Lawyers in the Fontenot case have submitted document indicating they agree to a stay of the case until there's a ruling on final approval of the House settlement, per USA Today’s Steve Berkowitz, who adds the NCAA and conferences have agreed to not prevent lawyers for Fontenot from adding athletes who opt out of House settlement to their case. Additionally, Berkowitz reports the parties agreed to “certain House final-settlement scenarios under which Fontenot injunctive-relief case would be stayed, be dismissed or proceed.” (link)

Big East Commissioner Val Ackerman joins Huddle Up’s Joe Pompliano to discuss the evolution of college basketball, how media rights deals are actually negotiated, the overall college landscape and more. While the Big East doesn’t bring in the revenue the Power 4 conferences do, Ackerman says: “We don't have their distractions or their expenses either. And some of those attributes are, I think, contributing to some of the changes you're seeing elsewhere that we've been largely immune from. Conference realignment, some of the more difficult decisions that have to be made by football-driven schools, were out of that fray. Where that'll get us in a few years time I think is anybody’s guess.” Ackerman also says the Big East projects how many conference teams will make the NCAA Tournament each year and factors that into its budget. “Really as we build our budget, that is a revenue line item that we try to project out and we have what we think is a conservative [figure]. I won't give it to you, but we do try to project out based on past performance, our optimism about the strength of our programs, how many bids we would get into the NCAA Tournament and then how many wins. … It’s an important component of our revenue stream because we get a fair number of units every year.” More. SBJ’s Ben Portnoy reports from his weekend embedded with ACC Commissioner Jim Phillips in Berkeley where Cal hosted Miami (FL) in football. Phillips also made the short trip to Palo Alto, where Stanford hosted Virginia Tech. Portnoy on the difference between the two venues: “Where Cal fans had been whipped into a frenzy over ESPN’s presence and their looming contest against No. 8 Miami, those in Palo Alto were slower moving in the two hours before Stanford’s kickoff. The wine-and-cheese crowd might as well have sipped chardonnay at the tailgates in and around Stanford Stadium, eventually trickling into the luxury boxes on the southwest side of the facility. Students and other varying Cardinal fans spilled into the stands, but inevitably hid in concourses to fight off the unseasonably hot sun baking the field.” Portnoy characterizes Phillips’ mood on the West Coast trip as “downright chipper,” and during a conversation over a plate of loaded nachos, Phillips remarked: ‘I think what you’re trying to do is build through expansion. You’re building on what you have, right? I think you got a taste of it today.” In discussing the league’s tumultuous year, Phillips tells Portnoy he’s “really proud. All that we’ve been through, to end in this position, to strengthen the ACC, to add three really quality schools that have terrific athletic departments and obviously good football programs, it’s really a rewarding feeling.” More. America East Commissioner Brad Walker joins The Field of 68 during the league’s hoops media day and says that in his four years he’s been particularly impressed by member schools’ commitment to investing in other sports while prioritizing in basketball, “trying to promote this broad-based collegiate experience. But then also just the enjoyment of the sport of women’s basketball in this region has been amazing. For example, we’re going to spend a lot of time talking with our athletic directors today about what else we need to be doing to get us back to where we used to be. And just the commitment to thinking strategically about the sport has been great to see and the way that our people have been very proactive about it.” Walker also talks about the league’s new logo, which he says got a “great reception. It’s probably, you’re going to say, a little bit on the nose, but we want people to know it's America East and this time we're not going to miss on that one. But I think it's pretty bold and I think it shows it really well now. Our student-athletes have really loved it too.” (link)

Michigan regent Jordan Acker joins the MGoBlog podcast to discuss the current state of college sports and specifically a survey U-M recently sent to fans about generating additional revenue. The survey frustrated some fans, and MGoBlog Founder Brian Cook explains: “The final question is rank these ways in which we need to extract more money from you. The context of the survey is not like, ‘Well, we might do this if we feel we need to,’ it's like ‘How would you like to be further milked?’ … I, and I think a lot of other college football fans, find this off-putting because at the same time Michigan [and other athletic departments are] saying we need more money, they are getting more money. They’re getting it from a new television contract that radically increases the amount that the Big Ten is going to distribute to them every year and instead of saying, ‘Okay, we'll pay the players outside of that, we're getting a survey that is implying that whatever money that Michigan has is not enough. And the thing about that that really rankles is it's not like the things that that money will go to are going to directly impact the people who I think most Michigan fans care about the most, which are the players. The amount of money that Michigan itself can give to the players is capped by the House settlement – for now – and as more money goes into the athletic department, less of that money is available to slosh around and actually give to the players in the form of collectives and NIL.” Part of Acker’s argument is that he believes House settlement will not cap revenue-sharing. “I expect that that number may be $20M in Year 1. I think by Year 2 or 3 or 5 it might be an enormous share of revenue. I think in the NFL it’s like 47%, 48%, I wouldn’t be shocked if we got there at the end of the day, too.” Lots more, including Cook’s argument that the value proposition of attending a football game has been getting worse and worse from a financial standpoint and “what I’m hearing from the athletic department is it needs to get worse and worse and worse so that we can have a successful team.” (link)

Kansas is paying Arrowhead Stadium $125K in rent plus an estimated $485-720K in game expenses for each of the four home games the Jayhawks are playing there this year. Front Office Sports’ Jeff Benson explains that KU keeps the revenue generated from standard ticket sales, “minus a laundry list of fees, service charges, and taxes. Suites are a different story; KU receives six complimentary suites and can use another 10 but must pay 75% of the revenue on those to [Arrowhead Events LLC].” Also, while the Jayhawks keep 80% of merchandise revenue and can sell sponsorships, all concessions revenue goes to the stadium. So far, KU’s games at Arrowhead against TCU and Houston have averaged 43,274 spectators, slightly behind last season’s 45,889 average. (link)

Following the handling of the overturned defensive pass interference penalty in the Texas-Georgia game over the weekend, CBS’ Dennis Dodd calls for centralized officiating. “That is, a central group, company, or LLC of officials who answer to one authority instead of nine different FBS conferences. Because those officials work for their leagues instead of a central authority, even when they screw up, or are perceived to have screwed up, the conference's name is dragged through the mud. … Centralized replay is long overdue. The infrastructure and resources are there to make officials employees of a national officiating consortium, if you want to go that far. Even if they aren't employees, answering to a central authority rids them of a conference label.” Dodd goes on to analogize the lack of a central officiating authority to the lack of centralized governance in college football. “Every conference wants to scout, teach and develop its own officials. FBS leagues compete with each other to sign those officials coming up through the ranks. … Centralized officiating would ensure that talent, resources, training, etc., are spread out evenly. There is no downside. The game gets better. For now, we've got a mess.” (link)

Saturday’s Alabama-Tennessee football matchup averaged 10.7M viewers and peaked at 14.7M on ABC while that evening’s Georgia-Texas game averaged 12.9M viewers to the network, making the first time in 28 years two college football games brought in over 10M fans on the same network. The WNBPA has opted out of its current CBA with the WNBA and explains that players are seeking “a business model that reflects their true value, encompassing higher salaries, enhanced professional working conditions, expanded health benefits, and crucial investments needed for long-term growth." Players had until November 1 to opt out of the current deal, which was set to expire in 2027 and will still be in effect until October 31, 2025, and ESPN’s Michael Voepel reports the two sides have a year to come to an agreement. WNBPA President Nneka Ogwumike: “The world has evolved since 2020, and we cannot afford to stand still. If we stay in the current agreement, we fall behind. Opting out isn't just about bigger paychecks – it's about claiming our rightful share of the business we've built, improving working conditions, and securing a future where the success we create benefits today's players and the generations to come. We're not just asking for a CBA that reflects our value; we're demanding it, because we've earned it." WNBA Commissioner Cathy Engelbert: “With the historic 2024 WNBA season now in the books, we look forward to working together with the players and the WNBPA on a new CBA that is fair for all and lays the foundation for growth and success for years to come.” (link)

New Nike CEO Elliott Hill says after the company this week signed a 12-year extension as the official on-court uniform and apparel partner of the NBA, WNBA, and G League, that “Nike has always been more than a league sponsor – we’re a strategic partner with an unwavering commitment to growing the game, alongside the NBA, WNBA, and NBA G League. Our collective power, global reach, and genuine love for the game will only continue to create new pathways and opportunities for players and fans.” The last contract was an eight-year deal signed in 2015 and began in the 2017–2018 NBA season that was reported to be valued at around $1B. Law360’s David Steele observes that the “absence of noticeable change to address” U.S. District Court Judge Claudia Wilken’s concerns about the House settlement made Wilken’s “preliminary approval surprising, and those same problematic provisions likely will make final approval an uphill battle.” Baruch law professor Marc Edelman tells Steele: “Leaving aside the question as to whether I was surprised that Judge Wilken approved the settlement. I believed before, and still believe now, that there are meaningful long-term problems with the proposed settlement. Irrespective of whether or not the settlement should have been approved, the way it is written still leaves the NCAA member schools to substantial exposure under antitrust law. Despite lawyers’ contention, there is no way for a settlement of this nature to preclude future antitrust challenges to a salary cap – unless, of course, it is collectively bargained, and there is no collective bargaining here.” Indiana law professor John T. Holden saw nothing in revised settlement that would obviously sway it from rejection to approval but proposes it’s possible Wilken wanted to move the process to the next stage rather than keeping it tied up. “I think that’s kind of where I’m at now – ‘We’ve got this, all right, let’s see, are people actually going to object to this, or opt out of the settlement?’ Is there anyone that’s going to try to delay this, file some sort of appeal to the Ninth Circuit? It’s not a great legal answer, and I’m the first to admit that, but it’s a pragmatic answer.” At the end of the day, Edelman notes the biggest question remains whether the NCAA will have legal protection to maintain compensation restraints under antitrust law. “My conclusion remains that no, the NCAA member schools, do not – and thus, irrespective of whether the settlement is approved or not approved, future plaintiffs’ lawyers should be able to continue to challenge the settlement under federal antitrust law because, in essence, it continues to exist as a restraint on wages.” (link, link)

SBJ’s Ben Portnoy observes there are “discussions throughout the industry on basketball’s value in an even more football-centric college sports ecosystem,” and Indiana AD Scott Dolson tells him: “It is interesting to try to balance, particularly schools [with basketball tradition]. When we looked at making [a coaching change in football], we looked at schools like North Carolina and Duke, Kansas and Kentucky, and tried to look at schools that have a strong basketball tradition and how you build your football program together with that. I’m convinced that there’s no question you can have both.” WME Sports Co-Head/Endeavor EVP for Content Strategy & Development Karen Brodkin: “I’m not going to say anything stupid and say the value of college basketball from a media perspective is the same as college football. ... But I do think that delta is getting tighter.” Leading the charge on the value of college basketball has been Big 12 Commissioner Brett Yormark, who says: “I feel that basketball is undervalued, and there will be some upside in that part of our business moving forward, both short term and long term. As I look at the next TV cycle, we have optionality when it comes to how we might go into the marketplace. The traditional way is you bundle it, but we might or might not do that. Time will tell. But at least we’re in a position where we can look at that next TV cycle in a traditional way, or, for that matter, not a traditional way. It’s great to have optionality.” Portnoy points out that brands earned $482M in sponsorship exposure value from the NCAA men’s and women’s tournaments last year, per Hive, and Octagon SVP of Global Media Rights William Mao says: “If you look at the last couple of games of the [College Football Playoffs] compared to the Final Four of the NCAA Tournament, both of those usually fall within the top 100 broadcasts, if not top 150 broadcasts on an annual basis.” More. NCAA VP of Women’s Basketball Lynn Holzman covers more topics with SBJ’s Ben Portnoy, including whether there’s still an appetite to combine the men’s and women’s Final Fours. “Attendance-wise, we sell out [the women’s Final Four] every year. We continue, obviously, to find a lot of ways to elevate the event and uniquely position ourselves differently than the men’s Final Four. So there is no current conversation around that, but none of us know what the future holds.” Holzman also acknowledges that keeping the sport’s biggest stars in college for multiple seasons helps to grow the game’s popularity: “It’s tremendously valuable. Many of the changes that have occurred within the NCAA, around the [NIL] opportunities, the social media platforms that are there for either self-promotion or programs to be able to promote, and the opportunities to tell these stories [are important]. We know from fan data that fans want to find ways to connect to women’s sports, female athletes and women’s basketball players. That has been a consistent thread over the years that we need to continue to maintain in order for those fans to stay invested. We have such great opportunities in front of us to continue to embrace and continue to evolve as the world changes.” (link)

The Georgia Tech Athletic Association’s annual budget grew by more than $22M from FY23 to FY24 and is projecting another $10M increase for FY25, according to The Atlanta Journal-Constitution’s Chad Bishop, who reports that part of the increase includes a 30% uptick in the football program’s budget, which has been a point of emphasis. Yellow Jackets AD J Batt: “That’s a combined effort from donors, corporate partners, the institute continuing to support us and being aligned. Just continuing to innovate and find different ways to drive revenue and to grow our budget to the point where we’re competitive nationally in that space is important.” Bishop notes the overall athletics budget for FY23 was a little more than $105M and increased to nearly $128M for FY24. It is expected to cross the $137M threshold for FY25. In 2024, Tech also saw a $3M increase in ticket sales from 2023 and more than $9M in investments and endowments. Tech’s largest expenditure from 2023 was personnel (nearly $10M) and “general and administrative” (nearly $10M). The department projects another increase in investments and endowments by another $4M, $2M more in ticket sales and more than $2M in institutional support. (link)

The Washington Post’s Albert Samaha, Emily Giambalvo, Jesse Dougherty and Artur Galocha issued public records requests for NIL records from 56 public universities in major conferences. While “most schools refused to release any information, reporters ultimately obtained and analyzed records encompassing $125M in deals from 14 DI public schools.” Samaha, et al. found there are “disparities in whether — and how — universities maintain or disclose NIL records, making a comprehensive nationwide analysis impossible. With the bulk of funding shrouded in mystery, athletes have limited information to determine their market value.” Additionally, they note private companies “can bankroll publicly funded sports programs with little scrutiny. Including at the University of Colorado, where a production company with close ties to football coach Deion Sanders has provided nearly $600K to the team’s players.” In looking at UCLA student-athletes’ NIL endeavors, the Post reporters note the Bruins’ official collective “has distributed roughly $2M through NIL deals — all to football, men’s basketball and baseball players, the records show. The deals ranged from a $450K payment to a football player to 103 deals worth $500 apiece to football players for what was described as a “holiday post” on social media. Throughout 2023, the collective issued 46 payments worth between $1K and $5K to men’s basketball players, mostly for interviews, radio ads, and a March Madness event.” Also: “Of the more than 22K transactions in The Post’s dataset, nearly 13K were worth less than $100. Purdue’s records included roughly 8,000 of those transactions, in part because of how a merchandise company disclosed sales. At other schools, payments worth less than $100 accounted for anywhere from 18% of NIL transactions at UCLA to 60% at Illinois.” Lots more. (link)

Samaha and Giambalvo examine the way NIL functions specifically among women student-athletes and, as is the case across the board, companies are often more interested in players with large social media followings even if they aren’t big contributors to the team. Former Texas women’s basketball student-athlete Shaylee Gonzales was second-team all-conference heading into last season, but she was clear about what was driving her NIL earnings. “It didn’t matter how well I played on the court. Those brands just looked at how many followers you had.” Samaha and Giambalvo go on to contend that “while the women have exceeded the cultural relevance of their male counterparts, most continue to earn far less. … When they do earn substantial NIL money, The Post found, it often takes significant labor off the court for them to grow their online brands and secure deals. Gonzales and her Texas teammates earned a combined total of $435K in NIL income from July 2021 to July 2024, the records show. Their counterparts on the men’s team made a total of $4.8M, even as the women won more regular season and NCAA tournament games and had more than twice as many social media followers on their personal accounts at the end of last season.” UCLA Women’s Basketball HC Cori Close notes the “collective gets to decide the worth of an activity, the worth of an individual, what kids could get paid. We go into this year where we have unprecedented growth across the board in women’s sports, then we have collectives who take us back 50 years for women in sports.” Lots more. (link)

More from Samaha and Giambalvo on Colorado’s NIL setup, as they note SMAC Entertainment, which represents Buffs Football HC Deion Sanders, paid his football players a total of nearly $600K for appearing on or promoting Season Two of Coach Prime, the documentary series the company produced and sold to Amazon. CU Director of Athletics Strategic Communications and Spokesperson Steve Hurlbert disputes that SMAC was the football team’s biggest funding source, stating that the school’s NIL records contain “a fraction” of what athletes have received, including from booster collectives. “The onus of disclosure has been and remains on the student-athlete and many just choose not to do it.” According to Samaha and Giambalvo, the $594K provided by SMAC makes it CU’s largest NIL football vendor, followed by the Buffs4Life collective ($564K), Leaf Trading Cards ($400K), KFC ($378K), Overtime ($310K) and Google ($200K), among others. All but SMAC and Buffs4Life have deals with six or fewer players. For the Coach Prime documentary, SMAC issued nine payments to players for promoting the show on social media: two for $120K, one for $100K, another for $85K, four for $25K and one for $15K. U.S. District Court Judge David O. Carter ordered the U.S. Department of Veterans Affairs to select a vendor within a week and have a contract three weeks after that to build modular housing on the parking lot of UCLA’s Jackie Robinson Baseball Stadium. The Los Angeles Times’ Doug Smith explains the order is “Carter’s opening gambit — in the judge’s words, an ‘icebreaker’ to cut through bureaucratic malaise — toward an ambitious goal. He’s ordered the VA to create up to 750 units of temporary housing in 18 months on its West Los Angeles campus and an additional 1,800 permanent units over six years.” UCLA has appealed, and Justice Department attorney Brad Rosenberg informed Carter the decision whether the government would appeal would be made by the Office of General Counsel, not him. UCLA previously proposed to nearly double the school’s rent and “cede” back two of the lease’s 10 acres. Carter took exception with the notion of UCLA “ceding” the property: “Unless the 9th Circuit reverses me, this is veterans’ land.” (link)

Texas Tech has launched the public phase of its On & On campaign, which seeks to raise $1.2B over eight years to enhance the institution’s national and global standing. The campaign focuses on four key priorities: transform lives, fuel academic excellence, elevate campus and community and build champions. President Lawrence Schovanec on the latter, which will directly support athletics: "Our focus there is not on facilities, rather supporting those students and helping us deal with the challenges they now face in terms of revenue sharing and the new whole landscape of college athletics.” $700M has already been raised.
