Realignment Ramifications…
+ Mountain West Commissioner Gloria Nevarez released a statement addressing the Pac-12’s lawsuit. It reads, in part: “It is my responsibility to protect the Conference and always keep its best interests in mind. The Pac-12 Conference is challenging a contractual provision that it expressly agreed to and acknowledged was essential to the Mountain West Conference’s willingness to enter into a Scheduling Agreement, all while advised by sophisticated legal counsel. The provision was put in place to protect the Mountain West Conference from this exact scenario. It was obvious to us and everyone across the country that the remaining members of the Pac-12 were going to try to rebuild. The fees at issue were included to ensure the future viability of the Mountain West and allow our member institutions to continue providing critical resources and opportunities for our student-athletes. At no point in the contracting process did the Pac-12 contend that the agreement that it freely entered into violated any laws. To say that the Mountain West was taking advantage of the Pac-12 could not be farther from the truth. … Now that they have carried out their plan to recruit certain Mountain West schools, they want to walk back what they legally agreed to. There has to be a consequence to these types of actions.” (link)
+ JohnCanzano.com’s eponymous publisher “knew the Pac-12 was annoyed with the Mountain West Conference but didn’t grasp how pissed it was until Tuesday. … Pac-12 staff was frustrated as it ended the negotiation to extend the football scheduling agreement with the MW earlier this month. On the Sunday night when negotiations broke down, one source called the MW’s position ‘delusional.’ The court filing on Tuesday underscored that. It indicated that the Mountain West aimed to boost the annual scheduling payout from $14M this season to $30M next season. A MW executive confirmed that the conference upped the asking price to $30M. But only did so as a negotiating ploy after the Pac-12 made the Mountain West thought was a lowball offer – $7M.” Canzano also reports that Mountain West Commissioner “Gloria Nevarez became aware that the Pac-12 was in contact with some of her schools. But she did not know that it was ready to steal the top half of her conference. What the Pac-12 didn’t know was that the Mountain West commissioner was about to go on offense herself. Nevarez had discussed the idea of trying to split up Washington State and Oregon State, per an insider…but that plan never got off the ground.” Regarding the legality of the poaching penalties, attorney Matthew Wand tells Canzano: “The contract allowed the Mountain West to carve up the marketplace — that’s a direct violation of The Clayton Antitrust Act.” Wand also remarked after reading the complaint: “I’d say the Pac-12 is pissed off, and it wants to torch the entire agreement.” Meanwhile, Canzano observes: “The Mountain West is probably wondering why the conference doesn’t just take a few more of its members and cause it to dissolve. The truth is, it could. But the Pac-12 doesn’t want the rest of the members. It wants UNLV.” (link)

Former Pittsburgh AD Heather Lyke is expected to “at least temporarily” take the reins of LEAD1 following President/CEO Tom McMillen’s departure, according to CollegeAD, which also reports the organization is expected to engage in a more collaborative relationship with NACDA. One source says: “It looks like they’re going to LEAD1 under NACDA.” Another says: “It’ll still be autonomous to the FBS ADs but kind of incorporated with NACDA, so you’re not going to have too many separate events throughout the year and you can combine them.” (link)

UTSA AD Lisa Campos says of how the decision to remain in the AAC impacts the Roadrunners' annual revenue distribution from the league going forward: “Even prior to the recent discussions on realignment, the AAC has demonstrated a strong commitment to enhancing UTSA’s share within the conference through various revenue streams. They have honored their commitment to the revenue distribution, resulting in a distribution that exceeds our initial agreement.” (link)

Sacramento State releases the results of a feasibility study conducted by Collegiate Sports Solutions on a potential move to FBS. Among the primary recommendations are enhancements to the football and basketball facilities as well as increased resources for student-athletes. Specific facilities enhancements recommended include expanded seating, enhanced media and team areas, and increased revenue opportunities via premium seating and sponsorships. Verizon will make a “strong eight-figure” investment to improve the cellular service at Nebraska’s Memorial Stadium next year, according to Huskers AD Troy Dannen, who explains the department “looked at could we do anything to the Wi-Fi system shy of the stadium construction, and as I understand it, anything we put in, any repeaters we put in anywhere in the stadium are going to come down when the stadium is is rebuilt anyway. So I think the choice is going to be hopefully we can get the cellular system up and improved a little bit. Wi-Fi, it’ll be state-of-the-art once the new stadium is done in the ‘27-’28 timeline.” (link)

UNLV starting quarterback Matthew Sluka has decided to use his redshirt year, announcing yesterday that he is done playing for the year. Sluka: “I have decided to utilize my redshirt year and will not be playing in any additional games this season. I committed to UNLV based on certain representations that were made to me, which were not upheld after I enrolled. Despite discussions, it became clear that these commitments would not be fulfilled in the future. I wish my teammates the best of luck this season and hope for the continued success of the program.” He is a fifth-year senior and has one year of eligibility remaining. (link)

Here are the most-watched college football games from the weekend via SBJ’s Austin Karp: USC-Michigan (CBS): 6.32M; Tennessee-Oklahoma (ABC): 6.27M; Illinois-Nebraska (Fox) 4.21M; Marshall-Ohio State (Fox): 3.96M; Baylor-Colorado (Fox): 3.64M; UCLA-LSU (ABC): 2.73M; and Florida-Ole Miss (ESPN): 2.64M. (link); Sunday’s Louisville-Nebraska volleyball match on ABC averaged 684K viewers with a peak of 808K, making it the most-watched regular season match ever on ESPN platforms. Puck’s John Ourand notes that CBS’s agreement to sublicense Big 12 basketball games from ESPN “offers a unique window into how each of these entities views media rights. … For [Big 12 Commissioner Brett] Yormark, any deal that moves his games off of ESPN+ and on to a broadcast or cable network portends a higher value for his overall rights deal, which comes up for renewal in 2031. CBS, for its part, wanted more top basketball games in support of its March Madness centerpiece. And ESPN, which has seemingly endless college basketball inventory and loads of future costs as it rolls out its streamer, is happy to accept the passive income.” (link)

FloSports next month will launch FloCollege, which will be available to the general public for $19.99 per month or an annual commitment of $107.88 ($8.99 per month). Students can subscribe to the platform at a discounted annual rate of $71.88 ($5.99 per month) or monthly at $9.99. SBJ’s Ben Portnoy reports that “as part of the launch, FloSports will invest upward of $50M into FloCollege to support rights fees, production, content, product technology, and marketing. That commitment comes after the company has seen a 37% increase in viewers for football and a 45% increase for soccer since the start of the 2024 fall season. FloCollege will be available on Roku, Apple TV, Amazon Fire TV and Android TV devices. It will also be available on the internet and for download on mobile devices via the FloSports app.” (link)

Baylor, Maryland, Texas and UCLA will play in the inaugural Coretta Scott King Classic, a women’s basketball showcase scheduled for January 20, 2025, in Newark. The event is being organized by Playfly, HBSE and Fox Sports, which will air the games. Playfly Sports Consulting Co-Head Michael Neuman: “It was important to not only create a women's event but to create one with deeper meaning and purpose – one that would energize student athletes, coaches and our brand partners -- because we're not the only sports entity thinking about this right now. There's a lot more opportunities for the top women's teams to participate in events like this. It was really important for us to be super different, and the reaction from the top teams in women's college basketball was instant validation that this event would resonate with them in ways that others have not.” SBJ’s Ben Portnoy notes this is the “first time Dr. Martin Luther King and Coretta Scott King’s names have been licensed for a sporting event” and that the “arrangement came via the CSKC joint venture groups partnering with The King Center to launch the event.” (link)

With the publication of the Best Colleges rankings, the ACC has released a statement noting that it has “led all FBS conferences in the best average rank in each of the last 18 years. This year’s 51.7 average rank of ACC schools is the best among all FBS conferences; two ACC schools rank in the top 10, only one other school in an FBS conference is in the top 10; four ACC schools rank in the top 20, no other FBS conference has more than two; six ACC schools are among the top 30 in this year’s rankings, also the most among all FBS conferences; and the ACC has 14 member schools among the top 70, no other FBS conference has more.” Commissioner Jim Phillips: “ACC schools are dedicated to providing every student-athlete with a world-class academic experience and the highest level of athletic competition. Our schools' unwavering commitment to comprehensive excellence continues to be prominently recognized. We must never lose sight of the academic connection to intercollegiate athletics and the importance of these experiences for the long-term future of our student-athletes.” (link)

The Pac-12 has filed a legal complaint against the Mountain West in which it calls the “poaching penalties” owed to the conference unlawful, unenforceable and a violation of antitrust law. According to Yahoo’s Ross Dellenger, the suit is not related to the $37M in exit fees but states: “There is no legitimate justification for the ‘poaching penalty.’ In fact, the MWC already seeks to impose tens of millions of dollars in ‘exit fees’ on MWC schools that depart from the conference. To the extent the MWC would suffer any harm from the departures of its member schools, these exit fees provide more than sufficient compensation to the MWC.” The Pac-12 also asserts, per Dellenger, that the Mountain West “imposed the poaching penalty on a disadvantaged and desperate conference attempting to find competition for hundreds of athletes at Oregon State and Washington State. The two schools acknowledged during negotiations that the penalty was unenforceable and illegal.” From the complaint: “In the wake of this mass exodus from the Pac-12 caused by fierce competition from rival conferences, the Pac-12 had only months to salvage the 2024-2025 season and create opportunities for its one thousand student-athletes to compete with other schools.” (link)

The Mercury News’ Jon Wilner reports the Pac-12 has hired “San Francisco-based firm Keker, Van Nest and Peters, which represented Washington State and Oregon State in their successful 2023 lawsuit against the former Pac-12 schools” to represent it, and “Eric MacMichael, who took a leading role in court for the plaintiffs, is the first attorney listed on the complaint.” The suit also states that Mountain West Commissioner Gloria Nevarez “demanded” $30M from the Pac-12 in exchange for a scheduling partnership next fall, more than double the $14M the Pac-12 paid for a dozen matchups with Mountain West teams this season and adds that the poaching penalties hinder “the ability of MWC member schools to benefit from competition among athletic conferences – placing one of their most logical options at a severe competitive disadvantage.” As for why the Pac-12 agreed to the penalty, the complaint states: “Knowing that the Pac-12 was running out of time and short on leverage, the MWC not only charged the Pac-12 supra-competitive prices to schedule football games—over $14M for OSU and WSU to play just six games each—but it also forced the Pac-12 to accept an unprecedented Poaching Penalty provision wholly unrelated to scheduling football games and designed to limit the Pac-12’s ability to compete with the MWC for years into the future, even after the Scheduling Agreement will expire.” (link)

“The Pac-12’s rebuilding effort could, ultimately, result in the destruction of its sister conference (the Mountain West) if UNLV accepts its offer to join,” according to Yahoo’s Ross Dellenger, who adds: “Such a move could trigger a domino effect that may lead to the league dissolving itself, presumably including the elimination of exit fees and other penalties for those members departing the conference.” The departure of UNLV would also “likely send Air Force into more serious negotiations with the [AAC]. … If it agrees to leave, Air Force would be the seventh member to exit the conference. According to Mountain West bylaws, support from nine of the 12 football members is necessary to dissolve the conference. In short, two of the five remaining Mountain West members – Wyoming, Hawaii, San Jose State, Nevada and New Mexico – would have to vote in support of dissolution. The question looms: Would the Pac-12 invite two of them to avoid what amounts to more than $120 million in exit and penalty fees?” One AD with knowledge of the situation tells Dellenger: “That’s the play, honestly.” (link)

Her guidance and leadership of SU Athletics through this period of progress and success was pivotal in our university being invited into the West Coast Conference. Sportico’s Michael McCann notes that U.S. District Court Judge Mark Pittman last week issued a preliminary injunction against the NLRB “based on a company’s argument that NLRB administrative law judges are unconstitutionally insulated from the president’s removal powers. This is an important decision in the college sports context. If [NLRB Administrative Law Judge Eleanor] Laws finds that USC players are employees, the school, conference and NCAA could seek review by the agency’s board in Washington, D.C., and separately challenge the constitutionality of Laws’ order.” McCann also points out that the winner of the presidential election will likely also have significant bearing on whether student-athletes are designated as employees. While neither former President Donald Trump nor VP Kamala Harris have stated a position on the matter, McCann points out that President Biden’s pick for NLRB general counsel, Jennifer Abruzzo, “has played a historic role in advocating for college athletes as employees.” Meanwhile, Trump’s former NLRB general counsel, Peter Robb, “rescinded a (2017) memorandum authored by his predecessor, Richard Griffin, that had reached a similar position as Abruzzo: College athletes are employees. On the other hand, several Trump-appointed judges, including U.S. Supreme Court Justices Brett Kavanaugh and U.S. District Judge Clifton Corker, have authored judicial opinions that praise athletes’ economic rights and besmirch amateurism.” (link)

Tennessee AD Danny White tells CBS’ Dennis Dodd that if the Vols’ 10% talent fee “was about just cold-hearted business we could have gone up 25% and I still think we'd be sold out. We had that much demand." In fact, Dodd notes ticket renewals are tracking at 90% and writes: “Usually, if you increase ticket prices 14.5%, there is a corresponding drop in fan interest for those tickets. White is betting current season-ticket holders, as well as those on the waiting list, will crawl through Tennessee River mud to get those seats. … It is also an edgy move that invites NCAA enforcement to take a look. These are, after all, what seem to be direct payments to athletes. But the underlying impact of the increase is chaos. More of it is good for the current system. That is, if that chaos leads to collective bargaining. A lot of ADs believe in it, but can't or won't say it. Collective bargaining – whether it comes in the form of a union or employment status – provides cost certainly.” Also from Dodd: “The upside of White's ticket plan is impressive. Tennessee's ticket revenue was $75M for football last year. When it's all said and done, White hopes to increase that number to the "high $80s next year if we sell out, which I expect we will." VCU will consider paying its student-athletes, and Rams’ AD Ed McLaughlin estimates that may cost the athletic department between $3M and $5M per year, though he acknowledges those figures are “mere speculation.” According to the Richmond Times-Dispatch’s Eric Kolenich, it is “unclear how much a VCU basketball player would command. McLaughlin told the board of visitors that some athletes in the Atlantic 10 Conference have made $200K to $300K a year – in addition to their scholarships.” (link)

Penn State has received a $5M gift from Playfly Sports, bringing the Nittany Lions’ total fundraising efforts for renovations to Beaver Stadium to $60.25M. Nittany Lions AD Pat Kraft: "We are very grateful for Playfly Sports and their commitment to Penn State Athletics, not just as our MMR [multimedia rights] partner, but in this important project for our department and University. As a Pennsylvania-based company, Playfly Sports understands the economic and cultural significance Beaver Stadium and Penn State Football hold in our community, region and state. Their generosity will have a lasting impact on all 31 of our sports programs as these renovations play a critical role in increasing revenue to support all of Penn State Athletics." (link)

ECU has received a “record-breaking gift from Bill Clark Homes, the largest investment in the 63-year history of the Pirate Club,” to close out the funding for the Isley Indoor Performance Center and spearhead a final push to fully fund the Dick and Sarah Bennett Baseball Building expansion project. Bill Clark Homes has also pledged to match up to $1M to help close the remaining gap in funding the baseball building expansion. The Pirate Club will launch a week-long giving initiative to complete this funding and move the project forward. (link)

Delaware State is seeking to become the first HBCU with an indoor practice facility and has launched a dedicated website to provide information on the “pioneering initiative.” Plans for the facility call for it to be 70K square feet and include a 50-yard turf field, new football lockers, football team meeting and lounge spaces, coaches’ suites and offices, academic study labs, a dining facility, reception area and refueling stations. The South Carolina-focused Garnet Trust is launching 1801 Media, a new media company created in partnership with The College Sports Company and NOCAP Sports. According to SBJ’s Ben Portnoy, the “venture is designed to create branded content that will center on Gamecocks athletes including social media posts, video series and podcasts. The revenue generated via that content will be paid to athletes by Garnet Trust, while it will count on top of whatever agreements those athletes already have in place with the collective. The South Carolina-centric shows are, at first, expected to feature football and men's and women's basketball. Long-form videos will be available on YouTube, while segments from the varying shows will be clipped for social media as well.” College Sports Company and NOCAP Sports have launched similar ventures at Louisville and Penn State.
