Big 12 Commissioner Brett Yormark Q&As with the Arizona Daily Star’s Michael Lev and explains it’s a “real balance” trying to ensure the best possible fan experience while playing late-night games on Fridays and Saturdays. “We’ve got to be creative. We’ve got to explore new and different windows. I went out and met with Fox, I met with ESPN, already thinking about scheduling for next year. How do we create some open air, if you will, for the Big 12? … On a Friday night, that provides us with an opportunity. It might not be the only place for us to go, but…we’ve done pretty good on Friday night when you look at the numbers. ... So we’re going to explore what those opportunities look like moving forward.” Yormark says he’s enjoying the parity in football right now, “but I think over time – and when I say time, the foreseeable future, in the next couple of seasons – you’re going to want schools to ascend to the top so that they’re part of that national conversation even before the season. We might not be there just yet, but I think we’re well on our way.” It’s “more of a perception than a reality” that the Big Ten and SEC are consolidating power, Yormark continues, adding: “Speaking on behalf of the Big 12, we have a big voice in what happens in the future, and I make sure that our voice is heard and that I represent our membership in all the right ways. There is a spirit of cooperation amongst the four of us. We do meet quite a bit in person and virtually, just to make sure that we’re vetting what’s going on and where we need to go.” All things considered, Yormark believes college football is in a healthy overall place. “Stadiums are sold out. Ratings are at an all-time high. Saturdays, in some cases, are bigger than Sundays. So when these third parties claim that something’s broken, I’m not sure I see it. I’m not sure most people see it, because college football is pretty healthy right now.” (link)

Michigan State AD Alan Haller reacts to the Big Ten’s decision not to issue any punishment for the dustup at the end of the Spartans’ loss to Michigan on Saturday. “Regardless of whether I agree with the Big Ten’s decision, their decision is final. SBJ’s Ben Portnoy catches up with the leaders of various player organizations to get their thoughts on the House settlement, and NCPA Executive Director Ramogi Huma says: “We oppose the settlement, and the conferences and the schools have done a masterful job of throwing out breadcrumbs for the media long before the settlement was actually made public and analyzed. There’s a lot of cheerleading around [it] right now, but the reality is that this would be terrible for athletes.” Athletes.org Co-Founder Jim Cavale: “Until athletes are sitting at the table with representation as a group with their school, Athletes.org (AO) is going to be held back from what it could be for the industry – which is a solution for a sustainable future without litigation, with protection for the student athletes, empowerment for them to negotiate for themselves. That's where we're trying to get to.” College Football Players Association Executive Director Jason Stahl argues that the “NCAA wants to use any little piece of news that comes out to essentially say, 'OK, yeah, we need a federal piece of legislation.' We know what they want. They want college athletes classified as non-employees. They want antitrust protection. And it's clear they're going to use these cases to say, 'See, we made all these gestures of goodwill by settling these cases, and that's what's needed.' I hope, though, and what we're going to try to do as best we can… is basically to try to disrupt that debate." (link)

More from Athletes.org Co-Founder Jim Cavale as he remarks on the California Sports Lawyer podcast and that “if schools don’t collectively negotiate with all of the athletes to get them to agree to what each sport gets, how the athletes get paid, what the contracts look like, I think there’s going to be a lot more lawsuits – Title IX lawsuits and other types of lawsuits just around what's in the contract and the fact that the athletes didn't get a chance to really speak into that as a group. And so while those new lawsuits are emerging, there will be another reality legally, which is the athletes that are going to be paid are really being paid to produce revenue by playing. And while it's not a salary and it's not a W-2 deal, the Fair Labor Standards Act is pretty clear. I mean, if I’m building a business and I have a bunch of people on my team and I pay them all as contractors, the IRS is eventually going to say, ‘Wait a second, what's this person's job description? Why are you not paying them W2? Why are you not paying them payroll taxes? … Eventually I think the way that they choose to approach House is going to deem at least football and basketball athletes as employees, and if they haven't collectively negotiated with them as non-employees through an organization like AO by then, they're going to have to collectively bargain with those athletes now that they’re employees through an organization like AO.” Full podcast. College Hockey Insider’s Mike McMahon reports that every Head Coach he’s talked to believes a roster limit of 26 – as proposed by the House settlement – is too low. “Most agree with my thought back from the summer that 28 players was a more healthy roster cap for men’s hockey. There’s a group mobilizing, with attorneys, and they are prepared to oppose the House settlement over the roster limits.” McMahon also believes the slowdown in coaching turnover will stretch beyond football and into hockey. “I’ll add that every administrator I’ve talked to over the last six months has talked about limited spending. That’s across the board, from Power 4 schools to small DI schools. No one seems to be free spending at the moment, because no one knows where college athletics will be in a year.” (link)

Oak View Group COO Francesca Bodie noted during SBJ Dealmakers that one needn’t look further than Texas’ Moody Center to find a justification for private equity’s utility in college sports venues. “There’s clearly an opportunity. We saw that all too well with the Moody Center. If you look at Austin from a marketplace perspective, it has 1.3M people on paper, [but] it had no professional sports team – no disrespect to the Longhorns, because they pretty much are a pro team – it’s not a market that would have been top 20 in the traditional boxes you’d check. There’s not a lot of infrastructure, but it’s a top five venue in the nation for gross ticket sales.” Still, Bodie and the other panelists – Baltimore Ravens President Sashi Brown, PFL CEO Peter Murray and Monumental S&E President of Business Ops/CCO Jim Van Stone – agreed they’re unsure on the details of private equity in college sports, emphasizing that the idea of backing athletic departments is murkier. Brown: “If I’m investing in venues, I’m buying. If I’m investing in sports, I’m a sell.” The panelists also agreed that premium offerings at venues provide major growth possibilities, with Bodie remarking: Bodie’s OVG spends a lot of time maximizing the VIP potential in its recent deals. “We cannot seem to provide enough VIP. Whatever that price point is for you to feel like a VIP, we have been able to answer that question. If you have $10 extra dollars, there should be a journey. If you have $1,000 extra dollars, there should be a journey.” (link)

UTSA Football HC Jeff Traylor comments on Memphis’ NIL situation: “We have a tenth of their recruiting budget for a roster, and that’s a tremendous disadvantage. There’s a lot of kids on that roster that we recruited and had good relationships with and we couldn’t get them. The truth – and nobody wants to talk about it anymore – is that of course the coach matters. Of course relationships matter. Facilities matter. The city matters. Winning matters. But at the end of the day people vote with their pocketbook and young men aren’t much different than old men. That matters in the end. I don’t want to put the exact number out there because I don’t want to get that specific, but it’s six times more than what our roster is.” (link)

U.S. District Court Judge David O. Carter on Monday restored UCLA’s access to Jackie Robinson Stadium through July 4, 2025, allowing the team to complete its coming season. After that, the stadium will face an uncertain fate. Carter initially rejected UCLA’s offer to nearly double its rent to $600K and release two acres for veterans’ housing. However, after a hearing on Friday, Carter returned to court on Monday and explained he thought it would not make sense to pass up money that could be used for housing now. He again urged the university and veterans to come up with a “holistic” agreement by July 4 and made it clear he still considers the stadium as a potential site for housing. He suggested that one option would be for UCLA to use more than 30 acres it owns in the Palos Verdes Peninsula for a new stadium. Bruins AD Martin Jarmond: “We are excited to practice and play in Jackie Robinson Stadium this season. Our young men have been working hard and keeping a positive attitude throughout this period of uncertainty, and we are pleased that they will be able to resume their regular training at the stadium.” (link)

Marquette’s recently announced co-branded beer is notable in that it is not being used to support NIL, according to NIL Daily’s Noah Henderson, who explains: “Over the last three seasons, NIL collectives have served as the primary vessel for athlete compensation. In the wake of direct revenue sharing, universities are looking for new revenue streams to support this new expenditure. … Marquette has indicated that its focus is not on compensating athletes in the current model through their collective but rather on preparing for the new iteration of college athletics where athletes will be directly compensated by their universities. Marquette Athletics has opted to generate revenue through an exclusive sponsorship with Third Space Brewing, most likely including a licensing fee predicated on allowing university trademarks to be placed on the Marquette Golden Ale, rather than have their NIL collective reach an agreement that shifts a percentage of sales to their NIL war chest. In the new college sports system, many schools will leverage any revenue stream they can to remain competitive in revenue-sharing. This may mean redirecting certain wealth generation avenues away from NIL collectives and moving them in-house to the athletic department.” (link)

Nevada sportsbooks won a net $80.9M in September, setting an all-time record, according to ESPN’s David Payne Purdum, who notes the NFL and college football accounted for $55.8M of that figure. The previous record of $72M was set in November 2022. (link)

Big East Commissioner Val Ackerman says St. John’s Men’s Basketball HC Rick Pitino’s super hoops league idea is something she’s heard before and it’s “not anything we’re pursuing at the moment.” On the idea of expansion overall, Ackerman tells NJ Advance Media’s Adam Zagoria: “I think expansion decisions for us are going to be tied to the usual checklist. It’s geography, basketball strength, values fit, the kinds of things [University] presidents care deeply about and, importantly, are they additive in terms of the economics? … I think you need big brands. Brands big enough to command the absence of dilution with your network partner and that’s what we got with UConn. UConn joined the league and FOX paid pro rata, they paid as much as all the other schools were getting so none of our other schools had to go backward and get a diluted share because UConn was joining. … We’ve been approached by a lot of schools to come in, we haven’t seen fit to bring anybody other than UConn. Are we monitoring it? Yes. Could there be opportunities reactively in the future? Maybe. If something happens to a league like what happened to the Pac-12, who knows?” (link)

Oklahoma State AD Chad Weiberg joins Playfly’s On the Fly podcast and says he applauds those who have taken the time and energy to submit so-called super league ideas “because the core of both of them that resonates with me and with us here at Oklahoma State is college football is the second most valuable sports property in the country only behind NFL. It’s greater than the NBA, greater than Major League Baseball, greater than all the other other leagues except for we're not paid like that. The NBA outpaces us, the other leagues outpace us, and I think that's because we go into the market broken off into pieces and we're not able to fully capitalize on if we were going into the market together. So I think what I appreciate about both of the proposals is what they're trying to do ultimately is get us out into the market together and try to capture a full value of what we offer. And I don't think in either proposal they’re asking for anyone to take a step back from where they are. I think this is a net gain for everyone involved, and I think that's a good thing. I think everybody should be interested in trying to capture the full value.” Doing so, Weiberg continues, will “give us the ability to get back into what makes sense here in terms of geographic rivalries and not having to travel all over the country to do these things.” As for how the House settlement will impact OSU, Weiberg says like most places, “we don’t end the year with $20M sitting around that we haven’t spent. Yet, that’s what is possible with the House settlement. … So, the first question is where does that come from? And that puts pressure on a lot of places. … It puts pressure on the athletic departments and all of the other programs about how we're spending money. It puts pressure on our donors because we're going to be asking them to help even more than they already are…and I think it ultimately puts pressure on a lot of the institutions.” More from Weiberg. Extra Points publisher Matt Brown takes a look at what’s going on with Hawaii’s football stadium situation, noting the Rainbow Warriors were slated to play until the 2024 season at the Clarence T. C. Ching Athletics Complex before moving to a new Aloha Stadium. “Well, it’s the 2024 season…and construction on a new Aloha Stadium hasn’t even started yet.” ‘Bows AD Craig Angelos tells Brown the goal right now is to have the new stadium ready in time for the 2028 season and there is a strong coalition in support of the project. “We’re the only DI institution in the state of Hawaii. Everybody, from the Governor to the state legislature, is invested in this program. And that’s a good thing, because the state has funded many projects at the University of Hawaii over the years, from the baseball stadium, to the basketball arena. The school has not needed to go out and raise the money to fund them. … We think it'd be a tremendous thing for not just the university, but for the entire state, and we're very supportive of it. Playing our games at the new stadium, and then developing and upgrading our facilities here, would be best for everybody.” However, in the event things don’t work out with the Aloha Halawa District Partners, Angelos says there is a backup plan. UH has modeled the possibility of making the Clarence T. C. Ching Athletics Complex a more permanent stadium. Why the delay? Angelos says that while everyone wants what’s best for UH, “not everybody agrees on what is best, or how to get there.” Other administrators tell Brown the political slowdowns “aren’t so much the result of partisan bickering…as they are the result of Hawaii’s political culture. Things just do not happen quickly, especially large public works projects.” (link)

The Athletic’s Chris Vannini observes that college football is heading toward a conference tiebreaking “nightmare,” pointing out that “Clemson, Miami (FL) and SMU are all at least 7-1 overall, undefeated in ACC play and not scheduled to play each other. In the Big Ten, Oregon, Penn State and Indiana are all undefeated and don’t play each other. The SEC has five teams with one or zero conference losses, and the Big 12 has four. Not everyone in those two logjams plays each other. It might work itself out in the end. But the possibility that it doesn’t is very real. How could a conference defend itself if a team undefeated in league play didn’t make its title game? Whether undefeated or not, it’s likely some tiebreaking scenario is going to upset one or more fan bases. Especially because those conference championships determine which four teams earn first-round byes in the 12-team College Football Playoff, this situation doesn’t feel tenable in the long term.” Vannini goes on to note that expanding for the sake of TV money, or expanding for the sake of survival, has left us with oversized conferences, some of which go coast-to-coast. We’ve experienced that in the kickoff times. But we haven’t yet experienced how these currently crowded races could end with everyone holding up tiebreaker decision trees at the finish line. One year after undefeated Florida State was left out of the CFP, the potential for a different kind of chaotic and controversial finish to the regular season in several conferences is very much on the table.” (link)

USA Today’s Dan Wolken has obtained dozens of emails relating to schools’ decisions to forfeit volleyball matchups against San Jose State and explains that “in the case of Wyoming, USA Today Sports found, most players on the team wanted to play but were overruled due to political pressure and threats from the state legislature to cut university funding. Conversations with those same activist groups were part of Boise State’s decision-making timeline before announcing the forfeit.” Wolken reports that on September 25, two days before Boise State’s cancelation was announced, “university officials (including Broncos AD Jeramiah Dickey) had a conference call with Doreen Denny from Concerned Women for America, Marshi Smith from the Independent Council on Women’s Sports and Idaho State Representative Barbara Ehardt, the former head basketball coach at Cal State Fullerton who sponsored the first bill adopted by a state legislature banning transgender athletes in women’s sports.” Wolken asked Boise State “whether Dickey spoke with any LGBTQ advocacy groups, either on or off-campus, who might have presented a different or more favorable view of trans participation in sports. A Boise State spokesman said he did not but declined to explain why. That kind of dichotomy – University officials highly responsive to those who were in favor of forfeiting, while showing less interest in those with a different view – was evident throughout the tranche of e-mails Boise State provided. … [Volleyball HC Shawn] Garus personally responded to more than a dozen emails praising the school for its decision and thanked people for their support.” Also from Wolken: “A Boise State spokesman told [USA Today] it was unclear how many donations have been made or lost due to the forfeit decision.” (link)

Facility Features…
+ VCU will break ground on its Athletic Village project tomorrow. Construction of the village will span four phases, and, when complete, the area will include an 18-court indoor/outdoor tennis facility, a 4,000-seat soccer stadium, a track and field complex, and a 20K-sq-ft multipurpose training center. Phase 1 will reportedly include construction of the track and field complex and athletic fields. (link)
+ Eastern Illinois’ volleyball team will return to McAfee Gym as its home court beginning with the 2025 season, marking the first time the team has played at a sport-specific venue since the 1980s.
