Augsburg AD Jeff Swenson will retire at the end of the academic year, concluding a 24-year tenure leading the Auggies. Swenson: “As we celebrate 100 years of Augsburg athletics, and having been a part of athletics here for nearly 50 years, counting my undergraduate years, my family and I felt that the time was right to make a transition. Being diagnosed with Parkinson's Disease in June 2022 certainly entered into my thought process as well. I'm looking forward to helping Augsburg transition to the next athletic administrative team, and finishing up our fundraising for the men's locker room project and other university priorities. […] My goal has always been to provide the best possible experience for our student-athletes and to improve one percent each day in everything we do. I hope we've accomplished that in the areas I've had the opportunity to be part of at Augsburg during the last five decades. We have great coaches, an incredible support staff and an awesome administrative team, and I'm confident that Auggie athletics will continue to thrive and improve.” The university will launch the search for Swenson’s successor in early 2025. House Happenings:

+ In the revised House settlement agreement by attorneys yesterday the “basic reporting, clearinghouse and arbitration processes would remain as originally proposed, but the settlement now would do away with the term ‘booster’ and replace it with the term ‘Associated Entity or Individual,’” according to USA Today’s Steve Berkowitz. According to the lawyers, this constitutes “a narrower, more targeted, and objectively defined category that does not automatically sweep in ‘today’s third-party donor.’” Despite the removal of the term “booster,” Yahoo’s Ross Dellenger notes that it remains, “in essence, part of the settlement. Attorneys replaced the term with more specific terminology and parameters, including: Only deals involving a narrowed set of people closely affiliated with schools will be subject to the clearinghouse and enforcement process. For example, deals with commercial third parties, like shoe companies or apparel brands, are exempt from enforcement.” Deals with individuals whose families have provided less than $50K in support to a particular institution will also be exempt. Additionally, the filing clarifies that no deals will be prohibited under the settlement that are not already prohibited currently. Dellenger: “The amendment may pave the way for some school-affiliated boosters and collectives to survive, at least in a limited capacity. However, in all likelihood, those donating to collective efforts are likely to be considered a ‘set of people closely affiliated with schools,’ which would require them to clear their NIL deals through the clearinghouse.” Berkowitz points out that “Associated Entity or Individual” is defined by meeting any one of five criteria, including the following which appears to cover collectives: “An entity that is or was known (or should have been known) to the athletics department staff… to exist, in significant part, for the purpose of promoting or supporting a particular” school’s athletics program or athletes and/or “creating or identifying NIL opportunities solely for a particular” school’s athletes.” One source tells Berkowitz that U.S. District Court Judge Claudia Wilken could schedule another hearing or simply decide whether to grant preliminary approval based on the filings. + The NCAA sent a letter to members regarding yesterday’s amended House settlement filing. It reads, in part: “The plaintiffs have been working collaboratively with NCAA counsel and conference defendant counsel on the content of [the] brief. The brief addresses the questions raised by the court in three key areas: how third-party [NIL] issues would be regulated; the ability to commit future student-athletes to the settlement structure for a period of 10 years; whether the lawyers for the plaintiffs met their ethical obligations by representing both a damages class and an injunctive class. … With this clarification and explanation of the proposed settlement, we believe preliminary approval should be granted.” (link)

NCAA President Charlie Baker writes on X: “We continue to see evidence of dysfunction in today’s NIL environment, including examples of promises made but not kept to student-athletes. Just as anyone that owns stock or buys a house is afforded basic consumer protections, it's clear that student-athletes entering NIL contracts should be too. That’s exactly why we provide student-athletes with a template contract and recommended, fair terms through our new NIL Assist platform. While we’d love to see these resources used to protect student-athletes in every NIL deal, it’s not something the NCAA has the authority to mandate. In the meantime, we’re continuing to advocate for Congress to create national NIL guidelines that will protect student-athletes from exploitation, including the use of standard contracts. (link)

Albion AD Jennifer Rushton updates the Brits community about her first 90 days on campus, including a number of facility projects. Albion has fully renovated its athletic training space to include a hydrotherapy room and more and will begin upgrades to Kresge Gymnasium after the basketball season with new bleachers and locker rooms. The Brits have also begun relocating its Men’s and Women’s Golf team to a larger space downtown, as the squads have outgrown the Gracie Mack Golf Training Center. Ruston: “As we gear up for a new season, our goals are to achieve at the highest level in the classroom, in competition, and through leadership and engagement. We will challenge our athletes to pursue excellence in the classroom and in competition while enhancing their leadership skills through engaging in campus and community activities. In closing, I have been nothing but impressed with the faculty, staff, alumni, and students I have met in my first three months. SUNY Geneseo will add Women’s Flag Football with the program to begin this spring before recruiting a full roster of 25-30 student-athletes for fall 2025. VP for Student and Campus Life Mike Taberski: ”Seeing this sport grow across the country and in our area has been amazing. The number of women looking to play flag at the college level, coupled with Geneseo's outstanding academic profile and excellent facilities (two turf fields at the College Stadium), make flag a natural addition to our nationally recognized Division III athletic program.” (link)
