Education & Sports Law Group Partner Janet Judge joins AthleticDirectorU’s Tai M. Brown at the 2024 Women Leaders Convention to offer insights into the legal challenges facing today’s athletics landscape, including the House settlement, Johnson case and related NLRB cases, a recent NCAA study on online harassment and the Title IX implications from all the tumult. Judge notes that “football [is] quite important. The challenge is keeping the pipeline of Olympic sports, men’s and women’s, and not losing the diversity of sport as we move forward in the current legal landscape.” Judge goes on to point out that Title IX law does not pertain to employment relationships, which is another factor to be considered when thinking about whether student-athletes should be classified as employees. “So, it’s very complicated and really interesting. It is the epitome of a law school exam.” Judge also discusses the impact of today’s challenges on the way leaders think strategically, develop a team and build out their department: “We’ve operated as silos for a very long time. And we’re learning through the litigation that operating in that space without more broadly thinking about things that the institution is dealing with in the legal space has in some instances led to increased controls placed on young people that are coming to light. … So [I’m] spending a lot of time working with schools and also thinking more broadly about at the one time where all the legal pressures and social pressures may be leading some people in athletics to become even more insular, it’s absolutely the time where we need to not be insular.” More on ADU. Former Ohio State football standout/NFL veteran Malcolm Jenkins joins the Now It’s Legal podcast with Jim Cavale and discusses some of the nuances of collective bargaining. Jenkins, a member of the NFLPA Executive Committee Board, explains the system takes good care of quarterbacks, receivers and players who sell tickets. “The other majority of the league is getting squeezed. As money, contracts went up, the middle class got squeezed, and so you had a very low-salary majority, where I think the average at one point in time when I was in the league a while ago, the average salary was about $1M, and the majority of the league is made up of minimum-salary layers, minimum contracts.” Jenkins points out it was “really hard for us to fight for the middle man without pissing off the quarterbacks and those top earners. You start to limit what they can do, then you break up the ability to really be cohesive and stay unified.” Jenkins sees the same thing happening between college football and other sports where student-athletes are “still putting up the same time, still getting injuries and still valuable.” One way the NFLPA addressed the problem was to implement a standardized system “so that there is a cap that can be spread around multiple [players], that everybody has the same standard of play, regardless of where you go to school. That stops everybody from being in the wild, wild West, where the places that have the most money get all the best recruits and therefore dominate. At the same time, there are things like player performance where it benefits that the pool of money…is now not broken up by stats or predetermined contracts, but it’s based off of how long and how much you play in the game…so if you’re a rookie who has a low contract but you end up being a starter that whole year, your earning potential goes way up.” Full podcast. Front Office Sports’ Amanda Christovich examines how politicians are using college football games as opportunities to promote their candidacies, observing that “NFL games provide more eyeballs, but college football provides access to a more targeted demographic, one industry expert tells FOS. College football, specifically, offers a strategic opportunity for presidential candidates and the PACs that support them: Many of the most popular schools are located in swing states, and many rivalries remain regional despite conference realignment. This provides candidates with access to a large number of viewers likely residing (and voting) in the swing states they’re hoping to target.” Both former President Donald Trump and VP Kamala Harris, Christovich continues, have “flooded the airwaves with campaign ads on college football Saturdays. Trump and Harris received a larger portion of overall impressions from college football than any other sport except the NFL, according to data shared with Front Office Sports from iSpot.tv.” Specifically, between Week 1 and Week 9, the Harris’ campaign purchased 76 spots, while the Trump campaign purchased 60. Christovich notes that Harris and Trump spent just $1.45M and $1.23M on those ads, respectively, but they raked in hundreds of millions of impressions: The Harris campaign received 153.1M household TV ad impressions, while the Trump campaign got 126.2M. Both ramped up ads in mid-October, with 40% of Trump’s ads being aired between Weeks 8 and 9, and 18% of Harris’s coming during Week 9 alone. Basic Technologies VP of Candidates Jackie Huelbig: “In a world where people consume TV on streaming services on what I call ‘prime time on demand,’ live sports is one of the last ways to reach audiences in real time. Audiences/voters also tend to be more engaged while watching live sports—which is important leading up to election day with get-out-the-vote messaging.” (link)

U.S. District Court Judge Jose E. Martinez last week adopted the recommendation of U.S. Magistrate Judge Marty Fulgueira Elfenbein, who on October 15 ruled that Caneup LLP be held liable for trademark infringement and other claims in a lawsuit filed by Miami (FL). Sportico’s Michael McCann notes that Elfenbein “declined to recommend a default judgment regarding Miami’s trademark dilution claim” on the grounds that the U’s “prominence fell short of truly national fame.” As such, Miami “motioned to amend its complaint and withdraw the dilution claim. It did so, an October 24 court filing stated, ‘in the interest of justice’ and to bring the case ‘to a swift end.’ The university added that it ‘respectfully disagrees’ with Elfenbein regarding the famousness of its marks but explained that ‘rather than file objections to that recommendation’ and prolong the litigation, it sought to withdraw the dilution claim. Martinez granted Miami’s request, meaning Miami’s dilution claim has been removed from the litigation. The national fame of Miami’s marks is thus punted, perhaps for another case on another day.” (link)

South Carolina was fined $250K by the SEC after fans stormed the field in celebration of the Gamecocks’ win over Texas A&M. This is South Carolina’s second offense under the revised competition area policy. The first offense occurred when fans entered the court following a victory over Kentucky in men’s basketball in January. (link)

ULM Football AC Cameron Blankenship has posted an apology after ESPN cameras caught him making physical contact with a student-athlete with whom he was displeased on Saturday: “I want to sincerely apologize for my actions during yesterday’s game. I recognize that my physical contact with a player was inappropriate, and I take full responsibility for it. I value the trust of our players and there are no excuses for my actions. I am committed to learning from this incident. I appreciate the support of our team and am dedicated to creating a positive and respectful environment for everyone moving forward.” (link); Warhawks student-athlete Drew Hutchinson, the subject of Blankenship’s tirade, says Blankenship has “sincerely apologized for his behavior,” adding: “Coaches are humans, too, and just as players learn from their mistakes, I think coaches can learn from theirs as well. I’d like to leave you all with a quote I heard at church this morning: ‘Vengeance is in the Lord’s hands, and forgiveness is in mine.’” (link)

After multiple videos have surfaced of police officers engaging in violent interactions with fans during Saturday’s Florida-Georgia game, the Jacksonville Sheriff’s Office says that “administrative reviews of the incidents are being opened. As such, the agency will not comment until all facts are known and the reviews have been completed." Jacksonville Mayor Donna Deegan adds that the city is awaiting the results of those reviews: "I’m aware of several disturbing videos circulating from yesterday’s game. I have spoken to Sheriff Waters and the incidents are under investigation." It remains unclear what prompted the altercations. (link)

AD for Student-Athlete Development Tori Niemann and Florida Director of Gators EmpowHER Vicki Werskey join Her Competitive Advantage CEO/Founder Stephanie Barrett to discuss enthusiasm around women sports, the power of community and how their departments are providing professional development opportunities for female student-athletes. After rising steadily from the 1994-95 academic year, college tuition costs have remained largely flat since 2020-21. According to the College Board, tuition at private, four-year, non-profit institutions have actually fallen from a high of nearly $45K to $43,350, while their public counterparts have experienced a decline from over $12K to $11,160. Nielsen will allow media outlets to add their own audience data to its ratings calculations, a “move that the measurement giant sees as an inevitable one in the age of streaming but that detractors suggest could give an unfair early advantage to established digital players such as Amazon,” according to Variety’s Brian Steinberg, who notes the Media Rights Council “approved the use of first-party live streaming data into Nielsen’s national TV service, while renewing accreditation for Nielsen’s national panel measurement.” Nielsen CEO Karthik Rao: “With time-tested methodologies like our accredited persons panel and precise new solutions for the streaming era, we believe Nielsen is right where the industry needs us to be – at the convergence of all the ways people watch content. This will give the industry a true view of linear and streaming viewing like never before.” Steinberg also points out that “advertisers might also have a take on the matter. For decades, big marketers have relied primarily on third-party data from Nielsen and others to judge the performance of the media outlets on which they buy commercial inventory. If Nielsen’s new methodology is widely accepted, Madison Avenue could become even more dependent on its measurement services in an era in which the best way to gauge audiences is still very much up for debate.” (link)

And we're going to look for every opportunity to reallocate expenses. I'm not saying we're going to reduce expenses when we're facing all this, but we are going to take expenses that we're spending in one area and look at ‘is it going to help us win and be successful,’ right? And really be thoughtful about that, and look for other ways to turn more revenue. So we're going to do all that, but we also have to sort of modernize some of the things that we that we do from a fundraising and sales standpoint, and that's what we're trying to create awareness of where we're headed for, where we're at, so that when, you know, when we roll out and share some of these adjustments here later in the year, call it in December, that our folks kind of know some of the why behind it. [...] It's going to be a combination of both (raising ticket prices & donation levels). And we got to figure out that right mix, right? [...] We're going to still have, you know, price points and access for people that can't afford the 50 yard line seat. So it's going to be distributed across a big array. There are going to be significant increases, but you really can't articulate that till it gets down to that individual rollout, and we share that with them directly. We'll get there, and it's going to be significant. It's not going to be a minor increase. It's going to have to be for us to start to right size and get back to where we need to be to be competitive. [...] You hear things like concerts and other things that are happening more and more at other schools, we're going to have start to push in those directions as well, and we're also going to have to look to cut expenses and reallocate our spending in ways that are smarter and that more directly impact our success.. So there are shifts going to happen in our world, and whether that is how we operate, how we travel, staffing, there's all kinds of different things to think about. [...] I will tell you, I have been very clear with everybody in the department working with University leadership, (cutting sports) is like an absolute last resort. The latest from Purdue AD Mike Bobinski on the challenges ahead: “(In some ways) You’ve got the two little guys sitting on your shoulder saying, ‘Hey, hurry up and do this.’ And the other one says, ‘Hey, hold on a second here. Let’s not, let’s not just jump from left to right and, you know, make wholesale, quick, quick trigger type of changes.’ I look at other programs that we have and men’s basketball is a tremendous example of continuity, consistency, a long sort of a slow burn of a build, and then you get to a tremendous place of success that’s then sustainable. Every sport is different. I get that. But I think there are multiple ways to do this, and I don’t think you should get blinded by the realities of this current environment and really these last two years. [...] I think your point about that (academics) being a competitive advantage for us is something that we need to emphasize even more as we move forward. As the recruiting resource world levels out here (as a result of the House Settlement in 2025-26), assuming things hold together, you are able to really focus on those other elements that you bring to the table for us.” (link)

San Jose State Women’s Volleyball Assoc. HC Melissa Batie-Smoose is “not with the team at this time,” per a statement from the school. More from SJSU: “To be clear, we are not confirming a suspension. The associate head coach is not with the team at this time, and we will not provide further information on this matter.” Batie-Smoose spoke to Outkick & says the institution is trying to silence her after she previously voiced that “only women should be in women’s sports.” (link)

NCAA Director of Inclusion Gretchen Miron joins Connect’s Stephanie Garcia Cichosz for a discussion about emerging sports, what’s gaining traction, and what sports are trending to gain approval to be added as the next NCAA women’s sport. Miron says women’s wrestling in particular has a lot of momentum and has “grown exponentially at the youth level. They are sanctioned as a high school sport for girls in 47 states and they have over 90 schools competing this year. They’ve just been growing rapidly and providing new opportunities to a really diverse set of student-athletes – people that maybe would not have gone to college but for this opportunity. Miron also notes acrobatics and tumbling, STUNT and triathlon “are all getting closer, which is super exciting and then we do still continue to see great momentum with women's rugby. Obviously, the bronze medal at the Olympics was a huge part of that. And then equestrian has some really storied programs that continue to provide great opportunities to those student-athletes.” Miron also points out that four of those six sports are Olympic and Paralympic sports. According to the report of the NCAA Division I Council’s October meeting notes: “The council adopted Proposal No. 2024-51, which specifies that an active Division II member institution is eligible to compete in the Division I Men’s Ice Hockey Championship if no men’s ice hockey championship is conducted in Division II. With the adoption of the proposal, the opportunity for Division II institutions to participate in the Division I championship in other sports in which Division II does not offer a championship was eliminated. The proposal is effective August 1, 2025.” (link)

Hawaii’s football team is chartering all but one leg of its five road games this season. Rainbow Warriors’ AD Craig Angelos: “Every FBS team in the country charters. When I came here and saw we only chartered to Vanderbilt and everything else was a commercial flight with regular passengers on there, I thought: ‘is there a better way to do it?’ We’re going there way early and also staying overnight after the game.” Angelos had the business office run a cost analysis of traveling commercial, arriving early and staying overnight for last year’s schedule vs chartering to this year’s schedule and found that chartering allowed for a $70K smaller hit on the budget. Hawaiian Airlines offered a $150K rate round trip. (link)

Fleck ($100K); Toledo’s Jason Candle and UConn’s Jim Mora ($75K); Colorado State’s Jay Norvell and Arizona State’s Kenny Dillingham ($50K); Georgia Southern’s Clay Helton, Texas Tech’s Joey McGuire and Louisiana’s Michael Desormeaux ($25K). Indiana’s Curt Cignetti picks up a $50K bonus as the Hoosiers get sixth Big Ten win. Cignetti now has $350K in bonuses so far, plus an automatic 1-year contract extension and $250K raise beginning next season. With seventh win of the year, Ole Miss’ Lane Kiffin also gets an automatic 1-year extension worth $9M, with $7.2M guaranteed. Army’s Jeff Monken picked up $100K in bonuses: $75K for win over Air Force, plus $25K for team's eighth regular season win. Monken now has $225K in bonuses so far this season. (link)

Desser Sports Media Inc. President Ed Desser and Kosner Media President John Kosner publish a guide for sports rights owners seeking media partners in 2025 and explain that “to maximize potential audiences, once again look to broadcast networks (as the NBA just did by adding NBC), and/or streamers such as (176M+ U.S. subs) Amazon Prime (another recent NBA deal), or (70M+ U.S. subs) Netflix (NFL Christmas Day). No cable network by itself, including ESPN, can reach that potential audience size anymore. As they harness their unique and impressive promotional arsenals, Prime Video and Netflix may soon exceed the audience delivery of broadcast networks. … However, the biggest broadcasters and streamers remain focused primarily on the major leagues, which are now spread across more, smaller packages, while paradoxically, the key techs want to own something.” To reach younger audiences, “you must start with entertainment networks (formerly known as social media), YouTube and perhaps Twitch, and consider Instagram, Facebook, TikTok, Snap and X for clips. These are strictly ad sales/revenue-share opportunities. So too are the growing, free ad-supported streaming TV (FAST) channels Tubi, Pluto TV and Roku Channel.” Overall, they note that “execution in this age of video content abundance is a lot tougher…but this new era allows the most aggressive, creative and able to use emerging technologies to supercharge growth. Lamenting that your media partner does not understand your product or fans never worked, much less now. Klutch Sports Founder/CEO Rich Paul talks about the growing impact of women’s sports: “I think that from a marketing perspective, brands are starting to lean [in] more. I know that for a fact actually, and our marketing numbers, in terms of dollars made this year – LeBron excluded – was led by two women, which was actually pretty cool. We had these marketing meetings biweekly and the numbers rolling in – we were led by A’ja [Wilson] and [USC women’s basketball student-athlete] Juju [Watkins]. One is an NIL. And the deal I did for Juju is the largest footwear deal on the men’s or women’s side since probably Zion [Williamson].” (link)

The American Enterprise Institute has ranked more than 400 current and former college presidents who served between 2000–01 and 2022–23 on how well they improved access, affordability, and student success over the course of their presidency. The rankings reveal that some presidents were “superstars” at improving access, affordability and student success. These presidents cut tuition costs, expanded access to low-income and racially underrepresented student groups, and increased graduation rates. But some presidents performed poorly in these areas, with a handful overseeing steep declines in graduation rates, affordability, and access. According to the AEI’s Cody Christensen, the “wide spread across the rankings suggests that higher education boards should begin using performance metrics to hold college presidents accountable for the changes in the outcomes of their students.” The report also found that 20.1% of all current presidents are female, 79.9% of all current presidents are white, 9.7% are black, 2.2% are Hispanic, 8.2% are Asian and the average length of tenure is 7.6 years. For all presidents during the course of the study, the average tenure was 7.95 years. Christensen: “The goal of these rankings is to provide high-level, publicly available information that highlights the best leaders, similar to how public information about private companies (such as stock prices, quarterly revenues, and growth projections) is used to judge the best leaders of private companies. The rankings also reveal which college presidents are consistently low performers, helping oversight organizations keep institutional leaders accountable.” Full study and rankings, which for DI leaders is topped by San Diego President James Harris.
