+ NCAA President Charlie Baker today wrote in a letter to the membership: “Last night’s hearing did not go as we hoped. The court posed worthwhile questions that the NCAA began working through immediately last night with our partners in the conferences. … Our next step will be responding to the court’s questions. As we prepare to do that, we will discuss the issues with the appropriate NCAA governance groups, including student-athletes and campus and conference administrators. Regarding the Fontenot and Cornelio lawsuits, we are advocating to address these claims, which are the same as the ones at issue in the House, Carter and Hubbard cases. However, the Colorado cases are being litigated by different plaintiffs’ lawyers from those in California. Our belief is that either the federal judge in California or the federal judge in Colorado will recognize the duplicate claims and view the settlement to have addressed the student-athlete claims in all cases." + In response to an unnamed power conference president who told Yahoo’s Ross Dellenger last night that “there’s no reason to settle under these circumstances. Go to trial and take our chances on appeal,” Heither Legal Founder Darren Heitner comments: “Be careful what you wish for. The NCAA may lose this case on summary judgment.” Sportico’s Michael McCann adds: “This is the NCAA's conundrum. If NCAA rejects a free (or more free) market for NIL, then settlement falls apart and litigation resumes, and NCAA probably loses given Judge Wilken's views. But the NCAA worries NIL has become pay-for-play. If only the NCAA had listened to Ed O’Bannon.” (link)
+ The Collective Association “commends Judge Wilken’s commitment to fairness on behalf of current and future college athletes” and asserts that the “proposed limitations placed on third-party booster and collective deals was exposed as another attempt by the NCAA to take back rights from…college athletes.” The TCA adds: “Moving forward, we encourage stakeholders in Congress and the media to be leery of both the motives and the actions of the NCAA. After their business model was defeated by the U.S. Supreme Court ruling in 2021, the NCAA seems to have made its primary mission to 1) place blame for their inability to continue their illegal business practices at the feet of every other party, athletes and collectives included, and 2) to claw back power, with a goal of limiting opportunities for athletes to realize their true value in the marketplace.” Full statement. + Charlie Winfield, founder of the Mississippi State-focused Bulldog Initiative, tells CBS’ Brandon Marcello that leading up to yesterday’s hearing, “it feels like a lot of people in college athletics read the marketing literature on this settlement. They wanted to be rid of collectives, they wanted it to go away, and they just kind of kept hoping they could write it into a settlement, but it still faces the same legal hurdles that brought them to court in the first place, which are the antitrust and anti-competitive aspects. … This was a situation where they thought they could come up with the answers and push them past everybody, and I don't think they wanted input," Winfield said. "I think it's unfortunately part of what has led them to where we are now." Kennyhertz Perry attorney Mit Winter on what he thinks comes next: “If I had to bet, in three years, five years, whatever it is, some college athletes are going to be employees because that's really the only way you can solve all these antitrust problems and actually legally create these restrictions that they want to create, like we see in pro sports.” (link)

Purdue AD Mike Bobinski last week weighed in on several topics with GoldandBlack.com’s Alan Karpick and said of conference expansion: “I think, just out of necessity, and with all the other elements that are in play right now, that it’ll be quiet for a period of time. From the Big Ten perspective, the only way it would ever make sense for us to be something other than 18 teams would be if someone can come in that adds clear and unquestioned value to the table. … and there are very few of those that exist in the landscape right now, period.” Bobinski also said – obviously before yesterday’s House settlement hearing – that objections to the settlement for various reasons “are, in my opinion, short-sighted and don’t really take in the entire picture. But that’s for the judge ultimately to decide if, in fact, those challenges are deemed to be not worthy.” In regards to football scheduling, Bobinski said the Boilermakers would like to “work it to where we maybe have a Group of 5 and FCS and then a Power Four team as sort of our lead-in to our year. It’ll take some time. We’re not going to bail out on a bunch of contracts, unless there’s a mutual interest to walk away from future games or series. And that, I think, is something that you never know. … Nobody thinks three layups is a great idea. When you’re getting ready to play in the Big Ten, you’ve got to be tested. You got to know what it looks like to play against real people. That being said, you want to come out of it in a reasonably confident and healthy way to the best of your ability. And so having some more balance, I think, is the plan going forward.” (link)

The ACC “provided its clearest defenses yet” in its legal battle with Florida State via a 162-page court filing in Leon County, Florida, according to the Tampa Bay Times’ Matt Baker, who explains: “Most of the technical arguments fall into two larger buckets: The first is time. The dispute largely centers on who owns the TV rights to FSU home games if/when the Seminoles leave the ACC. FSU wants them, but the ACC contends the school gave them to the league until as late as 2036.” The “second defense bucket focuses on a previous conference realignment lawsuit: the ACC’s suit against Maryland. That dispute started a dozen years ago as the Terrapins were moving to the Big Ten. The settlement ended with the ACC keeping $31M from the school.” The ACC points out that FSU was a conference member during that dispute and voted to enforce the exit fee, took their share of Maryland’s money and accepted the “benefit of the stability of the ACC” because of the league’s rules. FSU’s actions, then, per the ACC, “led the ACC to reasonably understand that (FSU) did not contest the validity or enforceability of the withdrawal payment obligation.” The ACC’s filing also requests a jury trial, arguing FSU should “have and recover nothing” through its claim and that the league should be awarded costs in the case plus “further relief” as the court sees fit. The First District Court of Appeal has a hearing scheduled for Wednesday over part of the ACC’s attempt to pause or stop FSU’s suit in Tallahassee. (link)

In South Carolina, the ACC is also requesting a jury trial on “all issues of fact presented by (Clemson's) amended Complaint and (the ACC's) answer." The league also wants Clemson to pay its legal costs and for the Pickens County court to "award such further relief as it deems just and appropriate." Along with a request for a jury trial, the ACC's filing in Pickens County Court responds to Clemson's amended complaint, paragraph by paragraph, admitting to or disputing the university's claims. The 38-page brief objects to many of Clemson's assertions, including the Tigers’ interpretation of the GOR, about which it contends: “Plaintiff was aware that it had an obligation to object to this understanding and interpretation of the Grant of Rights agreements if it disagreed, but Plaintiff nevertheless accepted the benefits created by the Grant of Rights agreements without objection. The media rights granted in the Grant of Rights and its amendment were transferred 'regardless' of whether the Plaintiff remained a Member of the Conference and for the Term of the agreements." + The University of Alabama System Board of Trustees has approved plans for a 48K square-foot expansion near Coleman Coliseum to house a basketball training and player development facility. + Auburn has received initial board approval for a $9M multi-use north endzone facility to “combine premium seating, concessions, stadium support facilities, along with versatile conference event spaces, retail venues, student activity spaces, meeting rooms, as well as future shell space.” Work is expected to begin after the 2026 season. Utah State has unilaterally taken away 1K student football tickets that will now be for sale, according to the Utah Statesman’s Ashley Dorius, who writes: “Students may not be able to attend larger games, such as the upcoming historically well-attended game against University of Utah, without reserving seats. Even if students are given seats leftover after sales, they won’t be with the student section.” USU student/HURD President Dallin Wilson on the possibility of getting the tickets back in the hands of students: “I know that, at least in section 116, they started opening those tickets up to be sold, so there’s no way to get those back. We were hoping that we could retain all of Section 117 for student tickets, and we’ve been told that that’s not possible for the Utah game, and they’ve made no promises about games after that. … The biggest thing that’s frustrating to me and to the student leaders is that the athletic department felt like they could make this choice without approaching any student leaders. There was no one consulted in student affairs or the student involvement office about these changes. I was never officially told. I saw it with my own eyes on Saturday and had to ask in my standing meeting with athletics.” USU has yet to comment on the matter. (link)

House v. NCAA…
+ U.S. District Court Judge Claudia Wilken will not rule on the House settlement following today's hearing and explained she will "throw it back on [the lawyers] to find something workable, something consistent" with respect to the third-party and booster restrictions, adding: "It seems to me likely enough that there will be a settlement, even if there’s some changes to what’s been agreed to so far.” NCAA counsel Rakesh Kilaru subsequently remarked: "Based on your comments, we have to talk about whether we have a deal." During the hearing, Wilken suggested she would give preliminary approval to the Hubbard portion of the case and is "reluctant to stay Fontenot case," while encouraging the NCAA to request the Colorado judge overseeing that case to delay Fontenot. Fox Sports' Bryan Fischer adds: "NCAA counsel says they don’t want to finalize Hubbard settlement without doing House. House plaintiffs say it’s not an issue." Attorneys are scheduled to bring an amended settlement back before Wilken in three weeks. (link, link, link)
+ According to Yahoo’s Ross Dellenger and others, Wilken voiced particular concern over language in the settlement that specifically prohibits school boosters from compensating athletes through endorsement deals, as well as language prohibiting pay-for-play. Wilken is skeptical the NCAA could or should enforce such a rule and told Kilaru: “I think we’ve got problems with this. I don’t have an idea of how to fix this. I will throw it back on you all to come up with something better and consistent. Keep in mind that taking things away from people doesn’t work well.” Kilaru noted that such language is a “central part” of the settlement and told Wilken that “without it, I’m not sure there will be a settlement to submit.” Dellenger also reports: “Kilaru made clear that the NCAA wants all three cases – House, Hubbard and Carter – to be approved or there is no agreement to settle any of them. Hubbard is in the best position to be approved, but the judge, based on Kilaru’s comments, did not approve it.” During the hearing, plaintiffs’ attorney Jeffrey Kessler informed Wilken that plaintiffs and defendants were “not trying to make anything prohibited [in the settlement] that was not already prohibited. This was not designed to eliminate NIL from boosters currently prohibited.” To which Wilken responded: “That may be your view, but I’m not sure that is the NCAA’s view.” After the hearing, one power conference president told Dellenger: “It’s truly madness. There is no reason to settle under these circumstances. Go to trial and take our chances on appeal.” (link)
+ Sportico’s Michael McCann observes that Wilken “also expressed worry about a hypothetical person – ‘a six-year old playing kickball on asphalt’ – who, if they eventually become a college athlete a dozen years from now, will be subject to the settlement. Kessler and Kilaru insisted the athlete would have a voice on settlement terms since new class representatives would be added as the years go on. Kessler also argued that college sports will be better for the six-year-old with the settlement than without since the settlement offers ‘an incredibly improved system with billions of dollars of compensation, no scholarship limits and not having to wait to bring their own antitrust cases,’ which would require many years of litigation.” McCann reiterates that “Kilaru repeatedly told Wilken that his client agreed to a deal as is and is not necessarily willing to move forward with another deal, which presumably would necessitate making more concessions on NIL in order to satisfy Wilken.” (link)
+ According to the AP’s Ralph Russo, Wilken “seemed unswayed by objections raised by a group of female former Division I athletes who claim they won’t receive a fair amount of the damages, which will mostly go to football and men’s basketball players. Wilken said that was a sexual discrimination issue covered by Title IX, but not applicable to an antitrust case.” (link)
+ Kessler tells ESPN’s Dan Murphy that he’s comfortable with Wilken’s suggestion to remove the new language about NIL collectives from the settlement. "We are perfectly fine with those changes. It's now up to the NCAA. Hopefully, they'll agree to them. If the deal falls apart, we go back to trial. If they want to face that, it's a decision they have to make.” (link); Kessler also says he wants Wilken to set a deadline because there's a chance they can't reach a new settlement and the cases go back on the docket, per Sportico’s Michael McCann, who adds: “Pretty stunning development. This NCAA settlement that's been talked about like a done deal now has a good chance of collapsing.” (link)
+ The NCAA says in a statement: “The settlement agreement the NCAA and autonomy conferences submitted to the court was the product of hard-fought negotiations that would bring stability to and sustainability to college sports while maintaining an education-based model that equips hundreds of thousands of students every year with with degrees and tools to succeed throughout their life. That continues to be our goal and the NCAA and autonomy conferences will carefully consider the court’s questions, which are not uncommon in the context of class action settlements.” (link)

The Big Ten is not interested in expanding further, according to Iowa President Barbara Wilson, who remarked this week: “I would say for now that we’re done. If we’re going to grow, it will be for the right reason. Right now, there’s no compelling reason. But I’m one vote in the grand scheme of things. We’ve certainly been asked by other schools.” Wilson went on to explain that “we have implicit criteria for who we want to be part of this conference. The academic excellence is really at the [forefront]. … Most of the other conferences don’t have that collaboration at the academic level. That’s something we don’t talk about as much as we probably should. We want the institutions to be as similar as possible because those groups wouldn’t be as helpful if we didn’t have those connections.” (link)

AAC Commissioner Tim Pernetti joined Oregon women’s basketball student-athlete Deja Kelly and Altius Sports Partners VP Brittney Whiteside for a panel discussion as part of the Bloomberg Power Players event in New York City. Topics included schools’ relationships with college athletes since the introduction of NIL, challenges and opportunities with collectives and boosters, effects of the transfer portal and the potential impact of private equity. Pernetti says of the current state of the industry: “The way I look at it from a commissioner's perspective is everybody's lamenting, ‘Oh, God, how is this happening? What are we going to do?’ And I'm sitting there saying we have failed to modernize the business over the last 20 years, so this is overdue. We need to look at student-athletes as our partners now on the business side in everything we do.” Pernetti goes on to note that despite the industry’s uncertainty right now, private equity firms see the value of college sports. “And they also see every 10 years when the media rights contract comes up, it doubles, it triples. They see the value exponentially growing. I think it's an exploration right now. … We've had a million conversations. What I always tell people is our conference is juiced up about this because I've gotten them excited. What I say to them is if you're not all committed to being in this conference for the next period of years, no private capital group’s going to sit here and invest in you. They want to know that that asset that they bought, at worst, looks like that asset at the end of the relationship, if not better.” Pernetti on collectives: “The term ‘collective’ is new, but the theory of people donating money to support student-athletes has been going on since the beginning of time. … There are administrators out there that think post-House settlement – if it gets settled, there’s actually a public hearing today – if it gets settled that the collectives should go away. And I think the collectives are going to have something to say about that because that is the ability to put more value on top of what the cap may be. So, I don't see the collectives going away and I certainly don't see them going away without a legal fight, and the one thing I know about the industry is we are not interested in any more litigation right now.” (link)

Oregon State AD Scott Barnes joins the Canzano & Wilner podcast to talk about the future of college athletics, his programs and the Pac-12's strategy for 2025 and beyond and says of the TV deal with The CW: “Our priority was reach for all the reasons that we know, and there was more than one suitor. We had an opportunity to work with an excellent consultant who got us in front of several different entities, but we landed with The CW. We love the reach, but we also love the time slots, we love what they're doing, we love their mentality. We're both in growth mode and in this thing together and so [we have] that partnership.” Barnes goes on to talk about what comes next for the industry and submits: “What has happened in some cases is built on a bit of a false premise and that’s that we all operate like we're all sophisticated business entities, and that this settlement says we're all sophisticated business entities so we should be able to do revenue-share and the like. Well, what sophisticated business entity builds 20 or 30 subsidiary organizations and they build them to lose money? And they are supported by one or two [sports] and operate under this higher ed model. … We have to in some form or fashion decouple ourselves from the university operations. … In order to do that, you can’t stay in the same structure. So you're going to have to decouple or uncouple yourself from some of the bureaucracy of higher education to structure yourself in a way that you can execute the new innovative things that you may be doing.” Lots more from Barnes. Michigan AD Warde Manuel asserts Michigan will “absolutely not” play Friday football games. “I understand television would like us to do it, I understand primetime gets a lot of coverage, but also Big Noon (Kickoff) gets a lot of coverage and we’re happy with that. And when we’re on at 3:30 on CBS, they get a lot of coverage. In other words, our fanbase is important to me, important to Sherrone, and to our staff, our student-athletes. We want [to make sure] our fanbase has an opportunity to see us in person.” (link)

As of August, Memphis had secured $21.33M, “the result of 25 separate gifts, in closed donations and $1.5M in verbal pledges to be used toward their ongoing $220M renovation of Simmons Bank Liberty Stadium,” according to the Daily Memphian’s Tim Buckley, who notes that since Tigers AD Ed Scott’s first day on the job on July 29, the Tigers have secured more than $2.17M more in pledges. Scott: “In the last 30 days, just to give you an update, we’re now over $25M in verbal and signed (stadium donations).” The family of FedEx Founder Fred Smith has since unlocked the first $25M portion of a $50M matching gift, and Scott says the Tigers have now started on the second half of the $50M, which would allow completion of the third part of the three-phase renovation. Louisiana Tech Athletics introduces the Louisiana Tech Sports Performance Institute (LTSPI), a cross-campus initiative that will integrate with the university’s “research and scholarship to realize innovation in every area of athletics.” More specifically, the LTSPI will “disseminate best practices to sports organizations throughout the region and nationally. Different from existing collegiate sports institutes housed within academic departments, the LTSPI will engage with donors and participate in academic research opportunities in which the athletic department has a competitive interest.” LTSPI’s functions include the Bulldog Venture Fund, which will merge the “benefits of traditional venture capital firms with the benefits of the Louisiana Tech Foundation” and allow for donor access to technology on campus.
