The six remaining Mountain West members have signed binding commitment agreements, per multiple sources. Yahoo’s Ross Dellenger notes the league is expected to “later release per-school tiered distribution of signing bonuses derived from Pac-12 exit fees (~ $100M). The remaining unsigned Mountain West member is Hawaii. … As a partial member in football, Hawaii does not impact the MWC agreement as all full members signed, according to those familiar with the terms. Hawaii plans to sign the agreement with the Mountain West to remain a football member. All seven are signed. Hawaii officials and those from the Pac-12 held conversations about membership over the last day, but the league did not extend an invitation.” (link, link)

A group of student-athletes led by Big Ten women's basketball players sent a letter to NCAA President Charlie Baker on Wednesday asking the association to drop its proposed restrictions on the types of NIL deals players can sign with collectives and third-party groups. ESPN’s Dan Murphy reports the letter is “signed by USC captain Dominique Darius, who told ESPN she sent it on behalf of roughly 100 athletes from different schools and sports. The letter specifically asks the NCAA to drop the proposed portion of its industry-shifting antitrust settlement that would give the association authority to determine which NIL deals are for ‘valid business purposes.’ … The basketball players said they were concerned that so far they haven't had a large enough voice in a process that could be reshaping at least the next 10 years of the college sports industry. All four players who spoke to ESPN said they have not received any information about the pending deal from their schools.” Northwestern senior Caileigh Walsh: "There has been absolutely zero communication. Northwestern isn't telling us anything about it, so we're trying to get our hands on as much information about it as we can." Fellow Wildcat Melannie Daley adds: "It deeply bothers me that people are making decisions without us having any say in it. Decisions are being made above our heads about what we deserve in compensation." (link)

Officials from the SEC and Big Ten will meet in Nashville next month in “what is viewed as a continuation of their announced partnership,” according to Yahoo’s Ross Dellenger, who reports, however, that “those briefed on the meeting do not expect impactful decisions to be made and believe this to be only a next step in a partnership that the two conferences entered six months ago with the creation of a joint board. Athletic directors are expected to begin discussion about a range of topics that they have mostly, so far, kept within their individual leagues. Those topics include the House settlement case, a new third-party (not NCAA) enforcement model, the future of the College Football Playoff format and — most noteworthy of them all — a regular-season and postseason scheduling arrangement. Discussions are expected to go beyond the regular season with the possibility of what officials describe as an ‘overhauled postseason’ for those programs not advancing to the CFP. Administrators are exploring ways to arrange more matchups that pair teams from the two leagues as opposed to their current bowl agreement pairings,” which expire after the 2025 campaign. Doing so is seen as a way to generate additional revenue, as Dellenger notes the two most-watched games this season involve interconference matchups between the two leagues with Michigan-Texas drawing 9.19M viewers and USC-LSU attracting 8.2M. More Realignment Rumblings…
+ Without going into specifics, Utah State AD Diana Sabau says the Aggies “received financial support from across the state of Utah” to help with the Pac-12 move. While there is no media deal lined up, Sabau explains USU is "very happy with our agreement” and received a deal that is “pretty equitable with what was promised by the Pac-12” to Boise State, Colorado State, Fresno State and San Diego State. Sabau also notes once those four schools left the Mountain West, "you could tell that there was a shift in the dynamic. As an athletics director I want to future-proof our programs but also be in alignment with future growth of the institution too. When the opportunity arose (to join the Pac-12), sometimes you have to take a leap of faith.” Meanwhile, Honolulu Mayor Rick Blangiardi has assembled a third-party group that has been “lobbying for the University of Hawaii football team to gain admittance into the Pac-12.” Blangiardi adds: “As mayor, I’m not supposed to cross a few lines. But this is really important to our community.” The Honolulu Star-Advertiser’s Stephen Tsai noted the negotiating team includes: former Mountain West Commissioner Craig Thompson; retired UCLA AD Dan Guerrero; and DHR Global Sports Practice Managing Partner Glenn Sugiyama. Blangiardi said that his group’s "priority is for UH’s football team to receive a Pac-12 invitation.” (link)
+ Sacramento State announces it has secured millions of dollars in funding for a new football stadium as part of a public pursuit of Pac-12 membership, according to Yahoo’s Ross Dellenger. In a release, the school calls on “business leaders across the region to join efforts to elevate Sac State to the Pac-12.” (link)
+ According to Dave Campbell’s Texas Football’s Mike Craven, Texas State has engaged in “active conversations” with the Mountain West, Pac-12 and AAC while also talking with the Sun Belt about staying. Meanwhile, UTEP has “long wanted” an invitation from the MW, and Craven notes the Miners’ Conference USA buyout is close to $2M while the Bobcats would owe the Sun Belt $5M. (link)
+ The Mercury News’ Jon Wilner contends it’s a “terrible decision for UNLV’s athletic future” to stay in the Mountain West. “The Rebels were paid approximately $25M to remain in the Mountain West — we’ll get to that issue momentarily — but that cash will vanish quickly given the athletic department’s fragile fiscal situation. Moving to the Pac-12 would have elevated UNLV’s competitive profile, resulting in more annual media revenue and enhanced community support for name, image and likeness efforts.” Wilner also posits that Pac-12 Commissioner Teresa Gould “could not have justified a $25M outlay to her newest members, which are worth more than UNLV, or to Washington State and Oregon State.” As it stands, Wilner notes the financial commitment from the MW is not without risk, as the league is counting on the poaching penalties to help fund the endeavor. “The Pac-12 is challenging the legality of the poaching penalty, and the five departing schools assuredly will fight to reduce the exit fees. The Mountain West could emerge with $145M to use as it pleases, or much less.” While Texas State appears to be high on the Pac-12’s list of expansion candidates, Wilner believes the league should be patient. “Take the seven-school structure to executives at ESPN, Fox, Turner, Apple, The CW, CBS — and any other potential suitors — and get real numbers. Then use those numbers to find No. 8.” He also contends the league should prioritize Gonzaga. “It makes little sense to offer the Zags a full share of the Pac-12’s annual revenue because they don’t play football. But a partial share (in the $6M-to-$8M range, for example) might not constitute a significant increase from the West Coast Conference media distributions.” More. (link)

As James Madison prepares for potential changes to roster and scholarship limits, Dukes AD Matt Roan says it remains unclear whether the department will max out the number of allowable scholarships. “The conversations we have had with our coaches is to start to plan for the roster limits. Start to think about football as though you have 105. Start to plan on that, because that feels pretty real when you’re looking at what your scholarship budget could be, what your revenue share, what that number might be. I think those are the things where we are having dialog and understanding the finances of it. Do you go up to your roster limit or do you try to maximize the value of another number that is somewhere less than what that limit might be?” Dukes Football HC Bob Chesney on how his program could be impacted: “If that happens and we’re rolling it out next year, that’s a tough one. As far as what it looks like on the day-to-day, there’s more of an NFL model when it comes to practice that you have to get involved in.” (link)

Meanwhile, Houston Men’s Basketball HC Kelvin Sampson says he needs a private plane to recruit “not because of convenience. It’s because of necessity. It’s not like every kid we’re recruiting is within 20 miles of this campus. These kids are in different states. … I can’t get on a United flight at 6 in the morning and fly to Point A and then have to drive two hours because that’s the closest airport to that school. So now I’m locked into seeing one kid that day. Where, if you have access to a plane, I can see a kid do an early morning workout somewhere in Texas and go see a kid in Salt Lake City and go see a kid workout in Arizona and get home and be in the indoor practice facility for conditioning at 6:15 in the morning.” Relying on donors for private jet hours, Sampson continues, is not sustainable. “I get tired of having to go ask our donors for stuff and knocking on their door. That's not fair to them. I’ve been on this administration that we need to quit asking the donors for their hours. That’s their hours. Let’s get our own hours. Most of the schools in the Big 12 have their own plane.” Sampson goes on to note that “we’re having to learn how to be a Big 12 school. This is not my second year in the Big 12, this is my 14th year in the Big 12. We’re still not a Big 12 school. We’re a long way away from being a Big 12 school. We’ve got Big 12 players, obviously, but that’s about it.” (link)

UCLA’s baseball program will be locked out of its stadium on veterans’ land west of the campus pursuant to an order issued by U.S. Federal Court Judge David O. Carter “enjoining UCLA from accessing the Jackie Robinson Stadium and an adjacent practice field until it produces a plan that meets his satisfaction to ensure that service to veterans is the predominant focus of 10-acre facility leased from the U.S. Department of Veterans Affairs,” the Los Angeles Times’ Doug Smith reports. Carter: “The VA is ordered by noon tomorrow to cordon off and prevent any use of the UCLA baseball stadium and practice field until further notice from the court.” Carter declared the UCLA lease illegal because its focus was not predominantly service to veterans. Friars AD Steve Napolillo: “We are excited that we are continuing our very successful partnership with Learfield. Learfield has been the exclusive multimedia rights holder for the Friars since 2014. Even though we are seeing dramatic changes in the college landscape, we look forward to working with Learfield across their divisions to generate significant revenue to help our programs compete for Big East, Hockey East and NCAA Championships and be a leader on NIL partnerships.” (link)

Sportico’s Eben Novy-Williams weighs in on Tennessee’s 10% “talent fee” ticket surcharge and observes that Vols AD Danny White “did not address whether the transparency he espoused might also generate resentment between Volunteers fans and a group of athletes just starting to scratch the surface of their true market value. It’s a savvy sleight of hand. The move lets the school celebrate progress for athletes while simultaneously passing much of the financial burden onto its most passionate fans. How those fans feel about the athlete labor movement could have significant consequences for how far that movement ultimately goes.” Novy-Williams accepts that fans have benefited from “the economics of an industry built on severely under-compensated labor” but notes UT has never added a “coaching surcharge” to its tickets. Novy-Williams goes on to observe that the talent fee reminds him of the “winnings surcharge” DraftKings announced it would be adding to winning payouts in high-tax states. “Its stated goal was to help the company improve its business by passing that burden on to consumers. … But it also had another purpose. When I asked DraftKings CEO Jason Robins if part of the strategy was to nudge consumers to direct anger toward lawmakers, he said it wasn’t the main goal, but conceded that it was a ‘potential effect.’” The Collective Association President Russell White believes it may actually create ill-will toward UT: “It just shows how flawed the whole model is. Any logical thinker would say, ‘You have to pay your labor,’ and many schools chose not to have a plan for what that looks like. Instead, they just built another facility or hired seven more people for their media team to twiddle their thumbs and post on social.” More from Novy-Williams. (link)

Sportico’s Michael McCann analyzes the legal arguments likely to be made in former USC Heisman Trophy winner Reggie Bush’s NIL lawsuit against the NCAA, USC and the Pac-12 and explains: “For starters, nearly two decades have passed since Bush played college football. Antitrust claims generally have a four-year statute of limitations, while unjust enrichment normally must be brought within three years of their discovery. The defendants will almost certainly argue that Bush waited far too long to sue them. They could assert it wasn’t as if Bush lacked notice of possible claims: O’Bannon brought his case in 2009 and his victory was affirmed on appeal in 2015. Bush’s attorneys anticipate a statute of limitations defense and try to diffuse it in their complaint. They argue the alleged violations are ‘continuing,’ which if accepted by the court would make it more likely Bush’s claims are not time-barred. The attorneys also stress that Bush was young when he ‘signed away his [NIL] and thus he should be ‘entitled to equitable tolling of his claims.’” Furthermore, the NCAA, et al. could argue that its NIL prohibition was compliant with antitrust law during the era in which Bush played and could point out that other courts have rejected claims that college athletes should be paid for their TV appearances.” (link)

Utah State AD Diana Sabau says the Aggies’ move to the Pac-12 “gives us an opportunity to stand on a bit more national stage for our herd, for our fans, to be seen more nationally and our student-athletes to achieve success that would guarantee and hopefully have them participate as a multi-bid league in numerous sports, not just one sport.” Sabau says it’s “too early” to talk about a potential media rights deal. “We need to fill out our football slate with at least one more institution to become a CFP conference and then you can look for some positive growth also within basketball within our conference. And then we can start having this media conversation. It’s really important to note that there's some really big media partners out there right now that don't have a footprint in intercollegiate athletics…so they have some open space and some open inventory.” Also from Sabau: “The topic of the Department of Justice and our failure to comply was brought up by the Pac-12. They did have several questions around it. They do feel confirmed and assured that we are moving forward united with new advancements to work together and to not repeat the past.” (link)

CBS’ Gary Parrish argues that Memphis should’ve accepted its invitation to the Pac-12, contending that while the Pac-12 won’t be a Power 4 league, it will be the best of the non-P4 conferences. To support his point, Parrish points out that the AAC has one football member in the top 60 of the Massey Ratings and one men’s basketball member in the top 80 of the preseason Bart Torvik ratings. Both are Memphis. The Pac-12, meanwhile, has four members in the Massey ratings (five with Memphis and a potential sixth with UNLV) and four in the Bart Torvik ratings (five with Memphis and potentially a sixth in Gonzaga). Parrish goes on to point out Memphis’ decision to remain in the AAC “seems mostly to be money,” specifically the roughly $25M buyout it would owe the conference, of which the Pac-12 would only cover around 10%. In addition to asking why a university would agree to such a large exit fee in a Group of 5 league, which Parrish acknowledges was made before Tigers AD Ed Scott arrived, he asks: “How do all these other schools always figure out a way to pay the exit fees? … History tells us when schools are given a chance to upgrade leagues, they do it. Exit fees don't typically stand in the way. You figure it out. But at Memphis – for my entire life – no matter who's in charge they can never figure anything out, even things other universities always figure out.” Regarding the lack of a media rights deal, Parrish believes Memphis should’ve made the same “educated guesses” the five Mountain West members made that the Pac-12 would eventually outstrip the AAC financially by virtue of having better members and therefore a more attractive league. Fallout continues regarding UNLV QB Matthew Sluka’s departure from the team over NIL concerns. While not commenting on the situation specifically, NCAA President Charlie Baker believes the House settlement could prevent such scenarios: “People will know what everybody is getting, which, up until now, you just have to believe whoever says something to you. The number of student-athletes that I’ve talked to, who went into the portal under a false promise is pretty significant. The big point behind the settlement is to actually put in place a structure that will be transparent where people will have obligations and assignments and responsibilities and accountability. I’ve said for almost a year now, the primary relationship in this should be between schools and student-athletes.” Sluka’s agent, Marcus Cromartie, tells Yahoo’s Ross Dellenger: “We must allow these negotiations and these written agreements to happen and not put so many regulations on them. The school and coaches are negotiating but you are allowing someone else [collectives] to pay for it, hoping they get the money from boosters. It’s very messy … The collective may not have agreed to $100,000 but coaches did.” Cromartie also says the NCAA’s opaque rules around NIL were the reason Sluka didn’t sign an agreement before enrolling. “People say, ‘Why didn’t they get anything signed?’ You can’t sign anything until you enroll.” (link)

NCAA SVP for External Affairs Tim Buckley: “The NCAA fully supports college athletes profiting from their NIL, but unfortunately there is little oversight or accountability in the NIL space and far too often promises made to student-athletes are broken. Positive changes are underway at the NCAA to deliver more benefits to student-athletes but without clear legal authority granted by the courts or Congress, the NCAA, conferences and schools have limited authority to regulate third parties involved in NIL transactions.” (link)

Sportico’s Michael McCann points out a key issue in the NIL dispute between UNLV and former QB Matthew Sluka involves the enforceability of non-written agreements and explains that “even the firmest of handshakes and clearest of recollections are no substitutes for a written document. Yet oral contracts are often enforceable when the necessary elements for contract formation are proven. … Under Nevada law, as is the case in other states, oral contracts are generally unenforceable if they can’t be performed in one year. If Sluka were to attempt to enforce the oral agreement, he would present the strongest case if he could provide sworn testimony from witnesses that they too viewed it as a $100K offer where Sluka, by attending UNLV, accepted and would be paid ostensibly for his NIL. He would also want the deal to be understood to only involve Sluka’s time at UNLV during the 2024-25 academic year (and thus the deal would be performed in under a year). Any accompanying texts, direct messages, emails or other evidence would also help show that his case is more than his word versus the coach.” Complicating matters, McCann continues, is the NCAA’s ban on pay-for-play. “If Sluka has partaken in NIL-related activities in furtherance of his $100,000 deal, he would have a more compelling argument that the money was for NIL. But if the deal was really just payment to play at UNLV, a court could find it unenforceable on grounds of public policy in that it defies an athlete and school’s membership obligations to the NCAA.” Also from McCann: “The Sluka matter seems to corroborate (Judge) Wilken’s underlying point that NIL appears to mean whatever a school and athlete want it to mean and that, through its actions, the college sports industry has accepted a pay-for-play world.” More. Georgia Football HC Kirby Smart and LSU HC Brian Kelly weigh in on the UNLV QB Matthew Sluka situation, with Smart saying he doubts this will be the last of these types of situations, adding: “The NIL, because it becomes a third-party piece, you lose control. And that’s why the revenue-sharing piece is so important and getting that legislation passed now puts that back through the universities. And now those contracts can be written a lot differently. When you’re dealing with a third party and collectives and NILs, the universities are at arm’s length. And so it’s much more difficult to put in the kind of language necessary to kind of see that maybe a quarterback doesn’t leave halfway through the season or, you know, a guy doesn’t opt for a particular bowl game. Revenue-sharing changes the dynamics.” Kelly emphasizes the need for student-athletes to retain certified agents: “A certified agent versus somebody that does it as a part time job — those should be red flags for families and they should be very, very cautious relative to signing anything if they are not a certified agent. Or, if they want your name, image and likeness [exclusively] and that, to me, are the kind of things that we try to educate when we have the young men on our campus.” (link)

St. Bonaventure GM Adrian Wojnarowski says since his new role was announced last week, “I’ve been absolutely blown away with the incoming opportunities coming our way from national sponsors and entities who want to be in the NIL business with St. Bonaventure basketball. Game-changing opportunities to help us recruit and retain our student-athletes.” Bonnies AD Bob Beretta says Wojnarowski will be working with other teams at the school, not just men’s basketball, and has, in fact, already helped land some baseball recruits. Beretta: “Woj has been known to color outside the lines, he’s going to be coloring all over the tablet here at Bonnies.” Ultimately, Woj says his goal is to help lift the Bonnies’ men’s hoops team to where it is “standing shoulder to shoulder with the best programs in college basketball” but also to “keep us pursuing meaningful March basketball, keep us sending players to the NBA and the top leagues all around the world and, most importantly, graduating with degrees and experiences that prepare them for a life beyond the game.” (link)

Texas Southern will break ground on its new baseball and softball stadiums on October 3. Both facilities are made possible through a partnership with the Houston Astros Foundation. The softball stadium will have a capacity of 480 while the baseball stadium is slated to seat 1,080. Both stadiums will share a concession stand and will have locker room space for both programs along with press boxes and lighting for night contests. The baseball stadium will also feature VIP seating for 80 fans. The projects are expected to open in the spring of 2026. (link)

This combined group aims to enhance and amplify the student-athlete experience with donation levels starting at $25K a year.
