Gannon and Ursuline have signed a letter of intent to enter a strategic partnership, for the purpose of, as Gannon President Walter Iwanenko Jr. states: “creating something special that addresses long-term sustainability and has the ability to transform Catholic higher education in the region.” Next steps: “During the next two months, both schools will enter an information gathering or “due diligence” phase that will lead to a Definitive Agreement between the two institutions. That agreement will be subject to several regulatory and accreditor approvals. Concurrently, integration teams will begin working to identify how the schools will best operate together. The entire process could take 12 to 18 months.” (link)

Attorneys on both sides of the House settlement are preparing to file briefs with the court as soon as this week, according to Yahoo’s Ross Dellenger. In response to U.S. District Court Judge Claudia Wilken’s concerns about third-party compensation for student-athletes, plaintiffs’ attorney Jeffrey Kessler says: “I think it was actually more of a lack of clarity. We expect to address those questions and we don’t expect it to be a problem for the judge to approve [the settlement] the next time we go back.” Dellenger notes that language “relating to third-party endorsement (NIL) deals is expected to only be ‘clarified’ and not amended or changed in a significant way. … Any significant change to language regulating third-party pay is described as a ‘non-starter’ and would likely lead many within the industry to choose trial as an alternative.” Kessler says attorneys for both sides have met in recent days and believes “all of those issues can be worked out.” (link)

Morehouse Football HC Terance Mathis was asked if the team is preparing to move up to DI and said: “Yes, there has been talk about moving up, and we’re preparing ourselves for that. If that is the future of this program, we’ll be ready when it happens. … My job is to make this program better for the future, and if moving to Division I is part of that, we’ll be ready.” Should Morehouse make the move, HBCU Gameday’s Cobi Simmons notes it would “renew the Black Ivy League rivalry with Howard University, another one of the most celebrated HBCUs in the country.” (link)

Johnson v. NCAA plaintiffs’ co-counsel Paul McDonald pens a guest post for Sportico in which he notes the NCAA “opposes college athletes having the same employee rights and protections as student ticket-takers, student seating-attendants and student food concessions workers at NCAA contests. Since Berger v. NCAA was filed in 2014, the NCAA has made its argument by relying upon legal precedent to compare college athletes to unpaid prison labor under the 13th Amendment ‘slavery exception.’ Yet sports media has largely, and inexcusably, failed to cover this outlandish argument at the time of this writing. … To recap, the 13th Amendment abolished slavery and involuntary servitude ‘except as a punishment for crime whereof the party shall have been duly convicted.’ Vanskike v. Peters is the seminal case establishing that prisoners, therefore, are precluded from recognition as employees under federal laws. The NCAA has relied upon Vanskike v. Peters to argue that its tradition of amateurism should be given the same legal deference, and legal effect, as this ‘slavery exception,’ i.e., that NCAA members have the right to treat college athletes like convicted prisoners.” McDonald notes the Third Circuit Court of Appeals rejected this argument over the summer, yet sports media said nothing. Nor did the media speak up when Rev. Al Sharpton and NFLPA issued a joint statement denouncing the NCAA’s prison labor comparison. … Since this is football season, consider this Op-Ed a hand-off to sports media, which, to make its living, relies upon access to black people in college and pro sports. I implore sports media to run with this story, call this flagrant foul, and respect black history and dignity.” (link)
