The Inside Zone’s Matt Fortuna reports a “pending federal case alleging violations of the Trafficking Victims Protection Act and Title IX against Northwestern, former AD Mike Polisky and three other defendants was dismissed Tuesday with prejudice and without settlement by a former NU cheerleader.” Polisky: “This dismissal is vindicating and over three-and-a-half years in the making. The Plaintiff voluntarily dismissed this case with prejudice and without a settlement. Her allegations of human trafficking and other unethical behaviors were meritless and never should have been filed. … I’m relieved that these allegations are now behind me and I can return to a life and career with my reputation intact”. House plaintiffs’ counsel Jeffrey Kessler joins the Now It’s Legal podcast with Athletes.org Co-Founder Jim Cavale to discuss the pending settlement and says: “I think there are four things schools have to figure out. Number one, are they going to fully fund it? Number two, how are they going to split up the money per sport? I would include scholarship and benefits in that, Alston, all that. Number three, how are they going to split up the money per athlete? Because they don't have front offices that are going to negotiate 500 different deals with 500 different athletes. And number four, what are the terms in the contracts that they put together? … If I were an athletic director, I would want to partner with my athletes. I would want to hear their views and include them in the process. For two reasons: One, because if you do that, you're going to make your school much more attractive to those athletes. Two, it's the right thing to do. These are benefits you're giving to the athletes, and you're dividing them up, so you should have that interest. If you do that, you're less likely to get sued over Title IX or something else in the future.” Kessler goes on to note that a feature of the system House proposes to put in place is that “competition will ultimately decide outcomes…and ultimately, you're going to get an outcome where, as I said, you either go along or you're not going to be part of it. You'll get some who resist at first, but that's not going to last a long time if they want their programs to be successful. … The ones who don't like that will either change or be changed.” Cavale adds: "It's almost like a daily survey when I'm talking to different ADs. Some completely agree with what you just said, and that's why we're talking. They believe Athletes.org can organize their athletes and help educate them so that athletes can then be team reps for each team, sit at a table, and vote on a deal. Then there are other athletic directors who think that's the furthest thing from what they would ever consider dealing with. So it's a pretty mixed bag." (link)

Non-Power 4 commissioners have for the most part decided to support the House settlement proposal and have no formal plans to object, according to Front Office Sports’ Amanda Christovich. WCC Commissioner Stu Jackson, for instance, says: “I am thoroughly convinced that the notion of settling versus not settling … that settling is the best option—and President Baker has made that very clear. The alternative could have effectively destroyed college athletics.” Southland Commissioner Chris Grant adds: “A settlement had to happen. We wanted the settlement to happen. We’re going to move forward and not cry over spilled milk.” Mountain West Commissioner Gloria Nevarez points out the settlement has several benefits, including the ability to pay it over time and sharing revenue with student-athletes. “The financial hit—it does impact us. Michigan plans to pay $23.5M in revenue-sharing with student-athletes next year, according to Wolverines AD Warde Manuel, who says U-M is “not going to cut sports,” but “there are going to be some difficult choices" about reducing expenditures across 29 sports. Manuel also tells The Michigan Insider’s Sam Webb that when it comes to NCAA cases, "We're going to fight when we need to fight. ... But we have a responsibility to adhere to rules that we agreed to participate in." Manuel on former Football HC Jim Harbaugh: “It's not that we didn't have our differences. We did. But the sense of people out there is dead wrong about me not wanting Jim Harbaugh. ... We did a lot to try to keep him. The Chargers did a lot to bring him to the NFL." (link, link, link)

Connecticut “raised and spent about $100K last [football] season through NIL efforts,” according to the CT Post’s Mike Anthony, who notes: “This season, the number is up tenfold to somewhere between $1-1.25M.” Huskies AD David Benedict tells Anthony: “We’re going to double it next year, at least. We’re going to pour gas on it. We’re going to win in football. I’m tired of being disrespected as a brand, nationally, because of football. And I get it. But the difference as we sit here today is we have NIL and revenue-sharing now. And before, when we were a BCS affiliate with the old Big East, we could recruit differently. When that went away, it really impacted this university in a way that is probably unique because of the location. There are very, very good recruits here. But there are a limited number. And they all go, if you look at the top 10 every year, there’s one thing in common — all of them are going to power [conferences]. Whether NIL and revenue-sharing will help us keep some of those kids will be determined, but we can recruit in a totally different way. … The reality of a year ago is, there was no emphasis on it. There wasn’t a plan. It was still something that, collectively, everyone was trying to figure out the best approach with. Last year, we made a decision that this was something we had to get in the business of and we quickly were able to organize and have people lead an effort that aggregated resources that put us in the very top echelon in the Group of 5.” Anthony notes the Huskies spread more than $1M into the hands of 20-plus football student-athletes this year and would like to increase that figure to $2-3M spread among roughly 40 players. Syracuse AD John Wildhack met with the media to discuss the advancements made to the JMA Wireless Dome, NIL, the upcoming football season and other topics and said of the Orange’s NIL efforts: “We’ve made great progress. Over the past nine months, we have had more businesses, local businesses, step up in a meaningful way. … We need that corporate support. That’s going to enable us to have a competitive NIL program. Because if we do, you can see the results. If you don’t have a competitive NIL program, Kyle McCord is not here. Fadil Diggs isn’t here. Some of our veterans who returned aren’t here.” He adds of revenue-sharing: “I’m not going to commit to a specific number yet today, because we’re figuring this out. We spend a portion of every day on it, in terms of various modeling and scenario planning. But we will be competitive.” Wildhack on the JMA Wireless Dome renovations: “It looks like a totally different building. It looks great, and I can’t wait for our fans to experience it.” For football games, the dome’s capacity has decreased from 49,057 to 42,784. The student section will be switched from the section 102 area to the east end zone, a 500-seat increase. Student season tickets are already sold out, but the Orange are exploring additional single-game ticket options for students. (link)

Utah AD Mark Harlan joins the Hans and Scotty G. Show to discuss several topics, including the move to the Big 12, about which Harlan says: “All of it came together in this moment in August, when we got the official entry date. I feel like we’re a really good match. I feel like our teams are prepared to get in and get after it.” He contrasts the Utes’ move to the Big 12 with their transition to the Pac-12 and says the latter was a “huge step up in budget, and obviously, we go in with equal shares and we go in with a pretty healthy budget in the Big 12. Going from a Power Four to a Power Four doesn’t make it easy, but certainly a whole different level of preparation than what we had to go through 12-plus years ago.” Harlan says Utah continues to enhance its NIL capabilities: “The football situation has really grown. But we had a gigantic gain in men’s basketball this last year, in terms of NIL around the team, which really helped us get this next group of young men in. The Crimson Collective played a significant role in getting the ball rolling. It seems though that changes are on the horizon but ones that will put the responsibility on the programs and universities themselves.” Harlan also addresses the “true NIL” component of the House settlement and believes it is “going to have some real teeth in terms of enforcement. We’re waiting to see how that plays out. The rules now that we’re seeing, the ones to be taken seriously, are the ones that should be. Significant tampering type allegations, and or NIL contracts that are pay for play i.e. contracts that maybe include how many touchdowns you score, those kinds of things.” (link)

Following Colorado’s loss to Oregon last season, CU football staffers “identified multiple potential incursions into the team’s online service that stores practice video and other data,” according to Front Office Sports’ A.J. Perez, who reports Buffs HC Deion Sanders was involved in the initial outreach to the Pac-12 about the matter, in which CU alleged UO played a role in the unauthorized access. A source tells Perez that “conference officials reached out to Colorado’s athletic department and administration to seek more information and to determine whether the school wanted to pursue an investigation—one that potentially could have led to an FBI probe if any illegal incursions occurred.” Meanwhile, Catapult conducted its own review of allegations of improper access last fall and found “the security of [Catapult’s] systems was not compromised.” CU backed off and did not provide evidence that UO or anyone else was involved in an alleged incursion. The Tampa Bay Times’ Matt Baker examines the USF football stadium construction contract and points out the “document calls the final price tag a guaranteed maximum price, or GMP. The figure is still blank. Trustees will have to sign off on the final cost. If USF and the builders can’t agree, the school has the right to cancel the contract. USF can also cancel the deal after the maximum price with 28 days’ notice. USF’s construction budget is listed at $324M. There’s also $16M listed for general conditions: about $14.6M for labor, $934K in non-labor costs and the rest for worker’s comp.” The stadium is expected to be complete in time for the 2027 season, and if it’s not, the builders owe the Bulls $2M for every game it’s unavailable. USF must make its final payment within 30 days of completion, and the deal includes a 12-month warranty for the construction company to correct any issues. Also from Baker: The Manhattan Construction “build team wants to expand its ties to USF sports, including female athletes to ‘increase opportunities in construction for women.’ Relationships with current players could lead to internships or careers and, ‘to the level of the University’s desires,’ name, image and likeness (NIL) deals.” (link)

Everett Sports Marketing (ESM) has facilitated $4.3M in cash NIL deals for Georgia football players in 2024 alone, according to On3’s Pete Nakos. ESM, which represents UGA QB Carson Beck, cornerback Malaki Starks and tight end Oscar Delp, along with 12 others, declined to indicate how much of the $4.3M in NIL deals was generated by Beck, but Nakos reports the “majority of the dollars have landed with Beck, Starks and Delp.” (link)

ESPN has launched the “Where to Watch” feature on its website and mobile app to show fans where they can watch any sports event on ESPN platforms and beyond, including broadcast, cable and regional sports networks and streaming services. The service includes one-click access to ESPN network streams for pay TV authenticated users and ESPN+ subscribers. Beyond just ESPN, fans are also linked directly to select partner networks, which currently include NESN and Monumental Sports. (link); According to CNBC’s Alex Sherman, further one-click media partners have yet to be determined and there’s no timeline on when such a feature would launch for games outside the ABC/ESPN family. Also from Sherman: “While the business terms of the concept could still change, ESPN has considered a model in which it would take a cut of subscription revenue from a user who signed up for a streaming service through the ESPN app or website. … If a customer already subscribes to a given service, ESPN would collect no money and just provide the link as a courtesy.” Furthermore, Sherman observes ESPN’s “willingness to promote other streaming services suggests a strategic shift in the streaming wars. Disney is less focused on gaining streaming subscribers — and eyeballs — at all costs. Company executives have emphasized they want investors to prioritize revenue and profit rather than subscriber growth.” (link)

George Washington yesterday formally introduced new AD Michael Lipitz, who remarked that given all the changes happening across the industry, “we have to be nimble, we have to be innovative, and as the landscape continues to evolve, we have to participate to the fullest extent possible to ensure that our student-athletes have every opportunity to succeed in and out of competition, and that our teams have every resource they need to compete at the highest level." Lipitz also promised that “we will aggressively pursue a culture of competitive excellence. GW competes for conference titles, year in and year out, in multiple sports, and in all of our fully resourced programs we do expect to compete for A-10 titles and earn NCAA Tournament bids. Our flagship men's and women's [basketball] programs have rich tradition and history – a combined 29 NCAA Tournament appearances. Championship basketball is very much in our DNA. We embrace the expectation to compete for titles and play deep into March." (link)

The Pittsburgh Post-Gazette’s Jason Mackey argues Pittsburgh Chancellor Joan Gabel must find a way to retain Panthers AD Heather Lyke: “Lyke has done her part. Now, it’s on Pitt and Gabel to reciprocate, to give Lyke the resources necessary to succeed while also challenging and supporting the longtime college administrator to help the Panthers reach new heights.” Mackey goes on to observe that “if desire was enough to get this done, that would be great. But I think it’s probably deeper than that. There are likely a variety of factors at play, the biggest one probably being money and whether Pitt can convince Lyke it’s ready to become a bigger player on the national stage. … Nobody should be surprised there’s interest in Lyke, who in 2023 was named by the National Association of Collegiate Directors of Athletics as one of its Cushman & Wakefield AD of the Year Award recipients. The Sports Business Journal also named her a finalist for its Athletic Director of the Year.” Mackey adds: “Look across the state and the steps Penn State took with [AD Patrick] Kraft, refusing to let him leave. Whether her contract is indeed up or not, it should be time for Pitt and Chancellor Gabel to do what it takes to keep Lyke around, giving the university a chance to continue the athletic ascent that was triggered by her arrival.” (link)

TCU AD Jeremiah Donati met with the media yesterday to discuss the House settlement, conference realignment, revenue sharing, scholarships and more and says the Horned Frogs’ plan is not to add new scholarships but to potentially reallocate them. “We’re going to be focused primarily on putting that $21M of rev-share in the hands of the players.. … We understand that does not guarantee championships, it does not guarantee wins, but it's a way in which we think that we can be competitive across the board here with the programs that are going to share in that. I think it's probably reasonable to assume that the sports that generate revenue are going to participate in that.” Donati says TCU has six programs that generate revenue, “so we think that program probably makes the most sense. Let’s be honest about why we’re here. It’s been a football and men’s basketball issue. I’m not advocating that they get all the money. I don’t think that’s fair, but I do think it should be commensurate with what the programs bring in.” In regards to roster limits, Donati notes that student-athletes need information sooner rather than later. For instance, there are around 130 players on the football team right now, which means at least 25 can’t return next season. “What does that look like in how you run your program?” In baseball, TCU will have to trim the roster from 44 to 34 and figure out how to add scholarships above the 11.7 limit should they choose to do so. “I wish we had a longer runway. I think for the most part these are the right decisions. I wish it didn't come from a settlement; I wish we could go back 25 years and find a more elegant solution to get there, but we've got to figure out a way to create a new business model in more or less six to eight months.” More from Donati, who says there are no plans to eliminate sports; “however, they’re probably going to look different.” (link)

Oregon State AD Scott Barnes Q&As with The Oregonian’s Nick Daschel and says OSU and Washington State are “really close to resolving” the 2025 football schedule. “In the next few weeks, I’d say is where that sits. But, you know, making progress every day.” Asked if it’s likely to be a continuation of the partnership with the Mountain West, Barnes says: “To be determined. Certainly, it’s a strong option.” Barnes says as recently as a year or so ago he would have opposed bringing NIL in-house, “but given the runaway train that NIL has become, I believe the only way to bring any sort of consistency and tamp down the improprieties that are occurring is to bring it in-house and regulate it more. One of the pieces of this House settlement is it calls for strong enforcement. They don’t know what the enforcement mechanism is yet, but we need one, and we need one badly. So bringing in-house, I am now an advocate of we will do that. It doesn’t mean we won’t still have an outside collective, but we will have inside NIL. We’re adding staff as we speak to help manage NIL.” Barnes on renovations to the multipurpose Gill Coliseum: “In our facilities master plan, one of the next items up is the field sports building. That would house our men’s and women’s soccer programs, track and softball and cross country. That would free up space in Gill to start to reimagine what it would look like. We have made significant progress on the lead gift for the facilities project, which is $25M. We will embark on a campaign for that this fall. With the additional space in Gill, we start to reimagine in terms of fan amenities and revenue generation.” More. (link)

ESPN’s SVP for College Sports Programming and Acquisitions Nick Dawson talks with SBJ’s Ben Portnoy about the networks’ expectation for increased exposure this college football season: “There's no doubt there's depth of TV brand strength with those [Oklahoma and Texas] in the fold. [That] creates more weeks where, at least on paper, going into the season, you look at it and say [there are] one, two, three, maybe even sometimes four games that you would say, ‘That's a high-quality TV matchup from a brand-versus-brand perspective.’” ESPN plans to stagger kickoffs throughout the day between its main cable channel, SEC Network and ABC to allow fans to watch SEC football all day if they wish, and Dawson notes: “We looked at it and felt like if we could do something slightly different with SEC Network, that would allow opportunities for halftime live look-ins across networks and things like that. When things are staggered, you have live action all day long.” Dawson also talks about the Big 12 and ACC matchups that will air in the late-night window: “You'll see some new schools and new brands show up in that window based on them being a road team in those games that haven't had that experience before. And it's a nice opportunity for those schools to continue to build brand awareness and build following just given the ‘only game on’ nature in that window that we've seen over the years.” (link)

CBS’ Isaac Trotter unpacks the growing number of GMs in men’s basketball, where staffs are beginning to look more like NBA front offices. Trotter notes there are “values to be had in the transfer portal, and general managers can help uncover them with data-based analysis, an eye for scheme-based fits and on-point, behind-the-scenes intel. Dalton Knecht, the reigning All-American, was not Tennessee's highest-paid player. Marcus Domask didn't cost a fortune for Illinois in the transfer portal last summer, but the Southern Illinois transfer turned into one of the best value gets in the cycle after he put together an All-Big Ten campaign.” Trotter also points out that even staffers whose title doesn’t include GM are increasingly performing GM functions. For instance, Trotter notes of Kentucky AHC Mark Fox, who spent last season as the director of student-athlete relations and NIL partnerships at Georgetown: “Fox might not have the GM tag next to his name at Kentucky, but make no mistake, he's expected to help [Wildcats HC Mark] Pope with more than just pick-and-roll defensive coverages.” Trotter goes on to highlight several notable GMs and the “under-the-radar moves that they helped put together in the 2024 transfer portal cycle.” The list includes Duke’s Rachel Baker, BYU’s Doug Stewart, Villanova’s Baker Dunleavy, DePaul’s LaVall Jordan, Michigan’s Kyle Church, Arkansas’ Chris Woolard, Texas Tech’s Kellen Buffington and Baylor’s Jason Smith. Connecticut Governor Ned Lamont says he will defer to UConn AD David Benedict on whether to pursue Big 12 membership, adding: “Obviously there is an enormous realignment of these leagues and you don't want to be left behind. I understand where they are coming from there. TV revenues are important as well.” According to reports, UConn would be expected to invest more in football before it could join the Big 12, and Lamont remarks: "I think that UConn’s got to set its priorities. They have one of the biggest grants per capita of any state university in the country. So rather than ask the taxpayers to do a little bit more…but let me see what the proposal is coming in, there may be a private/public partnership that makes some sense in this, as well." Meanwhile, U.S. Senator Chris Murphy (D-CT) yesterday wrote on X: "I’ve always believed UConn should stay in the Big East. Our athletes and fans have a great regional conference that clearly works for our highest profile sport, basketball. Chasing football relevance is a mistake. We will get burned." (link)

DePaul unveils updates to the Sullivan Athletic Center and McGrath-Phillips Arena. The modernized spaces feature new team-specific locker rooms, enhanced recovery, sports medicine, and sports performance spaces, as well as the addition of dedicated recruiting spaces and modernized arena amenities. Private Equity in Sports…
+ NFL owners approved a new policy that will allow them to sell up to 10% of their teams to a select group of pre-approved private equity firms. The league’s initial list of approved firms includes Arctos, Ares Management, Sixth Street and a four-member consortium made up of Blackstone, Carlyle, CVC and Dynasty Equity. The Wall Street Journal’s Andrew Beaton and Miriam Gottfried: “It seems inevitable that the list of approved firms will expand. Under the rules, each group is allowed to buy stakes in up to six different clubs—so Arctos could own pieces of both the Kansas City Chiefs and the San Francisco 49ers, for instance. But with only four groups set for initial approval, there wouldn’t be enough to cover all of the league’s teams even if each firm hits the limit. It may also be necessary to expand the pool of approved buyers to create a big enough market for stakes when time comes for the original buyers to exit. The only team that won’t have this new option available is the Green Bay Packers, which has a unique community-based ownership structure.” (link)
+ ESPN’s Michael Rothstein adds that “funds are capped at investing in a maximum of six teams, and the minimum investment for institutional wealth in any franchise is 3%. If a fund buys into a team, it must hold onto the investment for a minimum of six years. Funds must have a minimum of $2B of committed capital to invest and a maximum of 20% of a fund's money can be invested into one team. Team owners or their immediate family members may invest up to 3% in a fund. Any ownership changes still need to be approved by a three-fourths majority of teams. … Sovereign wealth funds – such as the Qatar Investment Authority, Saudi Arabia's Public Investment Fund and the wealthiest sovereign fund, the Norwegian Government Pension Fund – are not allowed to invest into teams directly. They can, though, own part of an approved fund. No individual or single investor (including a sovereign wealth fund) may own more than 7.5% of any fund.” (link)
