Attorneys on both sides of the House settlement are preparing to file briefs with the court as soon as this week, according to Yahoo’s Ross Dellenger. In response to U.S. District Court Judge Claudia Wilken’s concerns about third-party compensation for student-athletes, plaintiffs’ attorney Jeffrey Kessler says: “I think it was actually more of a lack of clarity. We expect to address those questions and we don’t expect it to be a problem for the judge to approve [the settlement] the next time we go back.” Dellenger notes that language “relating to third-party endorsement (NIL) deals is expected to only be ‘clarified’ and not amended or changed in a significant way. … Any significant change to language regulating third-party pay is described as a ‘non-starter’ and would likely lead many within the industry to choose trial as an alternative.” Kessler says attorneys for both sides have met in recent days and believes “all of those issues can be worked out.” (link)

ESPN’s Pete Thamel reports that “Air Force has emerged as a serious target to be added to the American Athletic Conference. Air Force had emerged in conversations as a potential AAC add in recent months, prior to the Pac-12 taking four Mountain West schools last week.” (link)

Providence AD Steve Napolillo tells the Boston Globe’s Dan McGowan that Connecticut-Big 12 discussions are “going to be a daily story. The Big East is a great conference. It is with them, it was without them, and it will be without them again” if they were to leave. Napolillo adds that, like all conferences, the Big East is “100% looking over our backs” as the realignment wheels continue to turn. “It’s really an arms race. We’re just making sure we have our pulse on things.” (link)

The Missouri Valley Conference saw 86 men’s basketball student-athletes enter the transfer portal this offseason, including 12 of the 16 players voted to the MVC's three all-conference teams. Commissioner Jeff Jackson acknowledges the league’s egress but notes: “I remember two years ago, we were ranked 15th as a conference. After all those (players) departed, and our teams went out and replenished, we ended up ranked ninth or tenth last season. … I think there's a lot of different ways institutions can find to be successful." Bradley HC Brian Wardle also offers an optimistic perspective: "I view this as an opportunity to raise our players up to a higher level. So we have to see where all this goes. It's still changing. But we will be able to do some things, continue to have good basketball, good players. Our program will do everything it can to compete and succeed." Jackson says the league is lucky to have Wardle, who’s been a successful team-builder, even in the new environment. “I'm not sure it's whether you keep a certain student-athlete. What matters is if you have the ability to recruit and to replenish and then have the ability that is necessary as a coaching staff and administrative support and academic support…to create the type of experience where your institution can continue being relevant. … One of the things were all trying to figure out how to manage better is NIL, true NIL, and that's the setting which gets dangerously close to crossing the line of being pay-for-play, which is not an environment I think our institutions want to be in. I don't favor pay-for-play. I do not see us getting into a world where student-athletes become employees." (link)

Portland State has released a statement concerning the cancellation of last weekend’s football game against South Dakota and explains that the whooping cough “diagnosis for the one individual was confirmed Thursday evening, with several additional PSU players exhibiting symptoms of upper respiratory illness, though they had not yet been officially diagnosed at the time of the game. Multiple players were in close contact with the infected individual. … As a precaution, all PSU players who may have been exposed to the illness have begun a five-day course of antibiotics, under the guidance of our OHSU medical professionals. These measures are expected to be completed in time for the team's next scheduled game at Boise State on September 21. Only athletes and staff who have completed the antibiotic regimen will be eligible to travel and participate in the upcoming game.” Full statement. (link)

Meanwhile, South Dakota AD Jon Schemmel writes on X: “Respect PSU’s decision, but it was theirs & theirs alone (not mutual). We (USD) clearly stated ‘We are playing’ to PSU, MVFC, & Big Sky – only after that statement was made did PSU inform us they were not playing. We were not made aware of the situation at PSU until after we landed in Portland Friday afternoon, PSU knew Thursday evening/night. PSU repeatedly said they were intending to play. At no point did we (USD) indicate we were not playing. … Our university leaders were all involved & supportive of our plan to play (very grateful for them). We planned to communicate everything to players before we left the hotel for the game. There are several unresolved issues pertaining to this game.” (link)

Extra Points publisher Matt Brown provides more details on former Colorado Football AC Trevor Reilly’s outreach to Saudi Arabia, including the pitch deck he sent to VisitSaudi.com, which Brown notes is “full of 5430 Foundation branding.” The proposal highlights several social accounts tied to CU, the majority of which are of individuals relating to HC Deion Sanders. The deck explained how the 5430 Foundation collective “sought to fit in with brands and partners, proclaiming that ‘We Are A Hub’ that ‘connects you to Prime & athletes and them to you,’ as well as explaining the concept of NIL deals.” Additionally, the deck “highlighted the growth of these main accounts, along with the success that other brands have had in partnering with [standout student-athlete] Travis Hunter and various Sanders family members. It then appears to ask for $10M dollars.” Brown goes on to note that it’s “unclear if the figures in this specific deck were created for a PIF-centric campaign, or are part of a default media kit. My reading of the documents is that Reilly envisioned a world where the PIF would give X amount of money (perhaps $10M) in exchange for various Colorado and Sanders Family accounts promoting Saudi Arabia.” As for why this responsibility fell to Reilly, Brown notes it’s unusual for ACs to unilaterally engage in such an endeavor, and if NIL outreach was part of his responsibilities, then “why wasn’t he simply named to an NIL or staff development role?” More. Michigan appears to have agreed not to part ways with Football HC Sherrone Moore for cause based on its current knowledge of Moore’s involvement in the alleged sign-stealing scandal, according to USA Today’s Steve Berkowitz and Tony Garcia, who report that Moore’s recently finalized contract states he can be suspended without pay or fired for cause “if the University determines that the Head Coach has been involved in a violation of the Governing Rules, whether prior to or after the Effective Date of this Agreement.” The contract goes on to state that “notwithstanding the foregoing, a violation of the Governing Rules which occurred prior to the Effective Date, to the extent the University had actual knowledge of the facts or alleged facts that are the basis for the violation prior to the execution of this Agreement by all parties, shall not be deemed a basis for termination with cause.” Financial details remain as they were spelled out on the MOU under which Moore had been working. The deal is set to run through Jan. 31, 2029, and Moore's basic compensation for this season is $6M, including the annual $500K retention payment Moore would receive if he is Michigan's head coach through January 31, the day of each contract year. Auburn is generating new revenue streams after “creating new premium options and modernizing Jordan-Hare Stadium’s food and beverage service this past offseason, following multiple successful trials in 2023,” according to SBJ’s Bret McCormick, who notes that last year, “5.7% of Jordan-Hare Stadium’s capacity was premium seating, well below the SEC average of 10.2%. There also was a premium waitlist of nearly 1,000 accounts (equivalent to more than 4,000 individual seats), meaning Auburn had plenty of impetus to create new premium spaces. That manifested in six new permanent field-level suites that sold out for the 2024 season in weeks. An area behind the Tigers’ bench was converted into an on-field space accessible as a purchasable add-on for any ticketholder, while a 1940s era storage space was renovated and turned into the new Locker Room Club (designed by Goodwyn Mills Cawood).” The projects cost $1.5M collectively, and Tigers Deputy AD for External Affairs Rhett Hobart expects they will be paid off in two seasons and begin bringing in $1M annually. Meanwhile, Auburn spent $2.8M modernizing its F&B setup and rolled out stadium-wide alcohol sales this fall, and McCormick reports that in the Tigers’ season opener, overall transactions increased by more than 10K, a 25% increase YoY. In the second game, transactions went up by 9K from the first game, topping 59K (Auburn averaged 43K per game last year). Some stands saw 30% increases in sales.” (link)

Wisconsin Men’s Basketball HC Greg Gard acknowledges that the NIL world is “like any business. You have a budget, you have expenses, you have revenue, (you) have to fundraise. It's market-driven." However, Gard does advocate for more structure, pointing out that “there isn't transparency with this. We don't know if somebody's really getting seven figures at another school. We have the same access that you have, what you see. You just have to choose whether you believe it or not. … Until we get to the point where we have some contracts and we have a regulatory body around it as we walk through this, we're all on our own." Gard adds: "The navigation piece of that has been probably the most challenging, and knowing that we're in a very competitive market, and you have to be very competitive with it. So it adds an extra layer of responsibility and challenges." (link)

Montana women’s soccer student-athletes Taij’a Anderson and Riley Carolan have entered into NIL agreements with the political activism group Montana Together to endorse incumbent U.S. Senator Jon Tester (D). NIL Daily’s Noah Henderson notes student-athletes were offered NIL deals ranging from $400-$2,400, depending on services provided, to produce scripted or unscripted social media videos supporting Tester and his policies. Tester previously stated he was unaware of the Montana Together’s NIL program. (link)

Minnesota State announces the creation of the Maverick Line Change Collective (MLCC), which will serve as the official collective of the MSU Men's Hockey program. Mavericks AD Kevin Buisman: "We are working diligently to keep pace in a rapidly challenging collegiate landscape and the addition of a collective is the next logical step along that continuum. West Virginia AD Wren Baker sits down with the Blue & Gold News’ Greg Hunter and discusses a turbulent 12 months in Morgantown on the men’s hoops front, about which he says: “Now that last year is behind us, I can admit it was the hardest year I ever had professionally. Everyone has some hard years, but you just add in the way everything had happened. Then we all know how important our sports programs are to the state. The weight of that definitely is something you can feel. Adversity is not fun when you’re going through it, but when you reflect back on it afterward, you understand how much you grew. I feel like we emerged from that with me having a better understanding of the University, of the fan base and of the state.” Overall, Baker believes the Mountaineers had a “great year overall,” noting: “When you look across at most of our sports, we had the best seasons, if not one of the best, in most everything else (outside women’s soccer and men’s basketball). I’m really proud of our student-athletes and our coaches. I’m really proud of our support base – our fans and our community. We had some very large crowds in women’s basketball, the largest crowds ever in men’s soccer, our largest crowds ever in baseball. If you looked at how our fans came out and supported us, it was pretty special. West Virginia loves any team that goes out and represents the state in a positive manner.” (link)

JohnCanzano.com’s eponymous publisher is also told the Pac-12 prefers to settle on nine members for football and basketball scheduling purposes and adds: “There’s also a good reason why the Pac-12 is in a hurry to finish expansion, despite the July 1, 2026, deadline to reach eight schools. Membership requirements in other conferences dictate a one-year notice to withdraw. That means the Pac-12 only has until June of 2025 to get things finalized, which makes getting the decisions made by the end of this calendar year a target. I was told by an involved source: ‘Stay close.’ If we’re looking at Pac-12 expansion ONLY through a media value lens, then Tulane, Memphis, and [UTSA] are at the front of the line, per my consultant friends. One reliable and wise media-world source told me: ‘Taking Air Force along with Army and Navy wouldn’t be a bad idea, either. Service games are good TV.’” On how closely tied Nevada and UNLV are and how that might impact UNLV’s departure to the Pac-12, Canzano “was reminded by a former conference commissioner…that there’s a precedent to divide the schools. UNLV joined the WAC and left Nevada behind in the Big West in 1994. Also, the current governor of Nevada, Joe Lombardo, is a UNLV alum. If UNLV and Air Force don’t land in the Pac-12, I’ll bet the American Athletic Conference would take them both. I’m told there has already been contact between those sides.” (link)

Korn Ferry and D1.ticker partnered to invite 24 current ADs and executive-level leaders positioned to guide the industry into the future to take the Korn Ferry Four Dimensional (KF4D) leadership assessment. Built over the last 50 years, the KF4D takes a “whole person” view of leaders, providing information about how they typically prefer to work as measured against 56 elements. For the assessment, Korn Ferry compared this cohort of college leaders’ scores to the benchmark scores of the aspirational Enterprise Business Leader success profile in order to quantify current strengths and identify areas for improvement. Korn Ferry Head of Collegiate Sports Jenna McLaughlin explains that “enterprise leaders are those who sit at the helm of highly transformational companies that deliver extraordinary results. They perform and transform. … As college athletics continues to evolve, athletic directors must now respond to multiple stakeholders simultaneously, all while they handle challenges more complex, situations more ambiguous and duties more significant than their predecessors faced which is where enterprise leadership comes in.” The college leader cohort over-indexed the enterprise leadership success profile in the areas of strategic mindset, collaboration and balancing stakeholders while falling short in the areas of managing ambiguity and customer focus. One participating AD said of the assessment: “This exercise and assessment provided critical insight and analysis to stimulate thought-provoking discussion. Former Florida AD Jeremy Foley joins Texas A&M sports management professor Gregg Bennett’s class to discuss topics including his upbringing and journey to Gainesville, the ups and downs during his time leading the Gators, the future of college athletics and lots more in between. In discussing the power of college athletics, Foley compares sports to a big window through which the world gets a look at the whole university. “If you’re playing it well and you’re on TV a lot and you’re representing well, you can be a tremendous asset to our great institutions. And, conversely, when you're not doing it well – I'm not even talking about just winning – but not living your life the right way or having coach who is not living their life the right way and athletes doing things wrong…then people look at your university and it doesn't look right, doesn't look the same. Therefore, it is incumbent upon us to run our programs the right way.” Foley also talks about investing in women’s sports and says when a student-athlete decides to come to an institution like Florida or Texas A&M that means they could have likely gone anywhere in the country. “So, don’t we have the responsibility to reward that choice by giving them the best experience possible? … And we didn’t do it because of Title IX. That’s the legal obligation. I always said we had a moral obligation. It is the right thing to do. How do I sit in front of a woman and her parents and say, ‘We want you to come here, but your experience is going to be less than our starting quarterback’s?’ How could you even have that conversation? If that is the future of this program, we’ll be ready when it happens. … My job is to make this program better for the future, and if moving to Division I is part of that, we’ll be ready.” Should Morehouse make the move, HBCU Gameday’s Cobi Simmons notes it would “renew the Black Ivy League rivalry with Howard University, another one of the most celebrated HBCUs in the country.” (link)

Johnson v. NCAA plaintiffs’ co-counsel Paul McDonald pens a guest post for Sportico in which he notes the NCAA “opposes college athletes having the same employee rights and protections as student ticket-takers, student seating-attendants and student food concessions workers at NCAA contests. Since Berger v. NCAA was filed in 2014, the NCAA has made its argument by relying upon legal precedent to compare college athletes to unpaid prison labor under the 13th Amendment ‘slavery exception.’ Yet sports media has largely, and inexcusably, failed to cover this outlandish argument at the time of this writing. … To recap, the 13th Amendment abolished slavery and involuntary servitude ‘except as a punishment for crime whereof the party shall have been duly convicted.’ Vanskike v. Peters is the seminal case establishing that prisoners, therefore, are precluded from recognition as employees under federal laws. The NCAA has relied upon Vanskike v. Peters to argue that its tradition of amateurism should be given the same legal deference, and legal effect, as this ‘slavery exception,’ i.e., that NCAA members have the right to treat college athletes like convicted prisoners.” McDonald notes the Third Circuit Court of Appeals rejected this argument over the summer, yet sports media said nothing. Nor did the media speak up when Rev. Al Sharpton and NFLPA issued a joint statement denouncing the NCAA’s prison labor comparison. … Since this is football season, consider this Op-Ed a hand-off to sports media, which, to make its living, relies upon access to black people in college and pro sports. I implore sports media to run with this story, call this flagrant foul, and respect black history and dignity.” (link)

College football GMs, Directors of Player Personnel and other staffers are seeing marked increases in their salaries as their duties expand, 247Sports’ Chris Hummer observes, noting that “the sweeping nature of the job, with salaries that haven't always matched up to the demand, has often led to major turnover in the profession.” 247Sports national analyst Cooper Petagna, a former DPP at Washington and Director of Recruiting at Oregon, tells Hummer: "It's more of an all-encompassing job than people tend to think sometimes. … When you're trying to rationalize it in your head: Is this making sense with how much I'm investing of my life into this and what the payout is financially?" Which is why Alabama GM Courtney Morgan’s $825K salary represents a “watershed moment in the industry,” and Hummer notes Morgan is one of several such staffers making over $300K per year. Others include Oregon Chief of Staff Marshall Malchow ($550K), LSU Senior Assoc. AD for Football Administration Austin Thomas ($425K), Ole Miss GM Billy Glasscock ($425K), Texas Tech GM James Blanchard ($400K) and Auburn GM John Miller ($360K). Blanchard on the difference between college and NFL GMs. "Coaches see schemes and how this guy fits into what I do. Personnel people see skill set and what's the upside of this guy if coaches get him to buy into what we do. It sounds similar but it's two very different lenses. If you think about it from that perspective, it makes a hell of a lot of sense why the NFL split it up.” (link)

ESPN is making a profit off the Pat McAfee Show, the Washington Post’s Ben Strauss tells Puck’s John Ourand: “I did ask ESPN…does The Pat McAfee Show make money for ESPN? And the answer was yes.” Strauss says ESPN didn’t give him specific numbers, saying only that the company is bringing in more money off McAfee’s show than it is paying him on the five-year $85M licensing deal. Awful Announcing’s Brendon Kleen: “Before PMS took over the noon-2 p.m. ET slot on ESPN, the network aired SportsCenter and This Just In with Max Kellerman. So the first factor in the financial calculus around PMS is how ESPN’s cost structure changed from producing those two shows versus licensing PMS. It’s possible and perhaps even likely that ESPN saved some money by paying a flat $15M a year for those two hours of programming which would lower the bar of how much money those two hours would have to bring in to breakeven.” (link)
