Sportico’s Michael McCann, Indiana law professor John T. Holden and Fordham law professor Marc Edelman co-author a paper for the Boston College Law Review titled “(Still) Anticompetitive College Sports” in which they note: “Some commentators, eagerly amplifying talking points shared by class action attorneys who stand to handsomely profit, have described this proposed [House, et al.] settlement as a monumental step to resolve the longstanding labor strife within college sports. However, this rosy portrayal of the proposed settlement ignores that, as proposed, the settlement would continue to allow NCAA member schools to deny college athletes access to free labor markets, as well as would continue to deny them any meaningful voice in determining the future governance of the college sports industry. The settlement also ignores important questions in terms of implementation, including the role of Title IX on proposed revenue allocation. This article explains why, even in the proposed new era of intercollegiate sports, there remain bona-fide anticompetitive concerns pertaining the NCAA's rules, as well as meaningful concerns pertaining to the future representation and voice of college athletes.” The paper goes on to analyze the current antitrust cases facing the NCAA, the employment cases facing the NCAA, unsettled Title IX issues and other factors complicating the House settlement. It also offers four “better alternatives to remove anticompetitive restraints in college sports,” including a true free market approach, a competitive conference approach, a labor union approach and an athlete equity approach. “The true free market approach is a superior way for allocating college sports revenue to the athletes than the proposed House settlement approach for at least four different reasons. First, to the extent one believes that the fair market price is the free market price, all college athletes under the free market approach would receive their ‘fair’ wage and not some wage designated through ad hoc mechanisms. Second, a true free market approach would obviate NCAA member colleges’ potential liability under federal antitrust law because schools would no longer be colluding to fix athlete salaries.” Full paper. Florida names UF General Counsel/VP Amy Hass as Deputy AD/SWA. Hass has served in the university’s general counsel’s office since 2006. The Gators also announce that Deputy AD Chip Howard has been named COO of the department. Howard will work closely with Gators AD Scott Stricklin with oversight of all internal units. Additionally, UF has promoted Assoc. AD for Operations and Facilities Lindsey Thomas to Senior Assoc. AD. In addition to Thomas' current oversight of Operations, Facilities and Lacrosse sport administrator, she will now also be responsible for Championships, Concessions, and Volleyball sport administrator. Asst. AD for Sports Health Dave Werner is also getting a promotion. Werner takes over as Senior Assoc. AD for Men’s Basketball. Senior Assoc. AD Mike Spiegler, who has administrative oversight of Bostick Golf Course, Aviation, Equipment Staff, Gator Sport Shop along with both golf, swimming and diving programs, will now also oversee both Gator Boosters and Information Technology within the department. CBS’ Gary Parrish and Matt Norlander return with the Candid Coaches series in which they survey over 100 DI men’s basketball coaches ranging from high-major HCs to small-school ACs. To start, they ask: “What is the most amount of NIL money somebody has asked you or your staff to pay for a player?” 10.4% of respondents indicate they’ve been asked for $2M+, 40.6% say between $1M and $2M, and 49% say less than $1M. Parrish clarifies that “among the power-conference coaches we polled, the main thing you need to know is that a whopping 77% of them told us their staff has been asked to pay at least $1M in NIL for a player. Does every power-conference transfer ask for that much money? No. Does every power-conference program pay that much money? No. But what the results of our poll showed is that impactful transfers at the high-major level are indeed routinely asking for at least $1M to enroll. What they're actually getting to enroll is another story.” The highest figure cited by a coach was $5M. Parrish also explains that more than 75% of the coaches who answered “less than $1M” work outside of the Big Ten, SEC, Big 12, ACC and Big East. One coach on how the going rate is increasing rapidly: "The same player who got $50K a few years ago is now getting $200K – and the player who got $200K a few years ago is probably asking for a million (now) and nearly getting it. I used to have a good NIL package. About $2.5M. That used to be good. But it's nothing now compared to some SEC and Big 12 schools. I swear some schools are spending $6M or $7M in the transfer portal. We can't do that at my place. But that's about what it takes now." More. (link)

Extra Points publisher Matt Brown believes Northern Arizona’s rollout of the Astrojacks alternate moniker and Blouie the Space Ox mascot “isn’t just a goofy one-off promotion. I actually think it’s a strategy that can be scaled and replicated across mid and low-majors to bring in actual money. If you are a dominant program that perennially competes for national championships, you’re going to be able to sell tickets. I don’t want to say that folks at Ohio State football or Duke basketball don’t have to try to move tickets or find sponsorship partners, because I know they do…but on some level, there is an understanding that you could just throw the doors open and lots of people are going to show up. Northern Arizona is not one of those programs. Most schools in DI aren’t. They do not have the ticket and promotional model of most major professional sports teams. The value proposition to watching Big Sky college basketball, Southland football or MAC baseball is closer to that of minor league sports. … If minor league ball clubs want folks to show up, they know they have to be prepared to stand on their head a little bit.” Opening up this new revenue stream comes with challenges, though, as Brown notes that “existing apparel contracts, retail distribution channels and minimum orders will make it very difficult for most mid-majors to produce a one-off alternate uniform package to sell in the bookstore and local athletic apparel shops. But I don’t think there is anything stopping NAU from, say, auctioning off the uniforms at the end of the season. Split the money with an NIL collective, use them as flagships for a donor silent auction, make them a grand prize attached to donor points, etc.” (link)

Colorado has teamed up with Aflac to unveil custom headsets for coaches this football season. According to Learfield, Buffs HC Deion Sanders “will wear eight unique headsets throughout the season, designed to coordinate with his team’s helmets and prominently featuring the Aflac logo. Each headset was meticulously created to match the Buffaloes’ on-field uniform combination every week so Coach Prime’s game looks will be in sync with his players.” The multiyear expanded partnership between CU and Aflac is overseen by Learfield’s Buffalo Sports Properties. Dr Pepper’s Fansville returns for a seventh season and has released an ad featuring Texas QB Quinn Ewers as Brian Bosworth’s deputy and a sign-stealing reference. Ryan Lehr, the chief creative officer at Deutsch LA, the ad agency that has the Dr Pepper account, says of Ewers: "Quinn was so eager, so fun getting to know. We kind of met with him in the trailer and gave him the 101 of what was going to happen. The one thing about these high-level athletes is they are no stranger to high-pressure situations. … It's like him and Bosworth as a comedy team. We did challenge Quinn a little bit more. In the past maybe [DJ Uiagalelei] was just sort of playing himself. Bryce [Young] was playing himself. We thought it would be a good opportunity to be more of a character." (link, link)

Incoming Houston AD/then-New Mexico AD Eddie Nuñez sat down with AthleticDirectorU’s Tai M. Brown to share how challenges such as Hurricane Katrina and the pandemic honed his difference maker mindset. Nuñez walks Brown through his thought process of moving football out of state to compete during the pandemic and reflects on the value of relationships when navigating difficult decisions. He also discusses how he defines success and identity in the context of his job title: “I want to make a difference – that’s what we all do this for. It’s about our student-athletes and what we can do to make a difference. Whatever aspect or ability they give us to do so, we want to make it happen.” On achieving a work-life balance and shielding his family from the inevitable criticisms that come with being an AD, Nuñez says his family “has learned to tune it out because they should. But I also try to separate myself if I know it's not a good conversation so that they don’t have to experience it because that's not that's not their life, that's my life. And, yes, they're part of my life, but I want to make sure that they understand that when we're together [as] a family it's family time. So, we’re never off, we're always on, the balance is never perfect, but they know I'm 100% my family comes first. And if something is not right with the family, everything else gets pushed to the side. I think anyone hopefully has that perspective of life.” More. (link)

Houston President Renu Khator tells PaperCity’s Chris Baldwin that “I want to see our budget double for athletics. That’s not something we’re going to be able to do on the backs of our students. We won’t do that. It’s not something we can do with just our donors and alumni. It’s something that’s going to take tapping into all the corporate resources out there in Houston and nationally, building bridges in this city the likes of which haven’t been built before, crafting unique partnerships, being creative and innovative and never giving up. I believe [incoming AD] Eddie [Nuñez] can help get us there, take us to a new level at a critical time in the history of college athletics and this university.” Khator says she could feel Nuñez’s passion relatively early in the AD search, “but I held my judgment. I kept an open mind. I continued to talk to him. I’d reach out and ask him how he’d handle an issue we’re facing or how he’d resolve a dilemma presented by the drastic changes college athletics are undergoing.” UH Board of Regents Chair Tilman Fertitta adds: “He’s been at the biggest of the big athletic schools and at private schools. All the experiences he’s had give him a unique perspective. He looks at things in different ways to find a solution. That helped set him apart. We wanted somebody who had something different to offer. At the same time, he’s still been an AD for seven years. He’s been a boss.” (link)

Oregon State President Jayathi Murthy visits with JohnCanzano.com’s eponymous publisher to discuss the Pac-12’s strategy moving forward, the TV deal with The CW, branding and more, including this about Pac-12 Commissioner Teresa Gould: “The thing that really surprised me about Teresa is how quickly we got to a place of trust very, very quickly. I mean, this was literally weeks in, we were able to talk to each other in complete frankness. I will say anything I want to her. I mean, I don’t hold back. And the same is true of [Washington State President] Kirk Schulz because we’ve been in this cauldron together. … She proved herself. I mean, you saw how she handled the whole College Football Playoff negotiation, just moved it from $300K to $3.6M. I mean, that took a bunch of doing. She does it subtly. She’s built relationships. She’s got good relationships with the other commissioners, a good relationship with us.” While there’s no specific timetable, Murthy acknowledges there is urgency for the Pac-12 to pick a conference realignment path and explains that fans “should also know that we are not risk-averse. I mean, I hope they know that from the way we handled this crisis. We’ve not just sat around and let things be done to us. We take risks. We’re willing to play the game a little more toughly than people might expect. And we’re doing that. And all of that is playing out underneath. I can’t talk about it. More from attorneys on both sides of the House settlement, who last week filed briefs with U.S. District Court Judge Claudia Wilken rebutting a recent spate of objections. NCAA/Power 4 conferences’ attorney Rakesh Kilaru argued that 97% of DI programs “have expenses that exceeds their revenues when excluding universities subsidies,” that at most schools, football is the “only program” that generates “positive net revenue” and that schools “vary dramatically” in “level of individual benefits,” but schools still offer scholarships and additional benefits to athletes other than the football players. Sportico’s Michael McCann notes that Kilaru “implies the settlement might not be perfect but maintains it is a logical arrangement for addressing a highly complex fact pattern. To that end, Kilaru blasts the objectors’ counsel for–he says–failing to provide ‘a working economic model capable of determining whether and which student-athletes at each of these hundreds of schools would have been injured’ or ‘even describe how one could be generated.’’ Also from McCann: “Even if the settlement gains final approval, that wouldn’t prevent other antitrust lawsuits. The settlement terms haven’t been (and can’t be) collectively bargained with a players’ union, which itself can’t exist unless and until college athletes are recognized as employees. But the attorneys involved in the settlement can’t yet worry about complications that might later surface. They need to first get Wilken to grant preliminary approval. That’s the first play in their legal playbook.” (link)

Oklahoma State AD Chad Weiberg in remarks to donors last week noted the Cowboys’ finish in last season’s Learfield Directors’ Cup standings. “We finished No. 19 and that is the fourth consecutive year we have finished in the top 25. If you look at the other schools that are with us, it is the elite brands in all of college athletics. We believe we are an elite brand in college athletics and we belong in that group. … Only one school last year in the Big 12, as we knew it, finished ahead of us and that is the school down south, the University of Texas. They have lots of resources and a great athletic department. They finished first, so kudos to them.” As the Pokes get set to begin the football season after appearing in two of the past three Big 12 title games, Weiberg believes: “You are seeing the maturing of a fanbase. I knew it was our fans buying the tickets and filling our place. This year without Oklahoma (Bedlam) and Texas on the schedule we have sold out of every football ticket earlier than it has ever happened before. Our people did that.” On the $55M renovation to Boone Pickens Stadium: “We don’t have the biggest football stadium in college football. We will probably never have the population center where we will need the biggest stadium in the country. Our goal is to have the nicest football stadium in college football in the country. I think we are well on the way there if not there already.” (link)

Stetson AD Ricky Ray camps with WKMG’s Ryan Welch to discuss his first few months on the job, his leadership principles, where the Hatters fit into the changing landscape and more. Ray notes that “in the NIL space, we’re not going to be six-figures and handing those types of deals out. What we’d like to do is compete with those that are trying to pull kids away. If we can do well enough in the NIL space to retain our students, I think that’s a win.” Ray also points out that student-athletes transferring doesn’t send up red flags the way it may have before. “There may have been something wrong. There may have been an issue with the program or the institution or whatever, and now it’s strictly a business decision.” Phase 1 of the multipurpose Edmunds Center renovation is complete, and Ray explains that in addition to new locker rooms, the focus was on the fan experience with an improved look in the lobby, upgraded bathrooms, a new sound system and new seating, among other updates. “People don’t care how much you know until they know how much you care. … The ability to be kind, the ability to have empathy, the ability to want what’s best for people costs nothing. In a world where we need to talk about how do we find more staff, how do we resource the staff appropriately, being kind and being supportive is not something that shows up on a balance sheet in a negative way.” That’s Virginia Tech Executive Associate AD for External Affairs and Advancement Brad Wurthman in conversation with AthleticDirectorU’s Steph Garcia Cichosz. Wurthman breaks down his empathetic leadership style and discusses his methods for empowering his team to push boundaries, embrace change, temper ego and prioritize personal balance: “Leadership, if I could distill it down for me, it’s the ability to know when do you press, when do you need to say we’re not in gear and we need to kick it up, and when do you pull someone aside and say, you’re doing great.” When meeting with team members who have different viewpoints, Wurthman emphasizes that it’s “more important to get it right than it is to be right…especially when we end up in a conversation that’s heated, which I don't want to make it seem like it's never heated – it's a very often heated. But it's heated with the focus on Improvement. It’s not heated in terms of, ‘Hey, your idea is terrible, mine's better.’ It’s heated on what is the best available idea and so my job in that space is to help the voices be heard to ultimately – if we need to – break the tie and make the call. More from Puck’s John Ourand and Matt Belloni, whose conversation focuses on the migration of sports from linear to streaming platforms, and Belloni predicts that “eventually we won’t even be talking about sports on linear. They will all – or the major sports will – migrate over to digital and to the streaming services. I don't know what the timeline is for that. My guess would be in the next NFL deal in the late 2020s or early 2030s that we will see that, but in the meantime we are in this awkward transition period where sports is all over the place and you’ve got to subscribe to so many different services to get it all and these companies are desperately trying to make it easier for the consumer while not destroying their own business. And that has proven elusive so far. We're seeing these digital bundles, this Venu service that's coming. … You’re seeing Netflix put its toe in the water. They were very adamant that they don't want live sports, don't want live sports, well, lo and behold, they do want live sports. They just don't want to pay for a traditional package, so they're just going to put their toe in the water and have some Christmas Day NFL games.” Belloni also points out that Apple+ “had 0.2% of viewership on connected TVs last month,” according to Nielsen. “That’s below all of the majors. That’s competing with, like, Discovery+ and some of these very niche services, and Apple is spending real money to generate original content on this service. It’s just not that many people are watching, so when you're working with these sports leagues, they want to know not just that you're going to pay them a lot of money, but that people are going to watch. And for the most part people are not watching stuff on [Apple], which is bizarre because it’s the world’s largest company and they have phones in everybody’s pocket.” More, including why Belloni believes Netflix is in the “experimentation” phase of adding live sports.
