In the revised House settlement agreement by attorneys yesterday the “basic reporting, clearinghouse and arbitration processes would remain as originally proposed, but the settlement now would do away with the term ‘booster’ and replace it with the term ‘Associated Entity or Individual,’” according to USA Today’s Steve Berkowitz. According to the lawyers, this constitutes “a narrower, more targeted, and objectively defined category that does not automatically sweep in ‘today’s third-party donor.’” Despite the removal of the term “booster,” Yahoo’s Ross Dellenger notes that it remains, “in essence, part of the settlement. Attorneys replaced the term with more specific terminology and parameters, including: Only deals involving a narrowed set of people closely affiliated with schools will be subject to the clearinghouse and enforcement process. For example, deals with commercial third parties, like shoe companies or apparel brands, are exempt from enforcement.” Deals with individuals whose families have provided less than $50K in support to a particular institution will also be exempt. Additionally, the filing clarifies that no deals will be prohibited under the settlement that are not already prohibited currently. Dellenger: “The amendment may pave the way for some school-affiliated boosters and collectives to survive, at least in a limited capacity. However, in all likelihood, those donating to collective efforts are likely to be considered a ‘set of people closely affiliated with schools,’ which would require them to clear their NIL deals through the clearinghouse.” Berkowitz points out that “Associated Entity or Individual” is defined by meeting any one of five criteria, including the following which appears to cover collectives: “An entity that is or was known (or should have been known) to the athletics department staff… to exist, in significant part, for the purpose of promoting or supporting a particular” school’s athletics program or athletes and/or “creating or identifying NIL opportunities solely for a particular” school’s athletes.” One source tells Berkowitz that U.S. District Court Judge Claudia Wilken could schedule another hearing or simply decide whether to grant preliminary approval based on the filings. Sportico’s Michael McCann points out that U.S. District Court Judge Claudia Wilken could also permit other interested parties to file objections and hold hearings to evaluate their arguments. Also from McCann: “Even if Wilken grants preliminary approval, that doesn’t mean she’ll grant final approval. She’ll then look at how many athletes opt out and hear concerns raised in a fairness hearing. There’s also the possibility the settlement could be challenged at the U.S. Court of Appeals for the Ninth Circuit and then at the U.S. Supreme Court. It could be years before the settlement is actually in force. The settlement could also collapse along the way, and the three lawsuits would then return to the docket. The NCAA could rationally decide that it would likely win the three lawsuits given applicable precedent.” At the same time, McCann notes that “one structural problem for the settlement is that it resembles a labor agreement without labor having a voice. So long as college athletes aren’t recognized as employees, they won’t be able to unionize. That means any restraints on their economic opportunities will be fair game for antitrust litigation, since the non-statutory labor exemption only insulates collectively bargained terms from antitrust exposure. And no matter what happens with the settlement, it can’t stop labor and employment lawsuits (including Johnson v. NCAA), NLRB charges (including those involving Dartmouth and USC athletes) and, especially given that male athletes would receive more money than female athletes under the settlement, lawsuits brought under Title IX.” (link)

According to the MOU signed by all seven Mountain West members, the league will distribute revenue utilizing the following formulas: Air Force and UNLV will receive 24.5%, Nevada, New Mexico, San José State and Wyoming 11.5%, and Hawaiʻi 5%.” The conference and member institutions have also agreed on a GOR from July 1, 2026, through June 30, 2032. (link); UNLV will also receive a lump sum of $10-14M from the Mountain West next year and $1.5-1.8M annually over six years starting in 2026. According to a statement from the school, those payments are in addition to the “current revenue streams from existing contracts and media assets.” Additionally, the Rebels “have the flexibility to explore future membership” in a Power 4 conference “without penalty should the opportunity become available.” (link)

The Mountain West has also notified the MAC of its interest in Northern Illinois and Toledo as football-only members in 2026, Action Network’s Brett McMurphy reports, adding: “This adds Central Time Zone to MW, potentially increasing future media rights value. NIU & Toledo have combined for 7 of last 13 MAC titles. MW currently has 7 football members but would still need 2 full-time members in addition to NIU & Toledo.” (link); ESPN’s Pete Thamel reports Texas State “has emerged as a target for Mountain West expansion, which would be an all sports addition. One other target that could soon come into focus for the Mountain West is Northern Illinois, which would be as a football-only member.” (link)

Hawaii AD Craig Angelos talks about the decision to remain in the Mountain West and says the Rainbow Warriors had “numerous discussions with Pac-12 officials and their consulting firm, Navigate, about the value we might be able to bring to that conference. … They knew of our timeline and our interest in the Mountain West Conference, of course, but we said we'd certainly entertain any interest that people had in us. And after being involved with a lot of discussion back and forth, we asked them to let us know what they thought one way or another as soon as they could, and they let us know this morning after a Pac-12 meeting that we were not going to be extended an offer. One of the things they cited is the exit fees,” which combined with the poaching penalties, would’ve been upwards of $30M. “As they said to me, the cost benefit of bringing in a Mountain West team in and Hawaii just didn't seem to satisfy the lawyers and the finance people, so they elected not to not to extend us an offer.” Angelos says of the 5% revenue distribution UH will receive: “We certainly would have liked to have seen more, but we certainly accept our share and will be good members of the Mountain West Conference going forward.” Angelos notes that discussions about potentially joining the Mountain West in all sports “can still take place later on down the road. I think right now it’s all about just solidifying the eight teams going forward and what that looks like. … I’m not sure which is best for our programs, whether it be to have that split program or better to be unified.” More from Angelos. Memphis AD Ed Scott says of the decision not to join the Pac-12: “When I hear people say, ‘I'm not going to buy tickets,’ ‘I'm not going to support the programs,’ you're not really hurting me, you're hurting the student-athletes. And you're hurting the people that are on the field playing, and that's really, really important for me. So, where does this go? If y'all haven't seen the latest reports of what's going on between the Mountain West and the Pac-6,7 right now, this is a fluid situation. …That was not a binary decision. That was not a, ‘Now we’re not ever going anywhere.’ It was based on the offer that was presented in front of us that we’re not taking that offer because we don’t think less of ourselves. And I came here for a reason. You heard me in the press conference. You’ve heard me in any interview that I’ve done. I’m bullish on Memphis’ future. And so I think sometimes we get enamored by the new and we want to take a bad deal, and that deal was not a good deal for the University of Memphis, it certainly wasn’t a good deal for our athletic department and, most importantly, it was a really, really bad deal for our Olympic sports.” Scott goes on to explain that "we've done the math on this. If we owe $25M (in exit fees), which is precedent by SMU (when it left for the ACC) . . . if it's $25M to get out, we're getting offered $2.5M, that still leaves a gap of $22.5M, OK? If we're talking about a five-year deal to get through 2031…that still leaves you $22.5M you've got to pay back over five years. And there's another piece of the deal, without putting all of the information out there, part of the deal was that two of the schools — and you can figure out who those were — would be able to keep all of the College Football Playoff annual distribution money. … I don’t know any coach in our portfolio that thought us making that move was going to put them in a better position to recruit or a better position to get into the postseason right now.” More from Scott. William & Mary AD Brian Mann’s new five-year contract through June 30, 2029, includes a base pay raise from $250K per year to $370K. Mann can earn up to $45K in bonuses for meeting academic and athletic goals. He can also earn $10K for each sport that reaches the NCAA postseason that hasn’t in the past 10 years. Additionally, Mann is eligible for an annual retention bonus worth 5-10% of his salary based on rolling six-month goals established with President Katherine Rowe. For parting ways with Mann early, the Tribe would owe him 50% of his remaining salary unless it is the last year of the contract, in which case the school would owe him his remaining salary. Mann would owe the university $150K if he leaves for another AD role before June 30, 2028 unless Rowe is no longer the president. If Mann were to leave for a Power 4 job he would be required to provide William & Mary with the option to schedule a football or men’s basketball game, either as the highest-value guarantee game or as part of a home-and-home. More on Sacramento State’s plans for a new 25K-seat multi-use stadium that will replace Hornet Stadium. The stadium will be designed to host football, men’s and women’s soccer, and men’s and women’s rugby and also host college, professional and international competitions, NCAA championships, concerts, club sports and other events including Commencement and Convocation. The Hornets have retained Populous for the stadium design, which is set to include student sections, premium seating and boxes. Hornets AD Mark Orr: “This new, state-of-the-art multi-purpose stadium will be more than just an amazing home to our Hornet athletic teams. It will serve as an entertainment hub for many types of events for all Sacramento State students, alumni, fans and community members to enjoy. Eastern Washington will renovate Roos Field contingent on raising $13M in pledged donations. EWU already secured $6M in pledges and Eagles AD Tim Collins says: “Our university leadership and our board of trustees are committed to being a vibrant and thriving member of the Big Sky Conference, and I think you can see how that falls in line with our university’s aspirations as a whole, where we’re being positioned as a university and how we serve Spokane County.” Upgrades will include the addition of new club seats at the top of the bleachers on the west side of the field, and the current structure that includes the press box would be redesigned to include more suites and club seating. A new press box would be built on the opposite side of the field in a space that would also include new concessions. (link)

Washington will take its multimedia rights to market, Huskies AD Pat Chun tells SBJ’s Ben Portnoy. UW’s current agreement with Learfield runs through June of 2025. Learfield notes in a statement to SBJ that its relationship with the Huskies dates back to 2006, and that over the last three years, Huskies Sports Properties team has "powered revenue growth of 22%, anchored by strong sponsorships with over 144 brand partners." Learfield also noted that upon Chun's arrival at UW, the school "migrated to our Fanbase data platform, helping the university join a community of over 150 schools that can directly reach over 150M college athletics fans." Clemson trustee David E. Dukes, a partner at Nelson Mullins, billed the university for 250 hours of legal work related to the Tigers’ legal dispute with the ACC from March through May for a total of $187,500, according to The Post and Courier’s Jon Blau, who adds: “Dukes' payout was the largest chunk of the nearly $735K invoiced by the Columbia firm. … Nelson Mullins reports that Dukes, who charges $750 an hour, invested 114 hours on the case in April, which amounts to an average of 5.2 hours per weekday.” A statement from Clemson notes that Dukes is “lead litigator in two pending cases spanning two states. As previously communicated, the Clemson Board of Trustees does not have a role in selecting or approving outside counsel for the university. It is important to note again, the funds expended on this litigation are being paid through athletics-generated revenues and private donations — not from any state allocation." (link)

The six remaining Mountain West members have signed binding commitment agreements, per multiple sources. Yahoo’s Ross Dellenger notes the league is expected to “later release per-school tiered distribution of signing bonuses derived from Pac-12 exit fees (~ $100M). The remaining unsigned Mountain West member is Hawaii. … As a partial member in football, Hawaii does not impact the MWC agreement as all full members signed, according to those familiar with the terms. Hawaii plans to sign the agreement with the Mountain West to remain a football member. All seven are signed. Hawaii officials and those from the Pac-12 held conversations about membership over the last day, but the league did not extend an invitation.” (link, link)

A group of student-athletes led by Big Ten women's basketball players sent a letter to NCAA President Charlie Baker on Wednesday asking the association to drop its proposed restrictions on the types of NIL deals players can sign with collectives and third-party groups. ESPN’s Dan Murphy reports the letter is “signed by USC captain Dominique Darius, who told ESPN she sent it on behalf of roughly 100 athletes from different schools and sports. The letter specifically asks the NCAA to drop the proposed portion of its industry-shifting antitrust settlement that would give the association authority to determine which NIL deals are for ‘valid business purposes.’ … The basketball players said they were concerned that so far they haven't had a large enough voice in a process that could be reshaping at least the next 10 years of the college sports industry. All four players who spoke to ESPN said they have not received any information about the pending deal from their schools.” Northwestern senior Caileigh Walsh: "There has been absolutely zero communication. Northwestern isn't telling us anything about it, so we're trying to get our hands on as much information about it as we can." Fellow Wildcat Melannie Daley adds: "It deeply bothers me that people are making decisions without us having any say in it. Decisions are being made above our heads about what we deserve in compensation." (link)

Officials from the SEC and Big Ten will meet in Nashville next month in “what is viewed as a continuation of their announced partnership,” according to Yahoo’s Ross Dellenger, who reports, however, that “those briefed on the meeting do not expect impactful decisions to be made and believe this to be only a next step in a partnership that the two conferences entered six months ago with the creation of a joint board. Athletic directors are expected to begin discussion about a range of topics that they have mostly, so far, kept within their individual leagues. Those topics include the House settlement case, a new third-party (not NCAA) enforcement model, the future of the College Football Playoff format and — most noteworthy of them all — a regular-season and postseason scheduling arrangement. Discussions are expected to go beyond the regular season with the possibility of what officials describe as an ‘overhauled postseason’ for those programs not advancing to the CFP. Administrators are exploring ways to arrange more matchups that pair teams from the two leagues as opposed to their current bowl agreement pairings,” which expire after the 2025 campaign. Doing so is seen as a way to generate additional revenue, as Dellenger notes the two most-watched games this season involve interconference matchups between the two leagues with Michigan-Texas drawing 9.19M viewers and USC-LSU attracting 8.2M. More Realignment Rumblings…
+ Without going into specifics, Utah State AD Diana Sabau says the Aggies “received financial support from across the state of Utah” to help with the Pac-12 move. While there is no media deal lined up, Sabau explains USU is "very happy with our agreement” and received a deal that is “pretty equitable with what was promised by the Pac-12” to Boise State, Colorado State, Fresno State and San Diego State. Sabau also notes once those four schools left the Mountain West, "you could tell that there was a shift in the dynamic. As an athletics director I want to future-proof our programs but also be in alignment with future growth of the institution too. When the opportunity arose (to join the Pac-12), sometimes you have to take a leap of faith.” Meanwhile, Honolulu Mayor Rick Blangiardi has assembled a third-party group that has been “lobbying for the University of Hawaii football team to gain admittance into the Pac-12.” Blangiardi adds: “As mayor, I’m not supposed to cross a few lines. But this is really important to our community.” The Honolulu Star-Advertiser’s Stephen Tsai noted the negotiating team includes: former Mountain West Commissioner Craig Thompson; retired UCLA AD Dan Guerrero; and DHR Global Sports Practice Managing Partner Glenn Sugiyama. Blangiardi said that his group’s "priority is for UH’s football team to receive a Pac-12 invitation.” (link)
+ Sacramento State announces it has secured millions of dollars in funding for a new football stadium as part of a public pursuit of Pac-12 membership, according to Yahoo’s Ross Dellenger. In a release, the school calls on “business leaders across the region to join efforts to elevate Sac State to the Pac-12.” (link)
+ According to Dave Campbell’s Texas Football’s Mike Craven, Texas State has engaged in “active conversations” with the Mountain West, Pac-12 and AAC while also talking with the Sun Belt about staying. Meanwhile, UTEP has “long wanted” an invitation from the MW, and Craven notes the Miners’ Conference USA buyout is close to $2M while the Bobcats would owe the Sun Belt $5M. (link)
+ The Mercury News’ Jon Wilner contends it’s a “terrible decision for UNLV’s athletic future” to stay in the Mountain West. “The Rebels were paid approximately $25M to remain in the Mountain West — we’ll get to that issue momentarily — but that cash will vanish quickly given the athletic department’s fragile fiscal situation. Moving to the Pac-12 would have elevated UNLV’s competitive profile, resulting in more annual media revenue and enhanced community support for name, image and likeness efforts.” Wilner also posits that Pac-12 Commissioner Teresa Gould “could not have justified a $25M outlay to her newest members, which are worth more than UNLV, or to Washington State and Oregon State.” As it stands, Wilner notes the financial commitment from the MW is not without risk, as the league is counting on the poaching penalties to help fund the endeavor. “The Pac-12 is challenging the legality of the poaching penalty, and the five departing schools assuredly will fight to reduce the exit fees. The Mountain West could emerge with $145M to use as it pleases, or much less.” While Texas State appears to be high on the Pac-12’s list of expansion candidates, Wilner believes the league should be patient. “Take the seven-school structure to executives at ESPN, Fox, Turner, Apple, The CW, CBS — and any other potential suitors — and get real numbers. Then use those numbers to find No. 8.” He also contends the league should prioritize Gonzaga. “It makes little sense to offer the Zags a full share of the Pac-12’s annual revenue because they don’t play football. But a partial share (in the $6M-to-$8M range, for example) might not constitute a significant increase from the West Coast Conference media distributions.” More. (link)

As James Madison prepares for potential changes to roster and scholarship limits, Dukes AD Matt Roan says it remains unclear whether the department will max out the number of allowable scholarships. “The conversations we have had with our coaches is to start to plan for the roster limits. Start to think about football as though you have 105. Start to plan on that, because that feels pretty real when you’re looking at what your scholarship budget could be, what your revenue share, what that number might be. I think those are the things where we are having dialog and understanding the finances of it. Do you go up to your roster limit or do you try to maximize the value of another number that is somewhere less than what that limit might be?” Dukes Football HC Bob Chesney on how his program could be impacted: “If that happens and we’re rolling it out next year, that’s a tough one. As far as what it looks like on the day-to-day, there’s more of an NFL model when it comes to practice that you have to get involved in.” (link)

Meanwhile, Houston Men’s Basketball HC Kelvin Sampson says he needs a private plane to recruit “not because of convenience. It’s because of necessity. It’s not like every kid we’re recruiting is within 20 miles of this campus. These kids are in different states. … I can’t get on a United flight at 6 in the morning and fly to Point A and then have to drive two hours because that’s the closest airport to that school. So now I’m locked into seeing one kid that day. Where, if you have access to a plane, I can see a kid do an early morning workout somewhere in Texas and go see a kid in Salt Lake City and go see a kid workout in Arizona and get home and be in the indoor practice facility for conditioning at 6:15 in the morning.” Relying on donors for private jet hours, Sampson continues, is not sustainable. “I get tired of having to go ask our donors for stuff and knocking on their door. That's not fair to them. I’ve been on this administration that we need to quit asking the donors for their hours. That’s their hours. Let’s get our own hours. Most of the schools in the Big 12 have their own plane.” Sampson goes on to note that “we’re having to learn how to be a Big 12 school. This is not my second year in the Big 12, this is my 14th year in the Big 12. We’re still not a Big 12 school. We’re a long way away from being a Big 12 school. We’ve got Big 12 players, obviously, but that’s about it.” (link)

UCLA’s baseball program will be locked out of its stadium on veterans’ land west of the campus pursuant to an order issued by U.S. Federal Court Judge David O. Carter “enjoining UCLA from accessing the Jackie Robinson Stadium and an adjacent practice field until it produces a plan that meets his satisfaction to ensure that service to veterans is the predominant focus of 10-acre facility leased from the U.S. Department of Veterans Affairs,” the Los Angeles Times’ Doug Smith reports. Carter: “The VA is ordered by noon tomorrow to cordon off and prevent any use of the UCLA baseball stadium and practice field until further notice from the court.” Carter declared the UCLA lease illegal because its focus was not predominantly service to veterans. Sportico’s Eben Novy-Williams weighs in on Tennessee’s 10% “talent fee” ticket surcharge and observes that Vols AD Danny White “did not address whether the transparency he espoused might also generate resentment between Volunteers fans and a group of athletes just starting to scratch the surface of their true market value. It’s a savvy sleight of hand. The move lets the school celebrate progress for athletes while simultaneously passing much of the financial burden onto its most passionate fans. How those fans feel about the athlete labor movement could have significant consequences for how far that movement ultimately goes.” Novy-Williams accepts that fans have benefited from “the economics of an industry built on severely under-compensated labor” but notes UT has never added a “coaching surcharge” to its tickets. Novy-Williams goes on to observe that the talent fee reminds him of the “winnings surcharge” DraftKings announced it would be adding to winning payouts in high-tax states. “Its stated goal was to help the company improve its business by passing that burden on to consumers. … But it also had another purpose. When I asked DraftKings CEO Jason Robins if part of the strategy was to nudge consumers to direct anger toward lawmakers, he said it wasn’t the main goal, but conceded that it was a ‘potential effect.’” The Collective Association President Russell White believes it may actually create ill-will toward UT: “It just shows how flawed the whole model is. Any logical thinker would say, ‘You have to pay your labor,’ and many schools chose not to have a plan for what that looks like. Sportico’s Michael McCann analyzes the legal arguments likely to be made in former USC Heisman Trophy winner Reggie Bush’s NIL lawsuit against the NCAA, USC and the Pac-12 and explains: “For starters, nearly two decades have passed since Bush played college football. Antitrust claims generally have a four-year statute of limitations, while unjust enrichment normally must be brought within three years of their discovery. The defendants will almost certainly argue that Bush waited far too long to sue them. They could assert it wasn’t as if Bush lacked notice of possible claims: O’Bannon brought his case in 2009 and his victory was affirmed on appeal in 2015. Bush’s attorneys anticipate a statute of limitations defense and try to diffuse it in their complaint. They argue the alleged violations are ‘continuing,’ which if accepted by the court would make it more likely Bush’s claims are not time-barred. The attorneys also stress that Bush was young when he ‘signed away his [NIL] and thus he should be ‘entitled to equitable tolling of his claims.’” Furthermore, the NCAA, et al. could argue that its NIL prohibition was compliant with antitrust law during the era in which Bush played and could point out that other courts have rejected claims that college athletes should be paid for their TV appearances.” (link)
