Seven more former women’s student-athletes have joined the group of former women’s rowers who oppose the House settlement. They include three former Florida gymnasts, one former UCLA gymnast, one former Georgia gymnast, one former Virginia Tech soccer player and one former SMU basketball player. They argue the House settlement "vastly undercompensates female athletes; creates a new anticompetitive cartel to limit athlete compensation; and attempts to improperly cut off claims for fair employment compensation.” There are now 17 former and/or current student-athletes who have joined this objection. Ahead of today’s House settlement hearing, Sportico’s Michael McCann says to “expect attorneys for the players and defendants to stress to [U.S. District Court Judge Claudia] Wilken that their deal is not intended to be a universal panacea for all current and future legal challenges confronting amateurism. It is a more limited and targeted resolution for antitrust claims raised in three cases.” McCann adds: “It is possible, if not probable, the settlement’s implementation will generate Title IX litigation. There is debate over whether proposed payments concern matters governed by Title IX. … The architects of Title IX could not have foreseen there would be a multibillion settlement more than 50 years later that effectively morphs ‘big-time’ college sports into pro sports. It is understandable there is debate about the settlement’s Title IX implications.” The settlement is also likely to trigger immigration law problems for international student-athletes and, again, McCann expects House attorneys to contend that these concerns are not reason enough to reject a deal only trying to remedy antitrust claims. “The saying ‘don’t let the perfect be the enemy of the good’ very much applies. The ‘fair, reasonable and adequate’ threshold accords Wilken wide discretion to determine if the deal, even if flawed and perhaps much better for some than others, is good enough to move forward to the next stage.” (link)

CBS’ Dennis Dodd observes that if there is a breakaway of the wealthiest athletic departments to form a super league, the split will be acrimonious. “The NCAA/FBS brand impacts the ability to land grants, donations and talented faculty. CBS Sports reported in July NCAA President Charlie Baker had proposed a separate governing body for the Power 4. Late last year, Baker proposed a new NCAA subdivision for top schools.” Nebraska AD Troy Dannen weighs in: "We're trying to conflate governance and championships. Keep the championships out of it, we've already had Power 4 governance in autonomy and never exercised it. Without question, the Power 4 are going to have to govern themselves in a different way. That doesn't mean the championships will be any different. People talk about, 'Well the NCAA is gonna have a new division.' Maybe a new division of governance, but that doesn't mean anything else needs to change." Ohio State AD Ross Bjork points out that even if there’s not a formal split, a de facto separation could occur naturally. "The programs that are $100M-$150M [in revenue], you can't cut $23M from that budget. We [can’t] find it in our budget. I don't even know if Texas A&M can find it." Meanwhile, Miami (FL) AD Dan Radakovich notes that the “feeling around a lot of athletics right now is that [$23M is] not a cap. That's a floor. It's kind of one of those things where, if you want to be in this game, this is what you're going to have to be able to do…each year. It's a $20M mortgage that you've got no building for." More. College Football Playoff Executive Director Lt. General Richard Clark joins SBJ’s Austin Karp to discuss settling into his new role, why he believes the CFP is at an inflection point, why the CFP needs to help non-CFP bowl games “stay vibrant and stay integral to what we do” and more. Clark also talks about why he wanted this job and explains: “I didn’t know that I wanted this job. I got approached by a selection firm that was looking for candidates to get put into the mix…and they asked me if I would put my name in the hat. They told me I'd be a longshot candidate because I didn't have any experience, and I was like, ‘You're right,’ but in the end I went through the interview process and I am thankful, grateful, blessed, excited, everything you can imagine to be sitting here right now.” Clark says to continue growing the CFP, it’s incumbent upon CFP leaders to ensure that “this 12-team playoff [is] exceptional. It’s got to be spectacular this year and then we're going to grow from there, just like [former CFP Executive Director] Bill [Hancock] did. … But also I have to help the commissioners think through some of their problems that they have to deal with, and, you know, I wouldn't say problems but they're just issues that they have to navigate and I want to be able to help them as they think through what the College Football Playoff will be. But it has to be in conjunction with the other things that they have to think about so that it all comes together and that we do the right things for the good of all college football.” Full podcast. Rutgers has retained the law firm Lowenstein Sandler to conduct a review of the school’s gymnastics program, according to NJ Advance Media’s Brian Fonseca, who reports the investigation will be led by Matthew Boxer, a former state comptroller and federal prosecutor who previously led an investigation into the Rutgers softball program. Fonseca also notes the agreement calls for the investigation “to be completed as expeditiously as possible,” and Rutgers President Jonathan Holloway says recommendations made at the conclusion of the investigation will be made public. Rutgers will pay at least $470K for the investigation, including “a retainer of $50K and a rate of $225K for the first month, dropping to $195K for the second month.” In a letter to the Rutgers Board of Governors, Holloway notes the investigation “will ensure that any and all concerns raised about the program have been thoroughly reviewed, determine whether appropriate follow-up steps were taken, identify reasons for any potentially insufficient responses, and recommend areas where additional steps may be necessary.” (link)

The Pac-12, former Pac-12 Networks President Mark Shuken and former Pac-12 CFO Brent Willman have “agreed to resolve all claims related to their former employment. Mr. Shuken and Mr. Willman believe they acted appropriately during their employment; the Pac-12 believes it acted appropriately, but the parties believe it is in their best interests to resolve this matter. No further statements will be issued on the matter.” (link)

Memphis Chief Communications Officer Michele Ehrhart acknowledges the university is aware of the existence of an anonymous letter alleging widespread potential rules violations in the program and says the letter has been passed along to the NCAA. Sports Illustrated’s Pat Forde reports the letter “alleges [Tigers HC Penny] Hardaway’s personal involvement in what could be major violations in the recruitment of a player who came to Memphis and a second prospect who did not enroll at the school. The letter claims those violations occurred in 2020 and ’22. It also alleges academic violations occurred in the ’23–24 school year. The allegations in the letter have not been independently substantiated.” The news comes as Hardaway yesterday announced the Tigers had parted ways with ACs Rick Stansbury, Faragi Phillips and Jamie Rosser, as well as special adviser Demetrius Dyson. Per Forde, no reasons were given by the school for their dismissal, and it remains unclear whether the firings were related to the letter. (link)

Washington State’s win over Portland State drew 223K viewers in the 12 PM window on The CW, according to The Mercury News’ Jon Wilner, who notes Oregon State’s victory over Idaho State generated 381K viewers at 3:30 PM. While The CW’s relative newness to college football and complete newness to the West Coast make YoY comparisons difficult, former Fox Sports President Bob Thompson tells Wilner: “Given the matchups — and in the case of OSU, the other games they were up against — it’s not a bad start for the first week on The CW.” Wilner adds: “But as an example, that viewership number for Oregon State compares reasonably to the number generated (418K) last season in OSU’s victory over San Diego State on FS1. Also difficult, if not impossible: Comparing the ratings for the Cougars and Beavers on The CW to previous broadcasts on the Pac-12 Networks. The conference’s now-defunct network was not rated by Nielsen.” (link)

Season Share is rebranding as Attend, and SBJ’s Ben Portnoy notes the company aims to provide “ways for fans to buy tickets in bulk with the flexibility of single-game tickets” and a “way to bridge the gap between younger fans and, in the college space, alumni who aren’t quite to the point of buying season tickets, while giving them a more flexible way to buy packages.” App users can purchase varying packages and then check in on game days to see what seat they’ve been assigned. CEO Aaron Holland: “It's positioned in the product ladder, so to speak, to move fans from being a single-game buyer, up to a plan buyer, and then, hopefully, into more of a donor-style, traditional product, like a full season [ticket].” (link)

NCAA leaders are looking to hire outside entities to oversee post-House management and enforcement systems, Yahoo’s Ross Dellenger reports, adding that “power conference officials have seen presentations from some of the world’s largest professional service providers, such as PricewaterhouseCoopers” and “leaders are in the process of selecting outside companies to oversee a cap management reporting system; regulate a clearinghouse for third-party endorsement/NIL deals; and enforce existing NCAA rules, such as those against pay-for-play, etc.” Meanwhile, House plaintiffs’ attorney Steve Berman remains confident U.S. Judge Claudia Wilken will grant preliminary approval of the settlement, telling Dellenger: “We’re very positive she’s going to overrule the [Fontenot] objections. There could be minor changes.” While the settlement requires student-athletes to report their outside compensation, it does not require the approval of deals through any governing body or clearinghouse. As such, NCAA and power conference leaders are establishing a clearinghouse and enforcement entity on their own, and Berman comments: “The NCAA has indicated that it may change its enforcement bureaucracy or may even outsource it. Frankly, we don’t care if they do that or don’t do that. That’s up to them.” As for the clearinghouse attempting to reject deals between collectives and athletes, Berman says: “We’ll see what the NCAA tries to impose. The NIL [collectives] have not agreed to anything. If the NCAA tries to punish a student or school, if they try to take action against an NIL [collective], I think they’ll probably see that NIL organization in court.” More. (link)

Athletes.org issues a statement supporting the House settlement while urging schools to negotiate with their student-athletes per Yahoo Sports’ Ross Dellenger. From the statement: “The next step, after the settlement is approved, is for individual schools to work with AO to hear the voice of their athletes and discuss what resources and benefits are the most important to provide them. An authentic partnership between each school and their athletes is paramount. AO supports this settlement because of the new benefits and compensation it immediately unlocks for many college athletes, and because it can be the catalyst for the schools to do what is right, both for their athletes and their institution – negotiating the terms of athlete participation, through Athletes.org to finally achieve a true partnership.” Read the complete statement. The ACC has asked the North Carolina Supreme Court to streamline its litigation against Florida State and Clemson, according to the Tampa Bay Times’ Matt Baker, who reports the conference suggests in a legal filing that the schools’ appeals processes should follow the same schedule, including having oral arguments on the same day. Baker adds: “Though the ACC’s suits against FSU and Clemson are separate, they center on the same documents (the ACC’s grant of rights and TV contracts) and arguments (sovereign immunity for public schools based in other states). The proposed timeline: briefs by the schools in October, briefs by the ACC in December and replies by the schools on or before mid-January.” (link)

As the ACC begins the first season under its new success initiative revenue distribution model, North Carolina AD Bubba Cunningham tells the AP’s Aaron Beard: “We’re seeing more and more of a movement toward if you generate it, you get it. You’re seeing that within leagues, by the conference affiliations and those changes. You’re seeing it more within sports programs, that ‘If I generate it, I should get it.’ So all of this is following that natural pattern. And we’re trying to deal with that while trying to keep a league together and make the league competitive from top to bottom.” NC State Football HC Dave Doeren adds: “It’s a great opportunity for the teams that succeed and put the product on the field. That’s what it’s about, earning who you are on the grass. ... And now you’re getting money for your program when you do that.” Beard notes that under the new model, teams can earn $4M for an appearance in the College Football Playoff, another $4M for reaching the second round, $6M for reaching the semifinals and another $6M for reaching the title game – a total of $20M. ACC Commissioner Jim Phillips explains: “That grows as we go forward because those other numbers grow, and the CFP dollars grow.” Wake Forest Football HC Dave Clawson also weighs in: “I think anything the ACC can do as a conference to encourage investment in football, it would probably be a wise move for the league. Clearly, right now in the business of college athletics, football is the driver.” (link)

After criticizing the MAC’s decision to add Massachusetts, the Toledo Blade’s David Briggs talks with Minutemen AD Ryan Bamford, who explains that while UMass has enjoyed success in men’s basketball and hockey, football drives everything. “[Decisions] are not being made outside of football conferences. We didn’t have that vote. We didn’t have the ability to have our voice heard.” If all goes according to plan, UMass’ presence in a football conference will help lift the entire department, and Bamford notes: “We had 13,000 for our game here against Eastern Michigan on Saturday. There aren’t a lot of things that draw 13,000 people to campus or anything in Western Massachusetts for a three-hour period of time. Football can be the front porch of an institution. We have a strong desire to position our football program appropriately to compete for championships.” Given UMass’ previous difficulties in the MAC and other hurdles to building a successful football program, Briggs asks why the Minutemen don’t return to FCS and continue to compete in the Atlantic 10 in other sports. Bamford replies: “We’re extremely aspirational. We’ve seen it in our academic profile…and we want athletics to complement the academic and research pedigree, to be the front porch. If you look across state flagship schools, 43 of the 50 are in the Football Bowl Subdivision. That’s an important aspect of growing our university. At a time when there are less college-aged students coming into age in the next 10 years, athletics can be a vehicle to get people to engage with the institution.” (link)

Recruiting violations occurred in the SMU women's swimming program when HC Ozzie Quevedo impermissibly contacted a transfer prospect and her family prior to the student-athlete entering the transfer portal, according to an agreement released by the Committee on Infractions. All sides have agreed to Level II-mitigated penalties for SMU and Level II-standard penalties for Quevedo. Those penalties include one year of probation; a one year show-cause for Quevedo, during which Quevedo must be restricted from attending practice for 15 consecutive days for the 2024-25 championship season and must attend the 2025 NCAA Regional Rules Seminar at his own expense; and a four-week prohibition in recruiting communications in the women's swimming and diving program, among others. South Carolina Football HC Shane Beamer weighs in on mandatory player availability reports and admits: “I'm kind of indifferent, I'll be honest with you. Certainly, I will see a list of what we’re going to submit, how we are listing our players (available, questionable, out), but it's not like I’m going to be spending a lot of time on it. I've always kind of been one of those guys, it is what it is, not super-secretive about that kind of stuff. If it's an injury, get it out there. The guys know.” Georgia HC Kirby Smart adds: “I think it will go well. I think it’s equitable, at least across our conference, and takes the pressure off of the reporting for the coaches, at least in our world, to our training staff. Takes the pressure off from a gambling perspective. Anything that puts our student-athletes at a risk, that they might…be manipulated for information, they might be used to try to gather stuff. If it’s open and if it’s out there, certainly makes it more equitable.” (link)

The Athens Banner-Herald’s Marc Weiszer breaks down the price points for alcohol sales inside Sanford Stadium this season. Domestic beers are $10 for 16 ounces and include Miller Lite, Coors Light and Michelob Ultra. Premium beers/malt beverages are $11 for 16 ounces and include High Noon, Modelo and Twisted Tea. Speciality beers/seltzer are $12 for 19 ounces and include Tropicalia, Classic City Lager and Sip’Em Seltzer, all of which are from Athens-based Creature Comforts Brewing Company, the official craft beer of Georgia athletics. There will be 59 locations in all with 162 points of sale at every level of the stadium except the 600 level. UGA expects to sell 45K beers per football game and projects revenue generated from alcohol sales across all its athletic venues to be $1.3M to $1.4M in revenue per year. (link)

ESPN’s College GameDay show from Texas A&M last weekend was the third-most-watched regular season episode of all time, averaging 2.5M viewers and 3.2M final-hour viewers, overall it up 47% YoY. ESPN Chairman Jimmy Pitaro and Disney Entertainment Co-Chairs Dana Walden and Alan Bergman have released a new statement concerning the distribution dispute with DirecTV: “DirecTV continues to misrepresent the facts around our ongoing negotiations. Our priority is to reach a marketplace deal that serves the needs of DirecTV and their customers while also recognizing the value of our top-quality content and the significant investment required to create and acquire it. We believe there is a path to a fair and flexible agreement that strikes this critical balance and works for all sides, especially the consumer.” (link)

The ACC is partnering with gaming technology firm Rally Cry to create the Rally Cry Championship Tour, which features a 10-week league in which individuals will play College Football 25 online as well as a mobile gaming truck visiting college campuses weekly where fans can compete in-person for a piece of the prize pool and a custom championship trophy. ACC Commissioner Jim Phillips: "We are thrilled to partner with Rally Cry for many stops along the season-long championship tour, and be part of this innovative approach that will bring a new level of entertainment to college football for our schools and fans. In addition to the tour stops, we thank Rally Cry and our partners at Raycom/ACCDN, in providing the 'ACCDN Game of the Week' stream that will offer our fans even more exciting opportunities to cheer on their favorite ACC teams every week."
