Wisconsin AD Chris McIntosh in a letter to the fan base about the House settlement writes: “Student-athlete opportunity will remain at the center of all we do. Our plan is to maintain our broad-based approach to supporting 23 sports, though the level of support we're able to offer each program will need to change. Above all, our overarching goal will continue to be for student-athletes to thrive within our program and earn a degree from our world-class institution. The environment in which we have been competing will be quite different in the future. The changes ahead will force us and athletic departments across the country to make difficult decisions given the financial impact of the settlement. We will adjust to the changing dynamics with our values and goals of academic achievement and a competitive athletic experience as our guide. … We are supportive of sharing revenue with student-athletes because it provides a level of stability in what is currently an unstable environment. However, to do that successfully, it will be critical for us to make adjustments in the way we have operated and to generate additional revenues through new opportunities. West Virginia AD Wren Baker in a Q&A with BlueGoldNews.com says he’s “not okay with the number of transfers here or anywhere in the way the portal is set up because I think a situation where a student-athlete goes to four or five universities in their college career is not good for the student-athlete. There is no way they’re getting a quality education, and there is no way they’re learning life lessons that prepare them for the ups and downs of life and leadership and resiliency and toughness and all those types of things. … If you ask me the redeeming value of college athletics, it is that you have to go and function on a team. You may have personal goals, but you have to reconcile those with team goals and initiatives. You get coached and you get critical feedback in ways to get better, and you have to come back and get better. You learn how you’re getting better feeds into the team.” Baker goes on to explain that “you also have the whole team dynamic where you’re in the locker room where you have to try to get along with people who maybe you don’t have much in common with them initially. All those things are lessons in life. I have a friend who is high up with Northwestern Mutual, and they brand a lot with the NCAA. He told me that their branding initiative had nothing to do with getting additional clients. They wanted to be a brand student-athletes recognized because student-athletes had much greater success as aspiring agents for their company than non-student-athletes because of all the things we just talked about.” More from Baker. The Clemson Board of Trustees approved a $150-per-semester student fee to support the athletic department upon the recommendation of the Finance and Facilities Committee. The university expects the fee to bring in an additional $7-8M for the athletic department. Tigers AD Graham Neff: “Students here at Clemson receive free access to all sporting events, including half of all student tickets for football games. Most Power 4 schools either charge a student fee or require students to purchase tickets. Every other NCAA Division I public university in South Carolina also charges an athletics fee. The request for motion is the implementation of a $150-per-semester athletic fee to be used solely for athletic operation expenses directly associated with student-athlete services and student experience beginning fall of 2025.” (link)

Extra Points publisher Matt Brown shares the executive summary of Project Rudy’s presentation deck, which “does not propose to share revenue equally among all members, like the Big Ten and SEC (and most other leagues) do with their membership. The largest and most successful brands will command a greater share of the pie. But the proposal believes that thanks to investor funding and substantially increased media and sponsorship revenues, every participating institution will still be better off than they were before. In fact, schools would be guaranteed a certain level of distribution.” The deck projects that if conferences maintain the status quo they will bring in a total of $13B over the first three years compared with $18.3B through Project Rudy. In years 4-12, those numbers are $64.8B and $74.6B, respectively. Brown notes that Project Rudy “aims to improve ratings and sponsorship revenues by simply getting rid as much of the [scheduling] fluff as possible, allowing the centralized league to create more premium matchups. Now, the question, of course, is whether dramatically increasing the supply of those matchups will do anything to diminish what makes them special, thus diminishing the potential ratings boom over time. Does Ohio State/Oregon matter the same way without Ohio State/Marshall and Ohio State/Akron as a comparison? I don’t know.” As for whether this would work, Brown believes more info is needed. “For one, based on my understanding of the Sports Broadcasting Act of 1961 and the Regents decision in 1984, consolidating the Tier 1 rights from all four P4 leagues would probably be illegal. The P4 would need congressional help to get this approved, and I imagine senators from, say, Idaho or New Mexico, wouldn’t be too excited about helping.” Lots more. (link)

Adidas has been outfitting Rutgers at a discounted price but without a contract since the end of the 2022-23 academic year, according to the Asbury Park Press’ Jerry Carino and Jake Matson, who note: “Though then-athletics director Pat Hobbs said last March that ‘we have extended our partnership with Adidas’ and ‘the contract is being finalized,’ a contract extension never happened. … An open records request of Rutgers' contract with Adidas revealed that Rutgers received $12.944M in value from Adidas and paid the company $16.257M over the six-year deal; the net result was that the university paid Adidas $3.313M over the duration of the agreement.” Carino and Matson posit that the “logical move from here is for Rutgers to partner with Nike, but right now the athletic department is in the process of exploring options with multiple outfitters. … There is no strict timeline for a deal, but the 25th-ranked basketball team’s season opener against Wagner Nov. 6 seems like an obvious goal date.” (link); NJ Advance Media’s Brian Fonseca adds that a school official would not say whether Adidas was among the companies to receive an RFP from Rutgers. Fonseca also reports the original pact between Rutgers and Adidas called for “exclusive athlete and staff use of Adidas products when engaged in athletic related activities included but not limited to: recruiting, training, traveling, competition.” But without a contract, the company “could not enforce those rules, and with Rutgers now looking for a new partner, it becomes a moot point.” (link)

Virginia Tech will welcome Metallica to Lane Stadium in May, and SBJ’s Ben Portnoy notes the concert has been in the works for two years. “First conceived in the athletic department as an appearance by the band to play ‘Enter Sandman’ live before a football game, that idea pivoted to a co-branded merchandise line between the group and school.” Hokies Executive Assoc. AD for External Affairs and Advancement Brad Wurthman: “You put Metallica in other college [properties], and I'm sure they'll do an amazing job. It just doesn't have the folklore aspect that they have here in Blacksburg. … This is the 25th year that we've played ‘Enter Sandman’ as the Hokies take the field. ... This has been a pipe dream for so many people for so long, and we did our homework. We found some people who had some contacts, and we called and worked through the process of ... ‘How do we just get you to come to Blacksburg for a game and play ‘Sandman?’ And we worked really hard on trying to make that possible.” Portnoy notes the concert is the latest in a growing trend of schools looking to further monetize their football stadiums. “Paciolan, the third-party ticketing solution company that’s under Learfield’s banner, has seen the number of live events like concerts jump from around three coming out of COVID to 44 last year. The stadium shows, Paciolan President Deana Barnes said, are also netting well into the seven figures in gross revenue.” (link)

A Los Angeles Times investigation finds that “USC quietly offered wealthy and well-connected families an alternative path to admission with much lower academic expectations and an acceptance rate of 85% to 90%. Internal records show USC fundraisers anticipated significant donations from families of those admitted and, in some cases, became enraged when money failed to materialize. When the Varsity Blues scandal threatened to expose the secret system, the university and some employees involved took steps to keep the details hidden, an effort that continued through at least 2022.” In one example, the Times’ Harriet Ryan and Matt Hamilton cite the daughter of real estate developer Jim Thomas who was accepted in 2016 as a tennis walk-on and never played for the Trojans. Former USC Assoc. AD Scott Jacobson in an email wrote to San Diego fundraising officer Karen Bowman: “Was there any talk of a donation if we got her in?” To which Bowman replied: “Yes, I spoke to them about a ‘gift [of] gratitude’ if we got her in. I told him 6 figures. He understood and seemed ok with this.” Thomas’ lawyer disputes the account, telling the Times: “As a USC alumnus, Jim Thomas regularly donated to his alma mater. He never made a donation approximating a six-figure sum and never suggested that he would.” Ryan and Hamilton also note Jersey Mike’s Founder Peter Cancro discussed how USC’s athletic department could help get his stepson admitted and wrote in an email to former Trojans Senior Assoc. AD Donna Heinel: “Planning to try walking on with tennis team as discussed.” Heinel later emailed Cancro to say: “In his essay [your stepson] states that he became tired of practicing tennis from 5-9 Pm every night so he quit playing tennis. It is hard to present a candidate as a walk-on tennis player when he states in his essay that he quit playing.” Lots more in an extremely in-depth article. (link)

Meanwhile, Rick Singer, architect of the Varsity Blues operation, tells Fox News: “Everything that the FBI and U.S. attorney and everybody else in the world says I did? I did it. … I’m the guy that’s hiding in plain sight. Nobody even knows who I am. Now, somebody may recognize me, and I can hear people talking. But nobody cares." According to Fox News research, at least 50 people had pleaded guilty or been convicted in the scandal as of October 2023, and Singer says: “I want to apologize profusely to all of the families that I’ve hurt, all the kids that I hurt. The administrators that I hurt. My own family.” Singer goes on to discuss how the operation worked and explains that "in 90% of the cases, the coaches every year are calling me saying, 'I got a spot open. I need to raise this amount of money. Find me a family.’ … The media missed that the colleges, they’re my partner in this. It takes two parties to play.” Asked if he thinks the college admissions system can still be gamed and if it's still being gamed today, Singer replied, "Every day." (link)

Tennessee Tech Football HC Bobby Wilder on Tuesday sounded off on the OVC/Big South scheduling alliance: "The first thing I'm going to do, because I'm pissed off right now, is address the scheduling model this league has, the scheduling model at Tech. This is absolutely horrendous. We're a 2-5 football team right now. We're beat up, lost our starting quarterback, and I inherited this when I got here. So, first two games, FBS; we play at Middle Tennessee, play at Georgia, who's No. 1 in the nation, get a bunch of kids hurt. Then we come home and play Tennessee State when we're still fairly healthy, even with a backup quarterback, and beat them. That's their only league loss, 6-2 and 3-1 right now. Then the league sends us on the road three consecutive times in the league on the road. I don't understand how that's even possible. And we've got to put up with it. So now we're sitting here at 2-5, we're all beat up; thankfully we just got our quarterback back. … In the big picture, the league has to change this or we're going to be a one-bid league. We've got nine teams in the league, five of us play seven away games, five home. Only four teams play six and six, which is unacceptable. All four teams who played two FBS money games all have losing records.” Wilder went on to reiterate that “I'm pissed about it. This bothers me. This is going to stay a one-bid league until leadership decides to make some changes. Because you look at the Missouri Valley, there will be probably six teams in; you look at the Big Sky, there will be probably four teams in. They have a smart model, they do it right, more home than away, they buy teams to come in to help with the schedule.” (link)

Netflix Co-CEO Ted Sarandos said in a Q&A at the Wall Street Journal Tech Conference that when it comes to live sports, “Never say never, but I would say that right now we are in the live events business. There’s something very interesting and very exciting about when the world comes together to watch the same thing at the same time. They don’t do it very often. That’s what makes it so special. I think the leagues do a phenomenal job of building fandom, and for that, they get to keep all the money, and distribution’s a pretty low margin business for full season league sports, I do think if we can add some value back to them, which I think we do uniquely, we can make that work.” (link)

Troy is adding two new premium areas – the Courtside Club and the Trojan Terrace – to Trojan Arena ahead of hoops season and has replaced all courtside seats with new cushioned theater-style seats. All courtside season ticket holders will have access to the Courtside Club. The Trojan Terrace is available on a game-by-game basis for $500 per game and includes cushion-style chairs, high top tables and high top chairs, drink coolers, TV and the ability to cater food to the area. Saint Louis has eliminated more than 20 staff positions and is freezing 130 vacancies in a cost-saving measure. The layoffs reportedly do not include faculty, but 30 of the unfilled positions are teaching jobs, according to an email from President Fred Pestello last week. Pestello disclosed that layoffs were on their way earlier this month in a post on the university’s website as the university seeks to reduce expenses by about 4%. (link)

NCAA President Charlie Baker spoke and answered questions during the Axios BFD event during which he said: "I definitely think the national association needs to change. We've been chasing that change pretty much ever since we got there. Main thing is to create a rev-share model for kids in sports in Division I." Baker also commented on collectives, saying they “spend a lot of time just circling and chasing kids. And it's a very transactional activity. … False promises, misrepresentations, and all sorts of other things. There's basically no rules governing those things." Baker confirms the NCAA doesn't know whether the House settlement rev-share must comply with Title IX. Asked whether he believes he has real authority, Baker responds: “I to say people all of the time that I have influence." On his optimism that Congress will pass a law, Baker explains: “When I was busy talking to those 97 conferences...I also went to Washington because I wanted to hear what people in Congress had to say. I did a lot more asking and listening than asking or demanding. What I learned was they said clean up your own house.” If the House settlement is approved and works the way he “thinks” it does, Baker believes it will be relatively narrow and include the preemption of state laws while making a defining statement about the question of employment. Does private equity have a place in college sports? "I think the answer is yes." But he adds PE is "usually kind of a 3-5 year window that most people think about. Colleges make decisions in a much broader time frame than that. I think the question would be you’d have to figure out on your table of risk and resources how to make a PE piece fit into a model that's not designed to deliver returns in 3 years." Front Office Sports’ Amanda Christovich also caught up with a half-dozen Democratic and Republican congressional aides and industry experts to discuss how the general election results could impact the future of college sports, and one Democratic aide says: “If Congress doesn’t get in the way, athletes are going to continue to notch wins in court and at the National Labor Relations Board. Time is on the athletes’ side.” However, should the GOP take control of the Senate, Christovich notes: “A Republican-led Senate could produce an NCAA-friendly bill—though the NCAA would probably need bipartisan support for it to pass, congressional aides on both sides of the aisle agree.” Further, Christovich reports the issue has “devolved into a partisan fight,” per a Democratic aide. “The strength of unions is a major ideological issue in the 2024 election, with Democrats wanting to appear as pro-labor as possible, and Republicans wanting to quell collective bargaining activity. Some Democrats also view the issue as an extension of the growing pro-labor movement on college campuses, from student dining hall employees to graduate student workers.” Meanwhile, two Republican aides, as well as NCAA SVP of External Affairs Tim Buckley, “believe there’s been significant progress in convincing Democrats to pass a law barring athlete employment status. Buckley points to comments [U.S. Senator Richard] Blumenthal (D-CT) made this summer essentially conceding athletes don’t have to be employees to have rights and protections. The Republican aides also believe Democrats might be more willing to sign onto a bill of this nature if players get additional perks, like assurances over health care and revenue-sharing. One lobbyist, however, tells FOS Democrats are ‘not going to vote on anything that forbids people from going into a union.’” More. (link)

The Pac-12 has retained Octagon to assist with the sale of its media rights, according to JohnCanzano.com’s namesake, who ruminates about what happens next: “Octagon’s fingerprints are on a few basketball-specific media rights negotiations in other places. Octagon helped the Atlantic 10 and Coastal Athletic Association do deals. The Atlantic 10’s deal with CBS Sports, ESPN, and NBC Sports in 2023 gave it a 40 percent increase in media rights revenue. Would Octagon split the Pac-12’s basketball media rights from football and try to sell the two assets independently? Or bundle them? Traditionally, those rights have been bundled for the most value. But industry insiders are curious and watching to see what the Pac-12 will do given that it has an attractive stable of basketball schools.” Crakes Media Principal Patrick Crakes tells Canzano: “[Octagon SVP of Global Media Rights Consulting] William Mao is sharp. [EVP of Global Media Rights Consulting] Dan Cohen is smart. They have lots of experience in rights deals. The Pac-12 fits into their mold. They will strictly be a media rights consult. This is a good choice for the Pac-12. They’ll do a good job.” Also from Canzano: “One firm the Pac-12 did not consider was Endeavor. Karen Brodkin is the senior vice president at Endeavor. Her firm is working for both the Big 12 and Mountain West, among others. As one industry insider quipped: ‘Karen can’t do all the deals.’” (link)

Miami (FL) AD Dan Radakovich covers several topics with media members. On the changing collegiate model means more coaches will have to adapt to a new environment, Radakovich continues, explaining that “as we move forward and coaches see how they have to manage their rosters and build their rosters, some of them (around the nation) will decide maybe there is something else for them to do with their time. I hope not, because we don’t need a brain drain in high-level coaches.” Radakovich says of the balance between guiding student-athletes and raising money to recruit and retain them: “Mine is more providing the resources to give to our coaches to be able to do that for our student-athletes. When they have their 20 hours of practice during the week when they are together it’s no different than it was for many, many years. [We] make sure our coaches have the resources, that’s our job. When you get into the molding [of young people], that’s why you look for great coaches.” (link)

+ USA Today’s Steve Berkowitz reports that plaintiffs in the lawsuit against the Ivy League challenging schools' refusal to award athletic scholarships have filed a notice of appeal to the Second U.S. Circuit Court of Appeals, seeking to overturn a district judge's ruling Oct. 9 to dismiss the case. + The NCAA, conferences and Turner Sports argue the antitrust lawsuit brought by former Kansas men’s hoops star/NBA veteran Mario Chalmers and 15 other former college basketball players over the use of their NIL in broadcasts is barred by the passage of time and the limitations of law. Sportico’s Michael McCann explains that “antitrust claims normally have a four-year statute of limitations. The players in Chalmers’ lawsuit appeared in games long before 2020, in some cases, during the last century. … Another defense is that the claims have already been litigated and are thus barred by res judicata and collateral estoppel. Those legal principles dictate that once legal claims and issues have been resolved in court, they’re over and can’t appear in future cases. … If the defendants succeed in making that point, the players would have contractually waived claims by virtue of settlements.” Specifically, the defendants note the players were represented in antitrust litigations led by Ed O’Bannon, Sam Keller and Shawne Alston. The NCAA, et al. concede that U.S. District Court Judge Claudia Wilken previously found there could be a right of publicity in a broadcast; however, the defendants maintain “that ruling is inconsistent with the vast weight of precedent cited [in the memorandum],” and they urge U.S. District Court Judge Paul A. Engelmayer to “follow the prevailing judicial consensus, not O’Bannon.” More from McCann. (link)
+ Alcorn State canceled its women’s soccer season after not having enough players to field a team, and the school has also confirmed the existence of two letters that contain allegations of possible Title IX violations within the program. Interim VP of Marketing and Communication Maxine Greenleaf tells the Clarion Ledger’s Sam Sklar: “Our previous interim head coach left the university, and we had a short period of time to recruit additional players after the new soccer coach arrived.” According to one of the letters obtained by Sklar, players were placed in facilities with "no running hot water for athletes or coaches," there were "bats and snakes in showers and locker room," promised soccer equipment, like cleats, that were never fulfilled, and the training room was "understaffed and not compliant with numerous undergraduate students attending and performing medical treatments with no experience or training." The letter was signed by 15 former or current players. Upon canceling the season, the Braves were fined and sanctioned by the SWAC, though the amount of the fine has yet to be reported. (link)

+ Rutgers is no longer an Adidas school, according to former Nike brand director Jordan Rogers, who cites sources from Adidas and an open records request indicating the school has no current contract with Adidas. Rogers: “The fact that there is not an official contract in place explains so much” in regards to men’s basketball student-athletes Dylan Harper and Ace Bailey wearing Nike shoes during a exhibition. “I think there were other issues at hand, but this certainly didn’t help.” (link)
+ Maryland and Under Armour are partnering to launch exclusive merchandise that will be available exclusively for new members of the One Maryland Collective. The merchandise features a vintage logo that will be exclusive to Under Armour. The NIT Board of Managers has announced new qualification procedures for the 2025 tournament, which include bids going to 16 "exempt" teams, as well as others that may qualify automatically as regular-season conference champions. Exempt teams will include the top two teams not selected for the NCAA Tournament from both the ACC and SEC. In addition, the top team not selected for the NCAA Tournament from the top 12 conferences (based on the Ken Pomeroy Rating) will receive an exempt bid to the NIT. The top teams from each conference will be determined based on the average of the teams' ESPN Basketball Power Index, Kevin Pauga Index, NCAA Evaluation Tool, Ken Pomeroy Rating, Strength of Record, Torvik ranking and Wins Above Bubble ranking. All rankings are already included in the "Team Sheets" used by the NIT Committee during the selection processes. Teams receiving exempt bids are guaranteed the opportunity to host a first-round game. Additionally, regular-season conference champions not selected for the NCAA Tournament can earn automatic NIT bids as long as they have an average of 125 or better across the aforementioned rankings. The rest of the 32-team field will be selected as at-large teams by the NIT Committee. The NIT Board also approved former multi-stop HCs Tubby Smith and Jeff Jones as the newest additions to the NIT Committee. (link)
