The Pac-12 has filed a legal complaint against the Mountain West in which it calls the “poaching penalties” owed to the conference unlawful, unenforceable and a violation of antitrust law. According to Yahoo’s Ross Dellenger, the suit is not related to the $37M in exit fees but states: “There is no legitimate justification for the ‘poaching penalty.’ In fact, the MWC already seeks to impose tens of millions of dollars in ‘exit fees’ on MWC schools that depart from the conference. To the extent the MWC would suffer any harm from the departures of its member schools, these exit fees provide more than sufficient compensation to the MWC.” The Pac-12 also asserts, per Dellenger, that the Mountain West “imposed the poaching penalty on a disadvantaged and desperate conference attempting to find competition for hundreds of athletes at Oregon State and Washington State. The two schools acknowledged during negotiations that the penalty was unenforceable and illegal.” From the complaint: “In the wake of this mass exodus from the Pac-12 caused by fierce competition from rival conferences, the Pac-12 had only months to salvage the 2024-2025 season and create opportunities for its one thousand student-athletes to compete with other schools.” (link)

The Mercury News’ Jon Wilner reports the Pac-12 has hired “San Francisco-based firm Keker, Van Nest and Peters, which represented Washington State and Oregon State in their successful 2023 lawsuit against the former Pac-12 schools” to represent it, and “Eric MacMichael, who took a leading role in court for the plaintiffs, is the first attorney listed on the complaint.” The suit also states that Mountain West Commissioner Gloria Nevarez “demanded” $30M from the Pac-12 in exchange for a scheduling partnership next fall, more than double the $14M the Pac-12 paid for a dozen matchups with Mountain West teams this season and adds that the poaching penalties hinder “the ability of MWC member schools to benefit from competition among athletic conferences – placing one of their most logical options at a severe competitive disadvantage.” As for why the Pac-12 agreed to the penalty, the complaint states: “Knowing that the Pac-12 was running out of time and short on leverage, the MWC not only charged the Pac-12 supra-competitive prices to schedule football games—over $14M for OSU and WSU to play just six games each—but it also forced the Pac-12 to accept an unprecedented Poaching Penalty provision wholly unrelated to scheduling football games and designed to limit the Pac-12’s ability to compete with the MWC for years into the future, even after the Scheduling Agreement will expire.” (link)

“The Pac-12’s rebuilding effort could, ultimately, result in the destruction of its sister conference (the Mountain West) if UNLV accepts its offer to join,” according to Yahoo’s Ross Dellenger, who adds: “Such a move could trigger a domino effect that may lead to the league dissolving itself, presumably including the elimination of exit fees and other penalties for those members departing the conference.” The departure of UNLV would also “likely send Air Force into more serious negotiations with the [AAC]. … If it agrees to leave, Air Force would be the seventh member to exit the conference. According to Mountain West bylaws, support from nine of the 12 football members is necessary to dissolve the conference. In short, two of the five remaining Mountain West members – Wyoming, Hawaii, San Jose State, Nevada and New Mexico – would have to vote in support of dissolution. The question looms: Would the Pac-12 invite two of them to avoid what amounts to more than $120 million in exit and penalty fees?” One AD with knowledge of the situation tells Dellenger: “That’s the play, honestly.” (link)

Her guidance and leadership of SU Athletics through this period of progress and success was pivotal in our university being invited into the West Coast Conference. Sportico’s Michael McCann notes that U.S. District Court Judge Mark Pittman last week issued a preliminary injunction against the NLRB “based on a company’s argument that NLRB administrative law judges are unconstitutionally insulated from the president’s removal powers. This is an important decision in the college sports context. If [NLRB Administrative Law Judge Eleanor] Laws finds that USC players are employees, the school, conference and NCAA could seek review by the agency’s board in Washington, D.C., and separately challenge the constitutionality of Laws’ order.” McCann also points out that the winner of the presidential election will likely also have significant bearing on whether student-athletes are designated as employees. While neither former President Donald Trump nor VP Kamala Harris have stated a position on the matter, McCann points out that President Biden’s pick for NLRB general counsel, Jennifer Abruzzo, “has played a historic role in advocating for college athletes as employees.” Meanwhile, Trump’s former NLRB general counsel, Peter Robb, “rescinded a (2017) memorandum authored by his predecessor, Richard Griffin, that had reached a similar position as Abruzzo: College athletes are employees. On the other hand, several Trump-appointed judges, including U.S. Supreme Court Justices Brett Kavanaugh and U.S. District Judge Clifton Corker, have authored judicial opinions that praise athletes’ economic rights and besmirch amateurism.” (link)

Tennessee AD Danny White tells CBS’ Dennis Dodd that if the Vols’ 10% talent fee “was about just cold-hearted business we could have gone up 25% and I still think we'd be sold out. We had that much demand." In fact, Dodd notes ticket renewals are tracking at 90% and writes: “Usually, if you increase ticket prices 14.5%, there is a corresponding drop in fan interest for those tickets. White is betting current season-ticket holders, as well as those on the waiting list, will crawl through Tennessee River mud to get those seats. … It is also an edgy move that invites NCAA enforcement to take a look. These are, after all, what seem to be direct payments to athletes. But the underlying impact of the increase is chaos. More of it is good for the current system. That is, if that chaos leads to collective bargaining. A lot of ADs believe in it, but can't or won't say it. Collective bargaining – whether it comes in the form of a union or employment status – provides cost certainly.” Also from Dodd: “The upside of White's ticket plan is impressive. Tennessee's ticket revenue was $75M for football last year. When it's all said and done, White hopes to increase that number to the "high $80s next year if we sell out, which I expect we will." VCU will consider paying its student-athletes, and Rams’ AD Ed McLaughlin estimates that may cost the athletic department between $3M and $5M per year, though he acknowledges those figures are “mere speculation.” According to the Richmond Times-Dispatch’s Eric Kolenich, it is “unclear how much a VCU basketball player would command. McLaughlin told the board of visitors that some athletes in the Atlantic 10 Conference have made $200K to $300K a year – in addition to their scholarships.” (link)

Penn State has received a $5M gift from Playfly Sports, bringing the Nittany Lions’ total fundraising efforts for renovations to Beaver Stadium to $60.25M. Nittany Lions AD Pat Kraft: "We are very grateful for Playfly Sports and their commitment to Penn State Athletics, not just as our MMR [multimedia rights] partner, but in this important project for our department and University. As a Pennsylvania-based company, Playfly Sports understands the economic and cultural significance Beaver Stadium and Penn State Football hold in our community, region and state. ECU has received a “record-breaking gift from Bill Clark Homes, the largest investment in the 63-year history of the Pirate Club,” to close out the funding for the Isley Indoor Performance Center and spearhead a final push to fully fund the Dick and Sarah Bennett Baseball Building expansion project. Bill Clark Homes has also pledged to match up to $1M to help close the remaining gap in funding the baseball building expansion. The Pirate Club will launch a week-long giving initiative to complete this funding and move the project forward. (link)

Delaware State is seeking to become the first HBCU with an indoor practice facility and has launched a dedicated website to provide information on the “pioneering initiative.” Plans for the facility call for it to be 70K square feet and include a 50-yard turf field, new football lockers, football team meeting and lounge spaces, coaches’ suites and offices, academic study labs, a dining facility, reception area and refueling stations. The South Carolina-focused Garnet Trust is launching 1801 Media, a new media company created in partnership with The College Sports Company and NOCAP Sports. According to SBJ’s Ben Portnoy, the “venture is designed to create branded content that will center on Gamecocks athletes including social media posts, video series and podcasts. The revenue generated via that content will be paid to athletes by Garnet Trust, while it will count on top of whatever agreements those athletes already have in place with the collective. The South Carolina-centric shows are, at first, expected to feature football and men's and women's basketball. Long-form videos will be available on YouTube, while segments from the varying shows will be clipped for social media as well.” College Sports Company and NOCAP Sports have launched similar ventures at Louisville and Penn State. Realignment Ramifications…
+ Utah State will join the Pac-12 as the reconstituted league’s seventh member, according to multiple reports, and Yahoo’s Ross Dellenger notes: “Mountain West Commissioner Gloria Nevarez set a 5 p.m. MT Monday deadline for schools to sign a deal as the Pac-12 raced to poach more members. That deadline passed without a signing from UNLV.” The Athletic’s Chris Vannini points out that the addition of Utah State “increases the Pac-12’s poaching fees owed to the Mountain West to $55M, while adding another Mountain West school would raise that again to $67.5M, on top of the about $18M owed by each departing Mountain West school in exit fees. That’s nearly $150M to recreate almost the exact same league they were just in.” Also from Vannini: “There have been some hard feelings between Mountain West schools after the initial four defected two weeks ago, blindsiding the others. One reason the remaining eight hoped to stay together was to stick it to them, either through receiving the tens of millions of dollars in exit fees or to get invited in as a group. But Utah State’s move may torpedo those hopes.” Dellenger notes that as of last night the Mountain West was still waiting on commitments from San Jose State and Nevada as well and that the MOU Air Force and other MWC teams signed – which included a $10M bonus for the Falcons – was “tied to the league being a … league. The Mountain West needs at least eight full members to qualify as a league under NCAA/CFP policy.” (link, link, link, link)
+ ESPN’s Pete Thamel adds: “Expect Air Force and UNLV to be in close contact about the future. Air Force and UNLV were both lockstep when they signed MOUs to commit to the Mountain West today. With those not valid because all eight schools didn’t commit, expect UNLV and AFA to be in close touch. … With UNLV’s interest outside the Mountain West with the Pac-12, Air Force’s interest outside the MWC would be with the AAC to keep ties to the other service academies.” (link, link)
+ USA Today’s Dan Wolken is told by a consultant that Memphis “is not valued by TV rights holders significantly more than, say, Utah State. And Oregon State and Washington State, the two original Pac-12 leftovers who decided to bring the conference back, aren’t valued much more than Memphis. In other words, the new Pac-12 was not going to be a power conference no matter which of the potential members jumped in. And the notion of a $12M per member payday, which had been the carrot for a school like Memphis (currently making around $8-9M in the AAC) was merely theoretical and based on calculations from the Pac-12’s paid consultants that few people across the college sports industry actually believed. But it’s also why, when Memphis wanted its substantial AAC exit fees paid for by the Pac-12, the new league looked at the math and decided that it wouldn't be good business to subsidize a potential $20 million move with a school that wasn’t going to actually add much more to its bottom line.” Wolken also reports that Memphis “engaged the Big East last week to explore the possibility of joining in basketball and other sports while going to the Pac-12 in football only. But given the quick timeframe, concerns about fit from the Big East side (the league is all private Catholic schools except UConn) and the lack of certainty about Pac-12 money, Memphis had little choice but to recommit to the AAC for now.” (link)
+ San Diego State President Adela de la Torre on why SDSU didn’t seek a counteroffer from the Mountain West before accepting the Pac-12’s invite: “I don’t think it’s like other business deals where they’re offering me this, hey, what are you going to give me? This is not really how presidents operate. You have to understand the constraints that we live in, and they are different than the constraints [ADs] live in. We did what we thought was important, and we got the job done.” (link)

Charlotte AD Mike Hill’s new contract, which runs through June 30, 2030, includes a raise from $325K to $400K annually, per CollegeAD, which also reports that beginning on July 1, 2025, Hill will receive an annual raise of $20K or an amount approved by the state legislature, whichever is greater. Hill will also earn $250K annually in supplemental compensation, and he received $60K in recognition of a top 100 finish in the Learfield Directors’ Cup and five 49ers sports that won AAC championships. Should Charlotte part ways with Hill without cause, he would be owed the remainder of his base salary for the rest of the contract. Should Hill leave, he would owe the 49ers 50% of his remaining base salary for the duration of the contract. (link)

Fresh off said four-year contract extension, Charlotte AD Mike Hill tells the Charlotte Post’s Cameron Williams: “I’m with the fans and media who cover us. I want to win football games now and I want to win basketball games now. But that is easier said than done. If you charted a path for a football program 11 years ago or 12 years ago, what the plan to succeed would be, it would not be to play two years of FCS and jump up to Conference USA. Then, move again to an even tougher league [the AAC]. That’s not how you would draw it up, but that’s when our opportunities arose, and we had to grab those.” Hill notes Charlotte has grown its athletics resources by 25% in the last six years, increasing its budget from $29M to $38M: “We’ve been able to secure a place and a better conference, a really strong league that’s given us more visibility. That’s impacting recruiting in the way we need it to. Our annual giving has doubled in the last six years, and so all of these are, again, healthy signs of a program that’s trending in the right direction.” Hill on his philosophy with coaches: “You’re assessing and evaluating all the time, but also supporting. The last thing you want to do as an athletics director is make your presence felt on a head coach like you are breathing down their neck, and you have to win [a certain number of] games now, or else that is not a great way to lead. So, you have regular conversations, you’re engaged and you’re paying close attention. But listen, coaches at every level in college football and college basketball right now, their jobs are harder than ever.” (link)

Montana President Seth Bodnar sounds off on the House settlement: “Our frustration is, as we think about this back pay…is that we want that to be equitable. We don't want that burden to fall more heavily on smaller universities like ours, where truly amateurism is alive and well at our level. We'd like to see that distribution of how that pay is spent to be more equitable.” (link)

Freshly minted Florida A&M AD Angela Suggs said during her introductory press conference yesterday that she wants to hear from members of the athletic department: “There’s no way I can come into a plan without having spoken to our coaches, student-athletes, stakeholders, and fans about the experience they will pour into time and time again. I’ve got to hear and understand what’s going on because anything else would be me assuming that I know – and I don’t. And listening is a part of learning. We’re going to be solution-focused and results-oriented. And the only way we can do that is to hear what solutions are required.” Big picture, Suggs says her “vision for FAMU Athletics is to win championships, create a stellar student-athlete experience, and create an experience for our coaches and staff. Bring FAMU into the community, bring championships home, and contribute to what is a championship town. It’s the hometown success, what Tallahassee is about, and what Florida A&M is about.” (link)

Ohio State AD Ross Bjork says membership to the 1922 Club could bring in upwards of seven figures in new revenue: “Some of it will be dependent on how many we sell, but we could be looking at several million dollars in net revenue on an annual basis. It’s not insignificant. … We all battle the 75-inch TV and the couch, so how do you make the game-day experience very similar to where they have creature comforts and easy access to food and beverage, easy access to restrooms, things like that? That’s the premium experience.” OSU also sees the year-round operation of the 1922 Club as a benefit, and Bjork notes demand has been high for the guided tours of Ohio Stadium that began in April. “It shows you that people want to be inside our stadium, and so how do we capitalize on that and create a unique space? The ability to do it was there, and the team has been working on it for a while. Now we’re getting it off the ground.” (link)

SBJ’s Bret McCormick examines South Carolina’s approach to its 885-acre mixed-use RFP and notes that “college venue-adjacent, mixed-use development offers an intriguing but mostly unproven prospect for private developers, who generally seek 6% to 7% returns on their initial capital investment.” Carter President/CEO Scott Taylor explains: “The universities prefer not to have any financial liability – they don’t want to impair their balance sheets at all. Balancing that from a private investor standpoint is the No. 1 challenge; you want to be involved with these really interesting, exciting projects, but you still have to make sure the numbers work. We are the ones typically taking the financial risk.” McCormick observes that while many ADs envision these types of projects, “their institutions and athletic departments tend to be limited in their ability to engage in them by process inflexibility and bureaucracy, a lack of in-house expertise, or both. In South Carolina’s case, the point person running the Williams-Brice development project, Chance Miller, was hired as the athletic director at Coastal Carolina in June, forcing the school to find someone new to lead the project internally.” In regards to the Gamecocks’ RFP itself, McCormick notes: “Developers that Sports Business Journal spoke with said the open-endedness of the USC RFP wasn’t helpful. The lack of direction plus the seemingly invaluable land – much of it far removed from the university’s brand (that’s where the value is on these projects) and prone to flooding – made the RFP feel almost like an excess land offering. Seen another way, the open-endedness is the university acknowledging its limited development expertise, while potentially signaling openness to out-of-the-box suggestions.” Lots more. The Cotton Bowl’s two-year, $140M renovation is “roughly half complete" according to the Dallas Morning News’ Brad Townsend. The project’s principal Bryan Trubey tells Townsend the unfinished half is mostly “the half that a lot of it is underground; a lot of its infrastructure. It’s not as cool-looking as the second half — because when you get the second half done, you’re finished. But it’s a significant accomplishment for the whole team. It’s significant because we haven’t improved this building anywhere near this much in really, 60 years. It’s a great investment for the city of Dallas.” Townsend notes the most noticeable part of the renovation is the completion of “concrete structures that will house 14 escalators on the stadium’s perimeter. Those escalators will enable fans to access the stadium’s upper sections without going through the main ground-level concourse.” Progress photos inside. (link)
