Sportico’s Michael McCann calls the House settlement a “historic win” for the NCAA, but warns of the future: “...even in a best-case scenario for the NCAA, the settlement only settles the three cases. A settlement is not a court ruling that sets precedent. It doesn’t reshape an industry and, in fact, can get rejected for trying to do so. A settlement is a contractual agreement that governs its parties but not those outside the contractual relationship. [...] The settlement also doesn’t foreclose the recognition of college athletes as employees who then might unionize. [...] The settlement also can’t stop an evolving, profit-driven market that caters to NIL and other business objectives and could generate legal controversies.” McCann also notes developments around a super league could bring its own set of additional legal challenges: “...colleges joining hands to alter how they compete and negotiate media rights could bring antitrust challenges. As the NFL has experienced over the last decade in court via the Sunday Ticket litigation, teams joining hands to restrict how they market their broadcasting rights can generate many billable hours.” (link)

More information on Pittsburgh Post-Gazette Christopher Carter's and Stephen Thompson’s article on former AD Heather Lyke's departure from Pitt. Carter and Thompson:: "When the University of Pittsburgh relieved Heather Lyke of her duties as athletic director on Sept. 9, the move surprised many in Pitt’s athletic community and beyond.” Sources told the Post-Gazette that Lyke was prepared to give a presentation about her plan [NIL & the House Settlement] for the department - a plan that [Chancellor Joan] Gabel felt didn’t sufficiently address the financial challenges facing Pitt.” However, sources confirmed, “Gabel never reviewed or met with Lyke about any of the department's financial proposals. There were at least ten variations of strategic plans to address the House settlement and NIL ranging from external resources - including private equity, rolling-up departments to the university, scholarships qualifications, and university funding— to name a few.” Multiple attempts to present tiered strategic plans to the Chancellor's office were rescheduled or canceled. Ultimately, Gabel chose to move in a different direction without Lyke or her executive team having the opportunity to present any options. Further correction by sources disconnected the Victory Heights project to Lyke. The Gazette originally reported “Ms. Lyke signed on to the project in January 2020, a few months before the COVID-19 pandemic hit - and 18 months before the NCAA would begin its NIL era.” Since then, however, sources confirmed to the Gazette that Ms. Lyke never "signed on to Victory Heights. The previous chancellor and Board of Trustees approved the project.” Lyke, still widely respected at Pitt amongst key stakeholders & constituents, garnered praise from Carter & Thompson: "At the moment, the university boasts two No. 1-ranked teams nationally - in women’s volleyball and men’s soccer. Pitt’s football team is 6-0 for the first time since 1982 after defeating the University of California, 17-15, on Saturday. It finished its non-conference schedule undefeated, a first in program history.” Lyke declined to address the matter or article, instead focusing forward as the new Acting President & CEO of the FBS Athletics Directors Association: “It is an honor and a privilege to step into this role and to serve an organization that has meant so much to me and so many other athletic directors.” (link, link)

Sportico’s Daniel Libit provides some more details on New Mexico State’s request for a $137M endowment from the state to help fund its women’s programs. “While the endowment’s principal would remain with the state, NMSU athletics would receive about $5M to $6M in the annual income it produces, according to the proposal. Alternatively, NMSU is asking for a one-time appropriation of $27.5M, to help float its women’s athletics programs for five years.” While New Mexico is one of the poorer states in the country, Libit points out that “oil and gas revenues in the state have more than quadrupled in the five-year span from 2018 to 2023. Typically, New Mexico earns about $4B in direct revenue from energy production, primarily through drilling and property taxes, which funds at least a quarter of the annual state budget. However, in the fiscal year 2023, those revenues exceeded $5B, after a 162% year-over-year increase.” Aggies AD Mario Moccia: “We are sitting on a significant amount of one-time money. So this year, seeing as the state had so much funding, we said, ‘Hey, let’s think outside the box.’ … Nobody has said this is a terrible idea. It has been out in the public, there are articles about it, a lot of our legislators have talked about it. So hopefully you go into the [legislative] session with some momentum.” Libit adds: “In addition to the endowment, NMSU is also pursuing athletic department monies from the bursting pork barrels of individual legislators.” Moccia: “Each state representative or state senator is a potential millionaire donor.” (link)

SBJ’s Ben Portnoy takes a look at the unique relationship between Kansas City Chiefs QB Patrick Mahomes, Adidas and Mahomes’ alma mater, Texas Tech, and observes that it became possible after the Red Raiders and Under Armour opted not to re-up their apparel agreement. Portnoy then notes that while several superstar athletes have their own brands and logos, “Mahomes is in the prime of his career, one of the most recognizable athletes on the planet and, as of this fall, a fixture on the front left breastplate of Texas Tech’s football jerseys.” Red Raiders AD Kirby Hocutt tells Portnoy: “We talked to Under Armour extensively about the future and what a future partnership could look like. But they didn’t have the Patrick Mahomes effect.” Mahomes says of Hocutt: “I believe Kirby’s one of, if not the best ADs in the country. The coolest thing about Kirby is he checks in with me all the time. He always has, even that year I wasn’t playing [as a rookie]. He always has a great vision. … He’s seen this entire university blow up [in scale], he saw the partnership with Adidas and he saw the partnership with me and the Mahomes brand.” Adidas VP of Sports Marketing for North America Chris McGuire says Texas Tech “became a part of the equation in terms of just [Mahomes’] love and his affinity for the university. The contract was not available, but obviously we knew from a timing perspective when we could engage with Texas Tech. Patrick kept us on the mark.” More. (link)

Front Office Sports’ Daniel Roberts participated in a panel dedicated to NIL at Advertising Week New York last week with Duke Men’s Basketball GM Rachel Baker, Wisconsin NIL Director Brian Mason, Under Armour Head of Collegiate Partnerships Catherine Marquette, head of collegiate partnerships at Under Armour and Hampton men’s hoops alum/Hampton Collective Founder Jeff Granger. During the discussion, Baker remarked: “When you’re making these promises to these athletes and families, the collective has to be in a lot of ways a reflection of what you’re telling them on a day-to-day basis. It, quite literally based on the contract, couldn’t happen at Duke.” Roberts: “My translation: We’re more careful; we draw up a contract; and no one should be making a college commitment decision based on a verbal agreement.” Granger noted that “Duke is gonna be Duke, Wisconsin’s gonna be Wisconsin, and the ads and TV revenue, all that’s gonna flow in. It looks different for us. … We can’t play in the portal the same way, because we don’t have the same pocket. … Now we’re recruiting a high school kid that comes and develops for freshman, sophomore year, and he transfers after the second year because we can’t afford him.” Roberts subsequently observes that “both the NIL director and GM jobs in a college sports setting are newer roles that are fast-multiplying across collegiate athletic departments. … It is clear to me that no one, including the people in those jobs, is exactly sure of what they are meant to be. The descriptions are different school by school, and everyone is feeling their way as they go. The same goes for the booster-led NIL collectives.” (link)

Puck’s John Ourand sits down with CAA Sports Co-Head Matt Kramer to discuss Adrian Wojnarowski’s decision to leave ESPN and return to St. Bonaventure to serve as GM. Kramer, who was Woj’s agent, explains that Woj only wanted to stay at ESPN if he felt like he could continue in the job giving it everything he had and compares it to the choice professional athletes make at the end of their careers. “A colleague of mine said it best. He said I can't imagine a world where LeBron James wakes up and says, ‘I want to keep playing for the Lakers only to average eight points a game.’ My assumption is LeBron wants to play for the Lakers an average 30 points a game by the same. … I think what [Woj] determined, which I completely respect and understand, is he only wanted to do it giving it 100% every single day, and he had an opportunity in his mind to leave on his terms, which, as we know, very, very few people ever get to do.” Kramer also talks about the market for on-air talent and compares it to the market for media rights – namely, companies are willing to spend top-dollar for premium talent in sports for which they pay top-dollar to broadcast. “And just like in the sports media rights ecosystem, there are challenges in the middle class, which is trying to figure out how you value personalities who aren't attached to premium sports rights and whatnot. And then you're seeing a real interest in this next generation and next wave of sports media talent, which we're really focused on at CAA Sports, and I know the sports media properties are also focused on in the same way, which is not just what’s the next iteration of interesting sports rights for them to have, but the next iteration of sports media talent and what is the definition of a sports media broadcaster now.” Full podcast. While Nike is in “reset mode,” Financial Times’ Sara Germano observes the rest of the athletic shoe industry is thriving and reports: “Global retail sales of sports footwear totalled $165B in 2023, up 23% from 2018, according to Euromonitor. Growth occurred in every geographic region, led by Latin America, up 38%, while Asia Pacific and North America remained the top two largest markets. In the US, where 99% of footwear is imported, sneakers are on the rise. Imports of athletic shoes are up more than 10% year over year through August…compared to a rise of just 1% for all footwear.” Germano goes on to point out that the proportion of Foot Locker’s Nike and Jordan Brand inventory peaked at 75% in 2020 before falling to 65% last year. Foot Locker CEO Mary Dillon says Nike will “always” be an important partner, but emphasized the retailer’s expanded offering of other brands, including Hoka, New Balance and On. “Customers are voting. People want choice in this category. It’s very clear. They’re buying multiple brands and…using them for lots of different occasions.” (link)

Brown AD Grace Calhoun and Cornell AD Nicki Moore join Sasaki Architect/Senior Associate Emily Parris and D1.ticker’s Kristen Eargle to dive into two facility projects: Brown’s Indoor Turf Facility and Cornell’s Meinig Field House and multipurpose Field and New Field Hockey Venue. They discuss the planning, funding and design phases from the standpoints of the athletic department and architecture firm as well as the importance of maintaining a strong relationship with architects as changes throughout the process invariably arise. Calhoun calls that relationship “critically important, not only to really understand the vision, but in our case we had a former chancellor of the university who really challenged us to create a facility that brought the right spirit and joy to the experience. So…seven of us were sent over to Milan to look at buildings that were particularly joyous and spirited, but it was clear very quickly that the more we really spent time together, we had strong relationships and really understood that alignment and had it in all directions that was going to deliver the best possible project and and product for us.” Moore adds that the university and the architect are “in the trenches” during this process and “need to become colleagues. You don’t know the challenges you’re going to encounter along the way, but you’re going to have challenges. … We shifted a bunch of times with ours and it's been so fortunate to have that relationship with Sasaki where it doesn't feel like we are a burden with these things. … I think especially when we're working with athletics people that tend to be goal-directed and motivated and high-energy it's important to have partners as architects that are willing and able to match that kind of energy and approach.” Full conversation. The Pittsburgh Post-Gazette’s Christopher Carter & Stephen Thompson write on the leadership transition at Pittsburgh, dig in on fundraising & NIL dollars as key areas of focus. Notably: “Once the new chancellor began poring over Victory Heights’ financial details, sources said, she had questions about the reasoning for taking on major facility upgrades without pre-raised funding. Some athletic department staffers had similar concerns. [...] Only about 5% of the cost of Victory Heights was on hand as construction continued there. [...] One such (NIL) idea involves Collegiate Athletic Solutions, an Atlanta-based private equity firm that offers low-interest loans to universities and NIL collectives. Sources close to Alliance 412 said partnering with CAS was being eyed as a possible solution to Pitt’s need for additional money. Under that strategy, CAS would provide the athletics department a one-time loan of up to $200 million that could be used at the university’s discretion to budget for talent acquisition in the revenue sports of football and men’s basketball. CAS would be repaid with money Pitt receives each year from the ACC Network — with an interest rate that wouldn’t overtax the future of the university’s athletics, sources said. The Associated Press reported earlier this year that the ACC distributed an average of $44.8 million to its football-playing members for the 2022-2023 season.” (link)

Meanwhile, Pittsburgh continues to excel on fields & courts of competition this Fall as Volleyball & Men’s Soccer top the national rankings & Football moved to 6-0 with a win over Cal yesterday. Interim AD Jennifer Tuscano: “The success, the recognition and the rankings are a good thing because we have really good teams. They deserve it. There's no question that Randy [Waldrum], Jay [Vidovich], Pat [Narduzzi] and Dan [Fisher] would say that they prefer to be No. 1 closer to postseason or at the end of the year. When you see how hard they are working in practice, watching film, preparing for opponents, it's really not a surprise that our success is coming when you see the work that they're putting into it.” Men’s Soccer HC Jay Vidovich: “Within the department is just that belief that we can win. It’s more than us. Football is undefeated. Volleyball is on another level. The women's soccer, what they did this last weekend against Clemson and out at Stanford getting the tie. Everybody is just rolling, and that just keeps breeding belief in the department.” (link)

UCLA AD Martin Jarmond catches up with the Minnesota Star Tribune’s Chip Scoggins as Minnesota visited Los Angeles for a Football kick last night. Jarmond on the myriad of moving parts across the industry: “You do have to modernize; you can’t romanticize, because college athletics are not the same. It’s not the same as it was even three years ago. [...] You’re worried about everything. [...] You have to be dynamic and adaptable or else you’re going to fall behind significantly. If you’re too tied to the past from a standpoint of where things are going, you’re not going to be as competitive as you need to be. And your brand is not going to be what it should be, quite honestly. You’ve got to change with the times.” (link)

Stanford Deputy AD/COO Alden Mitchell talked about the impact of the House settlement late last week: “As an institution, I can tell you we are treating this with the utmost urgency and a substantial level of serious analysis. We have been in very consistent contact with University leadership to begin developing an approach to these issues.” Cardinal AD Bernard Muir: “Whatever decisions we make, we have to do it in a way that’s authentic to Stanford.” (link)

“The Boys from Oklahoma” concert at Oklahoma State to support NIL has grown from one day to four as Pokes AD Chad Weiberg notes: “We had no idea that it would turn into four shows, which is great, because whatever we were hoping for, it quadrupled now. And that was accounts. That was not the number of tickets people were interested in; that was just the number of people (who registered for the presale). [...] All of what comes to us will go to NIL. But it’s not all going to us. In these things, the vast majority of it goes to the artists because that’s how they make their money… . But yes, all of the proceeds that are ours will go to NIL. We’ve got ticket sales, but concessions and parking and all those things that happen at the actual show is going to factor into it. So, we won’t know (what we expect to make) for sure until April after the shows. [...] I think one of the best things about the shows is now we have proof of concept. I think now we are going to be on the radar for a lot of those kinds of things in the future.” (link)

Rochester Institute of Technology (DIII) AD Jacqueline Nicholson and Coastal Carolina Assoc. AD for Student-Athlete Academic Services Alise Svihla sit down with AthleticDirectorU’s Tai M. Brown to reflect on their decades-long relationship and the role genuine connections play in advancing in college athletics. Svihla and Nicholson, who met as undergraduates, share insight into evaluating opportunities and making career changes, discuss burnout and offer advice for administrators looking to advance into a leadership role via the Academic Services unit. Svihla acknowledges she reached the point of burnout while at South Carolina and took a career development post on campus before accepting a job to return to her alma mater, Virginia Tech, “and then I wanted to be a director. I kind of felt like I had outgrown my role working with the day-to-day study halls, so I was excited to move into that next role to be a director, but I was really strategic about where I wanted to be a director.” Nicholson on managing people: “I think it’s based on relationships. Once people know me, know what makes me tick, know what makes me happy, and when I know the same things about them, we can get along we can coexist at a high level and I can let you kind of run with what you're doing and not have these crazy expectations. I tell my staff here if…they do their jobs, I'm going to be a happy person. If I ask your why and you don't have a why, we'll have a problem. But all my staff can tell you their why and why they make decisions.” (link)

Extra Points publisher Matt Brown talks with Advertising Week CEO Lance Pillersdorf about the brand side of NIL agreements, and while Pillersdorf is bullish on NIL-centered activity, he acknowledges the market is still maturing. He tells Brown the largest national brands are still in more of an “exploratory mode” when it comes to college athlete NIL deals. Brown: “That doesn’t mean that the largest brands aren’t interested in signing athletes to help promote products (i.e. Dr. Pepper and Fansville, EA Sports and EA CFB25, Nike and Shedeur Sanders, etc.), only that they’re a bit slower and more cautious than perhaps some athletes (and agents) would like. … While there’s more room for growth for the biggest-name athletes with massive national brands, particularly if those companies are trying to ‘localize part of their campaigns, Pillersdorf told me he sees more growth opportunities in ‘more regional, or even local, brand opportunities.’ Specifically, he highlighted entities like ‘regional health care networks, regional fast food and dining, and local service-based businesses as prime candidates to increase their future marketing spends.’” To do so, Pillersdorf explains many student-athletes need to get better at content creation. Brown: “That doesn’t just mean sharing engaging photos or memes…but also being punctual and professional around marketing campaign deliverables, making sure that lighting and marketing copy are high quality, and everything else that a professional influencer or, (ugh, I hate this term), creator, might do with a brand partner.” Education is also needed on the brand side, as Pillersdorf explains “the vocabulary needed to price out and evaluate a college athlete NIL deal could be completely foreign to them…and without that knowledge, those companies might never seek out a college athlete to begin with.” More. On Friday, Yale held the official ribbon-cutting and re-opening of the $38M, newly renovated Lapham Field House at the Smilow Field Center at the Carm Cozza Complex. Home to the Football and Men’s and Women’s Track & Field and Cross Country programs, the fresh digs feature a designated locker room for each team, a 110-person meeting space with a retractable wall, stadium seating and upgraded AV equipment, as well as positional meeting rooms, nutrition stations and a creative studio, plus space for athletic medicine and equipment services. As part of the capital project, the Yale Bowl complex was also dedicated in memory of Carm Cozza, who served as Yale Football's head coach from 1965 to 1996. (link)

Austin Peay AD Gerald Harrison announces that construction will begin immediately on the 2,500-square-foot Karen Edwards Indoor Golf Facility, located on the third floor of the Winfield Dunn Center. The new space will be turfed and equipped with golf simulators, Trackman systems, putting greens, a chipping area, and a lounge area, plus graphics and design. The late Karen Edwards, a 1978 graduate of APSU, was “deeply involved in women’s and youth golf in the local community.” (link)

While sports fans are willing to pay extra for “must-see events,” JohnWallStreet observes the problem for many sports properties is that those events are too few and far between. “It’s simply too easy to catch the next one, and the overall experience often isn’t great regardless of where one sits (think: traffic, lines). Rights owners can’t solve for every pain point that fans encounter on their way to the stadium, during their time there, and on the return trip home. But an increasing number are coming to realize that they are allowing others to dictate the fan’s experience with their product by failing to take ownership of as much of the outing as possible.” JWS notes that Elevate acquired Zinc Agency and subsequently introduced Elevate Experiences to help sports properties alleviate concerns about the “experiential and revenue leakage that exists” by offering a “menu of premium experiential add-ons that fans and corporate clientele can bolt onto ticket packages,” and Elevate President of Property Sales Flavil Hampsten explains: “Premium is not just sitting on or next to the court anymore. Premium is now sometimes a premium seat with a VIP entrance and a one-of-a-kind merchandise item.” It is “important to understand that premium experiences are not just for wealthy fans anymore,” JWS notes, and points to a recent Elevate study that “indicated that 30% of one University’s premium ticket base earns less than $100,000/year. … In fact, entry level premium is an underserved market and represents an opportunity for properties across sports. HENRYs –High Earners who are Not Rich Yet– value smaller suites and loge products. … As they begin earning more money, the club can move them up the ladder into more even premium offerings.” More from JWS. Business Insider’s Peter Kafka joins Puck’s John Ourand on The Varsity podcast to discuss the direction of the sports media landscape, including how streamers will view sports packages five years from now. Kafka says it “seems inevitable that given the amount of money available to the big tech streamers and the lack of money that's going to be available to terrestrial that some of these major sports will be essentially fully digital by that 2030 zone. But I have found this stuff always takes longer to materialize, and if you would’ve asked me 10 years ago, I would’ve said by 2024 one of these giant tech companies would back up the truck and they would make the economics so persuasive that whether it’s the NFL or the NBA, one of the major leagues would be willing to forgo terrestrial distribution for at least a big chunk of what we're doing and we're going to take the money and lock it in. And I know the reasons that hasn't happened, but it's still surprising to me that hasn't happened yet, which is why I'm hedging my bets about something in 2030 even though no one's going to come back and hold my feet to the fire.” Kafka observes that once Netflix became interested in the advertising business, the calculus began to change. “It seems like all the streamers now have accepted that advertising is going to remain part of their business and now it makes a lot more sense. … I think sports and news and anything else that generates live inventory for them is of some value.” Kafka and Ourand go on to break down likely strategies for each major streaming service moving forward and Kafka notes of Netflix that without the ability to acquire ownership in a season for a given sport, the company will continue to sign “event-style programming” deals.
