Mount Mary will exit DIII and join the NAIA starting next fall. MMU President Isabelle Cherney: “The NAIA serves the interests of small institutions like ours and is a perfect fit for us. U.S. District Court Judge Claudia Wilken has granted preliminary approval to the House settlement, concluding that “on a preliminary basis only, the settlement complies with the requirements of Federal Rule of Civil Procedure 23 that the agreement be fair, reasonable and adequate,” according to Sportico’s Michael McCann. The process of officially notifying current and former athletes of the terms and claims procedures is set to begin on October 18. Those who would be covered by the agreement will have the opportunity to object or opt out by January 31, 2025, with a final approval hearing scheduled for April 7, 2025. NCAA President Charlie Baker: "We are thrilled by Judge Wilken’s decision to give preliminary approval to the landmark settlement that will help bring stability and sustainability to college athletics while delivering increased benefits to student-athletes for years to come. Today’s progress is a significant step in writing the next chapter for the future of college sports. We look forward to working with all of Division I, and especially student-athlete leadership groups to chart the path forward and drive historic change." USA Today’s Steve Berkowitz notes schools could begin paying their athletes in the first academic year after final approval and the resolution of any potential appeals. “So, in theory, payments to athletes could begin during the 2025-26 school year. And [House plaintiffs’ attorney Steve] Berman has said current and former athletes could begin receiving checks from the damages pool in fall 2025, if not sooner.” McCann: “For the NCAA and the plaintiffs’ attorneys, Monday is a positive development but by no means represents the crossing of the finish lines. There are still miles to go on that front.” (link, link); Berkowitz adds that Wilken’s “order today did not include any specific commentary concerning her reasons for granting preliminary approval other than fairly standard general language saying that she will ‘likely be able to approve the Settlement as fair, reasonable and adequate ... subject to further consideration’ at the final approval hearing.” (link); Full order. NCAA President Charlie Baker sits down with DIII SAAC Chair/Cornell College Baseball student-athlete Jack Langan and Penn State Behrend Women’s Soccer student-athlete Molly Malachow to discuss a number of topics including outreach to legislative leaders and next steps from the House settlement. Prior to the settlement being preliminarily approved, Baker: “I think it also gives us a framework that makes it possible for us to go to Congress and say, ‘Okay we solved the big problem. We created a mechanism to deal with revenue-sharing and additional benefits. Help us just codify that so we can end this conversation once for all,’ because the injunction obviously doesn't last forever.” Asked how DIII schools and student-athletes can best engage their representatives: “The biggest thing I would say about about DIII is the opportunity to get some of the elected officials on the campus so they get a sense for what the schools are up to and have a chance to talk to kids in what I would describe as their own environment is probably the best way to do it. I do know of a lot of schools that have brought members of Congress onto campus and had them spend time with student-athletes and those members of Congress have walked away with a much better understanding and appreciation for, not just what DIII is about and what DIII does, but also what some of the issues and concerns are especially around the employment issue for student-athletes and for schools.” (link)

North Florida (DI) Dean of the College of Education and Human Services Steve Dittmore explores which DIII members “do the best job of achieving those stated [DIII] priorities of ‘rigorous academics’ and ‘competitive athletics,’” finding 42 members who finished in the top 100 of the LEARFIELD Directors’ Cup standings and latest U.S. News and World Report rankings for top liberal arts schools and national universities. Dittmore: “Does this mean the other 400-or-so Division III schools are somehow inferior? No, of course not. It simply means that, by these two measures alone, those 42 schools are providing the best blend of rigorous academics and competitive athletics. It also means that by joining the Centennial Conference for football, Carnegie Mellon University is aligning its program with institutions similar to itself for all sports. […] As schools such as CMU increasingly align their institution with others who share similar ideas about the purpose of academics and athletics, the potential for increased polarization among Division III exists. In much the same way that Division I has morphed from FBS to Power 5 to Power 4 (and everyone else), the idea that some Division III schools might wish to self-select into a ‘Division X’ is at least 20 years old.” (link)

+ Sportico’s Michael McCann analyzes the lawsuit filed late last week by former Ohio State (DI) Football standout Terrelle Pryor against the NCAA. McCann: “Pryor arguably has the most compelling argument that he was harmed by the old system. As his complaint notes, he was Big Ten Freshman of the Year in 2008 and he led the Buckeyes to the Big Ten championship in 2009. A year later Pryor was the MVP of the Rose Bowl. Then, the NCAA intervened in his career trajectory. [...] One concern for the NCAA is that they now face essentially the same lawsuit in three federal districts, and there’s no telling how many former college stars will file similar lawsuits in other districts. The litigation could eventually be consolidated in one forum, which would avert the possibility that courts reach conflicting decisions and relieve the NCAA of having to incur heavy legal fees playing defense across the country. This has happened before in sports litigation: More than 300 lawsuits brought by retired players against the NFL over concussions and long-term neurological ailments were eventually consolidated.” (link)

+ USCHO.com’s Jim Connelly reports: “The NCAA Division I Council is scheduled to take up a recommendation to adopt emergency legislation that would eliminate the prohibition on major junior players in NCAA hockey, according to a source. The council meets on Tuesday and Wednesday.” Connelly also adds a key note: “It is not clear how quickly the legislation changing NCAA rules would take effect.” (link)

News and notes from last month’s DIII Championships Committee Meeting include the group’s support of the legislative proposal to reduce the number of core members for multi-sport conferences to have AQ access from seven to six. The committee also discussed “options to involve ESPN+ with preliminary-round streaming in future years,” and will review DIII championships ticket pricing. (link)

Wisconsin-Whitewater broke the record for DIII attendance for an on-campus game with 21,233 fans at Perkins Stadium as the Warhawks defeated Wisconsin-Oshkosh. (link)

According to a Wall Street Journal analysis of the latest available Education Department data, the number of Northerners going to Southern public schools went up 84% over the past two decades, and jumped 30% from 2018 to 2022. The WSJ’s Douglas Belkin and Andrea Fuller: “Students say they are searching for the fun and school spirit emanating from the South on their social-media feeds. Their parents cite lower tuition and less debt, and warmer weather. College counselors also say many teens are eager to trade the political polarization ripping apart campuses in New England and New York for the sense of community epitomized by the South’s football Saturdays. Promising job prospects after graduation can sweeten the pot. … Though far more students apply to Ivy League schools than in 2002, some of the hottest Southern public schools—including Clemson and Georgia Institute of Technology—have seen even a bigger spike in interest. At Alabama, applications were up more than 600% in the same period—about three times as much as bids to attend Harvard.” Lots more. (link)
