The NCAA “might figure it’s time to make a game-breaking gamble by trying to win House” in the U.S. Supreme Court, according to Sportico’s Michael McCann, who points out the NCAA already made sweeping concessions in the settlement: “It has accepted an arrangement that demolishes its longstanding fidelity to amateurism, converts the upper echelon of college sports into a pro sports model, and obligates the association and member schools to pay about $2.8B over a 10-year period.” Therefore, it “stands to reason that NCAA President Charlie Baker – especially if swayed by conference commissioners, prominent university presidents and influential athletic directors – could decide enough is enough. Don’t be shocked if he declares he’s willing to take his chances in court.” McCann goes on to submit that before the case even comes before SCOTUS, it’s “not a slam dunk the NCAA would lose a trial. Some jurors might find the commercialization of college sports problematic and off-putting. Some might regard the transformation of college sports into something akin to pro sports undesirable, especially if they believe it would reduce academic opportunities for athletes. Jurors are ordinary people. They’re not seasoned litigators who can instantly cite sports antitrust case precedent or Ivy League economists who conduct empirical analyses on fan behavior. They often go with their gut and follow their moral compass.” In the event the case does go before SCOTUS, McCann emphasizes that while the court ruled 9-0 in the Alston case, no other justices signed onto Justice Brett Kavanaugh’s concurrence. Australian tennis player/incoming Texas student-athlete Maya Joint has filed a declaration in Braintmeier vs. NCAA supporting a preliminary injunction on the NCAA's prize money rules and lays out the stakes clearly: “Unless NCAA rules are set aside, on Sunday, September 8, 2024, I will be forced to either forfeit my NCAA eligibility and college scholarship or forfeit a substantial portion of $146K in prize money, stipends and per diems I earned at the U.S. Open.” (link)

Wake Forest Deputy AD for Administration/former Cleveland State AD Scott Garrett and Seattle Deputy AD/former Long Beach State AD Andy Fee join AthleticDirectorU’s Steph Garcia Cichosz to share insights on their journey from AD posts at the DI-AAA level and the Power 5 Deputy AD role. Fee and Garrett reflect on the strategic thinking behind their career transitions, including the opportunity to work with a mentor as their Deputy AD, and the resource management perspective they provide their departments in the post-House era based on their experience at the DI-AAA level. On what he can uniquely provide to an AD, Fee observes: “I can dive into the weeds a little bit more and provide that echo of ‘Hey, this is why we’re doing these things. Hey, great job on this, this goes right to our strategic plan.’” Garrett and Fee also discuss hiring head coaches, conveying stability in times of change and displaying vulnerability in high-pressure moments before offering their advice to first-time ADs. As the industry continues to change, Garrett emphasizes the importance of effective communication to student-athletes, “in particular our student-athlete leaders – our SAAC president, SAAC board, captains of various teams – so that as their teammates and peers look to them for for some some sort of advice or if there's speculation on the locker rooms about what might happen or not happen, they're well-positioned to share” the administration’s approach. New Mexico State has submitted a special appropriation request to the state’s Department of Finance and Administration to establish a $137M endowment to benefit the department’s 10 women’s varsity sports. Aggies AD Mario Mocca: “The looming implications of the House case is the impetus to accelerate this idea, because our women’s sports have been performing well — overperforming on what they’re being provided from a financial standpoint. But if the House case does go through, and if these scholarship changes occur, I can see us backsliding significantly, and we’re trying to get ahead of the curve and be innovative.” If the proposal were to pass, the endowment would generate $5M to $6M per year in interest, which would go to the school. The Albuquerque Journal’s Geoff Grammer also reports NMSU has also prepared a request of $27.5M over five years (fiscal years 2026-2030) for women’s sports assistance, if the endowment proposal fails, and Moccia adds: “Just from being up there (in Santa Fe during the legislative session) for years now, you get your people who maybe don’t like football or men’s basketball ... for whatever the reason. But women’s athletics has always been universally accepted really well, and it was never more apparent than when we brought our women’s athletes up there (this past session).” (link)

The Mercury News’ Jon Wilner examines how Fox factors into the Big 12’s Connecticut overtures and observes: “The network just signed a six-year media contract with the Big East reportedly worth $75M (approximately) annually. Remove the two-time defending national champions, and the conference is not worth what Fox plans to pay. Granted, Fox shares the Big 12’s media rights with ESPN, which assuredly would love adding UConn to its basketball inventory. But in theory, expansion should make sense for the conference and both partners. Had the courtship turned serious, would Fox have voiced opposition?” Wilner goes on to point out that UConn’s membership in the Big 12 makes sense if the Huskies plan to invest heavily in football, but the “imperative changes” if they don’t. “UConn’s basketball peers (Kansas, Kentucky, North Carolina, Duke, etc.) cannot plow $20M into revenue sharing with basketball players. Football will receive the most support, by far. In theory, the Huskies would need $4M to $6M annually to fund basketball at a competitive level. And they don’t need Big 12 money to hit that mark.” As for how the pause in talks between UConn and the Big 12 impacts Washington State and Oregon State, Wilner maintains that it’s a positive development from an optics standpoint and adds: “The Cougars and Beavers want chaos, but it needs to be the right type of chaos. They want disruption in the ACC, where Florida State and Clemson are seeking an escape hatch that could, maybe, possibly, lead to the conference expanding its presence in the Pacific Time Zone.” (link)

DirecTV has filed a complaint with the FCC in which it alleges negotiations with Disney have stalled because “Disney insists on bundling and penetration requirements that a federal district court judge in New York recently found in the context of the ‘Venu’ joint venture to be unlawful, anti-competitive, and ‘bad for consumers,’” adding: “Along with these anticompetitive demands, Disney has also insisted that DirecTV agree to a ‘clean slate’ provision and a covenant not to sue, both of which are intended to prevent DirecTV from taking legal action regarding Disney’s anti-competitive demands, which would include filing good faith complaints at the Commission. Not three months ago, however, the Media Bureau made clear that such a demand itself constitutes bad faith. DirecTV accordingly brings this Complaint asking the Commission to declare Disney’s clean slate and covenant not to sue demands to be in bad faith, and to take whatever other action it deems appropriate.” (link)

ESPN’s discussions to bring the NFL on as an equity partner are “decidedly on the back-burner” and “many outside executives have assumed that the deal was dead,” according to Puck’s John Ourand, who also reports there are no clear backup candidates to purchase NFL Media. “Multiple sources told me that the NFL appears to be no closer to selling some of its media assets today than it was at the start of this process in 2021. Instead, the league has prioritized selling the rights to the NFL Draft starting in 2026. … I’m told that the NFL never seriously brought up any kind of NFL Media sale as it talked with Skydance executives during the Paramount Global sale process.” (link)

The Michigan State Board of Trustees last week approved plans to construct a 4,000- to 5,500-seat arena to host volleyball, gymnastics and wrestling events. There were no details about the overall cost of the project; however, the board’s resolution indicated MSU plans to pay for the arena with event revenue and philanthropy as a funding source, while developers will pay for any buildings that are not MSU-owned on the site. Those buildings could include facilities to support academic programs, a hotel to augment the Kellogg Center, mixed-use retail/office/housing, market rate housing and more. Spartans AD Alan Haller notes the arena is for community and campus use, although it will be an MSU facility, unlike the Breslin Center. Haller: “I’ve been trying to get this project going off and on for the last couple years. [MSU President Kevin] Guskiewicz has been very supportive. … This is the university saying, ‘You know what, we think this should be done. Let's move forward with the planning of this project.’” (link, link)

FIU kicked off the Pitbull Stadium era on Saturday with the words “Dale FIU!” painted in each end zone for the home opener against Central Michigan. The art is part of Pitbull’s "commitment to spend" $1.2M per year for at least five years, and Panthers AD Scott Carr says: “[Pitbull] loves FIU. He wants to see us succeed. That’s why we don’t see this as a sponsorship. We see this as a partnership.” Carr also says that 60% of the signage outside the stadium has been completed and he expects the rest to be finished by next week. To commemorate Saturday’s event, Carr said that the first 10,000 fans were given Pitbull pins. “We wanted something we could put in the hands of our fans to commemorate this night. As a university, we’re doing amazing things on the academic side. This is the start of the next piece, which is to bring notoriety to our athletic program.” (link)

Davidson’s football team debuted in the new Davidson College Stadium with a 49-14 win over Catawba (DII) before a crowd of 4,477. Wildcats HC Scott Abell: “We’re all excited about playing here. [...] We’ve moved from an old stadium to the nicest facilities in our conference.” Adjacent to the new stadium is a sports performance/training center, which the Wildcat football program began using last spring. It includes a training center, office spaces for the coaches, locker facilities, and multipurpose rooms. (link, link)

Washington’s Husky Stadium was burglarized last week, and among the items stolen were 12 championship rings belonging to Director of Football Technology Jacob Otten, who’d accumulated the rings over the past 15 years. His two oldest rings were from his alma mater, Cal Poly, and commemorated the Mustangs’ Great West co-championship in 2011 and their 2012 Big Sky co-championship. He also had five rings from North Dakota State and two from Kansas State. His three most recent rings came from UW and celebrated the 2022 Alamo Bowl, the 2023 Pac-12 Championship and the 2023 Sugar Bowl, and Otten tells the Seattle Times’ Andy Yamashita: “Every year is unique. Every year is different. When I was at North Dakota State, those rings are national championship rings. You start in August and you’re not done until January. You’re sacrificing weekends and you’re working seven days a week. So getting that ring at the end of the year and winning a championship, that’s why you do it. You have it so in the summertime, you can have it displayed and people can come in and check it out and you can tell them stories about each ring, and tell them each story about each year and what we did that season.” UW police declined to release a report of the incident, citing the case’s active-investigation status, but Yamashita reports the stolen items also include multiple cameras and a bag. The Mercury News’ Jon Wilner offers his take on realignment scenarios, saying the likelihood of San Diego State being in the same conference as Oregon State and Washington State starting in the summer of 2026 would fall on the “very high side” of 50%. “It’s a near-certainty and could come in one of several forms: 1) Oregon State and Washington State join the Mountain West. 2) The Aztecs join a rebuilt Pac-12 with some or all of the Mountain West schools. 3) All three join the ACC to expand its western footprint. (This outcome has a 0.001 percent chance of materializing, and would require Florida State and Clemson to exit the ACC, along with North Carolina, in the next nine-to-12 months.) Not that you asked, but here’s one more layer to consider: I would include Boise State and make it a quartet.” He continues, noting that with the Mountain West’s agreement with Fox and CBS expiring in the summer of 2026, SDSU and Boise State “have no intention of signing up for more of the same when 2026 rolls around. Which means: 1) Either they stay in the Mountain West (with WSU and OSU as new members) and the top schools insist on unequal shares of media rights revenue. 2) Or they leave the conference and join a rebuilt Pac-12 with eight or 10 schools that have media valuations well above the current and future Mountain West averages. Put another way: A conference consisting of Washington State, Oregon State, Boise State, San Diego State, Fresno State, UNLV, Air Force and at least one more school — but no more than three — would generate more media value than the Mountain West if the current collection of schools signed a new deal together.” More. Missouri Valley Conference Commissioner Jeff Jackson joins D1.ticker/Connect’s Kristen Eargle to discuss conference realignment, evaluating fit with adding members and preparing for changes to the industry. Jackson explains that after bringing in Belmont, UIC, and Murray State, he’s learned that “the institutions are important, but the people are actually more important, and I think one of the things that has made those three institutions so valuable to our conference is the leadership that exists on those campuses. Having the opportunity to get to know their presidents and chancellors, their athletic directors, their senior women administrators, their FARs, their student athletes, they fit what we think the Valley is, which is a conference that puts the ideology, the concept, the importance of the student-athlete experience first and foremost. And those three institutions have come in and done a fantastic job and in that stead, and they fit right in. They geographically match our footprint. We can't be more happy and can't be more fortunate to have had the opportunity to add those three institutions.” More on Connect. (link)

The Richmond Times-Dispatch’s David Teel talks with 506Tek Founder/CEO Lou Stadler, who, as an undergraduate student at FIU in 2004, began interviewing more than 500 ADs from DI through NAIA to gather their thoughts on student-athlete compensation and a college football playoff (pre-capitalization). Teel notes that about 90% of the FBS ADs Stadler canvassed in 2004 opposed such a measure, and roughly 55% preferred the BCS to the four-team College Football Playoff that debuted a decade later. Teel observes that “for those who elaborated, including Virginia Tech’s Jim Weaver, Georgia Tech’s Dave Braine, who preceded Weaver in Blacksburg, and Baylor’s Ian McCaw, now at Liberty, the common refrain in opposing athlete compensation was the six-figure value of a full, four-year scholarship.” Big 12 Deputy Commissioner/then-Kansas State AD Tim Weiser remarked at the time: “If players were deemed employees, we would have to deal with unions and workers' compensation issues. We would then have to pay all athletes. … Philosophically, that is not what we are here to do. We are here to educate.” Former Virginia AD Craig Littlepage, now a senior advisor with Collegiate Sports Associates, said at the time: “I am not opposed, but I would need to know where funding will be coming from and that it is gender neutral.” If Littlepage was prescient regarding player compensation, former Temple AD Bill Bradshaw was clairvoyant when it came to a football playoff. “This is America, where a national playoff exists in every other sport. … There is nothing more exciting than teams playing at a neutral site to advance. The networks would pay billions for the rights. Bowl games would then finally mean something.” (link)

“My goal was not to be an athletic director. But if you’re in an industry … (and) you do your job, you do the best you can in whatever job you’re in, somebody will tap you on the shoulder. And I do believe this, you have to get yourself out of your comfort zone.” That’s new UMass Lowell AD Lynn Coutts, reflecting on her career, which landed her as the first female AD for the River Hawks. “I just wanted to stay in the industry, I do love it. If you could be an administrator before you were a coach, that would be really helpful. Now I see the bigger picture, and I think I have more of an impact in administration than I did in coaching. Coaching was just my team. Now I can have an impact on more people, and I love people. I like to learn about different sports, I like to learn about different people and look at things from different perspectives. … I knew I wanted to try this. I’ve always said yes, and then sometimes I say ‘Oh my gosh, what am I doing?’ … I like to go through a little adversity, and I like to make a difference and have an impact.” More, as Coutts gets the profile treatment from the Portland Press Herald’s Drew Bonifant. Memphis Men’s Basketball HC Penny Hardaway did a Q&A with College Hoops Today’s Jon Rothstein. When asked why he opted to make sweeping staff changes last week, Hardaway: “I don’t really want to get into that.” Rothstein pushed further, asking if the Tigers’ HC was surprised at the amount of turnover he has had on his staff during his tenure. Hardaway: “At the end of the day, this is who I am. I’m not traditional so stop trying to put me with the guys that are. I’m not a traditional dude — that’s first and foremost. People have come to me for various reasons. I’ve accepted them for various reasons. The turnover had a lot of graduate assistants, had a lot of managers. The coaches who have left have went on to get bigger and better jobs and better positions. No one has really just been fired. There’s been multiple things that have happened mutually and I still talk to everyone who was in the program because it’s a tree. For everyone else, it’s a coaching tree and for me, it’s turnover. … I don’t understand why this is unheard of for you guys who have been in the business for a long time. This is only my sixth year. I’m trying to figure it out. I started out having an NBA staff and now I’m trying to work everything else out.” Would he do anything differently? “I don’t think so because to me it’s the bumps and bruises. My bumps and bruises in this business can get louder than anyone else’s bumps and bruises. … But to say I’m not accomplished in everything that I’ve done — that’s just a lie. It’s who I am — I’m being judged harsher than an average coach that just came in. It is what it is. I’m not above criticism, but I know that I’m being judged harsher.” Are you confident you still have momentum as a program? “Why wouldn’t I? What have I done to not have momentum?” (link)

Former Ole Miss football student-athlete DeSanto Rollins’ appeal to the 5th Circuit Court of Appeals, following U.S. District Court Judge Michael P. Mills’ dismissal of Rollins’ civil case against Rebels HC Lane Kiffin in February, has been denied. The three-judge panel found “no error in the district court’s determination that Rollins has failed to carry his burden.” (link)

NIL was the differentiator in Oregon’s football victory over Idaho last weekend, according to The Athletic’s Bruce Feldman, who notes that while Georgia HC Kirby Smart is envious of the Ducks’ NIL apparatus, the Vandals lost seven of their top players to FBS programs via the transfer portal, five of whom received NIL deals in the six figures. Idaho HC Jason Eck: “If we had those (five) guys that got paid, I think we’d probably have beaten Oregon. We got sacked four times. Our quarterback, who is now at Oregon State, can really evade pressure and extend plays.” Eck says the job has definitely gotten harder since he took over in 2021 when NIL had just become legal. “You wouldn’t have thought guys would be getting recruited off your roster like it happens. It’s just a balancing act of trying to do right by the kids because for some, it’s life-changing money. The one thing that we’re gonna try to do with some of ours this year is, especially guys who are younger players — and we started a lot of younger players in this game — is have that ‘one more year’ thought. Our guys went to Oregon State, Cal, UCF and Cincinnati, they weren’t going to premier destinations. ‘Wait another year. Don’t go to a bottom-half Power 4 school.'” To help with that, Eck notes the Vandals-focused collective hopes to raise $100K by the time the portal opens in December. Meanwhile, Vandals AC Stanley Franks Jr. says the program uses the portal as a recruiting tool. “We have to recruit Mountain West-caliber guys: ‘Come here, get developed and play, and then bless your family your last couple of years of college.’ You want to educate these guys as much as possible. I tell them, we develop cats here. Why go somewhere else where I might sit on the bench just because of a logo? We flip it as a positive.” (link)

The News & Observer’s Chip Alexander talks with Centennial Authority Chairman Philip Isley and Executive Director Jeff Merritt about plans for the $300M PNC Arena renovation, noting the two went over options with the Raleigh City Council and Wake County Commission this week. Isley: “We think it’s important for them to know that we’re not sitting around idling, trying to figure out how to spend all this money. We have been very intentional in how we’re going to spend the money, what we’re trying to draw and design, and then put it out to market and see what we can build.” Merritt says the initial renovation work is expected to begin immediately after the 2024-25 Carolina Hurricanes season and adds: “We want to make this a world-class venue for the next 25 years. We want it to be unique to the region. We don’t just want a cookie-cutter. We want to grow our revenue opportunities, which is always important, but we want to be a catalyst for the community.” Isley this week told Wake County commissioners that “with tailgating, there are lots of really good ideas from the developer. By contract, there has to be a set amount of acreage that is dedicated to tailgating. There are conversations we’re going through right now, literally every week, trying to figure out what that might look like and everybody is happy about.” (link)
