The ACC is exploring a new revenue structure meant to bring an end to its legal battles with Clemson and Florida State. According to Yahoo’s Ross Dellenger, league presidents “recently examined a proposal that would distribute revenue differently to league members in a move to provide stability and preserve the membership of Florida State and Clemson. Nothing is imminent and particulars of the deal remain mostly private…but leaders have reviewed a plan to create a separate pot of revenue to be divided based on media value metrics. This separate distribution would be specifically tied to a school’s television viewership ratings for football and potentially basketball.” Conference leaders are also examining amending the GOR, which Dellenger notes would presumably be shortened. “It is unclear if enough support exists to approve these drastic moves. The belief is that, at the very least, a two-thirds majority is necessary.” Dellenger adds: “The proposal is seen as a temporary solution to keep them in the conference ahead of any court decision over the validity of the grant of rights. A potential loss in court that immediately opens the grant of rights could have a catastrophic impact not only on the ACC but other conferences, setting a precedent for all schools to break what were at first thought to be binding agreements.” (link)

ESPN’s David Hale and Andrea Adelson report the GOR could be shortened to as early as 2030 “to better fall in line with the expiration of TV deals in the Big 12 and Big Ten. While the basic talking points of the proposal had some support within member schools, there were significant questions about the details. As one athletic director who supported the general idea noted, properly evaluating something like TV ratings can be difficult with numerous outside factors influencing kickoff times, networks and ratings share that may not directly reflect a program's value. Several administrators who did not support the proposal did admit there was a potential incentive to continue discussions if it helped insure the future of the conference for the foreseeable future, with one noting that it would be better than seeing the ACC fall apart completely and another suggesting a brand-based revenue split could be inevitable for every league as TV contracts continue to grow and leagues continue to expand. The ACC is also in talks with ESPN,” which has until February 2025 to decide whether to extend the media rights deal from 2027 to 2036. (link)

AAC Commissioner Tim Pernetti was in Memphis yesterday and told reporters that conversations about conference realignment did come up when he spoke to Tigers AD Ed Scott: “And it’s not the first conversation we’ve had about it. In fact, I had a conversation with him about the broader landscape of expansion before…he actually started the job. So we had a good conversation about it. You know, at times like this, the vibe in the league where everybody is sharing information and being transparent with each other, is a very good vibe. And I think information is the most important thing right now. You guys are doing your jobs. Everybody’s speculating and reading. I don’t think the speculation does anybody any good, but we do have a lot of really healthy dialogue going on around us, and it was a really productive discussion. … As far as my comment about the importance of Memphis being successful for the league to be successful, it’s an important market, first and foremost. It’s a terrific brand, which is also the case. And I think the more success we can have here, it will benefit the conference and its membership as well. It’s not to say that their success is any more important than anybody else’s. We want everybody else achieving success as well.” (link)

In remarks to the media yesterday, freshly minted St. John’s AD Ed Kull said raising NIL money will be a priority for the men’s and women’s basketball programs: “I think we’re competing, I think we’re fighting, obviously there’s some good talent that’s arrived here. I’ve heard some large [NIL] numbers in terms of UConn and Villanova, I’ve done some research on that. Marquette as well, so I know there are some high numbers there, too. That’s something that needs to be sustainable, that’s something that needs to continue to grow because I don’t see it going away. We all hope that someday there will be some cap of some sort, but until then that’s gotta be a priority in terms of getting talent here and that’s also an opportunity for us. Yes, we’re going to continue to improve our facilities and continue to invest in capital projects, but if NIL is a means of getting us top talent and helping [Men’s Basketball HC Rick Pitino] win, then that becomes a priority very, very quickly, if not already.” Pitino agrees that it will be important for Kull to prioritize fundraising: “We don’t have football, so I think fundraising is No. 1. I think No. 2 on the agenda, and that’s from the President on down, is to build a social life for the student-athletes as well as the students on campus. We have a very pretty campus, but the student socialization is not great, that has to be No. 2. And then 3, it’s winning for all the sports.” (link)

Tennessee AD Danny White tells The Athletic’s Bruce Feldman he doesn’t really differentiate between NIL and revenue-sharing when it comes to the impact of raising ticket prices and adding a “talent fee.” White: “I really categorize all of it as resources going to the student-athletes, whatever label you want to put on it. If the settlement goes through, that is going to look like an agreed-upon revenue share. I don’t see any iteration where we’re not providing resources to them, if you want to call it NIL, you wanna call it revenue share, the financial reality stays the same.” White also tells Feldman donor fatigue is setting in among donors asked to shoulder the burden of the load: “We need better organization around the whole thing. This is a way for our fan base to help with a portion of it, certainly not all of it. It’s not just NIL and (revenue) share, it’s also the scholarship limits that are also being discussed as part of this settlement. If scholarship limits go away, there’s significant expense with that as well if we want to compete for national championships in every sport that we have, which we’re committed to doing at Tennessee.” On the talent fee itself, White says: “After talking about it a lot, we said, let’s just be transparent with our fans — tell them exactly what it is, and that’s where we came up with the concept of a talent fee.” (link)

Washington AD Pat Chun talks to SBJ’s Ben Portnoy about preparing to share revenue with student-athletes despite having only been at UW for roughly six months. “The nice thing for me is I started at the end of March, and the discussion [around] revenue share started happening a couple weeks after that. That kind of forces all of the niceties to go away, because we needed to come up with some real solutions. In terms of just trying to get to know an athletic department better, nothing helps build relationships and trust like when you have real problems to solve. … I remind everyone we're in the Big Ten and the Big Ten and Washington have always been at the highest levels of benefits and services for student-athletes. More from Arkansas AD Hunter Yurachek on Monday at the Little Rock Touchdown Club on being an AD in the current era: “It has been terrible. It's been awful. [...] In college athletics, we are our own worst enemy. And we find the loophole to every single rule in the rule book, and we found a loophole where we created these things called collectives. And collectives are donors pooling their resources together to pay student-athletes, collectives under the auspices of doing work, charitable work, whether that was tweeting about a charitable organization or signing autographs or making public appearances. But the amounts of money that were getting paid were simply ridiculous and still are ridiculous and they just continue to be ridiculous. Because when businesses are making decisions, you make good business decisions, right? And if you're going to hire a student-athlete to market your business, you're going to pay them market value. Well, collectives aren't paying market value; they're just buying teams. And so that figure has grown to just a ridiculous number, and athletic directors are charged many times with going out and raising those dollars through various means." (link)

Nebraska AD Troy Dannen in a sitdown with NTV News says: “I’ve said many times the standard we should have in this department is that everyone else should aspire to achieve what Nebraska is and who Nebraska is. I’ve told our coaches I don't want to hear what Ohio State or Michigan's doing. I want Ohio State and Michigan to be going to their athletic directors telling them what Nebraska is doing. That should be the standard and anything less than that shouldn’t be acceptable. Doesn't happen overnight, but we're on a pretty good path right now to getting that done.” (link)

Ohio State AD Ross Bjork tells the AP’s Ralph Russo that the future of guarantee games is opaque not just because of their price tags, but also because of the diminished revenue on those game days. Russo notes that “games that don’t involve Big Ten or marquee non-conference opponents drag down revenue in areas such as concessions, souvenirs and parking. Ohio State’s gameday revenue for Akron and [Western Michigan] were almost identical.” Bjork adds: “Meaning there’s a ceiling on those type of games from a revenue standpoint versus when I look at our projections for a Big Ten opponent. Those games can be double, triple, quadruple the amount of revenue that we’re seeing for a guarantee.” Meanwhile, Kent State AD Randale Richmond notes there may be fewer games from a success standpoint among the teams who are making the trips. “I don’t love the model and at the same time understand the things that we have to do financially to run this athletic department, because we do have a great opportunity to impact the lives of young people. And we can only do that if we are meeting our budgetary demands and needs. … It makes it very difficult to gain momentum when you have three guarantee games. I can’t answer whether it’s fair or not. I can answer that it does make it difficult.” (link)

James Madison AD Matt Roan would like to see Bridgeforth Stadium used more throughout the year and says: “Obviously there is a lot of interest. When you look at, 'Are we going to expand? Are we going to re-imagine Bridgeforth?' Whether it’s the east side and beyond those walls, to me it’s always a shame when you make those sorts of investments and utilize it six or seven times a year … We want to look at utilizing suites and club spaces where almost 365 days a year that space is a hub of activity and it’s adding value to our football program, our athletic department and our institution, but I think also our local economy as well.” Roan notes, however, that JMU needs to be discerning about the events it does host at the stadium. “Anybody would assume a concert or concert series of some sort could be something that’s used for. That’s what’s outside. We want to protect the investments that we’ve made. You have to be careful what you put on a field. The last thing we want is a bunch of ruts underneath that synthetic surface that we spent a lot of money on. But I think about the spaces, the suites. Are you hosting dinners on a Friday night? Can you do different banquets?” (link)

Michigan State has received a $10M gift from alumni Kristen and Justin Ishbia. The donation includes $8.5M for the men’s basketball and baseball programs and $1.5M in previous NIL funds for student-athletes. Specifically, their gift will fund the baseball program and facility upgrades with the field at McLane Stadium, renamed from Kobbs Field to Jeff Ishbia Field, in honor of Justin’s father. Justin is the brother of United Wholesale Mortgage CEO/Phoenix Suns and Phoenix Mercury owner Mat Ishbia. (link)

Dartmouth unveils several improvements to Leede Arena, including a center-hung halo board, two end wall video boards and a new Daktronics scoreboard, equipped with in-game statistics sideboards. In addition, the scorer's tables will be outfitted with eight LED boards. Big Green AD Mike Harrity: "Beyond elevating the quality of the fan, coach and student experience, the arena's modernization will allow the facility to better support College-wide events such as the panel discussion with the Surgeons General about the future of mental health and wellness that we hosted in Leede during the last academic year.” (link)

The SEC is using Hawk-Eye Innovations’ video replay system for soccer and volleyball this fall, and SBJ’s Joe Lemire notes the “Sony-owned company is providing its Synchronized Multi-Angle Replay Technology (SMART) solution to capture, replay, clip and distribute video. It is the same system used by the NFL and other major leagues. For soccer, SMART has been installed in every SEC home venue, with six high-speed cameras complementing what’s recorded on broadcast. A replay operator sits in a designated room to review the video and communicate with the referee. In volleyball, 12 high-speed cameras have been added, including six ‘pylon cameras’ on the floor for in/out decisions. In this case, the review referee sits at the scorer’s table.” (link)

Memphis and Tulane are the Pac-12’s next two expansion targets, according to JohnCanzano.com’s namesake, who reports: “Both schools have had back-channel discussions with conference representatives. The two schools are committed to investing in athletics and fit the vision of the new-world Pac-12’s mission. They also add media value.” Canzano doesn’t expect any announcements in the next 48-72 hours and is told by one Power 4 AD: “Media value is the only value that matters. It’s why the Mountain West will fall apart in the end…there is no value left.” Canzano: “On that note, Air Force is exploring a move out of the Mountain West. This week, the military academy became a top target of the American, which already has Army and Navy as members. Is it also on the Pac-12’s wish list, too? Maybe. One industry source told me he didn’t believe the Pac-12 would pursue Air Force as a primary option. Said the individual: ‘I don’t know if the Pac-12 needs them if you’re not going to go after Army and Navy as well.’” Meanwhile, the Mountain West sounds “prepared to litigate if they can’t find footing,” Canzano notes after speaking to one campus leader. “Gloria Nevarez, the Mountain West commissioner, has a law degree from the UC Berkeley School of Law. Nevarez’s statement last week included: ‘All members will be held to the conference bylaws and policies should they elect to depart.’” Also from Canzano: UTSA will get consideration due to market size, USF is a longshot candidate and consideration of Gonzaga is TBD. The reconstituted Pac-12 is not expected to "get much more than the current Mountain West deal,” sources tell CBS’ Dennis Dodd, who notes the “old Pac-12 broke apart basically because Utah President Taylor Randall convinced his peers that the league was worth $50M per school. They were brutally wrong. Will the new Pac-12 make the same mistake as the old Pac-12 in overvaluing itself?” Colorado State AD John Weber tells Dodd: "Yes, it has been vetted. We're confident in our decision. We're confident in our future. We're confident in our opportunity. One thing I've learned in business is every time there is change, there is opportunity associated with that change." As for who might pay the Pac-12 more than the Mountain West, Dodd notes: “A wild card might be Turner, which theoretically has a bunch of money to spend after losing the NBA. Turner's parent company, Warner Bros. Discovery, got the NHL fairly cheaply but spent lavishly recently ($650M) on the French Open. Pac-12 Commissioner Teresa Gould notes: "I feel confident in the team and the expertise I have around me. It's a little premature to start talking about or placing numbers on a media value. Our priority is member strategy." Gould also says geography will not be a limiting factor when it comes to further expansion, as “our presidents and ADs are open to lots of different membership iterations.” (link)

Tennessee AD Danny White tells On3’s Andy Staples the Vols will add a 10% “talent fee” to ticket prices to help offset the cost of paying players directly. White estimates the actual cost of revenue-sharing with new roster limits will be closer to $30M, and UT anticipates the surcharge will cover $10M of that. Staples: “White said the best comparison is restaurants charging large groups an automatic fixed gratuity atop the price of the meal. Tennessee might be the first school to add such a fee, but expect plenty of copycats. As college sports’ economic model evolves, schools will need to find a way to fund player compensation without forcing donors to choose between players and the capital projects and administrative costs they’ve traditionally helped fund.” White also tells Staples the Vols couldn’t wait for the House settlement to unfold before making plans to raise money for student-athletes. “You’re trying to solve a problem when you don’t know a lot of the details. We’re doing different scenarios all the time, but we can’t just put a 10% fee in the laps of our fans with a month before the season starts. We have to be prepared. There are financial realities. In any scenario, it’s going to become more expensive to compete at the level we want to compete at.” (link)

Meanwhile, Georgia Governor Brian Kemp has signed an executive order prohibiting the NCAA or any conference or organization from enforcing or taking “adverse action” against Georgia schools for facilitating or offering NIL compensation to athletes. The EO states that until the House settlement is approved and in place, “legislative and executive actions across the country create a patchwork of inconsistent rules regulating intercollegiate athletics.” Georgia AD Josh Brooks and Georgia Tech AD J Batt issued a joint statement released by Georgia Tech which reads: “We extend our sincere gratitude to Governor Brian Kemp for his leadership today. In the absence of nationwide name, image and likeness regulation, this executive order helps our institutions with the necessary tools to fully support our student-athletes in their pursuit of NIL opportunities, remain competitive with our peers and secure the long-term success of our athletics programs.” (link, link)

House case plaintiffs’ attorney Jeffrey Kessler reiterates to On3’s Pete Nakos that parties involved in the settlement continue to work on “clarification” of the language. “The discussions have been productive. … We’ll be able to agree on some clarifying language that will immediately move forward and be a benefit to the athletes. That’s what we believe is going to happen. And we’ll know in the next week or so. … We’ll submit it when it’s ready. We told the court we would report within three weeks, and so it’ll be before the time we told the courts. When it’ll exactly be, I don’t know, but when it’s ready, it’ll be submitted.” (link)

North Carolina AD Bubba Cunningham joins the Ovies + Giglio podcast and discusses the future of Football HC Mack Brown, saying: “When you hire someone his age, you worry about recruiting. Then when you watch him work, you realize that recruiting energizes the guy. And so the season does the same thing, so the conversation with Mack is as long as you're happy doing what you're doing, you’re energized doing what you're doing, we’re having success, you can coach you as long as you want and he's been great to work with.” Cunningham also notes that he has ongoing conversations with coaches, not just at the end of the season when they’re generally tired. On former Tar Heels Women’s Soccer HC Anson Dorrance: “He didn’t come to the conclusion he was tired at the end of the season. He came to the conclusion he didn’t have the energy to start the next season.” Asked whether he’s still participating in a college football think tank spearheaded by TurnkeyZRG CEO Len Perna, Cunningham says he’s been thinking for several years that the industry is headed toward some sort of collective bargaining, and “to me, the simplest one that we have that we haven't utilized is the CFP. The CFP has 11 games…and it has one contract and one group of students that play. Every other television contract has multiple sports, multiple kids, multiple tentacles that are harder to separate, so it's always seemed to me that that football nexus is the most logical one to create some kind of a collectively bargained situation, so anybody that wants to talk about how we make it better and how we provide more resources to those that generate it given this environment I'm happy to talk to them.” More from Cunningham. + Houston’s football stadium will be rechristened as Space City Financial Stadium after Texas Dow Employees Credit Union (TDECU) on Tuesday announced a merger with Space City Credit Union. The company will rebrand to Space City Financial. The Houston Chronicle’s Joseph Duarte notes the merger, “which still needs regulatory approval, is expected to be completed later this year. A name change won’t take place before the first quarter of 2025, plenty of time for signage to be updated in time for next season.” (link); The Cougars are also adding new Terrace Boxes as premium seating at the Fertitta Center ahead of the men’s basketball season. The new four-seat, banquette-style boxes will be located on the concourse level, and fans who purchase them will receive four tickets to all regular-season men’s hoops games, in-seat service and access to the Sideline Club. + Indiana State and Union Health agree to a three-year partnership which includes prominent placement of the Union Health logo on the Hulman Center basketball court, as well as naming rights to the Mezzanine and Suite. + Wichita State has broken ground on a roughly $20M softball-only indoor practice facility after raising enough money to start the $9.65M first phase.
