South Dakota Attorney General Marty Jackley has filed a complaint against the proposed House settlement, on behalf of South Dakota and South Dakota State. From the complaint: “It is common knowledge that the most prominent institutions amongst collegiate athletics are found in the power four conferences, and these institutions reap the greatest benefits from the NCAA amateurism rules. Further, the powerful schools are responsible for the vast majority of the damages for which the settlement is intended to compensate. However, the settlement requires them to shoulder less of a financial burden, and that of their less prominent counterpart.” Jackley: “As a former college student-athlete, I believe strongly in a system that presents our athletes with opportunities to compete and treats all of our athletes fair and equal. I am disappointed that our South Dakota athletes and universities are paying the price for a settlement that did not involve any of our conduct. This settlement unlawfully and blatantly discriminates against female student-athletes by limiting them to less than 10 percent of the proceeds.” Also of note from the filing, on Title IX: “Member schools are prohibited from making revenue share payments to student athletes disproportionate to their participation rates. Categorizing ‘revenue sharing payments’ as something other than ‘financial assistance’ by an institution or the NCAA severely undermines the legislative intent of Congress in enacting Title IX and is not consistent with the NCAA constitutional mandate of gender equity nor the NCAA constitutional commitment to gender equity.” (link, link - full suit)

Four former Michigan football student-athletes have filed a class-action lawsuit against the NCAA and Big Ten Network on behalf of all former football players prior to 2016. The suit seeks more than $50M in compensation for profiting off of their NIL through merchandise, social media clips and broadcasts of classic Wolverines games. From the filing: “Plaintiffs seek a declaration that any assignment of publicity rights is unlawful and unenforceable, a declaration of entitlement to a present and future share of any revenue generated from the use of their publicity rights, including but not limited to the use of their name, image, and likeness, and injunctive relief barring Defendants from using the same absent reasonable remuneration.” (link, link - Full suit)

Virginia Tech boss Whit Babcock talks to The Richmond Times-Dispatch’s David Teel about potential outcomes in Blacksburg of a House settlement: “We have a few sports here that we don’t budget at what I would say is a competitive level, and they really have to overachieve. If you went to a tier system or non-scholarship system, that’s a tough competitive environment for those student-athletes. But certainly, that’s on the table, nationally and not just at Virginia Tech.” Will Tech offer the max revenue share? “I do not have a final answer on that, but I do believe that’s the new floor, so to speak, for competing in the top tier. We will not fund every single scholarship on every single roster spot. That would be an additional $13 million, and I don’t know that having every single student-athlete on full scholarship in every sport is strategically smart. And there’s other ways (such as NIL and shared revenue) to distribute funds.” How about Tech’s appetite for a private equity deal? “Maybe being cutting edge is OK, but I’m not sure being bleeding edge is OK. Somebody else will maybe do it and show us the way. But yes, I do have some reservations. … We’ve had a number of private equity groups approach us, but we have not engaged with any of them and don’t plan to at this time.” (link)

The Detroit Free Press’ JC Reindl details Michigan’s termination of The M Den as its official retailer, as the retailer bounced a $3.8M check earlier this year. After The M Den filed for reorganization bankruptcy last month, U-M is the largest unsecured creditor with $8.8M in unpaid royalties. AD Warde Manuel in a February letter to M-Den Co-Owner Scott Hirth: “Your correspondence ... states an interest in preserving your relationship with the University of Michigan, but M-Den's conduct proves otherwise. Despite M-Den's assurances, its conduct suggests that M-Den is wasting assets, bleeding cash out of the business rather than paying its vendors or paying down its obligation with the university.” Now known as Heritage Collegiate Apparel, the company is working to sell itself, with Legends, the Wolverines’ new official retailer, and Lids bidding for the company. + Wake Forest unveils plans for phase one of The Grounds mixed-use development that will sit between Allegacy Federal Credit Union Stadium and Lawrence Joel Coliseum. Included are a 40,000-sf retail village, a 100,000-sf office building and a 240-unit, 500-bed residential community. Groundbreaking is expected in December, with the first two pieces targeted for completion in summer of 2026 and the latter piece in summer of 2027. Carter and Front Street Capital won the RFP for development of the project. (link)
+ Texas A&M Baseball HC Michael Earley reports the $80 million renovation of Blue Bell Park has “been accelerated.” The work will likely boost capacity toward 10,000, while Earley wants to emphasize the player development complex in the planning. A 360-degree concourse around the stadium with a drink rail remains part of the design. Timeline still TBD. (link)
+ Northwestern State receives a $1.9M donation from alums Dr. Jennifer and David Thornton to support upgrades to NSU’s baseball and softball facilities. The largest one-time gift in school history will cover the installation cost of Geosurfaces PIVOT no infill turf at both Brown-Stroud Field and Lady Demon Diamond, for the padding of baseball’s outfield wall and for the overhaul of the softball complex’s lighting system. The LA Times’ Ben Bolch shares that UCLA is expecting a 10-15% YoY increase in football ticket sales, due in no small part to interest in visiting the Bruins home venue from long-suffering fans of Big Ten teams with extended Rose Bowl droughts. UCLA AD Martin Jarmond: “One of the many benefits of being in the Big Ten Conference is a bigger audience, whether it’s Southern California-based Big Ten alumni and fans, or UCLA alumni in the other Big Ten locales. Some of the Big Ten schools have not had the opportunity to play in the Rose Bowl in decades, if ever, and there is no better setting for college football than the Rose Bowl.” To wit, Minnesota Senior Assoc. AD for External Affairs Mike Wierzbicki opines that “compared to our other Big Ten road games, UCLA has far and away the biggest level of interest among our fans right now,” while Delta has added a direct flight from Cedar Rapids to L.A. in order to accommodate Iowa fans heading west. Sportico’s Daniel Libit reports on new developments for The Players Era Festival including a three-year distribution deal with TNT Sports and a partnership with Publicis Sports. Event co-founder and EverWonder Studios CEO Ian Orefice shares that Players Era, which has committed to spending $50 million on NIL for participants, has already generated “eight figures” in revenue commitments for 2024 and would “not lose a lot of money in year one of the event.” More from Orefice: “Anytime you are challenging a status quo, there’s obviously going to be some friction with those that are trying to protect a previous business model. We recognize our entrance has created some disruptions, but we are unapologetically and relentlessly pursuing a future where the players are legally paid for their value.” Additionally, former CNN President Jeff Zucker, currently the CEO at Redbird IMI, which backs EverWonder, is apparently serving in a “strategic advisor” role. Teamworks GM offers a data-driven, integrated solution to support that future.” Here’s the whole integrated pitch: “By centralizing transaction data, GM will provide a holistic view of earnings from revenue sharing, collectives, royalty payments, brand deals, scholarships, Alston payments, and more. Looks like former Ole Miss/Auburn/Cincinnati Football HC & current Senator Tommy Tuberville (R-AL) is the latest podcast guest for Athletes.org’s Jim Cavale. Tuberville on where college athletics is headed: “We started this whole thing and there were no rules. When I started coaching there was a thick rulebook about what you could and couldn’t do. Now there are no rules. [...] Football is going to eventually go by itself, it’s going to have to because it’s a different animal. [...] If you’re going to get in the money game, like we’re going to get in with players, you’re going to have to get into some form of representation and education for everyone to understand, media on down. JohnCanzano.com’s namesake gets this from a source regarding Pac-12 + Mountain West Football scheduling dynamics: “The Mountain West is blocking that time out (the final 10 weeks of a 14-week schedule) to be intentionally problematic.” Canzano reports Oregon State & Washington State have been working with scheduling guru Dave Brown, as well as with Navigate for “valuation, branding, positioning, and strategy.” Canzano goes on to say the Beavers’ 2025 slate could have “some ACC flavor,” plus he points to Stanford as a possibility since the Cardinal still needs two kicks for next season. Elon has begun an investigation into its football program following allegations of a student-athlete yelling racial slurs during the Phoenix’s game at North Carolina Central. Assoc. AD of Strategic Communications Jason Knavel: “We are aware of the allegations about comments made during Elon’s recent football game. We are looking into this incident and any substantiated allegations will be addressed appropriately by the university. Elon University is a community based on a strong commitment to inclusivity and belonging, and intolerant behavior and comments have no place here.” (link)

I am immensely proud of the accomplishments of the student-athletes, coaches, staff, alumni, donors and community members that I have had the privilege to serve alongside at the University of Pittsburgh. This great university’s reputation and standing in intercollegiate athletics has never been stronger – a testament to the work of so many during my tenure.” Lyke goes on to thank the student-athletes, coaches and staff and notes: “With the focus on our purpose to build champions and remain committed to excellence, while preserving the mission of collegiate athletics, we have adapted our mindset, and internal and external operations, to ensure sustainability and long-term victories for the Panthers. When we began this journey seven years ago, we had won only one ACC Championship; today, we have ten, and six Coach of the Year accolades. And our graduation rates have consistently broken records and continue to rise. Mountain West Commissioner Gloria Nevarez says of extending the league’s scheduling partnership with Oregon State and Washington State: “I think we have to move on. The September 1 date was picked because this is the outer edge of the time when we can be making decisions about next year’s football schedule. There’s a lot that goes into it. Our schools need certainty so they can plan their non-conference schedules.” Nevarez says of the potential of MW schools leaving to form a de facto Pac-8: “If there are opportunities that come our way, we’re going to be ready to take advantage of them. But it’s probably a better question for other programs.” The San Diego Union-Tribune’s Mark Zeigler notes there is “also the matter of the fine print of the Mountain West scheduling agreement, which includes, for lack of a better term, ‘poaching penalties’ should OSU and WSU invite any of the current members to the Pac-12. It’s $10M for the first school, $20.5M for two, $31.5M for three, $43M for four, and so on. … The even finer print: The penalties extend for two years after the agreement ends, or August 1, 2027.” Nevarez: “That was a very important piece for us. At that point, there was so much unknown, so we just tried to protect ourselves against what we knew could potentially break us apart.” The “cheaper option” for OSU and WSU, Zeigler continues, would be if nine MW schools voted to dissolve the league for a reverse merger with the Pac-12. Could they? Nevarez: “Today, no. I talk with all of our schools regularly and I don’t think there’s a desire to dissolve the league.” (link)

Oregon State AD Scott Barnes is unapologetic about his schadenfreude when it comes to conference chaos, according to the Mercury News’ Jon Wilner, who notes: “You’re dam right he’s rooting for chaos in the ACC.” For his part, Barnes last week told Wilner and JohnCanzano.com’s eponymous publisher that “it’s an eat-what-you-kill environment right now.” Asked specifically if he’s rooting for conference turmoil, Barnes didn’t specifically mention the ACC but said: “Yeah, right now…because the most opportunities we’ll have is if there’s a crack that’s opened and we’re positioned. And we will be. The things we can control, I love how we’ve executed. We’re going to keep pounding pavement. We’re going to be aggressive. We’re not the little engine that could. Even though there’s been a mentality in our history, that’s not who we are. Look at the metrics, from TV viewership to historical success to current success. There’s all those reasons…that we are a Power 5 member. And I say that intentionally. We have five Power Five conferences. We’re one of them. (There aren’t) four. We need to be ready to pounce. … Disruption, chaos — whatever you want to call it — will take place again. There’s no question. It’s just how soon.” (link)

Former Florida AD Jeremy Foley moderated a discussion between Knight Commission CEO Amy Privette Perko and Athletes.org Founder Jim Cavale on the future of college sports. With all the uncertainty in the industry today, Foley asks who is supposed to be looking out for the entire enterprise, and Cavale remarks: “I think a lot of that has to do with the enterprise thinking about it for itself and thinking about it based on the future and not what they're used to doing.” Cavale explains that athletic departments have traditionally spent all the money they’ve made, and “guess where they spent it? On attracting talent. Because you can't win without talent and you can't keep making money without talent so they spend it on facilities, they spend it on all kinds of barber chairs in the locker room and all the things you read about. Well, now they're used to spending on all these things, they’ve also had to fund new sports and now they have to find $20M, and that is going to be hard, especially when another place they spend it is coach salaries – not just coach salaries, but coach buyouts. Jimbo Fisher just got fired last year and he's getting paid $75M to sit on the couch and watch the games.” Should revenue-sharing eventually occur, Cavale points out that separating football into its own entity would help solve the Title IX issue “because if you’re going to compensate football players more because they produce more revenue, doing it inside the school is going to be a lot harder in still being able to comply with Title IX than it would be if they were part of a separate league.” Perko adds that if one were to poll football coaches, they would be in support of a separate league “because they think it would help bring a unifying message to get things done that they need to help their sport. If you say who do I call, who's in charge of college football, you have to call four different commissioners, a couple of TV executives. I mean that's who's in charge of college football.” Lots more. Washington has launched Go BIG! for Washington, a five-year, $300M fundraising campaign to support UW as it moves into the Big Ten. Huskies AD Pat Chun: "As a proud member of the Big Ten Conference, the premier conference in college sports, Washington is entering an exciting new era. The Go BIG! for Washington campaign offers our alumni, donors, and fans the chance to help us forge ahead, ensuring our continued success in this evolving landscape of college athletics." To date, UW has already raised $50M, including an inaugural $1M gift from Football HC Jedd Fisch. (link); Fisch emphasizes the need to focus on facilities: “I think everything needs to be refreshed. I think you need to have a top-of-the-line nutrition program, a top-of-the-line hydrotherapy program, a top-of-the-line training program. You need to be able to have a team room, a locker room, meeting rooms that are all at an elite level. And on top of that, you need to be able to show players in a recruiting landscape that the commitment to winning is at the highest of levels. Then, of course, you need NIL money. And the NIL money is real, and it’s not just going to be revenue-share.” In envisioning an updated locker room, Fisch mentioned “the ability to put zero-gravity chairs in every locker, the ability to put Normatec boots in every locker,” and better ventilation for helmets and shoulder pads, per On Montlake’s Christian Caple. Villanova announces The Athletic’s Dana O’Neil will join the Wildcats in the role of Senior Assoc. AD for Strategic Communication. O’Neil will serve as overall brand ambassador and lead strategic communications executive for Villanova Athletics with an emphasis on men's and women's basketball, and will develop, direct and execute all elements of brand and strategic storytelling through traditional media, social, digital and graphic verticals. She will also collaborate with university partners in Communications and Marketing and support Olympic sports narratives. (link)

Saturday’s Colorado-Nebraska football game averaged 6.3M viewers on NBC and Peacock. Sports Media Watch’s Jon Lewis notes that while the Coach Prime Effect is not as strong as it was last season, it is still real. “As was the case for their closer-than-expected opener against North Dakota State (4.76M), Colorado did not draw quite as well as for the equivalent game last season, which also put the Buffaloes against Nebraska. Viewership declined 28% from that year-ago matchup, which averaged a Nielsen-only audience of 8.7M in the Fox Big Noon Saturday window.” (link)

The SEC has signed a deal with Netflix to produce a docuseries about SEC football, and Kentucky is one of several teams being featured, according to Kentucky Sports Radio’s Matt Jones. Netflix crews embedded with UK all week leading up to Saturday’s loss to South Carolina and will reportedly be with the Cats for at least one more game. The series is slated to come out in 2025. SBJ’s Ethan Joyce takes a look at the ways teams and venues are focusing on personalization, and YinzCam CEO Priya Narasimhan estimates that 10% to 20% of her 100+ pro sports clients have shifted forward from fan segmentation to that one-on-one relationship pursuit, and she continues to push them all to pursue the little details of their users to create the big, lasting memories. “Personalization is where the ultimate magic is going to lie.” Credenza CEO Sandy Khaund’s company is upgrading its universal ID for the St. Louis Blues (the Bluenatics Passport) to allow fans in the Enterprise Center to scan a QR code to find any discounts for which they are eligible. Those transactions then become data points for the team. Joyce also notes that “at some music festivals this year, Tradable Bits has tested special use cases that prove recency and relevance in offers have dramatic effects. As some attendees entered VIP areas, they were texted within 30 to 40 seconds of arrival with a special offer for future events or sponsored items. In that testing, Tradable Bits has seen an opt-in rate of 80%,” according to CEO Darshan Kaler, who tells Joyce: “I’ve never seen anything like that.” Khaund explains that when it comes to personalization writ large, it’s “incumbent upon the team to apply that to A) make the experience better, and B) create more revenue opportunities. Because ultimately at the end of the day, nine out of 10 big sports fans are all about ‘shut up and take my money,’ and these sports teams don’t know what to do with that. They’re just missing out on that opportunity.” (link)

A year after West Virginia eliminated 143 faculty positions and 28 academic programs, tensions have calmed on the surface, but Inside Higher Ed’s Ryan Quinn notes that it’s “unclear what effect the layoffs, program cuts and attendant national controversy may have had on that source of [enrollment] revenue. But what is clear is that the university remains in flux: It’s not just faculty members who continue to leave, but top administrators, too. … The university hasn’t released figures for how many faculty members have voluntarily left the university atop its forced Academic Transformation cuts. Some faculty members crowdsourced a spreadsheet that lists 38 unnamed faculty members who got new jobs after Academic Transformation and who only started looking elsewhere because of it.” Five law professors were let go as part of last year’s cuts, and seven more have decided to leave since, but WVU Executive Director of Communications April Kaull says the “attrition at the end of the 2023–24 academic year has not significantly impacted” that school's curriculum. However, current and former law faculty tell Quinn the layoffs have pushed them toward the exit, with one noting: “They have slashed us from a high of 43 [faculty members] before the pandemic to we’re down to under 20, and then they expect us to deliver the same services, but there’s only so much a person can do in 24 hours, seven days a week.” Overall, Faculty Senate Chair Scott Crichlow says: “Folks don’t have a sense of security that WVU is going to be what WVU has been,” so they’re more likely to be looking for jobs elsewhere. “The level of concern remains very, very, very high.” (link)
