Yahoo’s Ross Dellenger breaks down the impact tomorrow’s general election could have on college sports, particularly as “federal policy looms larger than ever for college sports decision-makers on at least three fronts: (1) comprehensive congressional college sports legislation; (2) the interpretation and enforcement of Title IX as it relates to athlete revenue sharing; and (3) the debate over college athletes as employees.” Former LEAD1 CEO Tom McMIllen explains that if “Republicans take the Senate and Democrats take the House, it’s going to be difficult to get stuff done. If Republicans have a clean sweep, they could get all the agenda done. The more likely scenario is a split government and it’s going to require hard work to get a compromise done. I don’t see a clean sweep.” McMillen also says a Kamala Harris presidential victory could be a “big factor” in how Title IX is applied to revenue-sharing. “She would be taking office right when this whole [House] thing happens. I’ve talked to a lot of Democratic members. [The distribution method] is not sitting well with a lot of female members of Congress.” Meanwhile, Illinois professor Michael LeRoy notes Donald Trump has suggested publicly he would eliminate the Department of Education, at which point something would have to give between higher ed and college athletics. “We would be in a world of unprecedented chaos. College athletics could not avoid the fallout.” (link)

CBS’ Dennis Dodd asks why Michigan AD Warde Manuel would want to serve as chair of College Football Playoff Selection with so many other things on his plate, and Manuel explains: "I wanted to do it because I wanted to help college football. It was a way to give back to a game that I love and [that has] done a lot for me over my lifetime." Dodd notes it’s “no secret the selection process largely doesn't matter until it absolutely does on Selection Sunday, Dec. 9. Everything else is programming and a media mating dance to get the chair to say something he shouldn't.” One former committee member tells him: "As you know, different media people that are 'gotcha' people. They think about it in a way they're going to try to trap you. At the end of the day, you've got to do the best job you can." For his part, Manuel says he’s “talked to three of the past four chairs. None of them have ever said, 'They put me in a gotcha moment’ or they wanted to do that. At times there are tough questions; you just have to be open and answer them. Even being in the [meeting] room the last two years, I never felt that Rece [Davis of ESPN] or anyone was trying to get the chair or anyone in a 'gotcha' moment." Manuel, who is in his third year on the committee, also tells Dodd: "I've never seen someone say, 'I'm in the SEC. And as an SEC AD I've got to support this team.’ Normally you can tell [something is up]. What would happen in the room, you would see everybody talking about one way and somebody talking about it another way. You can discern they are really pushing for a particular team because they're in a conference. It's never happened. … I don't feel like when I speak about a Big Ten team and I speak highly of a Big Ten team that I'm advocating for them or not, it's just my perspective.” More. (link)

The Big 12 has circulated an NIL agreement template among members to “effectively spell out, among other things, terms, services, payments and the timing of payments to athletes,” according to SBJ’s Ben Portnoy, who adds: “The template, which remains in its infancy and could undergo significant changes, was also created to allow each school to format it related to its varying needs, like, for example, whether athletes would sign over their NIL rights exclusively or non-exclusively to the university.” Portnoy also reports league officials are working to pare down the 20-page document, with one source indicating it’s unlikely to be short even once it’s trimmed. “You're just going to have to be like a real estate agent — ‘This means this. This means this, and this is what you're interested in.’” Another league source says more questions remain: “Are you going to commingle the scholarship agreement with the House payment? Are you going to keep those two separate? I don't think you're going to see institutions all do it one way or the other.” (link)

Florida’s First District Court of Appeals has denied the ACC’s attempt to halt Florida State’s lawsuit against the conference. Judge Joseph Lewis Jr.: “The ACC argues that under the principle of priority, the trial court should have stayed the FSU Board’s action pending the disposition of the ACC’s suit filed in North Carolina, which involves the same parties and the same issues. Because the trial court did not depart from the essential requirements of the law in denying the ACC’s motion to stay, we deny its certiorari petition on the merits.” (link); Full ruling. (link)

SBJ’s Bret McCormick profiles former AAC Commissioner Mike Aresco, who is part of SBJ’s 2024 Class of Champions: Pioneers & Innovators. Aresco’s career included stops at ESPN and CBS before taking over as Big East and, eventually, AAC commissioner, and former CBS Sports President Sean McManus says: “His reputation in the industry was flawless, universally respected, a thoughtful person and someone who, in my mind, didn’t have any hidden agendas. He just proved to me to be an invaluable resource.” SMU President Gerald Turner adds: “The strength of the American was down to two things. One, the schools, and two was Mike.” Aresco’s Big East tenure started with the near-immediate departure of Rutgers, whose former AD and current AAC Commissioner Tim Pernetti tells McCormick: “Put yourself in Mike’s shoes. He gets the job in August 2012, and two and a half months later, I called him to tell him we’re leaving the conference for the Big Ten. It was a tough call to make because of my relationship. But you know what his reaction was? He congratulated me.” McCormick also takes a look at Aresco’s campaign to make the AAC part of a so-called Power 6. The movement was appreciated by some but grew tiresome to others, including Turner, who says: “It was a little annoying for both ends of the spectrum. It was clear we weren’t going to knock down the whole wall between the G5 and the P5. And besides that, there were four or five of us [in the AAC] that really thought our destiny was in the P5.” Former College Football Playoff Executive Director Bill Hancock adds that even though it was “unlikely there would ever be a P6…Mike didn’t give up. He was so loyal to his schools, and that’s a point in his favor.” (link); McCormick also profiles Aresco’s CBS days, where he joined McManus and then-EVP Tony Petitti in a control room to determine when March Madness games should be switched. Aresco: “I don’t think there was anything I ever did that was as intense as those first two days of the tournament.” McManus adds: “With a minute to go and with a certain team up 11 points, Mike would say, ‘Well, we’ve gotten this team through to the next round,’ and I’d say, ‘Mike, stop jinxing us. Relax. Calm down. Do not put this in the win column yet.’ And you can imagine sitting next to him 13, 14 hours during those first two days. There was a lot of camaraderie, a lot of unhealthy food, and a lot of tension that just never ceased.” More. (link, link)

+ The state of Hawaii has approved the Aloha Halawa District Partners (AHDP) as the preferred development partner for the 98-acre New Aloha Stadium Entertainment District (NASED). SBJ’s Bret McCormick: “The selection of the AHDP bid team — which includes Cordish Companies, Populous, and AECOM Hunt — moves the process into an eight-month diligence and discussion phase. It is possible that the state and AHDP emerge from that without a deal to move forward for the redevelopment of the site. … If the next step proceeds as the state and AHDP hope, then necessary agreements should be executed by June 2025. The new Aloha Stadium is projected to open in time for the University of Hawaii’s 2028 football season.” (link)

Education & Sports Law Group Partner Janet Judge joins AthleticDirectorU’s Tai M. Brown at the 2024 Women Leaders Convention to offer insights into the legal challenges facing today’s athletics landscape, including the House settlement, Johnson case and related NLRB cases, a recent NCAA study on online harassment and the Title IX implications from all the tumult. Judge notes that “football [is] quite important. The challenge is keeping the pipeline of Olympic sports, men’s and women’s, and not losing the diversity of sport as we move forward in the current legal landscape.” Judge goes on to point out that Title IX law does not pertain to employment relationships, which is another factor to be considered when thinking about whether student-athletes should be classified as employees. “So, it’s very complicated and really interesting. It is the epitome of a law school exam.” Judge also discusses the impact of today’s challenges on the way leaders think strategically, develop a team and build out their department: “We’ve operated as silos for a very long time. And we’re learning through the litigation that operating in that space without more broadly thinking about things that the institution is dealing with in the legal space has in some instances led to increased controls placed on young people that are coming to light. … So [I’m] spending a lot of time working with schools and also thinking more broadly about at the one time where all the legal pressures and social pressures may be leading some people in athletics to become even more insular, it’s absolutely the time where we need to not be insular.” More on ADU. Former Ohio State football standout/NFL veteran Malcolm Jenkins joins the Now It’s Legal podcast with Jim Cavale and discusses some of the nuances of collective bargaining. Jenkins, a member of the NFLPA Executive Committee Board, explains the system takes good care of quarterbacks, receivers and players who sell tickets. “The other majority of the league is getting squeezed. As money, contracts went up, the middle class got squeezed, and so you had a very low-salary majority, where I think the average at one point in time when I was in the league a while ago, the average salary was about $1M, and the majority of the league is made up of minimum-salary layers, minimum contracts.” Jenkins points out it was “really hard for us to fight for the middle man without pissing off the quarterbacks and those top earners. You start to limit what they can do, then you break up the ability to really be cohesive and stay unified.” Jenkins sees the same thing happening between college football and other sports where student-athletes are “still putting up the same time, still getting injuries and still valuable.” One way the NFLPA addressed the problem was to implement a standardized system “so that there is a cap that can be spread around multiple [players], that everybody has the same standard of play, regardless of where you go to school. That stops everybody from being in the wild, wild West, where the places that have the most money get all the best recruits and therefore dominate. At the same time, there are things like player performance where it benefits that the pool of money…is now not broken up by stats or predetermined contracts, but it’s based off of how long and how much you play in the game…so if you’re a rookie who has a low contract but you end up being a starter that whole year, your earning potential goes way up.” Full podcast. Front Office Sports’ Amanda Christovich examines how politicians are using college football games as opportunities to promote their candidacies, observing that “NFL games provide more eyeballs, but college football provides access to a more targeted demographic, one industry expert tells FOS. College football, specifically, offers a strategic opportunity for presidential candidates and the PACs that support them: Many of the most popular schools are located in swing states, and many rivalries remain regional despite conference realignment. This provides candidates with access to a large number of viewers likely residing (and voting) in the swing states they’re hoping to target.” Both former President Donald Trump and VP Kamala Harris, Christovich continues, have “flooded the airwaves with campaign ads on college football Saturdays. Trump and Harris received a larger portion of overall impressions from college football than any other sport except the NFL, according to data shared with Front Office Sports from iSpot.tv.” Specifically, between Week 1 and Week 9, the Harris’ campaign purchased 76 spots, while the Trump campaign purchased 60. Christovich notes that Harris and Trump spent just $1.45M and $1.23M on those ads, respectively, but they raked in hundreds of millions of impressions: The Harris campaign received 153.1M household TV ad impressions, while the Trump campaign got 126.2M. Both ramped up ads in mid-October, with 40% of Trump’s ads being aired between Weeks 8 and 9, and 18% of Harris’s coming during Week 9 alone. Basic Technologies VP of Candidates Jackie Huelbig: “In a world where people consume TV on streaming services on what I call ‘prime time on demand,’ live sports is one of the last ways to reach audiences in real time. Audiences/voters also tend to be more engaged while watching live sports—which is important leading up to election day with get-out-the-vote messaging.” (link)

U.S. District Court Judge Jose E. Martinez last week adopted the recommendation of U.S. Magistrate Judge Marty Fulgueira Elfenbein, who on October 15 ruled that Caneup LLP be held liable for trademark infringement and other claims in a lawsuit filed by Miami (FL). Sportico’s Michael McCann notes that Elfenbein “declined to recommend a default judgment regarding Miami’s trademark dilution claim” on the grounds that the U’s “prominence fell short of truly national fame.” As such, Miami “motioned to amend its complaint and withdraw the dilution claim. It did so, an October 24 court filing stated, ‘in the interest of justice’ and to bring the case ‘to a swift end.’ The university added that it ‘respectfully disagrees’ with Elfenbein regarding the famousness of its marks but explained that ‘rather than file objections to that recommendation’ and prolong the litigation, it sought to withdraw the dilution claim. Martinez granted Miami’s request, meaning Miami’s dilution claim has been removed from the litigation. The national fame of Miami’s marks is thus punted, perhaps for another case on another day.” (link)

South Carolina was fined $250K by the SEC after fans stormed the field in celebration of the Gamecocks’ win over Texas A&M. This is South Carolina’s second offense under the revised competition area policy. The first offense occurred when fans entered the court following a victory over Kentucky in men’s basketball in January. (link)

ULM Football AC Cameron Blankenship has posted an apology after ESPN cameras caught him making physical contact with a student-athlete with whom he was displeased on Saturday: “I want to sincerely apologize for my actions during yesterday’s game. I recognize that my physical contact with a player was inappropriate, and I take full responsibility for it. I value the trust of our players and there are no excuses for my actions. I am committed to learning from this incident. I appreciate the support of our team and am dedicated to creating a positive and respectful environment for everyone moving forward.” (link); Warhawks student-athlete Drew Hutchinson, the subject of Blankenship’s tirade, says Blankenship has “sincerely apologized for his behavior,” adding: “Coaches are humans, too, and just as players learn from their mistakes, I think coaches can learn from theirs as well. I’d like to leave you all with a quote I heard at church this morning: ‘Vengeance is in the Lord’s hands, and forgiveness is in mine.’” (link)

After multiple videos have surfaced of police officers engaging in violent interactions with fans during Saturday’s Florida-Georgia game, the Jacksonville Sheriff’s Office says that “administrative reviews of the incidents are being opened. As such, the agency will not comment until all facts are known and the reviews have been completed." Jacksonville Mayor Donna Deegan adds that the city is awaiting the results of those reviews: "I’m aware of several disturbing videos circulating from yesterday’s game. I have spoken to Sheriff Waters and the incidents are under investigation." It remains unclear what prompted the altercations. (link)

After rising steadily from the 1994-95 academic year, college tuition costs have remained largely flat since 2020-21. According to the College Board, tuition at private, four-year, non-profit institutions have actually fallen from a high of nearly $45K to $43,350, while their public counterparts have experienced a decline from over $12K to $11,160. Nielsen will allow media outlets to add their own audience data to its ratings calculations, a “move that the measurement giant sees as an inevitable one in the age of streaming but that detractors suggest could give an unfair early advantage to established digital players such as Amazon,” according to Variety’s Brian Steinberg, who notes the Media Rights Council “approved the use of first-party live streaming data into Nielsen’s national TV service, while renewing accreditation for Nielsen’s national panel measurement.” Nielsen CEO Karthik Rao: “With time-tested methodologies like our accredited persons panel and precise new solutions for the streaming era, we believe Nielsen is right where the industry needs us to be – at the convergence of all the ways people watch content. This will give the industry a true view of linear and streaming viewing like never before.” Steinberg also points out that “advertisers might also have a take on the matter. For decades, big marketers have relied primarily on third-party data from Nielsen and others to judge the performance of the media outlets on which they buy commercial inventory. If Nielsen’s new methodology is widely accepted, Madison Avenue could become even more dependent on its measurement services in an era in which the best way to gauge audiences is still very much up for debate.” (link)
