House plaintiffs’ attorney Steve Berman remarked during a Temple Law School seminar that while he expects there will be an appeal of the settlement, the NCAA has agreed to move forward with revenue sharing in 2025-26 regardless. According to Berman, the NCAA has said: “We can't leave this thing hanging in limbo,” so it will move forward even with risk of settlement being overturned on appeal. (link); Kennyhertz Perry attorney Mit Winter: “Another reason that schools should begin implementing processes and procedures for paying/funding payments for athletes now. Doesn’t mean you have to start paying now, but waiting for final approval of House settlement in April to begin implementation of plans is too late.” (link)

The state of South Dakota Board of Regents hopes to keep the lawsuit it filed against the NCAA on behalf of South Dakota State University and the University of South Dakota in state court. Attorney General Marty Jackley: “For a case to be moved to federal court, the federal court must either have original jurisdiction or involve significant federal issues, and the NCAA fails to satisfy either requirement. We believe this case should remain in state court, regardless [of whether] the NCAA settlement is unfair to smaller universities and female athletes.” (link)

TurnkeyZRG CEO Len Perna explains to The Athletic’s Justin Williams why College Sports Tomorrow is involved in floating its super league idea: “Can’t the Big Ten do this? Can’t the SEC do this? The reality is, when you are focused on competitive balance, it’s hard to have one of the players in the ecosystem be responsible for it. So we don’t think it’s likely that the SEC or the Big Ten are going to drive the kind of increased competitive balance we believe is necessary to drive value and then support the costs in the system, reward the players, support the Olympic sports and all the rest of the stuff we want to do. … Every time you exclude one of those 136 schools, you create a political opponent. If you exclude 100 schools, you create such opposition politically that it becomes unrealistic to think anything can get done.” (link)

NJ Advance Media’s Steve Politi and Brian Fonseca chronicle the events leading to former Rutgers AD Pat Hobbs’ departure and report that Hobbs went to university leaders in June seeking a raise. “His pitch was simple. He was the man who hired a pair of coaches, Greg Schiano and Steve Pikiell, who had turned basement-dwelling programs into contenders. He also was the most tenured AD in the Big Ten with almost nine years on the job, bringing stability to a department that had descended into chaos before his surprising hire in November 2015. … The response from Mark Angelson, then the powerful vice chairman of the Rutgers Board of Governors, stunned Hobbs. Not only was the answer a hard no on the changes to his contract, but according to two people briefed on the meeting, Angelson told him that the university had launched an investigation into an improper, consensual relationship between him and a coach in his department.” Two months later, Hobbs received a notice that he was to turn over all electronic devices used for university business for forensic imaging at an August 16 meeting. That meeting never took place, as “Hobbs abruptly resigned that morning.” With reports later surfacing that relationship under review appeared to be with Gymnastics HC Umme Salim-Beasley, Politi and Fonseca report that during a social event at Rodkin Academic Success Center one of the highlights was a tarot card reading. “According to two gymnasts in attendance, the reader overturned a card and asked Hobbs to define the most important thing in life. He looked at Salim-Beasley before answering with a single word: ‘Love.’” One of the gymnasts says: “It was so weird. It’s really hard to put into words, but they were staring each other in the eye, sitting right next to each other. You could feel some type of tension between them. All my teammates looked at each other with the weirdest look like, ‘What is going on here?’” Lots more. (link)

Texas Tech budgeted $14.71M of institutional operating and debt support for the athletic department for the fiscal year that started September 1, and President Lawrence Schovanec, in reference to the revenue-sharing component of the House settlement, remarked last week: “I think if any unit on this campus was facing a 20-something-percent cut in their revenue, we would have to look at how we might respond, and we will in this case, especially when you consider the market value of athletics. It does play a role in our branding, our recruitment, and we can cite that with all kinds of data.” Schovanec says he thinks institutional support was higher than $5.7M in fiscal year 2024, which Tech athletics will report to the NCAA this winter. “We didn't go from $5.7M to $14.7M in one year. It's more than when I became president. At the same time, there's some numbers in there (this year) that I think could give a misleading impression of the nature of the support. There's some debt service on facilities, and I'm not just talking about the new (Jones AT&T Stadium) south end zone. Also, if you do a comparison to other institutions in this changing environment, you'll see that institutional support ... We're in the bottom end of that scale." Meanwhile, the Lubbock Avalanche-Journal’s Don Williams reports that despite there being no public announcement, the school began a university-wide capital campaign four years ago that Schovanec said has already raised $700M. Athletics is one of four components of the campaign. Schovanec: "When I say we haven't definitively decided what our contribution’s going to be in the future, it's because the campaign would bear upon that. If we get endowments for student scholarships and supports, that would offset maybe what we have to do (in institutional support to athletics).” More. (link)

St. Thomas has received a $20M gift from the family of alumnus Joe Ryan, along with alum Pat and Ann Ryan, to support construction of the Lee and Penny Anderson Arena. In recognition of their generosity, the plaza directly in front of and to the east of the arena will be named the Ryan Family Plaza. Tommies AD Phil Esten: "This is an extraordinary gift, and we are deeply thankful for the Ryan family's commitment to this project. The Ryan family has shared our vision for this project since it launched, and I'm extremely grateful for their support and shared vision in making the Lee and Penny Anderson Arena a reality for our entire campus community.” (link)

Boise State and Learfield have agreed to an 11-year extension of their multimedia rights agreement through 2038-39. Broncos AD Jeramiah Dickey: “This new deal allows us to continue to improve and enhance the experiences of so many while also dedicating resources strategically to elevate the brand of Boise State even more on a local and national level. It truly takes a TEAM, and we are grateful that Learfield is alongside us in this team effort.” (link); Boise State has also received a $1M pledge from Dennis M. and Matthew J. Charlotte has inked a new multiyear partnership agreement with Legends focused on enhancing the fan experience at Jerry Richardson Stadium. Legends will “lead sales strategy, execution, and marketing to maximize Charlotte revenue generation through a data-driven sales approach for premium and general seating associated with the Stadium renovation,” which will begin in 2025. + Sportico’s Daniel Libit profiles AAU coach Ryan Silver, founder of West Coast Elite Under Armour and Silver Waves Media, who sold a club promotion business to begin learning the AAU ropes with “Pump-N-Run, the elite grassroots hoops program run by the basketball influence-peddling brothers, David and Dana Pump.” Silver, whose career also included a stint at CAA where he was an assistant to Co-Founder Michael Ovitz, will “play host to a ‘power conference’ of basketball influentials at the Wynn Hotel, to commiserate over ‘the future of NIL,’” Libit continues, adding: “With its original plans to host 100, Silver says the event is now expected to field a crowd of 350, underscoring his increasing influence in the dog-eat-dog world of college basketball recruiting.” Unlike many in the AAU world, Silver is almost universally praised by allies and competitors alike. Greg Kristof, a one-time rival event operator of Silver’s who has since become a close business partner, tells Libit: “For a business that is cutthroat and about putting people down, Ryan is the opposite. It is amazing how grounded he is considering the people he grew up around.” Silver adds: “I don’t fight with anybody. People have taken every shot at me on planet Earth. I just don’t fight with them no matter what.” Despite his bevy of connections, Silver was hesitant to engage with NIL and tells Libit: “I’ve been in this space for 15 to 20 years, and I’ve seen everything, so I was kind of skeptical. I didn’t believe it was real.” Libit: “However, after seeing so many of his former West Coast Elite athletes sign NIL contracts, Silver decided that it was time to get off the sidelines and bring his network to bear. … He intends to make his Las Vegas power conference the kind of annual staple that draws crowds of 5,000 in future years. It’s a tall order in a competitive environment, but Silver has the connections—as of last week, his phone held over 15,800 contacts–and an abundance of good will.” (link)

Iowa produced its third and final report this month finding “no material issues with respect to UI’s compliance with Title IX.” The reports were required to satisfy an obligation as part of a settlement agreement from a 2020 lawsuit from female swimmers who alleged the university was out of compliance with the federal gender equity law even before it tried to eliminate their programs. Tulane Sports Law Director Gabe Feldman, who was hired to monitor the department’s compliance: “As per the settlement agreement, this public report concludes my role as the monitor for UI’s compliance with Title IX. I understand that UI will continue to monitor its Title IX compliance and make adjustments to address any existing inequities or other issues that may arise.” In his report, Feldman found UI had 366 male participants across eight sports — including 129 football players — and 448 women participants across 14 sports, including 74 rowers. “This represents a 1.02% disparity…in 2023-24, as compared to a 1.6% disparity in 2022-23. A significant portion of this increase was attributable to the increase in the roster size for women’s wrestling, from 16 athletes in 2022-23 to 28 athletes in 2023-24.” More. (link)

Sean “Diddy” Combs, according to a document obtained by the Los Angeles’ Times’ Richard Winton and Hannah Fry, was “so upset about the way his son was being disciplined by a UCLA football coach in 2015 that he went to the coach’s office and fought with him, briefly choked an intern and put another member of the coaching staff in a headlock.” Combs was arrested on suspicion of assault with a deadly weapon, making criminal threats and battery in the incident, but he was not ultimately charged with any crime. Representatives for Combs at the time said any actions he took “were solely defensive in nature to protect himself and his son.” Some also alleged that the younger Combs had been bullied by former Strength & Conditioning Coordinator Sal Alosi the entire time he was on the team. Attorney Mark Geragos, who represented Combs at the time of his arrest, tells Winton and Fry: “Two different prosecutorial agencies looked at it, and both declined to prosecute. I understand the interest now, but clearly, this did not rise to the level of criminal prosecution.” (link)

SEC Commissioner Greg Sankey joined the Paul Finebaum Show yesterday and said of the meetings with the Big Ten and the landscape overall: “I think we have a responsibility to continue to make progress. If we can do that with people, that's much healthier and I think [Big Ten Commissioner] Tony [Petitti] and I are both attentive to our conferences, to our working relationship with each other, and our working relationship with the people around us and will continue to be. And if we can bring people into problem-solving, I mean in a big way in Division I, I think that's success. And that's a bit of the opportunity in front of us. In fact, the conversations and the points of outreach I've had today – which, there were two other points this week from others kind of not in that Autonomy 4 group that I think indicate the health of conversations and relationships still being important.” (link); Sankey yesterday also addressed the status of expanding the hoops tournaments: “We were briefed as commissioners in the summertime about what I would call incremental growth. Whether that’s possible or not remains to be seen. … Obviously, we have a format this year, the NCAA has contracts that do go for a while. I expect that discussion and work would continue. My general view is interested and supportive of that discussion. I am curious about the format that might be proposed, if there is growth, how those teams are decided, how those teams are assigned.” Also: “I would contextualize this, people will talk about this should never change. I’ve seen plenty of that feedback. You continue to see changes around Division I, from conference membership, new members in new places. I think that discussion is the right discussion given the time we’re in.” (link)

Mountain West Commissioner Gloria Nevarez met with reporters during the league’s basketball media day and said: “Eight is the magic number for the NCAA and it's anchored in football language, but really for us basketball, because of who we are, is super important. And we're going to continue to analyze that and if there are opportunities out there that make us stronger, we're going to jump on them. … We’re going to take some time over these next couple weeks. We’ve been looking at membership since I started in 2023. So, it's not like we're starting from scratch. We have all the data, we have all the information, so [it’s] just really making informed decisions. But, like I said, those things that make us stronger in the areas we want to continue to grow and expand [in], we’ll continue to explore those.” (link)

Eastern Illinois AD Tom Michael is not in favor of the House settlement in its current form but adds: “I also don’t think we’re moving forward thinking that’s going to change.” Michael also remarks that “if the Power 4 schools want to go do what they want to do, [I say] go do it. But in the FCS world and non-football playing schools, we’re going to manage this in a different way. [The Power 4] might have a lot of different rules than us, so we’re going to try to do something different over here. … We still want to have access to championships, we still want to have revenue share, we need to have some say in some governance. But the governance really is, we still want to qualify for the championships and somehow have revenue share. Otherwise, if [the Power 4] wants to have revenue share in terms of individuals, go do it. If you want to pay your players, go do it.” Michael says of reports that Power 4 programs may no longer play FCS teams: “The question you would ask is, ‘Is Michigan really only going to have six home games?’ They need seven or eight home games financially to make it work.” (link)

Michigan State’s matchup with Michigan in football next week will mark MSU’s fifth consecutive night game and seventh of the season, and Spartans AD Alan Haller says at “some point, enough is enough.” Haller adds: "I mean, I'm a fan of a few prime-time games, but I'll admit, I'm a fan, too. There's a lot that goes into especially home night games. You've got people coming from at least a four-hour radius. That can be very, very long days. It's a challenge. It's something that I've had conversations with the conference office about. One of the things that needs to be clear: People wonder how much input I have. I don't have much, if any." The Detroit News’ Tony Paul notes that under the terms of its TV deal, MSU is “limited to five night games a season. However, that doesn't include its own scheduling moves – like Haller moving the season opener against Florida Atlantic to Friday night, August 30, because MSU fans have gotten used to that little Labor Day weekend tradition. Those limits also don't include out-of-conference scheduling, like the game at Boston College on September 21.” Haller: “I do want to play our fair share. However, let's make this thing, spread it out a little bit. Move to some other schools." (link)

College Hockey Insider’s Mike McMahon shares what he’s heard from coaches and NHL officials about the NCAA’s new rule allowing CHL players to play in college and notes: “A few coaches pointed out how easy it will be geographically for certain programs to recruit CHL players. Mercyhurst has the Erie Otters (OHL) in their backyard. Niagara (OHL) is not far from Niagara or Canisius. RIT isn't that far away, either. St. Lawrence and Clarkson are less than two hours from the Kingston Frontenacs (OHL) and Ottawa 67's (OHL). Vermont is less than two hours from several QMJHL teams.” One coach says: "If I am one of those programs, I can recruit those leagues and it doesn't cost me anything other than time. It's not a huge piece of the recruiting budget. I don't need a flight. I barely need a hotel. You're not just seeing one team. You're seeing that one team that's close to you, plus every other team in that league that goes through that town." Another coach notes that from what he’s observed, “a top-six player in the OHL would be a top-six player in the USHL.” Still, he asks: “How many of them are eligible and want to go to college?” Yet another coach tells McMahon: “It's going to become a lot harder for American-born players to play college hockey. There are 1,000 Canadian kids, who are all pretty good and were all ineligible before who are now eligible." Meanwhile, an NHL exec remarks: "I'll be honest, I don't know yet what this means for our organization. The NHL, the [NHLPA], and the CHL will have to sort a lot out with their agreement. That's what will ultimately impact [NHL teams] more than anything else. I'll say this: a lot of players coming out of the CHL at 19 or 20 years old aren't ready for the AHL. If there is another place for those players to go to develop, and we maintain their rights if they're drafted, that seems like a positive on paper." More. (link)

Creighton is set to debut a new basketball court this season. The court will feature six numbers on the west sideline, three in front of each bench, to recognize retired jersey numbers, the year 1916 inside the midcourt Bluejay logo to denote the school’s first year in intercollegiate basketball, Heritage logos to honor Creighton's history and more. The court was designed by GLGR out of Beaverton, Oregon, and produced by Ledford Sports Floors out of Jenks, Oklahoma. Bluejays AD Marcus Blossom: "We wanted to make this court uniquely Creighton. It was important for us to honor our storied basketball tradition along with our Jesuit values while also injecting a bit of new energy to the design. I hope we struck the right balance." (link)

A decade after penning an essay in favor of legalizing sports gambling, NBA Commissioner Adam Silver says he doesn’t “regret writing that op-ed piece and being in favor of legalized sports betting. I still think you can't turn the clock back. I think, as I said at the time, with the advent of the internet, widely available sports betting online…that we had to deal directly with technology and recognize that if we don't legalize sports betting, people are going to find ways to do it illegally. … I was in favor of a federal framework for sports betting. I still am. I still think that the hodgepodge of state by state, it makes it more difficult for the league to administer it. I think it creates competition, understandably, among states to get -- just think New York, New Jersey or a situation like that where you're both competing for the same customer so you can compete on tax rates and other things and a regulatory framework.” Silver admits there are downsides to sports gambling and calls former Toronto Raptor Jontay Porter’s actions last season a “cardinal sin,” adding: "We take this very seriously. As I said sort of day one, it's not a huge business for us in terms of a revenue stream into the league, but it makes a big difference in engagement. It's something that people clearly enjoy doing. I'd put it in the category of other things in society that I wouldn't criminalize them, but on the other hand that you have to heavily regulate them because if there's not guardrails, people will run afoul and create issues, problems for themselves, potentially for their families or for operations like us." The Department of Education this week began the second phase of beta-testing for the 2025-26 FAFSA and so far the “test-drive is going smoothly,” according to The Chronicle of Higher Education’s Eric Hoover. FAFSA Executive Director Jeremy Singer says the first phase was “a complete success” and “the system is working from end to end.” Though the testing revealed bugs, as expected, Singer says none were “critical errors.” According to the department’s list of updates on FAFSA-testing, 60 forms submitted in early October were initially rejected, mostly due to a missing student or parent signature: “The Department recognizes this is an ongoing issue from 2024–25 and we continue to explore ways to decrease these rejections, especially with better prompting for student and parent signatures.” Singer notes that students whose FAFSAs were rejected were able to correct and resubmit the form. “A modest uptick in fall enrollment will not be enough to stem intensifying pressure for many U.S. colleges heading into next year and likely beyond,” according to Fitch Ratings analysts during a webinar yesterday. Fitch Ratings Senior Director/U.S. Public Finance Higher Education and Nonprofit Head Emily Wadhwani says some “flagship public institutions, selective private institutions, and HBCUs are achieving record enrollment numbers. Conversely, many smaller, less selective colleges continue to see their enrollment decline.” Lower demand, analysts say, will keep tuition increases in check and have already increased institutional discounting levels. Wadhwani: “Discounting is at its steepest for every incoming freshman class, which then becomes a trailing reference point as those students head towards graduation.” From Fitch: “While most Fitch-rated colleges maintain Stable Outlooks, downward Outlook revisions have risen over the last several quarters. This could indicate more downgrades are ahead, particularly for colleges unable to maintain positive operating performance, as well as erode financial resources. Rating Outlooks vary by geographic region, with far less stress evident in the South compared to the Midwest and Northeast.” Also from Wadhwani: “We do expect the sector to yield generally softer operating margins and continue to show some strains on financial flexibility as we head into 2025.” (link, link)
