Maryland Eastern Shore AD Tara Owens’ new five-year contract includes a bump in salary from $190K to $235K, per CollegeAD. Owens is also eligible for several academic- and athletic-related bonuses ranging from $2K to $7,500, as well as 2% of the total amount of all sponsorships and donations UMES brings in above $500K in a single year. Should UMES part ways with Owens without cause, she would be owed a lump sum of her remaining base salary for the remainder of the contract. Owens must obtain written approval from the university before pursuing other employment. (link)

While Northern Illinois’ win over Notre Dame on Saturday provides a glimmer of hope for Group of 5 teams, Yahoo’s Ross Dellenger notes the deck is increasingly stacked against them as player retention only figures to become more difficult. The Huskies lost two offensive line starters to Louisville and Florida, respectively, to what Football HC Thomas Hammock calls “third-party situations.” MAC Commissioner Jon Steinbrecher says such tampering is commonplace. “In July, we had one of the most remarkable football coaches meetings I’ve ever had. I heard story after story about tampering. I heard this story about a school out West. Recruited our kid, got him to transfer and then they offered him an additional bonus if he got his teammate to transfer as well. That’s the crazy stuff going on that is flat-out wrong.” NIU AD Sean Frazier points out that for some players seeking transactional relationships, the grass isn’t always greener. “We’ve had kids in the portal and they are in other places right now and they are kicking themselves. They hate it. It’s the NFL model. … But if you’re just going to buy your players and a roster, you’re not going to have that connection that we have here.” Hammock adds: “If I want it to be transactional, I’ll go back to the NFL. I know what that is. I’m looking to have an impact on young people.” (link)

Utah AD Mark Harlan talks with SBJ’s Ben Portnoy about hiring new CRO Patrick Nowlin and says: “Our industry is going to be faced with awesome opportunities for student athletes in terms of sharing revenue, and we wanted to try to be ahead of the curve in that regard. We went about designing a job that we had not had here previously that when this person wakes up, they're going to be thinking about revenue all the way to when they go to sleep at night.” Nowlin tells Portnoy that Harlan “is somebody who has a great grasp on not only the present but also the future. And talking with him really drew me to [the job]. … The way college athletics is going, the dollar is being pulled in a lot of different directions. And if you don't have alignment within those or within your strategy, you're going to fall behind.” (link)

Legal Matters…
+ Sportico’s Daniel Libit reports the FBI’s Washington Field Office has been in touch with George Mason about its men’s basketball foreign tour to the Bahamas that was scrapped when the school says it discovered its airline and hotel accommodations had not been secured. “The extent of the FBI’s current involvement in the matter is not known. As per bureau policy, a spokesperson declined to confirm or deny the existence of an investigation and a GMU athletic department spokesperson would only refer to the school’s previous announcement.” On August 16, Christian Roccia, the special agent in charge of the FBI’s Northern Virginia Resident Agency, emailed GMU Deputy AD for External Operations Zack Bolno: “Were you able to assist with scheduling a meeting with someone from your office regarding the topic we discussed?” Libit reports that Bolno passed that message along to Patriots AD Marvin Lewis, who then forwarded it to Eli Schlam, one of the school’s in-house lawyers, noting: “We received a call and email from an FBI agent inquiring about the Bahamas trip. Will you advise on the appropriate next steps? … I can follow up but wanted to check-in prior to responding to the agent.” At Schlam’s instruction, Lewis then reached out to Carl Rowan, Jr., the chief of GMU’s campus police, for further guidance. + Ten more Iowa and Iowa State student-athletes and one Hawkeyes basketball equipment manager have joined a lawsuit seeking unspecified monetary damages from the state and its public safety and criminal investigation agencies for allegedly violating the athletes' rights and smearing their reputations. CBS’ Dennis Dodd checks in with former Michigan football staffer Connor Stalions and notes that “at this point, Stalions and his team of lawyers seem poised to go through the full [NCAA] enforcement process. … Two sources familiar with the details of the current NCAA investigation told CBS Sports not to expect a verdict from the NCAA on the sign-stealing investigation until perhaps next spring.” Dodd asks whether he would like to coach in college again, and Stalions responds: “I hope. I get a lot of support from various people about eventually bringing me back [to Michigan]." Regarding the 52 text messages Wolverines HC Sherrone Moore allegedly deleted from his phone, Stalions says: "I don't even know what I would have texted him. 'Hey, coach, so-and-so [recruit] is coming to your office right now?'” Stalions also says there is a Big Ten team that will remain nameless that has used the same signals since 2020, spanning multiple coaches; there are schools that have secretly used Bluetooth technology prior to the rule change to helmet communications with players in the field; and staffers routinely trade playbooks. “They'll say, 'I got fired from this school, [eff] them.’ That's everywhere." Asked whether former Michigan HC Jim Harbaugh would take his call right now, Stalions says: “I don’t know.” (link)

Houston has denied Houston Chronicle reporter Joseph Duarte’s open records request for a breakdown of total value of NIL deals over the last three years for athletes. Duarte: “The same request was approved recently by another public university in the state (Texas A&M). In its response, UH’s open records division said ‘the requested NIL information is confidential and not subject to public disclosure.’” Duarte shares the document TAMU shared, which shows the total value of NIL deals by year broken down by gender, and notes: “Frankly, this was enough. My argument is there is precedent set by another public school to release this info. If UH wants to cite statute that’s fine. But the request, in my opinion, wasn’t asking for state secrets or even KFC’s secret recipe. If you are going to ask the public for money there should be a level of transparency. Same thing when we were denied access to Memorial Hermann’s gift amount for the football operations center.” (link)

Then, all of a sudden something changed, and it had to pay its employees. So, you have a very rapid process here in which this gigantic set of sports activities under the NCAA is rapidly adjusting to a new economic reality in which they are evolving towards sharing greater and greater amounts of the revenue with athletes. + RevelXP is experiencing increased demand for temporary suites, particularly as many athletic departments are putting major construction projects on hold, according to SBJ’s Ben Portnoy, who reports: “Year 1 saw the company complete just two of these premium builds, while it has 14 on the books for this fall” in Year 3. RevelXP EVP/Venue Operations Tom Kleinlein says the “hardest premium for people to sell is single-game premium, because you’ve got a commitment that, if you build a suite, it’s got to be full all year long. Well, these are a way to offer single-game premium, pretty close to the field with a cool, unique view. … The reality is, right now, there's some people out there via social media kind of like, ‘What is this?’ But every one of these builds, when people have gone and sat in them and experienced them ... it's just a very cool experience.” (link)

Fox Corp. CEO Lachlan Murdoch said at the Goldman Sachs Investors Conference yesterday that the company plans to exercise its option to buy an 18.6% stake in FanDuel. The Wall Street Journal’s Joe Flint notes the company has six years to exercise the option and has begun the process. Murdoch also said bankers approached the company to suggest buying back the RSNs it sold off to Disney for half the price it sold them and noted: “We kept as far away from that as possible.” Fox Sports and Fox News continue to be “must-haves” for any kind of skinny bundle, Murdoch went on to explain, adding: “We haven't taken sports rights out of the traditional bundle” because “we don't need to support” a streaming service. “We are completely committed to the bundle,” which makes Fox a reliable partner to distributors. Murdock called Venu “a tremendous service...designed entirely for cord cutters and cord nevers.” Also, it “doesn't look like a cable service, doesn't look like a bunch of channels.” (link, link)

South Dakota Attorney General Marty Jackley has filed a complaint against the proposed House settlement, on behalf of South Dakota and South Dakota State. From the complaint: “It is common knowledge that the most prominent institutions amongst collegiate athletics are found in the power four conferences, and these institutions reap the greatest benefits from the NCAA amateurism rules. Further, the powerful schools are responsible for the vast majority of the damages for which the settlement is intended to compensate. However, the settlement requires them to shoulder less of a financial burden, and that of their less prominent counterpart.” Jackley: “As a former college student-athlete, I believe strongly in a system that presents our athletes with opportunities to compete and treats all of our athletes fair and equal. I am disappointed that our South Dakota athletes and universities are paying the price for a settlement that did not involve any of our conduct. This settlement unlawfully and blatantly discriminates against female student-athletes by limiting them to less than 10 percent of the proceeds.” Also of note from the filing, on Title IX: “Member schools are prohibited from making revenue share payments to student athletes disproportionate to their participation rates. Categorizing ‘revenue sharing payments’ as something other than ‘financial assistance’ by an institution or the NCAA severely undermines the legislative intent of Congress in enacting Title IX and is not consistent with the NCAA constitutional mandate of gender equity nor the NCAA constitutional commitment to gender equity.” (link, link - full suit)

Four former Michigan football student-athletes have filed a class-action lawsuit against the NCAA and Big Ten Network on behalf of all former football players prior to 2016. The suit seeks more than $50M in compensation for profiting off of their NIL through merchandise, social media clips and broadcasts of classic Wolverines games. From the filing: “Plaintiffs seek a declaration that any assignment of publicity rights is unlawful and unenforceable, a declaration of entitlement to a present and future share of any revenue generated from the use of their publicity rights, including but not limited to the use of their name, image, and likeness, and injunctive relief barring Defendants from using the same absent reasonable remuneration.” (link, link - Full suit)

Virginia Tech boss Whit Babcock talks to The Richmond Times-Dispatch’s David Teel about potential outcomes in Blacksburg of a House settlement: “We have a few sports here that we don’t budget at what I would say is a competitive level, and they really have to overachieve. If you went to a tier system or non-scholarship system, that’s a tough competitive environment for those student-athletes. But certainly, that’s on the table, nationally and not just at Virginia Tech.” Will Tech offer the max revenue share? “I do not have a final answer on that, but I do believe that’s the new floor, so to speak, for competing in the top tier. We will not fund every single scholarship on every single roster spot. That would be an additional $13 million, and I don’t know that having every single student-athlete on full scholarship in every sport is strategically smart. And there’s other ways (such as NIL and shared revenue) to distribute funds.” How about Tech’s appetite for a private equity deal? “Maybe being cutting edge is OK, but I’m not sure being bleeding edge is OK. Somebody else will maybe do it and show us the way. But yes, I do have some reservations. … We’ve had a number of private equity groups approach us, but we have not engaged with any of them and don’t plan to at this time.” (link)

The Detroit Free Press’ JC Reindl details Michigan’s termination of The M Den as its official retailer, as the retailer bounced a $3.8M check earlier this year. After The M Den filed for reorganization bankruptcy last month, U-M is the largest unsecured creditor with $8.8M in unpaid royalties. AD Warde Manuel in a February letter to M-Den Co-Owner Scott Hirth: “Your correspondence ... states an interest in preserving your relationship with the University of Michigan, but M-Den's conduct proves otherwise. Despite M-Den's assurances, its conduct suggests that M-Den is wasting assets, bleeding cash out of the business rather than paying its vendors or paying down its obligation with the university.” Now known as Heritage Collegiate Apparel, the company is working to sell itself, with Legends, the Wolverines’ new official retailer, and Lids bidding for the company. + Wake Forest unveils plans for phase one of The Grounds mixed-use development that will sit between Allegacy Federal Credit Union Stadium and Lawrence Joel Coliseum. Included are a 40,000-sf retail village, a 100,000-sf office building and a 240-unit, 500-bed residential community. Groundbreaking is expected in December, with the first two pieces targeted for completion in summer of 2026 and the latter piece in summer of 2027. Carter and Front Street Capital won the RFP for development of the project. (link)
+ Texas A&M Baseball HC Michael Earley reports the $80 million renovation of Blue Bell Park has “been accelerated.” The work will likely boost capacity toward 10,000, while Earley wants to emphasize the player development complex in the planning. A 360-degree concourse around the stadium with a drink rail remains part of the design. Timeline still TBD. (link)
+ Northwestern State receives a $1.9M donation from alums Dr. Jennifer and David Thornton to support upgrades to NSU’s baseball and softball facilities. The largest one-time gift in school history will cover the installation cost of Geosurfaces PIVOT no infill turf at both Brown-Stroud Field and Lady Demon Diamond, for the padding of baseball’s outfield wall and for the overhaul of the softball complex’s lighting system. The LA Times’ Ben Bolch shares that UCLA is expecting a 10-15% YoY increase in football ticket sales, due in no small part to interest in visiting the Bruins home venue from long-suffering fans of Big Ten teams with extended Rose Bowl droughts. UCLA AD Martin Jarmond: “One of the many benefits of being in the Big Ten Conference is a bigger audience, whether it’s Southern California-based Big Ten alumni and fans, or UCLA alumni in the other Big Ten locales. Some of the Big Ten schools have not had the opportunity to play in the Rose Bowl in decades, if ever, and there is no better setting for college football than the Rose Bowl.” To wit, Minnesota Senior Assoc. AD for External Affairs Mike Wierzbicki opines that “compared to our other Big Ten road games, UCLA has far and away the biggest level of interest among our fans right now,” while Delta has added a direct flight from Cedar Rapids to L.A. in order to accommodate Iowa fans heading west. Sportico’s Daniel Libit reports on new developments for The Players Era Festival including a three-year distribution deal with TNT Sports and a partnership with Publicis Sports. Event co-founder and EverWonder Studios CEO Ian Orefice shares that Players Era, which has committed to spending $50 million on NIL for participants, has already generated “eight figures” in revenue commitments for 2024 and would “not lose a lot of money in year one of the event.” More from Orefice: “Anytime you are challenging a status quo, there’s obviously going to be some friction with those that are trying to protect a previous business model. We recognize our entrance has created some disruptions, but we are unapologetically and relentlessly pursuing a future where the players are legally paid for their value.” Additionally, former CNN President Jeff Zucker, currently the CEO at Redbird IMI, which backs EverWonder, is apparently serving in a “strategic advisor” role. Looks like former Ole Miss/Auburn/Cincinnati Football HC & current Senator Tommy Tuberville (R-AL) is the latest podcast guest for Athletes.org’s Jim Cavale. Tuberville on where college athletics is headed: “We started this whole thing and there were no rules. When I started coaching there was a thick rulebook about what you could and couldn’t do. Now there are no rules. [...] Football is going to eventually go by itself, it’s going to have to because it’s a different animal. [...] If you’re going to get in the money game, like we’re going to get in with players, you’re going to have to get into some form of representation and education for everyone to understand, media on down. Elon has begun an investigation into its football program following allegations of a student-athlete yelling racial slurs during the Phoenix’s game at North Carolina Central. Assoc. AD of Strategic Communications Jason Knavel: “We are aware of the allegations about comments made during Elon’s recent football game. We are looking into this incident and any substantiated allegations will be addressed appropriately by the university. Elon University is a community based on a strong commitment to inclusivity and belonging, and intolerant behavior and comments have no place here.” (link)
