NCAA President Charlie Baker writes on X: “We continue to see evidence of dysfunction in today’s NIL environment, including examples of promises made but not kept to student-athletes. Just as anyone that owns stock or buys a house is afforded basic consumer protections, it's clear that student-athletes entering NIL contracts should be too. That’s exactly why we provide student-athletes with a template contract and recommended, fair terms through our new NIL Assist platform. While we’d love to see these resources used to protect student-athletes in every NIL deal, it’s not something the NCAA has the authority to mandate. In the meantime, we’re continuing to advocate for Congress to create national NIL guidelines that will protect student-athletes from exploitation, including the use of standard contracts. (link)

The NCAA sent a letter to members regarding yesterday’s amended House settlement filing. It reads, in part: “The plaintiffs have been working collaboratively with NCAA counsel and conference defendant counsel on the content of [the] brief. The brief addresses the questions raised by the court in three key areas: how third-party [NIL] issues would be regulated; the ability to commit future student-athletes to the settlement structure for a period of 10 years; whether the lawyers for the plaintiffs met their ethical obligations by representing both a damages class and an injunctive class. … With this clarification and explanation of the proposed settlement, we believe preliminary approval should be granted.” (link)

Purdue Board of Trustees Chair Mike Berghoff tells GoldandBlack.com’s Alan Karpick that “we believe the House case and settlement are the best possible outcome for Purdue. We view it as finally bringing order to the process. We finally have a pathway that everyone in the conference can follow; if this passes – and there is work to do – it provides an equal amount of gunpowder for every athletic department. Because (at Purdue) we are in the middle, not the lower third, not the upper third when it comes to revenue.” On how the Boilermakers will find the money to share revenue with players, Berghoff says: “We’re pretty close, you know, in terms of revenue generation already, but there are some knobs that we will need to turn in order to meet the percentage of revenue share, and some of those are athletic expenses that the department has been burdened with for a long time and some of those expenses that they currently pay the university are probably better off and reasonably located in the University’s responsibility to pay.” Berghoff on having one board liaison to the athletics department: “You don’t want five and six board members sharing their advice with the athletic administration and the coaching. … We know what the obligation and responsibility is academically for a Purdue athlete that’s well understood, and it’s our expectations that are high on the academic side.” (link)

The Liberty-App State football game in Boone this weekend has been canceled due to Hurricane Helene. The game will not be made up, but Flames AD Ian McCaw says the school will try to find a 12th opponent. Action Network’s Brett McMurphy: “If Liberty wins CUSA, it would be in contention for a [College Football Playoff] bid & could be hurt if it only plays 11 regular season games.” (link, link) Samford at Furman scheduled for tomorrow has also been canceled. Florida A&M’s athletic facilities “appear to be in decent shape” after Hurricane Helene made landfall last night, according to Acting AD Michael Smith. FAMU will continue assessing the damage, and Smith says once that assessment is done, “we’ll be able to determine what the next steps are.” Rattlers Football HC James Colzie III says the team has the rest of the week off and will schedule practice once the facility assessment work is complete. Realignment Ramblings…
+ Northern Illinois has released the following statement concerning overtures from the Mountain West: “Conference realignment is a highly dynamic situation, and NIU appreciates the interest in our strong brand and proven commitment to the success of our student athletes. At this time, we have not received a formal offer to consider a change.” (link)
+ SBJ’s Austin Karp estimates a new Mountain West media rights deal would command “slightly more” than what the MAC currently receives and explains: “Who’s going to be left in the Mountain West? Because the Pac-12 has that lawsuit against the Mountain West, and if they succeed, that might allow some of those schools out of having to pay something. So maybe UNLV and Air Force change their mind. Maybe the Mountain West just folds. I wouldn’t be confident putting my cards with the Mountain West right now.” If Toledo were to join the Mountain West, its travel costs would increase significantly, as the Toledo Blade’s Kyle Rowland notes the city is 659 miles closer to London than Honolulu. “A road trip to Hawaii would resemble playing a game in Munich, Germany.” Karp observes that ‘within the group of five, yeah, [Toledo has value]. I think it’s one of those schools that in the right situation could be in the [College Football Playoff] conversation just based on what they’ve done over the last 10, 15 years. I see no difference between a Toledo and a Utah State, even a Boise State. I mean, Boise State’s not what it was. So why can’t Toledo, especially if it stayed in the MAC and was the champion of the MAC, be that school.” (link)
+ In its defense of the Pac-12’s lawsuit concerning poaching penalties, the Mountain West will likely argue the “Pac-12—a sophisticated business actor—willingly accepted the terms that the MWC is imposing,” per Sportico’s Michael McCann. Regarding the complaint’s assertion that the Mountain West “forced” the Pac-12 to “unprecedented Poaching Penalty provisions,” McCann posits the Mountain West can counter that “even if the penalty provision is unfair or oppressive, and even if it was made at an especially exploitative moment, the Pac-12 still agreed to it. The Pac-12 is a multimillion-dollar entity advised by experienced business and legal professionals. This is not a situation where, say, an elderly person of limited means, knowledge and capacity was duped by a charlatan and there’s a viable case for unconscionability.” Furthermore, the Mountain West could argue the exit fees alone are “conclusively insufficient, given that five of the 12 schools are leaving for the Pac-12. … The MWC could assert the situation it now faces is exactly why it was worried about lending a helping hand to the Pac-12 and why a poaching penalty made business sense. By assisting a rival conference in its time of dire need, the MWC made it possible for that conference to regain its footing and then (MWC would argue) opportunistically undermine the MWC’s interests.” More from McCann. According to OregonLive’s Ryan Clarke, budget documents published by Oregon in the past week show projected FY25 expenses of nearly $162.8M “with the typical goal of equaling that number in projected revenues. That is up roughly 12.3% over the previous fiscal year — Oregon’s final in the Pac-12. Last year in FY24, Oregon expected to receive $39.15M from the NCAA and Pac-12 along with $21.37M from broadcast deals, sponsorships and royalties. Looking ahead to FY25, the Ducks project revenues of $54.04M (+38%) from the NCAA and Big Ten and $25.06 M (+17%) from broadcast deals, sponsorships and royalties” as half-share members of the B1G. Clarke also points out that “another major revenue difference for the Ducks in FY25 is a projected $37.5M in usage of Duck Athletic Fund gifts and contributions. That is down more than 16% from FY24 ($44.8 million).” An Oregon spokesperson emphasizes this figure reflects “how much we anticipate drawing from our gift accounts this year in support of athletics, not how much money we expect to actually raise in contributions.” On the expense side, Ducks AD Rob Mullens said in July that UO expects to spend roughly $4M more on travel this year, and Clarke points out that administrative expenses are set to go up by nearly $7M to a total of about $79M — 48.5% of the overall athletic budget. Additionally, per Clarke, “Oregon projects a more than $8M increase (+24.5%) in the overall operating budget for football in FY25, to about $41.6M. That makes up the majority of a men’s sports budget expected to increase by more than $9M, to a total of roughly $62.5M.” The women’s sports operating budget is around $21.3M. (link)

The Nebraska Board of Regents will discuss alcohol sales at Nebraska athletic events when it meets next month, according to its agenda, which includes as the first action item: “Approve request to permit alcohol sales at University of Nebraska athletic events, Addendum XI-B-1.” NU is currently the only Big Ten school that doesn’t sell alcohol in its football stadium. La Salle unveils its newly renovated basketball complex at John Glaser Arena with a celebration at the newly dedicated Tom Gola Plaza. John Glaser Arena will have a new audio and visual system, renovated air-conditioning, a hanging LED video board at midcourt and smaller LED boards in the corners, a new concession stand, and a section reserved for students behind the east baseline. Explorers AD Ashwin Puri: “We want to create a fun, engaging environment for kids so they choose to come here, have a great time, and then they graduate with fond memories and ultimately want to give back. Baylor officially dedicated the Fudge Football Development Center with a ribbon-cutting ceremony on Friday. The center includes a 14,000-square-foot weight room with 18 Power Lift racks; 1,300-square-foot Virtual Walk-thru Room with a 400-square-foot video wall; athletic medicine space for injury and illness evaluation and rehabilitation; a state-of-the-art hydrotherapy treatment room; a centralized fueling station to optimize nutrition needs; a locker room featuring video technology at each locker and a quiet room; and a team auditorium with space for 205 in tiered, theater-style seating, among other amenities. + DirecTV is in advanced talks to acquire Dish, the Wall Street Journal’s Lauren Thomas, Miriam Gottfried and Drew FitzGerald report, adding that a deal could be finalized as soon as Monday, “assuming talks don’t fall apart.” The deal would also include Dish’s streaming brand Sling TV. In the revised House settlement agreement by attorneys yesterday the “basic reporting, clearinghouse and arbitration processes would remain as originally proposed, but the settlement now would do away with the term ‘booster’ and replace it with the term ‘Associated Entity or Individual,’” according to USA Today’s Steve Berkowitz. According to the lawyers, this constitutes “a narrower, more targeted, and objectively defined category that does not automatically sweep in ‘today’s third-party donor.’” Despite the removal of the term “booster,” Yahoo’s Ross Dellenger notes that it remains, “in essence, part of the settlement. Attorneys replaced the term with more specific terminology and parameters, including: Only deals involving a narrowed set of people closely affiliated with schools will be subject to the clearinghouse and enforcement process. For example, deals with commercial third parties, like shoe companies or apparel brands, are exempt from enforcement.” Deals with individuals whose families have provided less than $50K in support to a particular institution will also be exempt. Additionally, the filing clarifies that no deals will be prohibited under the settlement that are not already prohibited currently. Dellenger: “The amendment may pave the way for some school-affiliated boosters and collectives to survive, at least in a limited capacity. However, in all likelihood, those donating to collective efforts are likely to be considered a ‘set of people closely affiliated with schools,’ which would require them to clear their NIL deals through the clearinghouse.” Berkowitz points out that “Associated Entity or Individual” is defined by meeting any one of five criteria, including the following which appears to cover collectives: “An entity that is or was known (or should have been known) to the athletics department staff… to exist, in significant part, for the purpose of promoting or supporting a particular” school’s athletics program or athletes and/or “creating or identifying NIL opportunities solely for a particular” school’s athletes.” One source tells Berkowitz that U.S. District Court Judge Claudia Wilken could schedule another hearing or simply decide whether to grant preliminary approval based on the filings. Sportico’s Michael McCann points out that U.S. District Court Judge Claudia Wilken could also permit other interested parties to file objections and hold hearings to evaluate their arguments. Also from McCann: “Even if Wilken grants preliminary approval, that doesn’t mean she’ll grant final approval. She’ll then look at how many athletes opt out and hear concerns raised in a fairness hearing. There’s also the possibility the settlement could be challenged at the U.S. Court of Appeals for the Ninth Circuit and then at the U.S. Supreme Court. It could be years before the settlement is actually in force. The settlement could also collapse along the way, and the three lawsuits would then return to the docket. The NCAA could rationally decide that it would likely win the three lawsuits given applicable precedent.” At the same time, McCann notes that “one structural problem for the settlement is that it resembles a labor agreement without labor having a voice. So long as college athletes aren’t recognized as employees, they won’t be able to unionize. That means any restraints on their economic opportunities will be fair game for antitrust litigation, since the non-statutory labor exemption only insulates collectively bargained terms from antitrust exposure. And no matter what happens with the settlement, it can’t stop labor and employment lawsuits (including Johnson v. NCAA), NLRB charges (including those involving Dartmouth and USC athletes) and, especially given that male athletes would receive more money than female athletes under the settlement, lawsuits brought under Title IX.” (link)

According to the MOU signed by all seven Mountain West members, the league will distribute revenue utilizing the following formulas: Air Force and UNLV will receive 24.5%, Nevada, New Mexico, San José State and Wyoming 11.5%, and Hawaiʻi 5%.” The conference and member institutions have also agreed on a GOR from July 1, 2026, through June 30, 2032. (link); UNLV will also receive a lump sum of $10-14M from the Mountain West next year and $1.5-1.8M annually over six years starting in 2026. According to a statement from the school, those payments are in addition to the “current revenue streams from existing contracts and media assets.” Additionally, the Rebels “have the flexibility to explore future membership” in a Power 4 conference “without penalty should the opportunity become available.” (link)

The Mountain West has also notified the MAC of its interest in Northern Illinois and Toledo as football-only members in 2026, Action Network’s Brett McMurphy reports, adding: “This adds Central Time Zone to MW, potentially increasing future media rights value. NIU & Toledo have combined for 7 of last 13 MAC titles. MW currently has 7 football members but would still need 2 full-time members in addition to NIU & Toledo.” (link); ESPN’s Pete Thamel reports Texas State “has emerged as a target for Mountain West expansion, which would be an all sports addition. One other target that could soon come into focus for the Mountain West is Northern Illinois, which would be as a football-only member.” (link)

Hawaii AD Craig Angelos talks about the decision to remain in the Mountain West and says the Rainbow Warriors had “numerous discussions with Pac-12 officials and their consulting firm, Navigate, about the value we might be able to bring to that conference. … They knew of our timeline and our interest in the Mountain West Conference, of course, but we said we'd certainly entertain any interest that people had in us. And after being involved with a lot of discussion back and forth, we asked them to let us know what they thought one way or another as soon as they could, and they let us know this morning after a Pac-12 meeting that we were not going to be extended an offer. One of the things they cited is the exit fees,” which combined with the poaching penalties, would’ve been upwards of $30M. “As they said to me, the cost benefit of bringing in a Mountain West team in and Hawaii just didn't seem to satisfy the lawyers and the finance people, so they elected not to not to extend us an offer.” Angelos says of the 5% revenue distribution UH will receive: “We certainly would have liked to have seen more, but we certainly accept our share and will be good members of the Mountain West Conference going forward.” Angelos notes that discussions about potentially joining the Mountain West in all sports “can still take place later on down the road. I think right now it’s all about just solidifying the eight teams going forward and what that looks like. … I’m not sure which is best for our programs, whether it be to have that split program or better to be unified.” More from Angelos. Memphis AD Ed Scott says of the decision not to join the Pac-12: “When I hear people say, ‘I'm not going to buy tickets,’ ‘I'm not going to support the programs,’ you're not really hurting me, you're hurting the student-athletes. And you're hurting the people that are on the field playing, and that's really, really important for me. So, where does this go? If y'all haven't seen the latest reports of what's going on between the Mountain West and the Pac-6,7 right now, this is a fluid situation. …That was not a binary decision. That was not a, ‘Now we’re not ever going anywhere.’ It was based on the offer that was presented in front of us that we’re not taking that offer because we don’t think less of ourselves. And I came here for a reason. You heard me in the press conference. You’ve heard me in any interview that I’ve done. I’m bullish on Memphis’ future. And so I think sometimes we get enamored by the new and we want to take a bad deal, and that deal was not a good deal for the University of Memphis, it certainly wasn’t a good deal for our athletic department and, most importantly, it was a really, really bad deal for our Olympic sports.” Scott goes on to explain that "we've done the math on this. If we owe $25M (in exit fees), which is precedent by SMU (when it left for the ACC) . . . if it's $25M to get out, we're getting offered $2.5M, that still leaves a gap of $22.5M, OK? If we're talking about a five-year deal to get through 2031…that still leaves you $22.5M you've got to pay back over five years. And there's another piece of the deal, without putting all of the information out there, part of the deal was that two of the schools — and you can figure out who those were — would be able to keep all of the College Football Playoff annual distribution money. … I don’t know any coach in our portfolio that thought us making that move was going to put them in a better position to recruit or a better position to get into the postseason right now.” More from Scott. William & Mary AD Brian Mann’s new five-year contract through June 30, 2029, includes a base pay raise from $250K per year to $370K. Mann can earn up to $45K in bonuses for meeting academic and athletic goals. He can also earn $10K for each sport that reaches the NCAA postseason that hasn’t in the past 10 years. Additionally, Mann is eligible for an annual retention bonus worth 5-10% of his salary based on rolling six-month goals established with President Katherine Rowe. For parting ways with Mann early, the Tribe would owe him 50% of his remaining salary unless it is the last year of the contract, in which case the school would owe him his remaining salary. Mann would owe the university $150K if he leaves for another AD role before June 30, 2028 unless Rowe is no longer the president. If Mann were to leave for a Power 4 job he would be required to provide William & Mary with the option to schedule a football or men’s basketball game, either as the highest-value guarantee game or as part of a home-and-home. More on Sacramento State’s plans for a new 25K-seat multi-use stadium that will replace Hornet Stadium. The stadium will be designed to host football, men’s and women’s soccer, and men’s and women’s rugby and also host college, professional and international competitions, NCAA championships, concerts, club sports and other events including Commencement and Convocation. The Hornets have retained Populous for the stadium design, which is set to include student sections, premium seating and boxes. Hornets AD Mark Orr: “This new, state-of-the-art multi-purpose stadium will be more than just an amazing home to our Hornet athletic teams. It will serve as an entertainment hub for many types of events for all Sacramento State students, alumni, fans and community members to enjoy. It will also have a significant positive impact on our ability to attract and retain student-athletes to compete for championship success at a national level.” (link)

Eastern Washington will renovate Roos Field contingent on raising $13M in pledged donations. EWU already secured $6M in pledges and Eagles AD Tim Collins says: “Our university leadership and our board of trustees are committed to being a vibrant and thriving member of the Big Sky Conference, and I think you can see how that falls in line with our university’s aspirations as a whole, where we’re being positioned as a university and how we serve Spokane County.” Upgrades will include the addition of new club seats at the top of the bleachers on the west side of the field, and the current structure that includes the press box would be redesigned to include more suites and club seating. A new press box would be built on the opposite side of the field in a space that would also include new concessions. (link)

Washington will take its multimedia rights to market, Huskies AD Pat Chun tells SBJ’s Ben Portnoy. UW’s current agreement with Learfield runs through June of 2025. Learfield notes in a statement to SBJ that its relationship with the Huskies dates back to 2006, and that over the last three years, Huskies Sports Properties team has "powered revenue growth of 22%, anchored by strong sponsorships with over 144 brand partners." Learfield also noted that upon Chun's arrival at UW, the school "migrated to our Fanbase data platform, helping the university join a community of over 150 schools that can directly reach over 150M college athletics fans." Clemson trustee David E. Dukes, a partner at Nelson Mullins, billed the university for 250 hours of legal work related to the Tigers’ legal dispute with the ACC from March through May for a total of $187,500, according to The Post and Courier’s Jon Blau, who adds: “Dukes' payout was the largest chunk of the nearly $735K invoiced by the Columbia firm. … Nelson Mullins reports that Dukes, who charges $750 an hour, invested 114 hours on the case in April, which amounts to an average of 5.2 hours per weekday.” A statement from Clemson notes that Dukes is “lead litigator in two pending cases spanning two states. As previously communicated, the Clemson Board of Trustees does not have a role in selecting or approving outside counsel for the university. It is important to note again, the funds expended on this litigation are being paid through athletics-generated revenues and private donations — not from any state allocation." (link)
