AAC Commissioner Tim Pernetti in remarks during Men’s Basketball Media Day: “We’re in a very challenging time period that won’t end anytime soon. And the reason is there’s been a failure to modernize the industry over time. But real leadership shows itself at times like this. Real leadership is when it’s hard.” Pernetti also touched on go-forward strategy for the league: "Internally - investment in athletics. Investment to me is table stakes. It has to continue year-over-year. [...] The second thing is reward. I think some institutions have invested…and are competing at a high level. And we’re talking about the future, performance-based revenue and trying to provide incentive to our members. [...] There are no participation trophies in this league. This is a group that is really out to earn it. And when they earn it, they should be rewarded for earning it. Externally it’s different. [...] Why do private capital groups want to play in college sports? Why are groups out there who want to create a new postseason in football? This thing has such power, and such a high affinity. That’s why private capital opportunities are there. That’s why brands are interested in our conference naming rights. That’s why we’re talking about conference-wide jersey patches. Our job is to create more resources so our institutions can continue to invest in young people. It’s exciting because there’s never been a time like this in 30 years.” On the latest iteration of conference realignment: “It’s maybe the first time in expansion history that someone has turned down the opportunity to do something different. We had all four members in the room multiple times talking about this. Our job to provide facts and actual outcomes – not deal with could be the projected outcomes. I think we did our job. I admire the institutions because do you know how hard it is to take emotion (out of) this?” Also, on potential new models for the industry: “I’ve seen them. I was a part of some of that discussion even before I became commissioner of the conference. If you see the narrative out there, there’s resistance. Why? Because it’s different. Maybe it’s not what happens, but it’s time to talk about change. Your job as commissioner is to listen to everyone, to learn as much as you possibly can, not to turn your head at something different because it potentially could be the future. But why is this happening? Collegiate athletics is an absolute powerhouse. While it has its challenges as every industry has, I do think that from being in the room with other commissioners, I do think there are people in the room that are one thousand percent committed to providing a great experience for young people. While some of these models have work to do as it relates to Title IX, to antitrust, they’re worth exploring. That doesn’t mean it will happen, but everything new is worth exploring because it will open our eyes to what’s possible.” Lots more. (link)

ULM AD John Hartwell is proposing a $10/per credit hour student fee that would support the construction of a new football practice facility. At a recent SGA meeting, Hartwell explained that it would be used “for football primarily, but every one of our student-athletes would use it, and we’d have the opportunity for students across campus and other campus groups to use it, too.” The funds would also be used to purchase a four-sided center-hung scoreboard for Fant-Ewing Coliseum and video boards for baseball and volleyball. Hartwell also told the SGA: “I don’t take lightly at all that this is something we’re asking the students to do that will increase the cost of their attendance. But I think you could also make the argument that a successful athletics program is a significant part of student life in general and your experience as a college student.” Overall, the fees could cost students an additional $120 to $180 per semester. The New York Times’ Joe Drape profiles how Missouri is taking advantage of a state law that has allowed the Tigers to create and fund a marketing agency, Every True Tiger, which distributes money to student-athletes. “The Mizzou Model, as it is known, has paid immediate dividends. … Flush with cash, Missouri was able to [retain] receiver Luther Burden III, a likely top-10 pick in next year’s NFL Draft; attract blue-chip players in the transfer portal; and sign and pay Williams Nwaneri, one of the best defensive prospects in the nation, while he was still in high school in Lee’s Summit, Mo.” Tigers Football HC Eli Drinkwitz: “I would just say that we embraced the new realities of college football and understood that it could be a competitive advantage for us to be aggressive in that space.” Drape subsequently observes that “in the Mizzou Model, Drinkwitz is the clear chief executive of Tiger Football Inc. He has a budget and knows the going rate for each position in the SEC: $1M for a quarterback and $710K for a receiver. With the help of his staff, he identifies who might fill those spots. By law, he is able to make a financial offer, and with the transient nature of members of a coaching staff, it behooves Drinkwitz to keep those exact numbers close to the vest so they don’t end up in the hands of a rival and eliminate Missouri’s leverage. The state law, along with the Every True Tiger agency, ensures that Drinkwitz will follow up on his promises.” Drinkwitz admits that “this absolutely changes the player-coach relationship because there is a business negotiation that has to occur in order for a deal or a commitment to happen,” Drinkwitz said. “A negotiation is going to affect the personal relationship that you have. But I think that families and players are smart enough to realize that there is still a developmental piece and still a relationship piece.” More. (link)

The Nevada women’s volleyball team will forfeit its match against San Jose State, which is scheduled for October 26. Earlier this month, UNR said it would play the match, but according to a report from OutKick, the decision to forfeit was made by the players, who wrote in a statement to the website: “We, the University of Nevada Reno women’s volleyball team, forfeit against San Jose State University and stand united in solidarity with the volleyball teams of Southern Utah University, Boise State University, the University of Wyoming and Utah State University. We demand that our right to safety and fair competition on the court be upheld. We refuse to participate in any match that advances injustice against female athletes.” Team co-captain Sia Liilii: “The school released that statement [committing to play] without consulting our team at all. We were pretty upset that we were not made aware that a statement was going to come out. We were actually in Las Vegas preparing for our match against UNLV, our in-state rival. It was a really frustrating time, especially because we were about to go and play a big game.” (link)

SBJ’s Ethan Joyce profiles WMT Digital’s growth within college sports and beyond, noting that in “college athletics in particular, WMT had built a clientele list of approximately 100 brands including Notre Dame, Clemson and LSU. WMT has morphed into a fully-fledged tech provider and platform builder. The company has created websites, team apps and OTT viewing services. It also offers support on a multitude of business factors such as fan engagement, SEO marketing and e-commerce.” Founder/CEO Andres Focil tells Joyce WMT grew based off its latest client and whatever unique need it requested. “Bespoke solutions then have become components of services that clients can now pick from.” Focil: “College sports, professional sports, just from somebody that was coming from the outside of that, it was very challenging. And it was one that we had to really navigate through the proof of our platforms and the success of our partnerships. I think that was a very important factor.” Joyce notes there were three projects in particular – at Miami (FL), Clemson and Arkansas, respectively – that served as “tentpoles” of WMT’s growth in college athletics. “The Clemson relationship (which still exists today, just as it does at Miami and Arkansas) evolved like many of other WMT connections — one service turned into multiple. And the problem-solving approach has now yielded a library of different products that partners can mix and match.” Focil: “If you stay in the ethos of ‘Here’s how we drive value,’ the rest is a technical problem. Now looking at what we’ve built to date…it makes us really lean from that perspective.” Lots more. (link)

+ ESPN’s Pete Thamel observes a “notable coaching carousel trend. It’s Oct. 14 and there’s been no in-season firings so far in college football. Compare this to 2022, when there were five power conference openings on Oct. 2. The reasons are parallel to all the changes in college football. The transfer rules, immediate portal opening, NIL and fear of a gutted roster have made athletic directors more deliberate with obvious firing decisions. Fire too early, and risk a swath of players redshirting. There’s also APR concerns with an early move.” (link)

While renovations continue at Florida State’s Doak Campbell Stadium throughout the season, FSU tapped InProduction, the company that built Northwestern’s temporary stadium, to “put 7,300 temporary seats into the lower portion of FSU's half-built west side,” according to SBJ’s Bret McCormick, who notes that has enabled FSU to continue hosting fans during home games, albeit with a capacity 24K below normal. McCormick also points out the visual effect of the temporary seating “against the precast above is seamless,” and Seminoles Senior Assoc. AD for Capital Projects and Facilities Ben Zierden says: “The fact that these types of products are out there really allowed us to be aggressive with our stadium renovation on the west side. We knew that once [the west side] was dropped, we weren’t going to be able to build it back in one offseason.” While the west side of the stadium has been the focal point of renovations, FSU felt the east side fan experience “needed some attention, too. They screwed more than 14,000 cushioned 4Topps seat pans – the bottoms of seats only – into the bleacher seating on the east side this offseason, improving that fan experience dramatically just by raising fans’ butts off the metal bleachers a bit. The FSU installation is the largest yet for 4Topps (and will be followed by more next year).” Zierden points out the installation “wasn’t a construction project to put those in. Didn't need a subcontractor or construction manager to manage it and it still enhanced the fan experience on the east side.” (link)

Sportico’s Michael McCann calls the House settlement a “historic win” for the NCAA, but warns of the future: “...even in a best-case scenario for the NCAA, the settlement only settles the three cases. A settlement is not a court ruling that sets precedent. It doesn’t reshape an industry and, in fact, can get rejected for trying to do so. A settlement is a contractual agreement that governs its parties but not those outside the contractual relationship. [...] The settlement also doesn’t foreclose the recognition of college athletes as employees who then might unionize. [...] The settlement also can’t stop an evolving, profit-driven market that caters to NIL and other business objectives and could generate legal controversies.” McCann also notes developments around a super league could bring its own set of additional legal challenges: “...colleges joining hands to alter how they compete and negotiate media rights could bring antitrust challenges. As the NFL has experienced over the last decade in court via the Sunday Ticket litigation, teams joining hands to restrict how they market their broadcasting rights can generate many billable hours.” (link)

More information on Pittsburgh Post-Gazette Christopher Carter's and Stephen Thompson’s article on former AD Heather Lyke's departure from Pitt. Carter and Thompson:: "When the University of Pittsburgh relieved Heather Lyke of her duties as athletic director on Sept. 9, the move surprised many in Pitt’s athletic community and beyond.” Sources told the Post-Gazette that Lyke was prepared to give a presentation about her plan [NIL & the House Settlement] for the department - a plan that [Chancellor Joan] Gabel felt didn’t sufficiently address the financial challenges facing Pitt.” However, sources confirmed, “Gabel never reviewed or met with Lyke about any of the department's financial proposals. There were at least ten variations of strategic plans to address the House settlement and NIL ranging from external resources - including private equity, rolling-up departments to the university, scholarships qualifications, and university funding— to name a few.” Multiple attempts to present tiered strategic plans to the Chancellor's office were rescheduled or canceled. Ultimately, Gabel chose to move in a different direction without Lyke or her executive team having the opportunity to present any options. Further correction by sources disconnected the Victory Heights project to Lyke. The Gazette originally reported “Ms. Lyke signed on to the project in January 2020, a few months before the COVID-19 pandemic hit - and 18 months before the NCAA would begin its NIL era.” Since then, however, sources confirmed to the Gazette that Ms. Lyke never "signed on to Victory Heights. The previous chancellor and Board of Trustees approved the project.” Lyke, still widely respected at Pitt amongst key stakeholders & constituents, garnered praise from Carter & Thompson: "At the moment, the university boasts two No. 1-ranked teams nationally - in women’s volleyball and men’s soccer. Pitt’s football team is 6-0 for the first time since 1982 after defeating the University of California, 17-15, on Saturday. It finished its non-conference schedule undefeated, a first in program history.” Lyke declined to address the matter or article, instead focusing forward as the new Acting President & CEO of the FBS Athletics Directors Association: “It is an honor and a privilege to step into this role and to serve an organization that has meant so much to me and so many other athletic directors.” (link, link)

Sportico’s Daniel Libit provides some more details on New Mexico State’s request for a $137M endowment from the state to help fund its women’s programs. “While the endowment’s principal would remain with the state, NMSU athletics would receive about $5M to $6M in the annual income it produces, according to the proposal. Alternatively, NMSU is asking for a one-time appropriation of $27.5M, to help float its women’s athletics programs for five years.” While New Mexico is one of the poorer states in the country, Libit points out that “oil and gas revenues in the state have more than quadrupled in the five-year span from 2018 to 2023. Typically, New Mexico earns about $4B in direct revenue from energy production, primarily through drilling and property taxes, which funds at least a quarter of the annual state budget. However, in the fiscal year 2023, those revenues exceeded $5B, after a 162% year-over-year increase.” Aggies AD Mario Moccia: “We are sitting on a significant amount of one-time money. So this year, seeing as the state had so much funding, we said, ‘Hey, let’s think outside the box.’ … Nobody has said this is a terrible idea. It has been out in the public, there are articles about it, a lot of our legislators have talked about it. So hopefully you go into the [legislative] session with some momentum.” Libit adds: “In addition to the endowment, NMSU is also pursuing athletic department monies from the bursting pork barrels of individual legislators.” Moccia: “Each state representative or state senator is a potential millionaire donor.” (link)

SBJ’s Ben Portnoy takes a look at the unique relationship between Kansas City Chiefs QB Patrick Mahomes, Adidas and Mahomes’ alma mater, Texas Tech, and observes that it became possible after the Red Raiders and Under Armour opted not to re-up their apparel agreement. Portnoy then notes that while several superstar athletes have their own brands and logos, “Mahomes is in the prime of his career, one of the most recognizable athletes on the planet and, as of this fall, a fixture on the front left breastplate of Texas Tech’s football jerseys.” Red Raiders AD Kirby Hocutt tells Portnoy: “We talked to Under Armour extensively about the future and what a future partnership could look like. But they didn’t have the Patrick Mahomes effect.” Mahomes says of Hocutt: “I believe Kirby’s one of, if not the best ADs in the country. The coolest thing about Kirby is he checks in with me all the time. He always has, even that year I wasn’t playing [as a rookie]. He always has a great vision. … He’s seen this entire university blow up [in scale], he saw the partnership with Adidas and he saw the partnership with me and the Mahomes brand.” Adidas VP of Sports Marketing for North America Chris McGuire says Texas Tech “became a part of the equation in terms of just [Mahomes’] love and his affinity for the university. The contract was not available, but obviously we knew from a timing perspective when we could engage with Texas Tech. Patrick kept us on the mark.” More. (link)

Front Office Sports’ Daniel Roberts participated in a panel dedicated to NIL at Advertising Week New York last week with Duke Men’s Basketball GM Rachel Baker, Wisconsin NIL Director Brian Mason, Under Armour Head of Collegiate Partnerships Catherine Marquette, head of collegiate partnerships at Under Armour and Hampton men’s hoops alum/Hampton Collective Founder Jeff Granger. During the discussion, Baker remarked: “When you’re making these promises to these athletes and families, the collective has to be in a lot of ways a reflection of what you’re telling them on a day-to-day basis. It, quite literally based on the contract, couldn’t happen at Duke.” Roberts: “My translation: We’re more careful; we draw up a contract; and no one should be making a college commitment decision based on a verbal agreement.” Granger noted that “Duke is gonna be Duke, Wisconsin’s gonna be Wisconsin, and the ads and TV revenue, all that’s gonna flow in. It looks different for us. … We can’t play in the portal the same way, because we don’t have the same pocket. … Now we’re recruiting a high school kid that comes and develops for freshman, sophomore year, and he transfers after the second year because we can’t afford him.” Roberts subsequently observes that “both the NIL director and GM jobs in a college sports setting are newer roles that are fast-multiplying across collegiate athletic departments. … It is clear to me that no one, including the people in those jobs, is exactly sure of what they are meant to be. The descriptions are different school by school, and everyone is feeling their way as they go. The same goes for the booster-led NIL collectives.” (link)

Puck’s John Ourand sits down with CAA Sports Co-Head Matt Kramer to discuss Adrian Wojnarowski’s decision to leave ESPN and return to St. Bonaventure to serve as GM. Kramer, who was Woj’s agent, explains that Woj only wanted to stay at ESPN if he felt like he could continue in the job giving it everything he had and compares it to the choice professional athletes make at the end of their careers. “A colleague of mine said it best. He said I can't imagine a world where LeBron James wakes up and says, ‘I want to keep playing for the Lakers only to average eight points a game.’ My assumption is LeBron wants to play for the Lakers an average 30 points a game by the same. … I think what [Woj] determined, which I completely respect and understand, is he only wanted to do it giving it 100% every single day, and he had an opportunity in his mind to leave on his terms, which, as we know, very, very few people ever get to do.” Kramer also talks about the market for on-air talent and compares it to the market for media rights – namely, companies are willing to spend top-dollar for premium talent in sports for which they pay top-dollar to broadcast. “And just like in the sports media rights ecosystem, there are challenges in the middle class, which is trying to figure out how you value personalities who aren't attached to premium sports rights and whatnot. And then you're seeing a real interest in this next generation and next wave of sports media talent, which we're really focused on at CAA Sports, and I know the sports media properties are also focused on in the same way, which is not just what’s the next iteration of interesting sports rights for them to have, but the next iteration of sports media talent and what is the definition of a sports media broadcaster now.” Full podcast. While Nike is in “reset mode,” Financial Times’ Sara Germano observes the rest of the athletic shoe industry is thriving and reports: “Global retail sales of sports footwear totalled $165B in 2023, up 23% from 2018, according to Euromonitor. Growth occurred in every geographic region, led by Latin America, up 38%, while Asia Pacific and North America remained the top two largest markets. In the US, where 99% of footwear is imported, sneakers are on the rise. Imports of athletic shoes are up more than 10% year over year through August…compared to a rise of just 1% for all footwear.” Germano goes on to point out that the proportion of Foot Locker’s Nike and Jordan Brand inventory peaked at 75% in 2020 before falling to 65% last year. Foot Locker CEO Mary Dillon says Nike will “always” be an important partner, but emphasized the retailer’s expanded offering of other brands, including Hoka, New Balance and On. “Customers are voting. People want choice in this category. It’s very clear. They’re buying multiple brands and…using them for lots of different occasions.” (link)
