There were several takeaways from today’s NIL hearing on Capitol Hill: 

+ OSKR partner/noted sports economist Schwarz, who starts by pointing out the “moment I see that the title of the hearing claims to be about ‘Protecting College Athletes’ NIL Dealmaking Rights,’ I am virtually certain there will be a lot of effort to curtail those rights. This is the same as calling an anti-union bill a "right to work" law, etc. … The committee is stacked with representatives of NCAA members (i.e., schools) and if you read the hearing announcement you can find that the real goal is "to ensure a clear set of rules…to preserve the future of college athletics. Voila, the rabbit goes into the hat!” (link)

+ Meanwhile, Washington State AD Chun, per Heitner Legal’s namesake, “says there will be irreparable damage to athletes if they are labeled employees. They can be fired for underperformance and there are negative tax implications.” (link)

+ Chun also called for “transparency in the marketplace,” but College Football Players Association Executive Director Stahl pushed back, arguing that any NIL regulations would only serve the interests of schools, conferences and the NCAA. “The federal government should stay out of the NIL free market.” (link)

+ Patriot League Commissioner Heppel in written testimony asserted that student-athletes being classified as employees would “likely represent a breaking point for the sponsorship of athletic programs at Patriot League institutions." (link)

+ Stahl, per USA Today’s Berkowitz, tells the committee that the problems in college sports can be solved by people within college sports (as opposed to Congress) — if schools will sit down and work through this with players and representatives. Stahl also says there should be bargaining with athletes over use of their NIL in live TV broadcasts. (link)

+ NCAA President Baker on today’s congressional NIL hearing: “NIL is a powerful vehicle that rightfully allows student-athletes the ability to earn compensation based on their unique market value. At the same time, the lack of transparency in today’s NIL marketplace puts student-athletes in jeopardy of exploitation by bad actors. Plus, differing state laws regulating NIL (currently more than 30) put student-athletes across the country on an uneven playing field.” Baker also notes he’s “optimistic” Congress will create “fair, equitable and sustainable NIL guidelines that protect and benefit student-athletes nationwide.” (link)

USC Aiken AD Wilkinson details some of his priorities with the local Rotary Club, pointing to excellence, graduation and to “consistently be in consideration for the NCAA (Division II) regionals.” Further: "we are going to build a culture that retains the students we recruit. You've heard of the portal. You've heard of people moving around. You build a culture, and you care about the students. We want to build that so ... they stay with us from start to finish." (link) 

The National Collegiate Women’s Bowling Championship field is set with top-seed McKendree, Fayetteville State and Maryville set to compete starting next week. (link)

Connect/MB Sports’ Banker sits down with Tarleton State (DI) Assoc. AD of Sports Medicine/Intercollegiate Council for Sports Medicine Chair Berkstresser to discuss the athletic trainer shortage in college sports, what’s happening on the front end of injury prevention, structuring compensation, return-to-play timeframes and more. Berkstresser says the issues facing athletic trainers are multifaceted and include compensation and benefits and day-to-day functions. “The important other piece to it is they want to be able to have the time to provide the care and the skills that they have to their patient population. So, for us in this environment, it goes way beyond taking care of injured student-athletes. … We are doing way more on the front end from an injury-screening standpoint, corrective exercises from an injury prevention standpoint…and so the majority of our time is actually geared towards completely healthy student-athletes or injured student-athletes that aren’t missing time.” Full conversation now on Connect. MSU Billings MBB HC Durham retires after five seasons with the Yellow Jackets. AD Bazemore: “Mick's career speaks for itself, a true testament to his skill level and the ability to adapt to the constantly changing landscape of men's basketball. His experience was instrumental in not only reshaping our program, but putting us in a position for success after his retirement.” (link)

Fort Hays State WBB HC Hobson retires after 15 seasons with the Tigers and will be succeeded by AC Kahrs. AD Hammeke: “Talia possesses all the traits we want to see in a coach to lead our program forward. She is passionate, knowledgeable, enthusiastic, and has a strong work ethic. These characteristics coupled with her personality, love for the game, and care for our student-athletes, makes her well suited to take over where Tony left off.” (link)

Drury WBB HC Eagan heads to Lindenwood (DI) in the same capacity. Drury VP/AD Milleson: “Four years ago, she chose to come to Drury as an assistant, having already established herself as an outstanding head coach. When the opportunity came for her to take over our program, she produced championship teams, the Lady Panthers were national contenders every year, and her players excelled academically. Her teams personified excellence in academics and athletics.” (link)

According to a survey conducted by the Art & Science Group, one in four prospective college students indicated they had ruled out higher ed institutions due to the politics, policies, or legal situation in the state where the college was located. The Chronicle of Higher Education’s Surovall notes the results were “consistent across the ideological spectrum — conservative students (28%) indicated they were about as likely as liberal students (31%) to reject an institution based on the political climate of a state.” Art & Science Group Principal Strauss: “We’ve been struck by the observation that liberals seem to be reacting mostly to very particular policies. Conservative students seem to be reacting a little bit to particular issues, but more to a general sense of a state being democratic or too liberal in a kind of generalized sense.” The states most likely to be ruled out overall included Alabama (38%), Texas (29%), and Louisiana, and Florida (21%). The most common policy issues cited by students were a lack of concern about racial equity and conservative restrictions on abortion and reproductive rights. (link)
