The memo for tomorrow’s congressional NIL hearing cites “dwindling athletic department budgets at the hands of NIL deal redistribution of capital,” high schoolers being “immensely impacted” by transfer rules and a four-star recruit getting burned by the promise of NIL, On3’s Wittry reports, adding: “When NCAA president Charlie Baker talks about ‘consumer protections,’ or if you think about the potential NYT audience for the op-ed from Notre Dame AD Jack Swarbrick and President Fr. John Jenkins, they can help determine how these issues are framed for members of Congress. … By the way, the footnote for the "dwindling athletic department budgets" is an Arizona Daily Star story published May 6, 2022. The only first hand source quoted is Arizona AD Dave Heeke. Not blaming the paper or Heeke but that footnote doing a lot.” (link)

While discussions continue regarding whether the NCAA should negotiate standalone championship rights on the Women’s Basketball Tournament, Sportico’s Caron notes there are some who warn that could have unintended consequences, particularly for the sports with which WBB is currently bundled. Octagon SVP of Media Rights Consulting Mao: “If you take that jewel out of the crown, does anybody still want the crown. That’s the risk because there are so many other championships that are tied together here. … There clearly is more value that could be had for the women’s championship on its own, but the broader consideration here from a strategic perspective is what does that do to potential value of everything else?” Mao suggests the NCAA could still license the rights to one broadcast partner in a package deal while contractually assigning specific values to some of the foundational pieces, including the WBB tournament. Mao adds that instead of telling interested media partners that “you can only buy the entire sheet cake,’ you say, ‘People who want to buy the entire sheet, you can definitely bid on that and tell us how much you’re willing to offer economically and distribution-wise for that. But we know there could also be interest from people who want to buy slices of it.” (link)

Meanwhile, 1.8M turned in to see UCLA-South Carolina, 1.3M to see Iowa-Colorado, 1.2M to watch Notre Dame-Maryland and 1.1M to take in LSU-Utah. Overall, 3.5B minutes were consumed through the Sweet 16. (link)

The AP’s Parry reports the American Gaming Association is adopting a new responsible marketing code that will “ban sports books from partnering with colleges to promote sports wagering, bar payments to college and amateur athletes for using their name, image or likeness, and end the use of the terms ‘free’ or ‘risk-free’ to describe promotional bets.” The AGA tells the AP the changes are necessary to keep up with developments in the nascent legal sports betting industry. (link); Meanwhile, NFL owners voted in favor of allowing physical sportsbooks to operate on game days in states where it is legal, per Sportico’s Kaplan, who reports revenue from the sportsbooks “will not be shared with other teams up until a certain threshold, believed to be around $20M, and then pooled with the other 31 clubs for any money that exceeds that bar.” (link)

+ The Montana State men’s tennis team will not compete for a Big Sky championship this spring after a rash of injuries has left the team with just three available student-athletes. Bobcats AD Costello: “It’s an unfortunate situation for the men’s tennis program, however, we will always prioritize health, safety and well-being when it comes to our student-athletes. There is very little room for error with the roster size, and we have been hit with a tidal wave. Our goal is to focus on recovery and get back on the court as soon as we are physically able.” (link)

+ U.S. District Judge DuBose has dismissed a lawsuit filed by eight former South Alabama volleyball student-athletes who accused former HC Meeks-Rydell of sexual harassment and the use of “psychological and emotional manipulation and intimidation.” DuBose ruled that Meeks-Rydell and five other defendants were entitled to qualified immunity, which grants government employees broad protection from lawsuits except in extreme cases. Long Beach State Interim AD Kadowaki says the university will increase the student athletics fee after receiving “overwhelmingly positive” on a survey related to the matter. The newly increased fee will generate roughly $4.5M in additional resources for the department and “will make a long-lasting difference and secure our ability to maintain a safe, competitive, and respected intercollegiate athletics program at the Beach.” (link)

+ UTRGV releases renderings of the $45M Vaqueros Performance Center, a new 45K-sq-ft facility being built north of UTRGV Baseball Stadium that will house the FB program and be used by multiple sports upon completion. The facility is expected to be complete by the fall of 2025. (link)
+ Eastern Washington will install a Gatorade Fuel Station and has already received donations of $100K specifically for the project, which is expected to cost roughly $150K for the build plus monthly expenses for food. (link)

+ Endeavor is exploring a sale of IMG Academy, according to Sportico’s Soshnick and Novy-Williams, who report the company was “contacted by interested parties about the academy, and those conversations are ongoing. … It’s unclear who has expressed interest or what the business might be worth. + The Horseracing Integrity & Welfare Unit is partnering with RealResponse to enable those in the thoroughbred industry to anonymously submit information regarding potential violations of the Horseracing Integrity and Safety Authority’s (HISA) Anti-Doping and Medication Control (ADMC) Program. According to a survey conducted by the Art & Science Group, one in four prospective college students indicated they had ruled out higher ed institutions due to the politics, policies, or legal situation in the state where the college was located. The Chronicle of Higher Education’s Surovell notes the results were “consistent across the ideological spectrum — conservative students (28%) indicated they were about as likely as liberal students (31%) to reject an institution based on the political climate of a state.” Art & Science Group Principal Strauss: “We’ve been struck by the observation that liberals seem to be reacting mostly to very particular policies. Conservative students seem to be reacting a little bit to particular issues, but more to a general sense of a state being democratic or too liberal in a kind of generalized sense.” The states most likely to be ruled out overall included Alabama (38%), Texas (29%), and Louisiana, and Florida (21%). The most common policy issues cited by students were a lack of concern about racial equity and conservative restrictions on abortion and reproductive rights. (link)

Nike increased the percentage of U.S. racial and ethnic minorities at the director level and above to 34.5% in 2022, ahead of its goal of 30% by 2025, per Footwear News’ Ciment, who cites the company’s 2022 Impact Report. The report also indicates Nike achieved 38.8% representation of U.S. racial and ethnic minorities in the U.S. corporate workforce in 2022, a 4.3% increase YoY and ahead of the 2025 target of 35%. Meanwhile, representation of women in Nike’s global corporate workforce increased by 0.7% to 51.1% in 2022, which surpassed the company’s target of 50% representation of women in these roles by 2025. The percentage of women in leadership roles grew from 43% in 2021 to 44.1% in 2022, less than 1 percentage point away from its 2025 target of 45%. (link)
