to implement our enhanced look as we compete for ASUN Championships and NCAA Tournament appearances.” Have a look. (link)

ScoopDuck’s Justin Hopkins talks about Oregon’s NIL infrastructure and notes it’s not just about flashing money. “Oregon is not richer than these other schools. Sure, Phil Knight has a lot of money and he can spend whatever he wants to spend. But he’s really not out here writing senseless checks.” Hopkins adds: “The structure is the key. The organization of Oregon’s NIL is the key. It’s put together in such a thoughtful way and there’s so many long-term benefits as to what Oregon presents on their NIL packages. That’s really what gets the parents and the kids motivated. Because again, it’s not them saying ‘here is $5M.’ Like, look, here’s a competitive offer, but then look at how this thing can stack up for you and how we can help you grow your brand and really help you monetize things. … I think that’s what people are missing. I know a lot of fans are mad at Oregon because they’re recruiting at an unreal level that we’ve never seen, but you have to understand, I don’t think they’re out there outbidding and buying everybody.” (link)

New Mexico has created a new team that will guide the department’s NIL strategy. The group will collaborate with the Lobos-focused 505 Sports Venture Foundation (505 SVF) to “help guide the growth of NIL deals in the future while providing education to student-athletes that will allow them to magnify their profile.” The team will be led by Senior Associate AD/Executive Director of the Lobo Club Jalen Dominguez under direction of Deputy AD David Williams. Lobos AD Eddie Nunez: “The development of an internal NIL strategy team for the benefit of Lobo student-athletes has been a priority. I have asked the team to focus on development of new NIL business opportunities, community impact, and education, all for the benefit of our student-athletes. Additionally, the team will work collaboratively with 505 SVF, CEO Kurt Roth and his team to further the success of the official collective of Lobo Athletics.” (link)
