Florida A&M Interim President Timothy Beard today explained his evaluation and assessment of each senior leadership member played a role in the decision to make the sweeping changes announced yesterday as part of a 100-day action plan. “I’ve been studying the team. I’ve also been looking at the bold and striking strategic plan. I want to make sure the personnel is appropriate to make sure those strategies are completed. We make decisions based on the plan and accountability.” Beard declined to comment on specific “employee-type issues” but said there will be a plan in place to ensure there are no compromise in the level of service to students. “Students represent our number one client. Oregon AD Rob Mullens joins the Navigating Sports Business podcast with Navigate Founder AJ Maestas to discuss the Ducks’ move to the Big Ten and the creative risks that have helped turn UO into a national brand over the past 20+ years. Mullens notes that “you have this marketing tool called college athletics – and specifically college football because of the reach – and how can you use that to benefit others? Benefit the institution? Benefit the community? Benefit the state? And so that's how you build that brand, starting with this vision of creating excitement. And it's been done in so many ways – facilities, uniforms, giant ducks in the White River – and so it has built that brand, as you and your team helped us quantify what that's meant to TV ratings, what that’s meant in market share, our place in college football. And now we have this incredible new opportunity to expand it to this conference with a rich tradition, huge loyal alumni and fan bases in new markets.” Mullens also talks about the “courage to be bold, to try things differently, and be first. … My very first week as the athletic director here, my first athletic director job, [Nike designer] Tinker [Hatfield] invited me to go look at what became that unique deep-in-the-woods basketball court,” which many people pushed back on. “But what became of uniforms and that court is people resisted it at first, but then it gets imitated. So that can show you the power of leaning into your DNA, of who you are…and even though at first you might say, ‘Well, that's a complete departure from what the rest of the industry is doing,’ it turns out to give you a competitive advantage.” Maestas adds that he believes “that’s one of the things that’s missing in college athletics. College Hockey Insider’s Mike McMahon breaks down the specifics of Canadian junior hockey player Rylan Masterson’s lawsuit against the NCAA and 10 member institutions. First, McMahon notes the lawsuit says CHL players do not receive a salary, but instead receive a stipend of “no more than $600 per month.” The stipend is intended to cover living expenses and is not considered income for tax purposes. “That’s true. However, the main crux of the NCAA’s argument over the years had less to do with the CHL stipend and more with the NHL’s ability to assign professional players to CHL teams, which the NCAA argues classifies the CHL as a professional league. However, the lawsuit later points out other examples (in other NCAA sports) where professional inclusion has yet to result in a loss of eligibility, including Olympic swimmer Katie Ledecky, who the lawsuit said made six-figures and was still allowed to compete as an NCAA swimmer.” The lawsuit calls the NCAA’s CHL rule a group boycott and argues it “puts 16-year-olds in the impossible position of deciding, at that young age, whether they will ever want to play Division I hockey.” Further: “The purpose of the Boycott is to harm Division I’s primary competitor, the CHL, by reducing its ability to recruit players in the Elite Young Player Services Market. It is not intended to promote or protect amateurism, if that is even a cognizable goal under the antitrust laws.” Kennyhertz Perry attorney Mit Winter tells McMahon: “Players definitely have a better chance of winning a case like this than they would have even just five years ago. I think that if the plaintiffs are successful in this, there are probably some other NCAA rules that might be challenged as well relating to who can play college sports and who can’t.” Lots more. Dan Furman, president of the Louisville-focused 502 Circle collective, tells On3’s Jeremy Crabtree that simply accumulating a war chest is not enough to measure success. “We're not just out here – and there are collectives around the country that do this – throwing money around. We've got a system. We have a plan. And we have a purpose behind what we do. And for us, it's not a race to spend the most amount of money. It's a race to put the most competitive team on the football field or basketball court." Furman explains that the collective’s plan focuses on smart fundraising tactics and launching a new media initiative that generates the "true NIL" the NCAA is looking for post-House. "From the get-go, we've been really creative. Everything that we do, we try to be first in the industry to do it. What we just launched with Floyd Street Media will be extremely successful. It'll have a lot of detail and player-driven content that's going to really showcase our athletes and gives us a pure NIL scope to college athletics. … We have the money to do what everyone else is doing, but at the same time, we want to build something around that as well. We want to build a community and build a sense of pride in what we're doing. … All of these schools are trying to sing the same tune of – we're bringing all these athletes here and they're not coming to finish fifth. These guys are coming here to win championships and play at the next level. How do we provide those resources? It's the same thing we've been doing in college athletics for a lot of years. And the schools that provide those resources are going to have the ability to recruit and retain and generate a return on their investments with wins and championships.” (link)

Georgia Tech and five-star offensive line recruit Josh Petty “agreed to terms of a three-year Roster Value deal with an annual payment of at least $800K,” according to On3’s Pete Nakos, who adds: “A source at Florida State, which lost out on Petty, told On3 that the offensive lineman ‘did not’ turn the final weeks of his recruitment into a bidding war.” Petty says: “Tech’s been very easy. Tech’s been very cooperative and efficient with working on that. I needed that number to be fair. Tech went beyond and above and really have taken care of me.” Nakos reports that “sources across the country have told On3 that programs have offered higher packages this cycle because of the pending House settlement, allowing schools to share $20M to $22M in revenue annually. Petty will enroll at Georgia Tech at the mid-year mark, months before revenue sharing is expected to begin. It’s unclear if those dollars are factored into his deal. While the 6-foot-4, 255-pound offensive lineman’s NIL package might sound jaw-dropping, it does not reset the market but rather matches it. Five-star offensive tackles David Sanders and Michael Fasusi have yet to announce commitments and are expected to command seven-figure agreements.” Petty’s father, James, on the need to work with an agent during the process: “We don’t know the NIL space. We don’t know what’s decent. We have to trust people like [Power Up Sports owner] Brian [Davis], who did a fantastic job of helping us understand these things. We don’t have a crystal ball into what a kid gets if they go play at Texas. Or what does a kid get if they go play for USC, right?” (link)

Dr. Keith Bell is suing Ole Miss Football HC Lane Kiffin for one count of copyright infringement for two social media posts Kiffin made in 2016 and 2022. In the first post, the lawsuit states that Kiffin retweeted a passage from Bell's 1981 book "Winning Isn't Normal." In 2022, Kiffin posted a seven-paragraph passage under the heading "WINNING ISN'T NORMAL." Asked about the suit earlier this week, Kiffin said: "I didn't really pay attention to it. I'm not supposed to comment. I mean, what are we talking about? I will just say, I've never read the book. I don't even remember the quote that I tweeted or something. I'm not supposed to say that either." According to the complaint, Bell sent Kiffin cease-and-desist letters following each post and Kiffin failed to comply with the demand in 2022. The suit also argues that the use of the "Winning Isn't Normal" passage is commercial in nature because of Kiffin's salary, the volatility of SEC coaching jobs and the impact social media can have on recruiting. The complaint does not make a specific financial demand of Kiffin. (link)

Tennessee AD Danny White discusses the Vols’ new partnership with Pilot, which will include Pilot’s logo on Shields-Watkins Field as well as signage on the East Side of Neyland Stadium, and explains that “we built a business plan on how we’re going to get this [Neyland Stadium renovation] project going as quickly as possible. But we knew all along we needed a lead corporate partner for the short and the long term for the viability of this stadium. It’s a $337M project. … It’s a difficult proposition to find the right partner for a building with this much history and pageantry. We feel like we definitely did that with Pilot. They’ve been here, entrenched in our community and such a big part of our athletics department for so long. And this day is really a celebration about moving forward in the next 100 years of Neyland Stadium.” White also addressed the possibility of adding a corporate sponsor to Baseball’s Lindsey Nelson Stadium: “We have a lot of different assets that I think provide a ton of value for corporate naming opportunities. That could be one of them. But there’s a bunch that we’re always looking to make sure we’re generating as much revenue as we can, but again, while also being good stewards of Tennessee tradition and the fact that we’re here in a university setting in a higher education environment.” More from White. Washington AD Pat Chun joins Inside the Arena with KOMO’s Chris Daniels and talks about the move from Pullman to Seattle, the Huskies entry into the Big Ten, construction on campus and more. Chun says his conversations with Washington State President Kirk Schulz have been “great,” adding: “Obviously, they’ve slowed down quite a bit. He’s got to run the university and I have a new task here, but our expectation and the reality of the move was we were going to maintain friendships with the lifelong friends we made.” Chun also says university leadership has been willing to work with the athletic department to alleviate some of the financial stressors of changing conferences and notes: “The reality of where we’re at with our budget coming out of the pandemic, we’re not different than a lot of athletic programs that had to shift dollars to cover shortfalls, and the out years of have had impact. And the reality is where we're headed there's bigger bills to pay.” Given the state of change in college athletics, Chun remarks that “one of the benefits of being in the Big Ten is…we are one of the two conferences that will have the biggest say in how the future is shaped. So to be at the table with the Big Ten, understanding that now from a future standpoint we have the security of being with like institutions in the major conference, and making decisions in an unknown environment is the right place for a school like Washington to be.” Also from Chun on the topic of eliminating sports: “We believe in a broad-based athletic program that brings diverse people to our campus, and those things have never been discussed with me on this campus.” (link)

When it comes to fundraising, Konya explains that “every institution has the ability to leverage key strengths…and for us, as you mentioned, we have a heavy lean into the corporate side based off of where we are. We also have individuals who are super connected to a few of our programs, so (the Spartans also lean into) those legacy gifts. So, that's kind of the two areas that I think work best for San José State. There are other institutions where there are other categories that might work best and yield their results, but for us, we do lean heavily into the corporate side and in terms of those legacy gifts.” On upgrades to the football stadium: “We’d like to do something like premium seating, loge seating. I think that's the key. For us to maximize our revenue opportunities, we have to continue to invest in the premium experiences and premium opportunities, and that's a challenge when you have a stadium that's over 100 years old.” (link)

The Arkansas-focused Arkansas Edge collective has partnered with local casino Saracen Casino Resort to “leverage existing mobile wagering technology to create a 50/50 raffle for Razorback fans to play and, by extension, benefit NIL capabilities,” according to Loyola Chicago professor Noah Henderson, who also notes: “For Arkansas to be able to implement such a raffle, changes in law will have to happen.” One such amendment currently being discussed by lawmakers: “Interactive gaming includes, subject to Commission approval, a NIL drawing game conducted through an electronic device or machine in order to benefit a Name, Image, Likeness (NIL) collective consistent with the Arkansas Student-Athlete Publicity Rights Act (Act 810 of 2021), as codified.” Henderson adds: “So why do Arkansas Edge and Saracen Casino aim to leverage gambling law? The answer is simple –– what they intend to do blatantly violates Arkansas’ Charitable Bingo and Raffles Act. … To hold a raffle in the state of Arkansas, an entity must be recognized and operational as a charity for a minimum of five years. Arkansas Edge was founded in November 2023 and is not recognized as a 501(c)(3) charitable organization and, therefore, is not eligible to hold such an event. These regulations exist, in part, to curb entities from profiteering through the operation of games of chance. … These are not 50/50 raffles nor any type of game for public benefit that the law intended to protect; these are conveniently disguised casino-backed games with poor odds that supplement the incomes of college athletes. The need to structure them under Arkansas’ casino gaming rules should leave no doubt in anyone’s mind that this is the truth and that the legislative intent of the Charitable Bingo and Raffles Act is being bastardized.” (link)

Texas Tech Football HC Joey McGuire continues to criticize the way in which helmet communication technology is being implemented. During the Red Raiders’ Independence Bowl matchup with Cal, the teams were given eight wired helmets, including two on offense and six on defense: the starting QB and his backup, a safety, and two linebackers and their backups. That’s twice the number that will be allowed during the upcoming regular season, and McGuire tells CBS’ Dennis Dodd: "You could have fixed it and they chose to take the easy way out and do the NFL model (even though most NFL teams huddle between plays). Guess what? We don't huddle [on offense]. How is that fixing anything? I've got a whole frustration level on it. I wish they would have said, 'If we're going to use the NFL [method], let's use it in [more than] the bowl games, instead of letting us experience the perfect way to do it and taking it away.'" Meanwhile, Ohio State HC Ryan Day says: "I do think with player-to-coach communications, you're going to see more huddling. More plays, possibly. I feel like huddling is kind of a lost art. I think people find themselves getting back to that, not showing the formation." Arkansas HC Sam Pittman adds: "You have to still signal with helmet comms. The only way you can do that is just everybody on the field have one. It's just going to be a liability right now.” GoRout Founder/CEO Mike Rolih agrees that helmet comms will help, but the current implementation is far from a cure-all for sign-stealing. "That was our pitch to the [NCAA Football Rules] committee. That was our pitch to every conference. What you guys are talking about doing is not going to solve your ultimate problem." (link)

Levy Restaurants heads into the upcoming college football season with seven recently renewed accounts in Ohio State, Colorado, Wisconsin, Texas A&M, Oklahoma, Arkansas and New Mexico, according to SBJ’s Bret McCormick, who notes those accounts amount to more than $100M in combined annual revenue. Levy EVP/Business Development Jeff Wineman tells McCormick that some of those are third renewals of the original deal, and McCormick adds: “The relationships average roughly 10 years, strengthen the company’s claim of a 99% account retention rate and underscore its focus on the college market.” Wineman: “[College venue concessions are] evolving so much, so quickly. What we’re seeing, schools that are self-operating want to ‘fire themselves’ and bring in third parties like Levy because it’s so important.” For example, Wineman notes that new agreements spell out what Levy and its college clients will do if players require compensation from F&B, such as when menu items are created around a school’s athletes. “What it is today may be different than what it is tomorrow, so these agreements provide a lot of flexibility to pivot in this landscape that is just changing.” (link)

College football fans are buying 13% more tickets on the secondary market than last year heading into the 2024 season, according to research from Elevate, which also indicates consumers are spending more on average on the top 20 games of the 2024 season, as the average ticket price has increased 13% from $266.05 last season to $299.75 this year. Elevate Chief Business Officer Jonathan Marks tells SBJ’s Ben Portnoy: “If you look back probably 20 years when the secondary market really started to develop in the early 2000s with StubHub first, and then you look at all the competition there is now – StubHub, SeatGeek, Ticketmaster resale, Vivid Seats – fans are not real concerned where they purchased the ticket. And so because of that, you also start to see some interesting ways that those marketplaces are dynamically adjusting their fees in order to see what ways they can attract a consumer.” Elevate also found that the November 30 Texas-Texas A&M matchup has the highest overall get-in price on the secondary market at $550, and SeatGeek continues to increase its market share, making up 28% of Elevate Marketplace’s total secondary market sales and boosting its total share to 36%. MLive.com’s Samuel Dodge shares more details on a federal lawsuit which alleges a change in Michigan’s football season ticket policy cost a ticket holder and reseller at least $2.5M in lost revenue. Maxim Tickets owner Kevin Brick has sued the university for “unfair, unconscionable, and deceptive business practices” in violation of the Michigan Consumer Protection Act. Brick argues that without warning, the athletic department prohibited people from buying tickets solely to resell them and blocked him from his tickets. Brick, who says he has bought hundreds of tickets for 21 years, claims this policy change misled him into spending millions of dollars without the possibility of making the money back. From the suit: “Despite UM’s longstanding policy of allowing resale and transfer of football season’s tickets, it unilaterally changed its terms and conditions without (our) consent or knowledge in (and) around 2023.” Dodge notes that U-M’s ticket policy states that tickets “may not be purchased for the primary purpose of resale and may be canceled at the discretion of the department. This policy was not mentioned in a 2022 email sent to season ticket holders that Brick attached to the lawsuit, as it allowed reselling of tickets on third-party platforms such as StubHub. However, the current policy says that season ticket holders may have no more than eight total tickets for both regular season and postseason play.” (link)
