Utah State AD Diana Sabau says the Aggies’ move to the Pac-12 “gives us an opportunity to stand on a bit more national stage for our herd, for our fans, to be seen more nationally and our student-athletes to achieve success that would guarantee and hopefully have them participate as a multi-bid league in numerous sports, not just one sport.” Sabau says it’s “too early” to talk about a potential media rights deal. “We need to fill out our football slate with at least one more institution to become a CFP conference and then you can look for some positive growth also within basketball within our conference. And then we can start having this media conversation. It’s really important to note that there's some really big media partners out there right now that don't have a footprint in intercollegiate athletics…so they have some open space and some open inventory.” Also from Sabau: “The topic of the Department of Justice and our failure to comply was brought up by the Pac-12. They did have several questions around it. They do feel confirmed and assured that we are moving forward united with new advancements to work together and to not repeat the past.” (link)

CBS’ Gary Parrish argues that Memphis should’ve accepted its invitation to the Pac-12, contending that while the Pac-12 won’t be a Power 4 league, it will be the best of the non-P4 conferences. To support his point, Parrish points out that the AAC has one football member in the top 60 of the Massey Ratings and one men’s basketball member in the top 80 of the preseason Bart Torvik ratings. Both are Memphis. The Pac-12, meanwhile, has four members in the Massey ratings (five with Memphis and a potential sixth with UNLV) and four in the Bart Torvik ratings (five with Memphis and potentially a sixth in Gonzaga). Parrish goes on to point out Memphis’ decision to remain in the AAC “seems mostly to be money,” specifically the roughly $25M buyout it would owe the conference, of which the Pac-12 would only cover around 10%. In addition to asking why a university would agree to such a large exit fee in a Group of 5 league, which Parrish acknowledges was made before Tigers AD Ed Scott arrived, he asks: “How do all these other schools always figure out a way to pay the exit fees? … History tells us when schools are given a chance to upgrade leagues, they do it. Exit fees don't typically stand in the way. You figure it out. But at Memphis – for my entire life – no matter who's in charge they can never figure anything out, even things other universities always figure out.” Regarding the lack of a media rights deal, Parrish believes Memphis should’ve made the same “educated guesses” the five Mountain West members made that the Pac-12 would eventually outstrip the AAC financially by virtue of having better members and therefore a more attractive league. Fallout continues regarding UNLV QB Matthew Sluka’s departure from the team over NIL concerns. While not commenting on the situation specifically, NCAA President Charlie Baker believes the House settlement could prevent such scenarios: “People will know what everybody is getting, which, up until now, you just have to believe whoever says something to you. The number of student-athletes that I’ve talked to, who went into the portal under a false promise is pretty significant. The big point behind the settlement is to actually put in place a structure that will be transparent where people will have obligations and assignments and responsibilities and accountability. I’ve said for almost a year now, the primary relationship in this should be between schools and student-athletes.” Sluka’s agent, Marcus Cromartie, tells Yahoo’s Ross Dellenger: “We must allow these negotiations and these written agreements to happen and not put so many regulations on them. The school and coaches are negotiating but you are allowing someone else [collectives] to pay for it, hoping they get the money from boosters. It’s very messy … The collective may not have agreed to $100,000 but coaches did.” Cromartie also says the NCAA’s opaque rules around NIL were the reason Sluka didn’t sign an agreement before enrolling. “People say, ‘Why didn’t they get anything signed?’ You can’t sign anything until you enroll.” (link)

NCAA SVP for External Affairs Tim Buckley: “The NCAA fully supports college athletes profiting from their NIL, but unfortunately there is little oversight or accountability in the NIL space and far too often promises made to student-athletes are broken. Positive changes are underway at the NCAA to deliver more benefits to student-athletes but without clear legal authority granted by the courts or Congress, the NCAA, conferences and schools have limited authority to regulate third parties involved in NIL transactions.” (link)

Sportico’s Michael McCann points out a key issue in the NIL dispute between UNLV and former QB Matthew Sluka involves the enforceability of non-written agreements and explains that “even the firmest of handshakes and clearest of recollections are no substitutes for a written document. Yet oral contracts are often enforceable when the necessary elements for contract formation are proven. … Under Nevada law, as is the case in other states, oral contracts are generally unenforceable if they can’t be performed in one year. If Sluka were to attempt to enforce the oral agreement, he would present the strongest case if he could provide sworn testimony from witnesses that they too viewed it as a $100K offer where Sluka, by attending UNLV, accepted and would be paid ostensibly for his NIL. He would also want the deal to be understood to only involve Sluka’s time at UNLV during the 2024-25 academic year (and thus the deal would be performed in under a year). Any accompanying texts, direct messages, emails or other evidence would also help show that his case is more than his word versus the coach.” Complicating matters, McCann continues, is the NCAA’s ban on pay-for-play. “If Sluka has partaken in NIL-related activities in furtherance of his $100,000 deal, he would have a more compelling argument that the money was for NIL. But if the deal was really just payment to play at UNLV, a court could find it unenforceable on grounds of public policy in that it defies an athlete and school’s membership obligations to the NCAA.” Also from McCann: “The Sluka matter seems to corroborate (Judge) Wilken’s underlying point that NIL appears to mean whatever a school and athlete want it to mean and that, through its actions, the college sports industry has accepted a pay-for-play world.” More. Georgia Football HC Kirby Smart and LSU HC Brian Kelly weigh in on the UNLV QB Matthew Sluka situation, with Smart saying he doubts this will be the last of these types of situations, adding: “The NIL, because it becomes a third-party piece, you lose control. And that’s why the revenue-sharing piece is so important and getting that legislation passed now puts that back through the universities. And now those contracts can be written a lot differently. When you’re dealing with a third party and collectives and NILs, the universities are at arm’s length. And so it’s much more difficult to put in the kind of language necessary to kind of see that maybe a quarterback doesn’t leave halfway through the season or, you know, a guy doesn’t opt for a particular bowl game. Revenue-sharing changes the dynamics.” Kelly emphasizes the need for student-athletes to retain certified agents: “A certified agent versus somebody that does it as a part time job — those should be red flags for families and they should be very, very cautious relative to signing anything if they are not a certified agent. Or, if they want your name, image and likeness [exclusively] and that, to me, are the kind of things that we try to educate when we have the young men on our campus.” (link)

St. Bonaventure GM Adrian Wojnarowski says since his new role was announced last week, “I’ve been absolutely blown away with the incoming opportunities coming our way from national sponsors and entities who want to be in the NIL business with St. Bonaventure basketball. Game-changing opportunities to help us recruit and retain our student-athletes.” Bonnies AD Bob Beretta says Wojnarowski will be working with other teams at the school, not just men’s basketball, and has, in fact, already helped land some baseball recruits. Beretta: “Woj has been known to color outside the lines, he’s going to be coloring all over the tablet here at Bonnies.” Ultimately, Woj says his goal is to help lift the Bonnies’ men’s hoops team to where it is “standing shoulder to shoulder with the best programs in college basketball” but also to “keep us pursuing meaningful March basketball, keep us sending players to the NBA and the top leagues all around the world and, most importantly, graduating with degrees and experiences that prepare them for a life beyond the game.” (link)

It takes time. That first year you’re figuring out new rivalries, your fan base is going, ‘All right, who are these schools and why do I need to care? Texas Southern will break ground on its new baseball and softball stadiums on October 3. Both facilities are made possible through a partnership with the Houston Astros Foundation. The softball stadium will have a capacity of 480 while the baseball stadium is slated to seat 1,080. Both stadiums will share a concession stand and will have locker room space for both programs along with press boxes and lighting for night contests. The baseball stadium will also feature VIP seating for 80 fans. The projects are expected to open in the spring of 2026. (link)

New Mexico announces the “largest-of-its-kind gift from Sandia Laboratory Federal Credit Union (SLFCU) supporting the Lobo Alliance. … The Lobo Alliance promotes stronger connection and alignment between 505 Sports Venture Foundation (505SVF), the Lobo Club, and Lobo Athletics. This combined group aims to enhance and amplify the student-athlete experience with donation levels starting at $25K a year. + Disney’s “cost-saving initiative” includes 300 layoffs this week. Per Deadline, “The positions — all based in the U.S. — are across Disney’s corporate operations, including legal, HR, finance and communications, we hear. Among the divisions that are not impacted in this round are Parks, ESPN as well as Disney Entertainment. … Disney’s layoffs started yesterday, on the same day Paramount Global laid off hundreds in the second round of its own layoffs aiming to cut 15% of the company’s U.S. workforce, with Paramount+ getting the brunt of the cuts.” (link)

Show Me the Money…
+ More on UNLV QB Matthew Sluka’s redshirt decision, as he claims the Rebels did not fulfill an NIL promise. ESPN’s Pete Thamel and Adam Rittenberg report that Sluka’s agent, Marcus Cromartie, indicates “UNLV didn't come through on a verbal offer of $100K from an assistant coach. The quarterback's father, Bob Sluka, told ESPN that head coach Barry Odom later said in a phone conversation that the offer wasn't valid because it didn't come from him, but rather from offensive coordinator Brennan Marion, who declined comment to ESPN.” According to Cromartie, the only formal offer Sluka received was for $3,000 a month for four months. The only money Sluka has received from UNLV, per Cromartie, was $3,000 for moving expenses. Bob Sluka notes Marion and the agents from Equity Sports agreed to a verbal deal back in the winter, after a recruiting visit where they spent most of their time with Marion but also met with the entire coaching staff. Once they arrived in Las Vegas, Bob Sluka says: “They keep deferring – 'We don't know. You have to wait.’ Then it was like, 'We're going to give him game checks.' So we're like, 'OK, great.' We did not ask for a single dollar [more]. At one point, we are out of pocket for him to be there, because his expenses to live there weren't even being covered." (link)
+ Sportico’s Eben Novy-Williams posits that “Sluka’s stance is an obvious next step in the college athlete labor movement. Football players across the country are being paid right now, but they’re largely being compensated for one thing (playing), under the guise of something else (marketing rights). That world has little oversight or regulation, and because of the wink-and-nod setup, which was forced by the courts as schools like UNLV fight desperately against a more legitimate employee-employer relationship, there’s no larger union or CBA through which Sluka and the school can mediate a disagreement. Both Sluka narratives—one a spurned athlete, the other a cutthroat one using mid-season success to change yesterday’s price—will likely become a more common piece of college football and basketball moving forward. It’s easier to promise money than it is to deliver it. It’s also fairly easy for an athlete, facing down his final year of making money in football, to try everything in his power to maximize that worth. This is the uncertainty that the NCAA and its members have backed themselves into by permitting NIL via a patchwork of state laws but no formal way for Sluka and UNLV to codify the terms of their affiliation.” (link)
+ UNLV has released a statement accusing Sluka’s representative of making “financial demands” of the university and the collective in order to keep playing and asserts: ”UNLV Athletics interpreted these demands as a violation of the NCAA pay-for-play rules, as well as Nevada state law. UNLV does not engage in such activity, nor does it respond to implied threats. UNLV has honored all previously agreed upon scholarships for Matthew Sluka. UNLV has conducted its due diligence and will continue to operate its programs within the framework of NCAA rules and regulations, as well as Nevada state laws.” (link)
+ The Friends of UNLV collective has also released a statement which reads, in part: “To clarify, there were no formal offers made during Mr. Sluka’s recruitment process. Additionally, Friends of UNLV did not finalize or agree to any NIL offers while he was part of the team aside from a completed community engagement over the summer. At Blueprint Sports and Friends of UNLV, we take our commitments very seriously. We would like to emphasize that we have upheld all Friends of UNLV contracts this season and have not defaulted on any agreements with Mr. Sluka.” (link)

Realignment Ramifications…
+ The Mountain West is offering “a new version of a membership agreement to its seven programs with sizable signing bonuses,” according to Yahoo’s Ross Dellenger, who notes the “agreements are only binding if all sign. Meanwhile, DI conference commissioners are meeting here in Chicago over the next couple days, including those on the CFP management committee (the FBS commissioners). MWC commissioner Gloria Nevarez is not attending. MWC [Senior Assoc. Commissioner] Julie Owen here in her place.” (link)
+ ESPN’s Pete Thamel is told that “UNLV officials are still analyzing the school’s conference future, as they are expected to make a choice between the Mountain West and the Pac-12 in the upcoming days. A change of conference requires Nevada System of Higher Education Board Approval. That approval would be expected to include a public meeting of UNLV athletic officials and the regents. From NSHE By-laws: ‘Any change by an NSHE institution in its athletic conference membership requiring an NSHE institution to vote on approval shall be approved by the Board on the recommendation of the president and chancellor with full consideration of all factors to include student competition in intercollegiate sports appropriate to the institution, fiscal resources available, and sound standards of student academic performance.’” (link)
+ JohnCanzano.com’s namesake was told by a Mountain West source that UNLV is “being smart and weighing their options.” Among the work being done is an analysis of the potential new-world Pac-12’s media value using third-party consultants. Meanwhile, he notes Gonzaga remains in discussions with the Pac-12, but “nothing is done. Nothing official yet. A trusted source in Spokane told me: ‘We are talking, but it’s going to take some time.’” Other notes: “In Week 4, Washington State-San Jose State drew 542,000 viewers on The CW on Friday night in a double-overtime game. Oregon State-Purdue garnered an audience of 452,000 on The CW on Saturday night. I have to think The CW viewed it as a solid weekend. Meanwhile, Penn State-Kent State drew 434,000 viewers as the top-rated game on Big Ten Network. Northwestern-Washington captured 378,000 on FS1, and Boise State-Portland State got 248,000 (FS1).” (link)

LEAD1 is changing its name to the FBS Athletics Directors Association and has appointed former Pittsburgh AD Heather Lyke as Acting President/CEO. Additionally, the association will now operate in affiliation with NACDA, and “changes will be made to its structure, meetings and membership dues. The association’s annual meeting will now take place during the NACDA & Affiliates Convention, to be held next year from June 8-11 at the World Center Marriott Resort in Orlando. Michigan AD/FBS Athletics Directors Association Chair Warde Manuel: “After gathering feedback for more than a year from our members, it was clear that we needed a new direction for LEAD1 in many ways, and our name change, affiliation with NACDA and the appointment of Heather demonstrates our strong desire to serve our members more effectively. I am grateful that Heather has accepted the role of Acting President and CEO, as she brings immediate credibility, broad experiences and demonstrated success as an athletics director to our organization.” Lyke: “While I look forward to once again serving on a campus, I will pour my heart and soul into the Association to ensure a smooth transition within the NACDA family. NBC’s Nicole Auerbach reports that during the College Football Playoff Management Committee meeting, commissioners “didn't discuss the latest with the Mountain West/Pac-12 today because they're waiting for the dust to settle before they discuss any impact on the new CFP deal, which begins in 2026. (Need to know who is or isn't a conference, which requires a minimum of 8 members).” CFP Executive Director Richard Clark noted that a lot of the conversation today was around preparations for the first-round games on campus, including the booking of hotel blocks, stadium renovation plans, etc. Auerbach also notes the CFP continues to work toward final decisions regarding future championship host sites. According to Clark, the selection committee will remain at 13 members. (link)

Nebraska AD Troy Dannen sent a letter to Big Ten Commissioner Tony Petitti “formally requesting not to host Friday games outside of Thanksgiving every other year – the game with Iowa. Just because of the size of the stadium and the locale, I don't think we want to be canceling in-person classes. I'm sure the students didn't mind. But at the end of the day the more we can avoid that I think the better off everybody will be.” UNL had to cancel classes last Friday due to the timing of the Huskers’ matchup with Illinois. Dannen adds: “"So if it happens again, it happens again. I don't like seeing other athletic directors in the league saying, 'By golly, we will not do that' and laying their foot down. I'm not sure any institution should have the unilateral ability to do that. But if we do, I raised my hand with the commissioner and said Nebraska should be in that same position with 90,000 fans and the proximity we have to campus." That said, Dannen acknowledges how impactful it was to have 4.21M viewers tuned in. “Showing people that this is a pretty neat place and showing people what the crowd does, and how the crowd has a chance and often has impacted our ability to win games – there are recruits watching that. There are other people that we are going to want to have part of our program. So that exposure, never underestimate how important it is." Dannen also says putting a new screen over the existing structure in the north end of Memorial Stadium may have to suffice for next season, but nothing can be done on the south end until construction is underway." Facility Features…
+ Iowa State will install 23 Daktronics LED displays across seven locations on campus. Basketball, volleyball, gymnastics, wrestling, soccer, track and field, and aquatics will be completed in 2024 while football and softball displays will be completed in 2025. In Hilton Coliseum, the Cyclones will install a 15.5 feet by 113 feet centerhung scoreboard and 830 feet of ribbon board. At Jack Trice Stadium, ISU will install a north end zone display measuring approximately 36 feet high by 157 feet wide while the south end zone will receive a display measuring roughly 36 feet high by 79 feet wide. Along the seating fascia, two ribbon displays will each measure 3.5 feet high by 625 feet long. More info on additional displays. (link)
+ UTRGV announces several enhancements coming to Robert & Janet Vackar Stadium to prepare for the inaugural 2025 season. Phase 1 is already underway and includes lowering the field to create improved sight lines for those who purchase the 39 existing field level suites and patios, all of which are being expanded and renovated. Each suite sold will have 400 square feet of outdoor space, allowing suite holders to be right up against the action. The Vaqueros are also adding 184 premium seats, including the addition of 19 loge boxes, each of which contains six seats, in the north end zone, as well as 2K bleacher seats, expanding total capacity to roughly 12K. UTRGV is making moves to remain compliant with the Americans with Disabilities Act and Texas Accessibility Standards through the addition of elevators and widening of walkways in the main seating areas.
